which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish procedures related to the coronavirus disease 2019 (COVID–19) in correctional facilities.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idfd39cbb70d324fbc99fbfa1a3e695dcb"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <short-title>Federal Correctional Facilities COVID–19 Response Act</short-title>.</text></section><section id="idb74eef6fb9984fd4a7bb03306d87734a"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id3be63dc7099a4a3ca18792711e3aed47"><enum>(1)</enum><header>Correctional facility</header><text>The term <term>correctional facility</term> includes—</text><subparagraph id="id2ff3dc3a45de4b82b90712781a492cf3"><enum>(A)</enum><text>Federal prisons, including all prison, correctional, and detention facilities run by the Bureau of Prisons; and</text></subparagraph><subparagraph id="id9a7d336edb4e47e7bac88d4056cd956e"><enum>(B)</enum><text>privately owned or privately operated prison, correctional, and detention facilities contracted by Federal entities, including the Bureau of Prisons, to house Federal incarcerated persons.</text></subparagraph></paragraph><paragraph id="id754f700905184953842b2dc06e520143"><enum>(2)</enum><header>Correctional facility employee</header><text>The term <term>correctional facility employee</term> means any individual employed at a correctional facility housing Federal incarcerated persons, including— </text><subparagraph id="id9D473B748A8C4E46AD120E6B338FD761"><enum>(A)</enum><text>a Federal employee;</text></subparagraph><subparagraph id="idC4610A09B61541A3A2D2B22B67F54A81"><enum>(B)</enum><text>an employee of a privately owned or privately operated prison, correctional, or detention facility contracted by a Federal entity to house Federal incarcerated persons; and</text></subparagraph><subparagraph id="id049A5C4951244F2980F5781685BCE6B9"><enum>(C)</enum><text>an employee of a private company contracted to provide goods and services at a correctional facility.</text></subparagraph></paragraph><paragraph id="idefcbbb227d084d7fbd50cc44656f9a7e"><enum>(3)</enum><header>COVID–19 diagnostic test</header><text>The term <term>COVID–19 diagnostic test</term> mean a test— </text><subparagraph id="idEDF88A664929442A9710E70723D9FE13"><enum>(A)</enum><text>that is an in vitro diagnostic product (as defined in section 809.3 of title 21, Code of Federal Regulations, or any successor thereto) for the detection of SARS–CoV–2 or the diagnosis of the virus that causes COVID–19; and</text></subparagraph><subparagraph id="id97CD3E278A6E4A2AA9CE2B509B30E123"><enum>(B)</enum><text>the administration of which—</text><clause id="idD3C4241B43F04DB3835F67F056229D5E"><enum>(i)</enum><text>is approved, cleared, or authorized under section 510(k), 513, 515, or 564 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360">21 U.S.C. 360(k)</external-xref>, 360c, 360e, 360bbb–3); </text></clause><clause id="id114D4E88883D4FEE8D1F2B7CFA29056F"><enum>(ii)</enum><text>the developer has requested, or intends to request, emergency use authorization under section 564 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360bbb-3">21 U.S.C. 360bbb–3</external-xref>), unless and until the emergency use authorization request under such section 564 has been denied or the developer of such test does not submit a request under such section within a reasonable timeframe; </text></clause><clause id="id63BB7657F3BB4739BB6393519B092AAA"><enum>(iii)</enum><text>is developed in and authorized by a State that has notified the Secretary of Health and Human Services of its intention to review tests intended to diagnose COVID–19; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id5AC0D8AC20284DFDAB32E2E824396BAB"><enum>(iv)</enum><text>is another test that the Secretary determines appropriate in guidance.</text></clause></subparagraph></paragraph><paragraph id="id9da509fab1104b7092997ec5fff70bde"><enum>(4)</enum><header>COVID–19 pandemic</header><text>The term <term>COVID–19 pandemic</term> means the period beginning on the date of enactment of this Act and ending on the date that is 1 year after the date on which the public health emergency declaration under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) with respect to COVID–19 terminates.</text></paragraph><paragraph id="id31934f705630466aa2f9271ba3b83f98"><enum>(5)</enum><header>High risk incarcerated person</header><text>The term <term>high risk incarcerated person</term> means an individual who meets the definition of <quote>incarcerated person</quote> under this section who—</text><subparagraph id="ida00be411b53448bf92bb0d95a84d17a7"><enum>(A)</enum><text>is 50 years old or older;</text></subparagraph><subparagraph id="idf583eefa24164ddb98430fa8cf251a23"><enum>(B)</enum><text>has chronic kidney disease;</text></subparagraph><subparagraph id="id82d1572cde13450088fa37a6dbb97c6f"><enum>(C)</enum><text>has chronic obstructive pulmonary disease;</text></subparagraph><subparagraph id="id35b499793d6b472ca5e38bf2d6a42fcf"><enum>(D)</enum><text>is immunocompromised;</text></subparagraph><subparagraph id="id7655db6c2ce94af0844e273636ab01af"><enum>(E)</enum><text>has obesity;</text></subparagraph><subparagraph