<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3308</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211202">December 2, 2021</action-date><action-desc><sponsor name-id="S406">Mr. Kelly</sponsor> (for himself and <cosponsor name-id="S403">Ms. Sinema</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the Colorado River Indian Tribes to enter into lease or exchange agreements and storage agreements relating to water of the Colorado River allocated to the Colorado River Indian Tribes, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Colorado River Indian Tribes Water Resiliency Act of 2021</short-title></quote>.</text></section><section id="id0e522596f06a4607b0fa049b16b7127f"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph id="id1c6dd0b50b7a4f05bda7ebe3111f4e75"><enum>(1)</enum><text>to authorize the CRIT to enter into lease or exchange agreements and storage agreements for the economic well-being of the CRIT; and</text></paragraph><paragraph id="idb2013d5eddf24d0b9305f43c63a72c12"><enum>(2)</enum><text>to authorize the Secretary to approve any lease or exchange agreements or storage agreements entered into by the CRIT.</text></paragraph></section><section id="id80a40366f1e3463899d6016cd3301f4d"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id271BEF00420C4A82B6497FD2EF21CB84"><enum>(1)</enum><header>Allottee</header><text>The term <term>allottee</term> means an individual who holds a beneficial real property interest in an allotment of Indian land that is—</text><subparagraph id="id322b891db9124117a5dfb7b7b55c1c20"><enum>(A)</enum><text>located within the exterior boundaries of the Reservation; and</text></subparagraph><subparagraph id="id2bbf1e172ee84f7aa703adac27ca5f1c"><enum>(B)</enum><text>held in trust by the United States.</text></subparagraph></paragraph><paragraph id="ida2e3ba7ede4246e7826b7c7b73455403"><enum>(2)</enum><header>Consolidated decree</header><text>The term <term>Consolidated Decree</term> means the decree entered by the Supreme Court of the United States in Arizona v. California, 547 U.S. 150 (2006).</text></paragraph><paragraph id="idc2f4b8f45ff9495f8aae7b64d34f6b46"><enum>(3)</enum><header>Consumptive use</header><text>The term <term>consumptive use</term> means a portion of the decreed allocation that has been consumptively used by the CRIT within the exterior boundary of the Reservation for a minimum of 4 of the 5 years immediately preceding the year of delivery of a portion of the decreed allocation according to a lease or exchange agreement or storage agreement. Any verified reduction in consumptive use pursuant to a system conservation agreement, a lease or exchange agreement, or storage agreement, or from the creation of intentionally created surplus, shall be deemed to be a consumptive use in the year in which the reduction occurred, if the reduction is reflected in the Water Accounting Report.</text></paragraph><paragraph id="id5f48977dfb024cada4e5566f59e1c02f"><enum>(4)</enum><header>CRIT</header><text>The term <term>CRIT</term> means the Colorado River Indian Tribes, a federally recognized Indian Tribe.</text></paragraph><paragraph id="idd81dec90d3f3409a8f65b1b8484a9ea6"><enum>(5)</enum><header>Decreed allocation</header><text>The term <term>decreed allocation</term> means the volume of water of the mainstream of the Colorado River allocated to the CRIT that is accounted for as part of the apportionment for the State in part I–A of the Appendix of the Consolidated Decree.</text></paragraph><paragraph id="idade3022853ea4f4ca17f7026c222c769"><enum>(6)</enum><header>Lower Basin</header><text>The term <term>Lower Basin</term> has the meaning given the term in article II(g) of the Colorado River Compact of 1922, as approved by Congress in section 13 of the Boulder Canyon Project Act (<external-xref legal-doc="usc" parsable-cite="usc/43/617l">43 U.S.C. 617l</external-xref>), and by the Presidential Proclamation of June 25, 1929 (46 Stat. 3000).</text></paragraph><paragraph id="idd5224019f7ab49bab5eef38aac6eb94f"><enum>(7)</enum><header>Person</header><text>The term <term>person</term> means an individual, a public or private corporation, a company, a partnership, a joint venture, a firm, an association, a society, an estate or trust, a private organization or enterprise, the United States, any Indian Tribe, a governmental entity, or a political subdivision or municipal corporation organized under, or subject to, the constitution and laws of the State.