<official-title>To prohibit the Department of Defense from discharging or withholding pay or benefits from members of the National Guard based on COVID–19 vaccination status.</official-title>

<section id="S1" section-type="section-one"><enum>1.</enum><header>Prohibition on discharging or withholding pay or benefits from National Guard members based on COVID–19 vaccination status</header> 
<subsection id="id3D12BDA9B6A6405DAEB4F235A91B0D99"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Defense shall not, based on whether or not a member of the National Guard has received a COVID–19 vaccine, take any of the following actions:</text> <paragraph id="id7B5EA09C90F9452C88F9D53BA93E4A5A"><enum>(1)</enum><text>Involuntarily discharge or discipline the member under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/47">chapter 47</external-xref> of title 10, United States Code (the Uniform Code of Military Justice).</text></paragraph> 
<paragraph id="id3311EF8C7B914AF797739E7A5E8AFE4F"><enum>(2)</enum><text display-inline="yes-display-inline">Withhold pay or benefits from the member. </text></paragraph> <paragraph id="id142F5CB4F08E49378198534F3B844069"><enum>(3)</enum><text display-inline="yes-display-inline">Prohibit the member from participating in training or using equipment funded by amounts appropriated by an Act of Congress.</text></paragraph></subsection> 
<subsection id="idA3D0D7D3AB72477E9849E54EC98DAF63"><enum>(b)</enum><header>Pay and benefits included</header><text>The pay and benefits referred to in subsection (a)(2) include the following:</text> <paragraph id="idf39efc93dd1c4d14b77335b9f246aab1"><enum>(1)</enum><text>Basic pay and special pay under title 37, United States Code, or title 10, United States Code. </text></paragraph> 
<paragraph id="id9e2140b7e8aa4ed59bdfebf26561d90c"><enum>(2)</enum><text>Medical and dental care under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/55">chapter 55</external-xref> of title 10, United States Code.</text></paragraph> <paragraph id="id10C837717BB348ABBB6DFAA1DC20CE9D"><enum>(3)</enum><text>Transitional health benefits under section 1145 of such title. </text></paragraph>