id="idf88e38bb293f4034bea7580c18dc461a"><enum>(F)</enum><text>has a heart condition, such as coronary artery disease or cardiomyopathy;</text></subparagraph><subparagraph id="id93532ed4773443a996499d6617e05403"><enum>(G)</enum><text>has sickle cell disease;</text></subparagraph><subparagraph id="id72ab812cf99c474ca6b76959b04a7568"><enum>(H)</enum><text>has type 1 or type 2 diabetes mellitus;</text></subparagraph><subparagraph id="id5fc0161c736c4e2a9f8801217e363b99"><enum>(I)</enum><text>has moderate to severe asthma;</text></subparagraph><subparagraph id="id92428535fea242568b2690f3c8a6f1ce"><enum>(J)</enum><text>has cerebrovascular disease;</text></subparagraph><subparagraph id="id8ff21b74ebb843f68670767df8add69d"><enum>(K)</enum><text>has cystic fibrosis;</text></subparagraph><subparagraph id="id7a6440372bed407cbb1cfbc0f0d45747"><enum>(L)</enum><text>has hypertension or high blood pressure;</text></subparagraph><subparagraph id="id80d758d8c7084273a2ab09770d03ef3c"><enum>(M)</enum><text>has a neurological condition such as dementia or Parkinson's Disease;</text></subparagraph><subparagraph id="id1da691edee34482783772e08dcf43848"><enum>(N)</enum><text>has liver disease;</text></subparagraph><subparagraph id="id59313dfd04e640b69493241ccc27f2c2"><enum>(O)</enum><text>is pregnant;</text></subparagraph><subparagraph id="id8cfca5a500bb4e55bba19e2e821cff68"><enum>(P)</enum><text>has pulmonary fibrosis;</text></subparagraph><subparagraph id="id342ccf2fd7f74e29965b9f0e9083131e"><enum>(Q)</enum><text>has thalassemia;</text></subparagraph><subparagraph id="id4afe21e62b1146c7a785f0c1efb2835e"><enum>(R)</enum><text>is a smoker;</text></subparagraph><subparagraph id="id7bc21c6da468412698000d0477518fc9"><enum>(S)</enum><text>has a disability; or</text></subparagraph><subparagraph id="id7495eef0744343fbbdd7a9f700e8c8fd"><enum>(T)</enum><text>meets any other characteristic identified by the Centers for Disease Control and Prevention as putting individuals at increased risk of developing sever illness from COVID–19.</text></subparagraph></paragraph><paragraph id="id08ff32a7eeab47a7a9bdeba0fec1869d"><enum>(6)</enum><header>Incarcerated person</header><text>The term <term>incarcerated person</term> means an individual involuntarily confined or detained in a correctional facility.</text></paragraph><paragraph id="idbdf0b9fefe814c40942d2e5599df2f02"><enum>(7)</enum><header>Signs and symptoms of COVID–19</header><text>The term <term>signs and symptoms of COVID–19</term> means fever or chills, cough, shortness of breath or difficulty breathing, fatigue, muscle or body aches, headache, new loss of taste or smell, sore throat, congestion or runny nose, nausea or vomiting, diarrhea, and any other medical condition or reaction identified by the Centers for Disease Control and Prevention as being a physical reaction to the contraction of the severe acute respiratory syndrome coronavirus 2 (SARS–CoV–2).</text></paragraph></section><section id="idddef2a5995bb45c890c9055364ac700d"><enum>3.</enum><header>Mandated COVID–19 testing and vaccination at correctional facilities</header><subsection id="id93195b8d7cea4b979db93948984d5a48"><enum>(a)</enum><header>Testing of incarcerated persons</header><paragraph id="ida046feabe1ff4fbe8dd3eb10da9c1ef1"><enum>(1)</enum><header>In general</header><text>Each correctional facility shall—</text><subparagraph id="id4d810cc5589d4e73a1484d119a7d0043"><enum>(A)</enum><text>not later than 15 days after the date of enactment of this Act—</text><clause id="idb139321bdcfe4ac5acf3a3c80589106d"><enum>(i)</enum><text>provide each incarcerated person in the facility with the option to take a COVID–19 diagnostic test, regardless of whether the incarcerated person exhibits symptoms of COVID–19, at no cost to the incarcerated person;</text></clause><clause id="ida764543940f84e3395f15cd123b26f6b"><enum>(ii)</enum><text>provide each incarcerated person with the results of the diagnostic test, regardless of the results, including an interpretation of what the test results mean in the incarcerated person’s preferred language;</text></clause><clause id="id76fb44b7e6bc4b8d92a933d6cb87cdbb"><enum>(iii)</enum><text>provide each incarcerated person who tests positive for COVID–19 with necessary medical care (as outlined in the National Institutes of Health COVID–19 Treatment Guidelines), including COVID–19 tests to monitor recovery if indicated by the Centers for Disease Control and Prevention, and housing in a medical isolation unit under the care of medical professionals, at no cost to the incarcerated person; </text></clause><clause id="idfaf1090ddfba477880b952c68e5244fc"><enum>(iv)</enum><text>place each asymptomatic incarcerated person who is exposed to a positive case in quarantine until testing is completed consistent with Centers for Disease Control and Prevention guidance; and </text></clause><clause id="idbb61e85994c84c74b8780304d4a09f53"><enum>(v)</enum><text>place each symptomatic incarcerated person into medical isolation while awaiting test results; and</text></clause></subparagraph><subparagraph id="id6f61e8ebd3ce4c509bb8279e6e0d3ff9"><enum>(B)</enum><text>during the period beginning not later than 45 days