</text></paragraph><paragraph id="id089c506cc54d4313afcedbb9bbd60d61"><enum>(8)</enum><header>Reservation</header><text>The term <term>Reservation</term> means the portion of the reservation established for the CRIT that is located in the State.</text></paragraph><paragraph id="id910832c51a41436d882abca28ca075ef"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="idebd03d471ba24778a97a26fa9cf2fae0"><enum>(10)</enum><header>State</header><text>Except for purposes of section 15, the term <term>State</term> means the State of Arizona.</text></paragraph><paragraph id="id48191a2b05b04d4884baffd8a8a56648"><enum>(11)</enum><header>Storage</header><text>The term <term>storage</term> means the underground storage, in accordance with State law, of a portion of the consumptive use off the Reservation within the Lower Basin in the State.</text></paragraph><paragraph id="id89dbb2fecb154f73babc4db7e0eecfa8"><enum>(12)</enum><header>Water Accounting Report</header><text>The term <term>Water Accounting Report</term> means the annual report of the Bureau of Reclamation entitled the <quote>Colorado River Accounting and Water Use Report: Arizona, California, and Nevada</quote> which includes the compilation of records in accordance with article V of the Consolidated Decree.</text></paragraph></section><section id="id1115cebc5b4f4b1d9ac7815431c77908"><enum>4.</enum><header>Lease or exchange agreements</header><subsection id="idd2bbf94ba51e41c3a69431fb7986aecc"><enum>(a)</enum><header>Authorization</header><text>Notwithstanding section 2116 of the Revised Statutes (commonly known as the “Indian Trade and Intercourse Act”) (<external-xref legal-doc="usc" parsable-cite="usc/25/177">25 U.S.C. 177</external-xref>) or any other provision of law, the CRIT is authorized to, subject to the approval of the Secretary under section 6(a), and has the sole authority to, enter into, with any person, an agreement to lease or exchange, or an option to lease or exchange, a portion of the consumptive use for a use off the Reservation (referred to in this Act as a <quote>lease or exchange agreement</quote>), on the condition that the use off the Reservation is located in the Lower Basin in the State.</text></subsection><subsection id="id09e4886e7dc44fb2bf631032cf4c0c76"><enum>(b)</enum><header>Term of lease or exchange agreement</header><text>The term of any lease or exchange agreement entered into under subsection (a) shall be mutually agreed, except that the term shall not exceed 100 years.</text></subsection><subsection id="idCA81170955674B84943627D61519C8C4"><enum>(c)</enum><header>Modifications</header><text>Any lease or exchange agreement entered into under subsection (a) may be renegotiated or modified at any time during the term of the lease or exchange agreement, subject to the approval of the Secretary under section 6(a), on the condition that the term of the renegotiated lease or exchange agreement does not exceed 100 years.</text></subsection><subsection id="id98bbef11d53243f39260a06fcefa0c7c"><enum>(d)</enum><header>Applicable law</header><text>Any person entering into a lease or exchange agreement with the CRIT under this section shall use the water received under the lease or exchange agreement in accordance with applicable Federal and State law.</text></subsection></section><section id="idfc0e0354d86b4a8db96eb8d2102f7a8a"><enum>5.</enum><header>Storage agreements</header><subsection id="id850d9f89e0214740b9b7fdce9a333ca3"><enum>(a)</enum><header>Authorization</header><text>Notwithstanding section 2116 of the Revised Statutes (commonly known as the <quote>Indian Trade and Intercourse Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/25/177">25 U.S.C. 177</external-xref>) or any other provision of law, the CRIT is authorized to, subject to the approval of the Secretary under section 6(a), and has the sole authority to, enter into an agreement, including with the Arizona Water Banking Authority (or successor agency or entity), for the storage of a portion of the consumptive use, or the water received under an exchange pursuant to an exchange agreement under section 4, at 1 or more underground storage facilities or groundwater savings facilities off the Reservation (referred to in this Act as a <quote>storage agreement</quote>), on the condition that the facility shall be located in the Lower Basin in the State.</text></subsection><subsection id="id76946256a9aa4112ab0ed1ab5a117e5d"><enum>(b)</enum><header>Applicable law</header><text>Any storage agreement entered into under this section shall be in accordance with applicable Federal and State law.