<section section-type="section-one" id="HDC870F51AEB54B0283F97386BDDB31BA"><enum>1.</enum><header>Permanent resident status for Shirley Constantino Tan</header> 
<subsection id="H6FDA2526400E4A219A67BB5C568ECB13"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding subsections (a) and (b) of section 201 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151</external-xref>), Shirley Constantino Tan shall be eligible for issuance of an immigrant visa or for adjustment of status to that of an alien lawfully admitted for permanent residence upon filing an application for issuance of an immigrant visa under section 204 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154</external-xref>) or for adjustment of status to lawful permanent resident.</text></subsection> <subsection id="H078D8B306C2F482288FA5AAA7C095A02"><enum>(b)</enum><header>Adjustment of status</header><text display-inline="yes-display-inline">If Shirley Constantino Tan enters the United States before the filing deadline specified in subsection (c), she shall be considered to have entered and remained lawfully and shall be eligible for adjustment of status under section 245 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref>) as of the date of the enactment of this Act.</text></subsection> 
<subsection id="HF4C1E11061E84C3D8DA066B4EA42C9E2"><enum>(c)</enum><header>Application and payment of fees</header><text>Subsections (a) and (b) shall apply only if the application for issuance of an immigrant visa or the application for adjustment of status is filed with appropriate fees within two years after the date of the enactment of this Act.</text></subsection> <subsection id="HE64128CC507F4A64B35FD142B587FB6A"><enum>(d)</enum><header>Reduction of immigrant visa number</header><text display-inline="yes-display-inline">Upon the granting of an immigrant visa or permanent residence to Shirley Constantino Tan, the Secretary of State shall instruct the proper officer to reduce by one, during the current or next following fiscal year—</text> 
<paragraph id="id396969391356473DA4AE2FE7FC331A0A"><enum>(1)</enum><text display-inline="yes-display-inline">the total number of immigrant visas that are made available to natives of the country of birth of Shirley Constantino Tan under section 203(a) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(a)</external-xref>); or</text></paragraph> <paragraph id="id49BADD6066CD42F5B6B884EA7B461CC9"><enum>(2)</enum><text display-inline="yes-display-inline">if applicable, the total number of immigrant visas that are made available to natives of the country of birth of Shirley Constantino Tan under section 202(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1152">8 U.S.C. 1152(e)</external-xref>).</text></paragraph></subsection> 
<subsection id="ID47f137c0b2b74a43b31e238555c3b189"><enum>(e)</enum><header>PAYGO</header><text>The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the Senate Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></subsection></section> </legis-body> </bill>