after the date of enactment of this Act and ending on the last day of the COVID–19 pandemic—</text><clause id="id447b4f8ddcf143c1b12e7d43813cfdd4"><enum>(i)</enum><text>conduct weekly COVID–19 diagnostic testing of incarcerated persons in the facility in accordance with the guidelines developed under section 6, regardless of whether such incarcerated persons exhibit symptoms of COVID–19, at no cost to incarcerated persons;</text></clause><clause id="idff6641171c22412fbc71489d9bb33fbd"><enum>(ii)</enum><text>conduct COVID–19 diagnostic testing for any incarcerated person with COVID–19 symptoms, or for any incarcerated person who is a close contact of a known COVID–19 case, in accordance with the guidelines developed under section 6; </text></clause><clause id="id1348a331ccf94ad4acae5e3aabf7e539"><enum>(iii)</enum><text>provide each incarcerated person with the results of the diagnostic tests, regardless of the results, including an interpretation of what the test results mean in the incarcerated person’s preferred language;</text></clause><clause id="id318c016f22a346f49970e8b66ce04dd7"><enum>(iv)</enum><text>provide each incarcerated person who tests positive for COVID–19 with necessary medical care (as outlined in the National Institutes of Health COVID–19 Treatment Guidelines), including COVID–19 tests to monitor recovery if indicated by the Centers for Disease Control and Prevention, and housing in a medical isolation unit under the care of medical professionals, at no cost to the incarcerated person, in accordance with the guidelines developed under section 6;</text></clause><clause id="id8d738d39900a4b339852950ee35d5e60"><enum>(v)</enum><text>quarantine each incarcerated person exposed to a positive COVID–19 case in accordance with the guidelines developed under section 6; and</text></clause><clause id="idd480899acbb547e08080578361601c51"><enum>(vi)</enum><text>establish a procedure through which incarcerated people can opt out of COVID–19 testing, in accordance with the guidelines developed under section 6.</text></clause></subparagraph></paragraph><paragraph id="idec2f83ae6b7648c986d2694413f47f37"><enum>(2)</enum><header>New entrants</header><text>During the period beginning not later than 45 days after the date of enactment of this Act and ending on the last day of the COVID–19 pandemic, each correctional facility shall—</text><subparagraph id="id0a3674eccfe74a899f33fa5265123edc"><enum>(A)</enum><text>provide each incarcerated person newly admitted or transferred to the facility with an optional COVID–19 diagnostic test within 24 hours of entering the facility, regardless of whether the incarcerated person exhibits symptoms of COVID–19, at no cost to the incarcerated person; and</text></subparagraph><subparagraph id="idaae568be980c4496915e7fb7335dd73b"><enum>(B)</enum><text>immediately quarantine each incarcerated person newly admitted or transferred to the facility within 24 hours of entering the facility, consistent with Centers for Disease Control and Prevention guidance, until the incarcerated person has been confirmed to be negative for COVID–19, in accordance with the guidelines developed under section 6. </text></subparagraph></paragraph></subsection><subsection id="id98df314f279f42718df9842fb70ff551"><enum>(b)</enum><header>Testing of correctional facility employees</header><paragraph id="iddf6fbc16615349d1a732da36898373ae"><enum>(1)</enum><header>In general</header><text>Each correctional facility shall—</text><subparagraph id="id0ffd828187714a17b662ddbd312d56de"><enum>(A)</enum><text>not later than 15 days after the date of enactment of this Act—</text><clause id="idde59c5312c484d51859144ea6e1dd3d8"><enum>(i)</enum><text>provide each correctional facility employee with a required COVID–19 diagnostic test, regardless of the whether the employee exhibits symptoms of COVID–19, at no cost to the employee; and</text></clause><clause id="ida23585ccecf44cc9ab28f1b9c1b456fc"><enum>(ii)</enum><text>provide each correctional facility employee who tests positive for COVID–19 with unlimited paid administrative leave for the purpose of recovering from COVID–19, and no cost COVID–19 diagnostic testing for the purpose of monitoring recovery if indicated by the Centers for Disease Control and Prevention, until the employee tests negative for COVID–19; and</text></clause></subparagraph><subparagraph id="ida88fd6d11c144f3ab08a199b91bad5bb"><enum>(B)</enum><text>during the period beginning not later than 45 days after the date of enactment of this Act and ending on the last day of the COVID–19 pandemic—</text><clause id="id52d77e6bba8d4b53a83bfa908ccba631"><enum>(i)</enum><text>conduct required weekly COVID–19 diagnostic testing of each correctional facility employee in the facility, in accordance with the guidelines developed under section 6, regardless of whether the employee exhibits symptoms of COVID–19, at no cost to the employee; </text></clause><clause id="idf659edfe609d40ae984abe782e9ae4ef"><enum>(ii)</enum><text>provide each correctional facility employee who tests positive for COVID–19 with unlimited paid leave for the purpose of recovering from COVID–19, and no cost COVID–19 diagnostic testing for the purpose of monitoring recovery if indicated by the Centers for Disease Control and Prevention, until the employee tests negative for COVID–19; and</text></clause><clause id="idf6468cef1f314e5f8e215254e692dfef"><enum>(iii)</enum><text>provide each correctional facility employee who is exposed to a positive COVID–19 case with guaranteed paid leave to quarantine, consistent with Centers for Disease Control and Prevention guidance, or until the employee has been confirmed to be negative for COVID–19.