</text></subsection><subsection id="id329a1c8a8d6247a5815c60cc296610ed"><enum>(c)</enum><header>Delegation of rights</header><text>The CRIT may assign or sell any longterm storage credits accrued as a result of a storage agreement, on the condition that the assignment or sale is in accordance with applicable State law.</text></subsection></section><section id="idf9908842886d4c2b9d027d91c5655bc8"><enum>6.</enum><header>Approval by the Secretary</header><subsection id="id39fdd9a4925146b899ff1bcd6c4f9dc6"><enum>(a)</enum><header>Authorization</header><text>The Secretary shall approve or disapprove any lease or exchange agreement, or any modification to a lease or exchange agreement, or any storage agreement.</text></subsection><subsection id="id85D8DF76988C40748BB9E64587A2FA6D"><enum>(b)</enum><header>Requirements</header><paragraph id="id654BF72EC8814981A257C8D99A2A5E05"><enum>(1)</enum><header>In general</header><text>The Secretary shall not approve any lease or exchange agreement, or any modification to a lease or exchange agreement, or any storage agreement that is not in compliance with—</text><subparagraph id="idAD7D59F9B4F84CFD84D2219F790230B5"><enum>(A)</enum><text>this Act; and </text></subparagraph><subparagraph id="idB4AD9E68410E4BC8BBE33ABC6C3EEE81"><enum>(B)</enum><text>the agreement entered into between the CRIT, the State, and the Secretary under section 9(a).</text></subparagraph></paragraph><paragraph id="id1ecbd2f632f644abb78665df10f30e47"><enum>(2)</enum><header>Permanent alienation</header><text>The Secretary shall not approve any lease or exchange agreement, or any modification to a lease or exchange agreement, or any storage agreement that permanently alienates any portion of the CRIT decreed allocation.</text></paragraph></subsection><subsection id="id85133aaaba4f45da95ab02d8cbe02958"><enum>(c)</enum><header>Other requirements</header><text>The requirement for Secretarial approval under subsection (a) shall satisfy the requirements of section 2116 of the Revised Statutes (commonly known as the “Indian Trade and Intercourse Act”) (<external-xref legal-doc="usc" parsable-cite="usc/25/177">25 U.S.C. 177</external-xref>).</text></subsection><subsection id="ida3bfd8e74a774321b2a9fc62003392b4"><enum>(d)</enum><header>Authority of the Secretary</header><text>Nothing in this Act, or any agreement entered into or approved by the Secretary under this Act, including any lease or exchange agreement or storage agreement, shall diminish or abrogate the authority of the Secretary to act under applicable Federal law or regulation, including the Consolidated Decree.</text></subsection></section><section id="id859a362ed39b4823875bdd8e07ede8b5"><enum>7.</enum><header>Responsibilities of the Secretary</header><subsection id="id8d017640549846bfb31109ac55839d3e"><enum>(a)</enum><header>Compliance</header><text>The Secretary, when approving a lease or exchange agreement or a storage agreement under this Act, shall ensure such agreement complies with—</text><paragraph id="idbb44d65be9724390a313c122a9d437b0"><enum>(1)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text></paragraph><paragraph id="id245239b28fb14635979d0d5d005aab3e"><enum>(2)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); and</text></paragraph><paragraph id="id33a37134f41745d382f98a661d8314ed"><enum>(3)</enum><text>all other applicable Federal environmental laws.</text></paragraph></subsection><subsection id="id24c34df017554b5a94b49109d914b392"><enum>(b)</enum><header>Documentation</header><text>The Secretary shall document any lease or exchange agreement or storage agreement in the Water Accounting Report.</text></subsection></section><section id="id1f020d4f879f4157adf4aa4b4c346c15"><enum>8.</enum><header>Agreement between the CRIT and the State</header><subsection id="id72A56ABBA8214FE9B1792F064C6D4EA4"><enum>(a)</enum><header>In general</header><text>Prior to entering into the first lease or exchange agreement or storage agreement, the CRIT shall enter into an agreement with the State that outlines all notice, information sharing, and collaboration requirements that shall apply to any potential lease or exchange agreement or storage agreement the CRIT may enter into.</text></subsection><subsection id="id0CB74D25F6A541FA8F7BE2661932FD75"><enum>(b)</enum><header>Requirement</header><text>The agreement under subsection (a) shall include a provision that requires the CRIT to submit to the State all documents regarding a potential lease or exchange agreement or storage agreement.