</text></clause></subparagraph></paragraph></subsection><subsection id="id566b92cd7abd4791a7d4d52411a431a6"><enum>(c)</enum><header>Vaccination of incarcerated persons</header><text>Each correctional facility shall—</text><paragraph id="id990a30e47caf4f3c86fb1384acf1223e"><enum>(1)</enum><text>not later than 45 days after the date of enactment of this Act—</text><subparagraph id="id81dd314518a2451a904abc191c83ddf3"><enum>(A)</enum><text>begin providing each incarcerated person in the facility with the option to take a COVID–19 vaccine; and</text></subparagraph><subparagraph id="idceb135be6f7941f8b848a56c6276ad6e"><enum>(B)</enum><text>begin providing each incarcerated person in the facility with information, offered in the incarcerated persons’ preferred language, on the type of COVID–19 vaccine offered, possible side effects of the COVID–19 vaccine, and educational materials on the benefits of COVID–19 and other vaccinations.</text></subparagraph></paragraph></subsection><subsection id="id8e410f66bb78474c9501617183d0df51"><enum>(d)</enum><header>Vaccination of correctional facility employees</header><text>Each correctional facility shall—</text><paragraph id="id59461e517c7645d2a03c33297fde6911"><enum>(1)</enum><text>not later than 45 days after the date of enactment of this Act—</text><subparagraph id="id16f077e6769f4f7fa45036a5b3c75a53"><enum>(A)</enum><text>begin providing each correctional facility employee with the option to take a COVID–19 vaccine; and</text></subparagraph><subparagraph id="id80b612069a814e1c967ffde90372c795"><enum>(B)</enum><text>begin providing each correctional facility employee with information on the type of COVID–19 vaccine offered, possible side effects of the COVID–19 vaccine, and educational materials on the benefits of COVID–19 and other vaccinations. </text></subparagraph></paragraph></subsection><subsection id="id6a505634a3c34b3299166966558edbde"><enum>(e)</enum><header>Privacy</header><text>Any data collected, stored, received, or published under this section shall—</text><paragraph id="id3b445661db274a5e8fd98f8518e2d0f2"><enum>(1)</enum><text>be so collected, stored, received, or published in a manner that protects the privacy of individuals whose information is included in the data;</text></paragraph><paragraph id="idd2f56317923847f6bf8910a6c0bb4d62"><enum>(2)</enum><text>be deidentified or anonymized in a manner that protects the identity of all individuals whose information is included in the data;</text></paragraph><paragraph id="idaddbd464f8c04f1881ad53352fffbc1d"><enum>(3)</enum><text>comply with privacy protections provided under the regulations promulgated under section 264(c) of the Health Insurance Portability and Accountability Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/1320d-2">42 U.S.C. 1320d–2</external-xref> note); and</text></paragraph><paragraph id="id88fbfe486b9d4668a4f979b2d3add441"><enum>(4)</enum><text>be limited in use for the purpose of public health and be protected from all other internal use by any entity that collects, stores, or receives the data, including use of the data in determinations of eligibility (or continued eligibility) in health plans, and from any other inappropriate uses.</text></paragraph></subsection><subsection id="id6487a25ec43346b386a802a0baa2c04e"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to relevant medical and public officials such sums as are necessary to procure and administer the COVID–19 diagnostic tests and provide the medical care required in this section. </text></subsection></section><section id="idf54982dfd44e40a68a0b0e72bbcb7c5f"><enum>4.</enum><header>COVID–19 data collection at correctional facilities</header><subsection id="id80e35b7916b447be88389768b0dafc71"><enum>(a)</enum><header>Data collection</header><text>During the period beginning not later than 45 days after the date of enactment of this Act and ending on the last day of the COVID–19 pandemic, each correctional facility shall submit weekly reports to the Department of Justice, the Centers for Disease Control and Prevention, and the public health authority of the State in which the facility is located on the following:</text><paragraph id="id89f2a965684749d2875dcad5ac6a2bee"><enum>(1)</enum><header>Testing numbers</header><text>COVID–19 diagnostic testing, including cumulative and new (since the previous report) counts of—</text><subparagraph id="id5322420f4ee742cf9edf604cb7f0bcda"><enum>(A)</enum><text>the number of incarcerated persons tested for COVID–19, disaggregated by routine weekly testing, symptomatic testing, close contact testing, recovery monitoring testing, and new entrant testing;</text></subparagraph><subparagraph id="id1a7e73c426e44540bbcb7de4f059c19a"><enum>(B)</enum><text>the number of correctional facility employees tested for COVID–19, disaggregated by routine weekly testing, symptomatic testing, close contact testing, and recovery monitoring testing; and</text></subparagraph><subparagraph id="id858339e5bcaa4da48f093a0422a772ad"><enum>(C)</enum><text>the COVID–19 diagnostic test developer, test name, and type of test (molecular, antigen, or other) for each COVID–19 diagnostic test conducted.</text></subparagraph></paragraph><paragraph id="ide10369051bb24210854adaf08a75bf68"><enum>(2)</enum><header>Test results</header><text>COVID–19 diagnostic testing outcomes, including cumulative and new (since the previous report) counts of—</text><subparagraph id="id1d352a4b5bf64c8cb864289129cfebd3"><enum>(A)</enum><text>the number of confirmed active cases of COVID–19 among incarcerated persons, disaggregated by routine weekly testing, symptomatic testing, close contact testing, recovery monitoring testing, and new entrant testing; </text></subparagraph><subparagraph id="idb75834e86d974684a5d938edff0e2ea6"><enum>(B)</enum><text>the number of confirmed negative cases of COVID–19 among incarcerated persons, disaggregated by routine weekly testing, symptomatic testing, close contact testing, recovery monitoring testing, and new entrant testing;</text></subparagraph><subparagraph id="idd140a8f878814d3ab8f63889fce22347"><enum>(C)</enum><text>the number of confirmed active cases of COVID–19 among correctional facility employees, disaggregated by routine weekly testing, symptomatic testing, close contact testing, and recovery monitoring testing;</text></subparagraph><subparagraph id="id2783fbed10d84bf6abd16fec77620706"><enum>(D)</enum><text>the number of confirmed negative cases of COVID–19 among correctional facility employees, disaggregated by routine weekly testing, symptomatic testing, close contact testing, and recovery monitoring testing;</text></subparagraph><subparagraph id="idd68e184201da4a34a99e73776178eecb"><enum>(E)</enum><text>the number of tests pending results, disaggregated by incarcerated persons and correctional facility employees;</text></subparagraph><subparagraph id="id4e703ace43954d65a4326dd79b7bc68b"><enum>(F)</enum><text>the average time between testing an incarcerated person for COVID–19 and receiving the results of the test; and</text></subparagraph><subparagraph id="id1d8542c158b14b8093c54a8ad7488468"><enum>(H)</enum><text>the number of correctional facility employees who have died from a case of COVID–19.</text></subparagraph></paragraph><paragraph id="id67fc9796aedf4e21a33b105bc5802be0"><enum>(4)</enum><header>Release of incarcerated persons</header><text>Data related to the release of incarcerated persons, including individuals released to home confinement and pursuant to compassionate release, as a result of the COVID–19 public health emergency.</text></paragraph><paragraph id="id0150d68004e34871aa197dc646ce0edf"><enum>(5)</enum><header>Daily population</header><text>Average daily population, disaggregated by incarcerated persons and correctional facility employees.</text></paragraph><paragraph id="id689cbd7eebdf4d268f5b920236c20346"><enum>(6)</enum><header>Vaccinations</header><text>Data related to distribution of the COVID–19 vaccine, including—</text><subparagraph id="id55f80dc703854d7291e4cfe1eb678f90"><enum>(A)</enum><text>the policies of the facility relating to the distribution of the COVID–19 vaccination to incarcerated persons and correctional facility staff, including how the facility is prioritizing distribution, both among correctional facility staff and incarcerated persons, and any changes or updates made to the policies;</text></subparagraph><subparagraph id="id906c62f907e846799616373cdda07ff3"><enum>(B)</enum><text>the total number of COVID–19 vaccine doses that the facility has received up to the date of the report;</text></subparagraph><subparagraph id="iddb6f7f17a2aa4fc1845b32a63c41b72c"><enum>(C)</enum><text>the total number and percentage of incarcerated persons who—</text><clause id="idfb815a4f861d4b749ee3215cf8c4b29a"><enum>(i)</enum><text>have been offered a COVID–19 vaccine;</text></clause><clause id="id5377ab2675ab4eb6a73f877ac80feeae"><enum>(ii)</enum><text>have received a first dose of the COVID–19 vaccine up to the date of the report;</text></clause><clause id="id749003d08497422d85be997168db4b75"><enum>(iii)</enum><text>are fully vaccinated, either because the person received a second dose of the COVID–19 vaccine or because the COVID–19 vaccine the person received required only 1 dose;</text></clause><clause id="id1422abec31e54c34a8bd881194e12b23"><enum>(iv)</enum><text>declined the COVID–19 vaccine; and</text></clause><clause id="id2b3ac064d4964275be5a04208b8bbc13"><enum>(v)</enum><text>are housed in a skilled nursing level housing unit or hospice and have—</text><subclause id="idfaba2bcf10ee4a7f9fc844b0d3a42369"><enum>(I)</enum><text>not received the COVID–19 vaccine;</text></subclause><subclause id="idc6e263205455485e991648888e86f7ba"><enum>(II)</enum><text>accepted the COVID–19 vaccine; and</text></subclause><subclause id="idf64d3da83304423498ec240ec2c551a0"><enum>(III)</enum><text>declined