</text></subsection></section><section id="id70e637d030654876b9f7f3abf553212d"><enum>9.</enum><header>Agreement between the CRIT, the State, and the Secretary</header><subsection id="id03a5ce81597744b4b8ca48159d2b75ce"><enum>(a)</enum><header>In general</header><text>Prior to approving the first lease or exchange agreement or storage agreement under section 6, the Secretary shall enter into an agreement with the State and the CRIT that describes the procedural, technical, and accounting methodologies for any lease or exchange agreement or storage agreement the CRIT may enter into, including quantification of the reduction in consumptive use and water accounting.</text></subsection><subsection id="id1b6fa2d16d824a03a217d49d6027265e"><enum>(b)</enum><header>NEPA</header><text>The execution of the agreement under subsection (a) shall not constitute a major Federal action for purposes of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></subsection><subsection id="id7a0f662e87394c4d94885c48f8cea74e" commented="no"><enum>(c)</enum><header>Effect</header><text>Nothing in this Act shall prohibit the Secretary from agreeing with the CRIT and the State to a modification to an agreement entered into under subsection (a) (including an appendix or exhibit to the agreement) on the condition that the modification— </text><paragraph commented="no" id="id19CFBE4384C74D5293C060D795C6C9E6"><enum>(1)</enum><text>is in compliance with this Act; and </text></paragraph><paragraph commented="no" id="id8A016120A38D4A6AABF68E6C2053E717"><enum>(2)</enum><text>does not otherwise require congressional approval under section 2116 of the Revised Statutes (commonly known as the “Indian Trade and Intercourse Act”) (<external-xref legal-doc="usc" parsable-cite="usc/25/177">25 U.S.C. 177</external-xref>) or any other provision of law.</text></paragraph></subsection></section><section id="id3952ed871cd1469babe25a36e3bb150a"><enum>10.</enum><header>No effect on the CRIT decreed allocation</header><subsection id="idcb1fa106ab7340498f6a7a271c293796"><enum>(a)</enum><header>Temporary use</header><text>A lease or exchange agreement or storage agreement—</text><paragraph id="id227B26FF6A204D5BB53BB26A0DCCB64A"><enum>(1)</enum><text>shall provide for the temporary use or storage of a portion of the consumptive use off the Reservation; and </text></paragraph><paragraph id="id1DCD9402D417486CB2F848D7774913C1"><enum>(2)</enum><text>shall not permanently alienate the decreed allocation.</text></paragraph></subsection><subsection id="id47FE282925494E1EAEA2136403102386"><enum>(b)</enum><header>Priority status</header><paragraph id="idA358F1932AF74F92A6B074EC7F8EAB5F"><enum>(1)</enum><header>In general</header><text>The lease or exchange of a portion of the consumptive use shall not cause that portion to lose or change its priority under the Consolidated Decree.</text></paragraph><paragraph id="id893E81F129B24FF6969130189201A715"><enum>(2)</enum><header>Nonuse</header><text>Any nonuse by a person who is a party to any lease or exchange agreement or storage agreement with the CRIT shall not result in forfeiture, abandonment, relinquishment, or other loss by the CRIT of all or any portion of the decreed allocation.</text></paragraph></subsection><subsection id="idc5e86af9d71f43b29cf76bf7ab3cd776"><enum>(c)</enum><header>Reservation of rights</header><text>The lease, exchange, or storage of a portion of the consumptive use shall not reduce or limit the right of the CRIT to use the remaining portion of the decreed allocation on the Reservation.</text></subsection><subsection id="id46c6c5f7d56b4962a2d4554b5d4155b7"><enum>(d)</enum><header>Storage agreements</header><text>Any storage agreement shall account for the quantity of water in storage off the Reservation in accordance with applicable State law.</text></subsection></section><section id="id325cb5355cc6403d9ed6b2b500378a30"><enum>11.</enum><header>Allottee use of water</header><subsection id="idfd266d0b7bd2475ca8282f0e0f77390a"><enum>(a)</enum><header>Interference</header><text>The lease, exchange, or storage of a portion of the consumptive use shall not directly or indirectly interfere with, or diminish, any entitlement to water for an allottee under Federal or Tribal law.