the COVID–19 vaccine;</text></subclause></clause></subparagraph><subparagraph id="id3e5936d65f204cc292f4eca70ed6024e"><enum>(D)</enum><text>the total number and percentage of correctional facility staff who—</text><clause id="id557e7f1a68244d8e9396f6da64b26512"><enum>(i)</enum><text>have been offered a COVID–19 vaccine;</text></clause><clause id="id61f55f4c23cc4fd5bbdd4ea2430f2acf"><enum>(ii)</enum><text>have received a first dose of the COVID–19 vaccine in up to the date of the report;</text></clause><clause id="id03a1e73d940e4e939939d41568a44c6e"><enum>(iii)</enum><text>are fully vaccinated, either because the person received a second dose of the COVID–19 vaccine or because the COVID–19 vaccine the person received required only 1 dose; and</text></clause><clause id="id00895d03ee524e7fa9b887a2441e4160"><enum>(iv)</enum><text>declined the COVID–19 vaccine; and</text></clause></subparagraph><subparagraph id="id6b27d8d6c08f4817b0064a92dff573fa"><enum>(E)</enum><text>in the case of incarcerated persons and correctional facility staff described in subparagraph (C)(iv) or (D)(iv), respectively, the 3 most common reasons given for declining the COVID–19 vaccine. </text></subparagraph></paragraph></subsection><subsection id="id80e22eb20fe1487ba61ba8a18b97d6cb"><enum>(b)</enum><header>Disaggregation of data</header><text>The data described in this section shall be disaggregated by sex, sexual orientation, gender identity, age, race, ethnicity, disability, and geography (including county and State).</text></subsection><subsection id="iddb87a50b43cf4684b1effb057f5d7b04"><enum>(c)</enum><header>Public reporting</header><text>The Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention, shall make publicly available on the internet the most recent and historic information reported weekly under subsection (a) in a machine-readable format.</text></subsection><subsection id="id4f703c4e2f9948d38bdd1db8a286a53e"><enum>(d)</enum><header>COVID–19 symptom tracking and medical record retention</header><text>During the period beginning not later than 45 days after the date of enactment of this Act and ending on the last day of the COVID–19 pandemic, each correctional facility shall systemically track and record of the signs and symptoms of COVID–19 among incarcerated persons and correctional center employees. As part of the tracking system, correctional facilities shall—</text><paragraph id="id0c6f468503894d729baae44158f15ce0"><enum>(1)</enum><text>document and retain a record of each request from incarcerated persons for medical care, including medical care for the signs and symptoms of COVID–19;</text></paragraph><paragraph id="id8b5a38e6c7f9423eb739dc9cf681e28e"><enum>(2)</enum><text>conduct weekly screenings, in conjunction with the testing requirements described in section 3, of incarcerated persons for signs and symptoms of COVID–19 and maintain records of the results of such screenings for each incarcerated person; and</text></paragraph><paragraph id="id7ded2cb544bb41b485f2418761e83dab"><enum>(3)</enum><text>present for review, as requested at any time by the Secretary of Health and Human Services or the Attorney General, records collected under paragraphs (1) and (2).</text></paragraph></subsection><subsection id="idd46e21b5255645059ed4cddd8075b964"><enum>(e)</enum><header>Incarcerated persons data</header><text>The data described in this section with respect to incarcerated persons who are serving a term of imprisonment and who are infected with COVID–19 shall include, to the extent practicable, the term of imprisonment imposed on the incarcerated persons, the time served, and the release date.</text></subsection><subsection id="id633ba72dd42a41a79d6d6379f9f9bfe0"><enum>(f)</enum><header>Privacy</header><text>Any data collected, stored, received, or published under this section shall—</text><paragraph id="ida75b10e65d1a4962b187566b9f8f7b46"><enum>(1)</enum><text>be so collected, stored, received, or published in a manner that protects the privacy of individuals whose information is included in the data;</text></paragraph><paragraph id="id01d743b7beaa4fb4913052746d3e2261"><enum>(2)</enum><text>be de-identified or anonymized in a manner that protects the identity of all individuals whose information is included in the data;</text></paragraph><paragraph id="id740f04c53d9a4dbfae068cc6e914394a"><enum>(3)</enum><text>comply with privacy protections provided under the regulations promulgated under section 264(c) of the Health Insurance Portability and Accountability Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/1320d-2">42 U.S.C. 1320d–2</external-xref> note); and</text></paragraph><paragraph id="id69a4feac068c48879e1992ce6379947b"><enum>(4)</enum><text>be limited in use for the purpose of public health and be protected from all other internal use by any entity that collects, stores, or receives the data, including use of such data in determinations of eligibility (or continued eligibility) in health plans, and from any other inappropriate uses.</text></paragraph></subsection><subsection id="id27a3959f3e234f9ebafee87349c1cc14"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Centers for Disease Control and Prevention such sums as are necessary to publicize the data as described in this section.</text></subsection></section><section id="ide299400ee5f7415ebf27cfb6d97c3729"><enum>5.</enum><header>Centers for Disease Control and investigation deployment</header><subsection id="id35C2E36326E64CBABFBE83AB73C5CEBC"><enum>(a)</enum><header>In general</header><text>Correctional facilities shall report to the Centers for Disease Control and Prevention instances when 3 or more incarcerated persons or correctional facility employees present new COVID–19 cases within 72 hours of each other, within 24 hours of identifying the third case.</text></subsection><subsection id="id55FFB7EE48304E1D8F1D28D88B1284AB"><enum>(b)</enum><header>Deployment of staff</header><text>In such instances, the Centers for Disease Control and Prevention shall deploy staff with experience in preventing the spread of infectious diseases in congregate settings to the facility for the purpose of mitigating and preventing the spread of COVID–19 at the facility.</text></subsection></section><section id="idc11df8a65c0d445a9f13fe319634a15b"><enum>6.</enum><header>Updated Bureau of Prisons guidelines on handling COVID–19 in correctional facilities</header><subsection id="id8c8ac67d2fd64532a592f960cf2d140d"><enum>(a)</enum><header>Updated COVID–19 guidelines</header><text>Not later than 30 days after the date of enactment of this Act, the Department of Justice, acting through the Bureau of Prisons and in consultation with the Centers for Disease Control and Prevention, shall release updated guidelines on the management of COVID–19 in correctional facilities.</text></subsection><subsection id="id6ae6bb729bf54a98954ac459fa792a83"><enum>(b)</enum><header>Expert consultation</header><paragraph id="id00ab5bb5335c4d3eb6d656acfb57d3e2"><enum>(1)</enum><header>In general</header><text>In developing the guidelines described in subsection (a), the Department of Justice shall consult with no fewer than 10 experts in public health and correctional facility management, which shall include—</text><subparagraph id="ide2b90687d9884be387eb281d4191feb1"><enum>(A)</enum><text>academics with medical and public health expertise;</text></subparagraph><subparagraph id="id61d4b908e2994422b2e245ee72727abf"><enum>(B)</enum><text>advocates for imprisoned populations;</text></subparagraph><subparagraph id="id621c85cfba124cf29e670c4b2983651f"><enum>(C)</enum><text>public health officials;</text></subparagraph><subparagraph id="id3b650e53884a4f7aa28b932f93e97912"><enum>(D)</enum><text>tribal leaders or their representatives; and</text></subparagraph><subparagraph id="id39d6d7e91b634581a5c4a6f5ee9f6c94"><enum>(E)</enum><text>labor representatives of correctional facility employees.</text></subparagraph></paragraph><paragraph id="id75a990895e624deb8de8304af8c2e5ef"><enum>(2)</enum><header>Publicly available</header><text>Recommendations from and correspondence with individuals described in paragraph (1) shall be made publicly available.</text></paragraph></subsection><subsection id="idcac626fe419942f5a364482137f50dbb"><enum>(c)</enum><header>Contents</header><text>The guidelines described in subsection (a) shall, at a minimum, include—</text><paragraph id="id8c3aef63fcfb4a04b41c93983179b895"><enum>(1)</enum><text>requirements that correctional facilities conduct voluntary COVID–19 diagnostic tests on, and quarantine consistent with Centers for Disease Control and Prevention guidance all new incarcerated persons who enter the facility during the COVID–19 pandemic, including incarcerated persons being held at the facility while in transit between other facilities; </text></paragraph><paragraph id="id26940ddb2b4440b79e0660e2f48a53aa"><enum>(2)</enum><text>guidance on how facilities should conduct weekly testing of incarcerated persons and correctional facility employees, including guidance on how to conduct pooled sample testing in lieu of individual testing, if appropriate, and guidance on how to identify the appropriate type of diagnostic test to use, consistent with the most up-to-date public health information and guidance on preventing the spread of COVID–19; </text></paragraph><paragraph id="id081c5e421fd841cc8dcdc6da56742749"><enum>(3)</enum><text>guidance on how correctional facilities should handle incarcerated persons who refuse to receive COVID–19 tests, such as through implementing time-based or symptom-based isolation and quarantine strategies;</text></paragraph><paragraph id="idfc87e698cbb64eff947610fd3db093d5"><enum>(4)</enum><text>requirements that correctional facilities, once a single case of COVID–19 is detected within the facility, screen every incarcerated person and correctional facility employee for signs and symptoms of COVID–19 within 24 hours;</text></paragraph><paragraph id="id27451b921deb4e27b7e9883a8bb62711"><enum>(5)</enum><text>guidance for correctional facilities on maximum occupational capacity, social distancing best practices, and how to reduce the incarcerated person population within the facility, including updated guidance on the proactive release of incarcerated persons, with special consideration given to high-risk incarcerated persons;</text></paragraph><paragraph