</text></subsection><subsection id="id83f52fcec5c54975a40a3ab16c2595c3"><enum>(b)</enum><header>Water rights of allottees</header><text>The Secretary shall protect the rights of the allottees to a just and equitable distribution of water for irrigation purposes, pursuant to section 7 of the Act of February 8, 1887 (commonly known as the <quote>Indian General Allotment Act</quote>) (24 Stat. 390, chapter 119; <external-xref legal-doc="usc" parsable-cite="usc/25/381">25 U.S.C. 381</external-xref>) (referred to in this section as the <quote>Act</quote>).</text></subsection><subsection id="id04a9688675f643b2b284b61464678bf6"><enum>(c)</enum><header>Relief under Tribal law</header><text>Prior to asserting any claim against the United States pursuant to the Act, or any other applicable law, an allottee shall exhaust all remedies available under applicable Tribal law.</text></subsection><subsection id="idaef87acbcdde48dda46a8c0c792a8ff3"><enum>(d)</enum><header>Relief under the Indian General Allotment Act</header><text>Following an exhaustion of remedies available under applicable Tribal law, an allottee may seek relief under the Act, or any other applicable law.</text></subsection><subsection id="idf181fc9780574f6fb9e9867b698cf200"><enum>(e)</enum><header>Relief from the Secretary</header><text>Following exhaustion of remedies available under the Act, or any other applicable law, an allottee may petition the Secretary for relief.</text></subsection></section><section id="id5755f651c1914ce88064779733813afe"><enum>12.</enum><header>Consideration paid to the CRIT</header><text display-inline="no-display-inline">The CRIT, and not the United States in any capacity, shall be entitled to all consideration due to the CRIT under any lease or exchange agreement or storage agreement.</text></section><section id="id3f3b92e88f8a4de5b76a505026290bc9"><enum>13.</enum><header>Liability of the United States</header><subsection id="id321a9317ea254819aa646b0e2bde2757"><enum>(a)</enum><header>Limitation of liability</header><text>The United States shall not be liable in any claim relating to the negotiation, execution, or approval of any lease or exchange agreement or storage agreement, including any claims relating to the terms included in such an agreement.</text></subsection><subsection id="id50380c4548be444daf3e192e53ca2e87"><enum>(b)</enum><header>Obligations</header><text>The United States shall have no trust obligation or other obligation to monitor, administer, or account for—</text><paragraph id="ide0d8539a2f534acca17f68b0b6b09fd2"><enum>(1)</enum><text>any funds received by the CRIT as consideration under any lease or exchange agreement or storage agreement; or</text></paragraph><paragraph id="id50e696cde9e242f7b80d082f385c6c84"><enum>(2)</enum><text>the expenditure of such funds.</text></paragraph></subsection></section><section id="ida397093ec36f450e9b10f3ad7f62920a"><enum>14.</enum><header>Application</header><subsection id="idFA8E33E37B74440D9BC9758B0044B747"><enum>(a)</enum><header>In general</header><text>This Act shall apply only to the portion of the decreed allocation that is available for use in the State.</text></subsection><subsection id="id642E78D6540C48009D212E3C636F3E9E" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Requirement</header><text>The portion of the decreed allocation described in subsection (a) shall not be used, directly or indirectly, outside the Lower Basin in the State.</text></subsection></section><section display-inline="no-display-inline" commented="no" id="idA3F42DF79F444D98B51AD30AE054126B"><enum>15.</enum><header>Rule of construction</header><subsection display-inline="no-display-inline" commented="no" id="id03E71364A49B444E8AC97D6A36A8077F"><enum/><text>Nothing in this Act establishes, or shall be considered to establish, a precedent in any litigation involving, or alters, affects, or quantifies, any water right with respect to—</text><paragraph display-inline="no-display-inline" commented="no" id="id45876645213C4BAE96571F4B46FBEE7B"><enum>(1)</enum><text>the United States;</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idAEC89BB637EF4193B42CEE93154B4FAB"><enum>(2)</enum><text>any other Indian Tribe, band, or community;</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id24E5D756A1AF45909C7B246B8961F773"><enum>(3)</enum><text>any State or political subdivision or district of a State; or</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id9C5C9B597F844B1F9FF085B1E3DBC710"><enum>(4)</enum><text>any person.</text></paragraph></subsection></section></legis-body></bill>