id="id091f1d09ffa44560b1a8690651af11d8"><enum>(6)</enum><text>guidance for correctional facilities on how to establish and implement cohorting strategies to minimize the spread of COVID–19 in facilities, with special consideration given to the cohorting of high-risk incarcerated persons;</text></paragraph><paragraph id="iddec50fe1c57a4608be626b99bfc0ad59"><enum>(7)</enum><text>guidance for correctional facilities on how to establish and implement contact tracing efforts to identify, track, and prevent the spread of COVID–19 among the contacts of incarcerated persons and correctional facility employees who test positive for COVID–19;</text></paragraph><paragraph id="id8975acbff93246a2b0a2b0516cd97eba"><enum>(8)</enum><text>guidance for correctional facilities on how to—</text><subparagraph id="idc8bee92e2edc4d7189217cd79c11689f"><enum>(A)</enum><text>humanely and effectively quarantine incarcerated persons exposed to COVID–19 and humanely and effectively medically isolate and provide medical care to incarcerated persons who contract COVID–19, including a prohibition on the use of punitive solitary confinement and other punitive measures as a means of treating and medically isolating incarcerated persons, with special consideration given to the quarantining and medical isolation and treatment of high-risk incarcerated persons;</text></subparagraph><subparagraph id="idd58b70c9c32042a48f84ff8f50ab2b6e"><enum>(B)</enum><text>authorize the provision of materials, such as books, television shows, magazines, and movies to, increase recreation hours for, and expand programming and phone and email communication privileges for incarcerated persons in medical isolation to minimize the similarity of punitive solitary confinement and other punitive measures with medical quarantine; and</text></subparagraph><subparagraph id="id992c6931cbbb4070a3b7e662583df333"><enum>(C)</enum><text>confirm that incarcerated persons and correctional facility employees who have contracted COVID–19 have recovered for the purpose of releasing them from medical isolation;</text></subparagraph></paragraph><paragraph id="idfa0a4524cdc441edbc9e1f07127c7022"><enum>(9)</enum><text>guidance for correctional facilities on the proper cleaning and disinfecting of the facility to prevent the spread of COVID–19;</text></paragraph><paragraph id="id75128923451146919da45bb87949ee89"><enum>(10)</enum><text>guidance for correctional facilities on proper ventilation and air filtration strategies to prevent the spread of COVID–19; </text></paragraph><paragraph id="id28d2fe0253124914a9586a6e1c853008"><enum>(11)</enum><text>guidance on the proper daily, weekly, and monthly allowance for incarcerated persons of personal protective equipment and face coverings, hand sanitizer, soap, cleaning items, and other materials that could reduce the spread of COVID–19 in facilities, which shall be provided to incarcerated persons at no cost, including information on how to update existing guidelines within facilities on the limitation of incarcerated persons’ access to such materials;</text></paragraph><paragraph id="id1a07031b735c4db38ce004c54d0c5589"><enum>(12)</enum><text>guidance for correctional facilities on how to educate incarcerated persons, and the medical facilities treating those incarcerated persons for COVID–19, on the healthcare rights of the incarcerated persons under Federal and State law and the minimum ethical standards of care, including the use of medical isolation that does not include solitary confinement;</text></paragraph><paragraph id="id768b6d3aad994f4aab1db6d24cb9352e"><enum>(13)</enum><text>recommendations for correctional facilities on how to increase communication between incarcerated persons and friends and family outside of the facility during the COVID–19 pandemic, including guidance on how to suspend fees for phone calls and electronic communications and expand visitation (including virtual visitation) options;</text></paragraph><paragraph id="idae113ec1b719436c84927fb0624c302c"><enum>(14)</enum><text>requirements that correctional facilities communicate, not less frequently than biweekly, and in such a manner that permits for feedback from incarcerated persons, to incarcerated persons the steps being taken to address the COVID–19 pandemic in the facility;</text></paragraph><paragraph id="id8ccd63655ffb4fa7a8e4415b1fc20ce9"><enum>(15)</enum><text>guidance for correctional facilities on how to connect incarcerated persons released from confinement as a result of the COVID–19 pandemic with post-release resources, such as health insurance, primary care providers, other health professionals, and quarantine facilities, with sensitivity to the immigration status of incarcerated persons; and</text></paragraph><paragraph id="idb7d69c5318514f098acf09ac54082756"><enum>(16)</enum><text>guidance for correctional facilities on how to equitably distribute COVID–19 vaccinations to incarcerated persons and correctional facility staff, with the goal of maximizing COVID–19 safety within correctional facilities and reducing health disparities among correctional facility populations. </text></paragraph></subsection></section><section id="id56e86c5e07ae438aa7c0704f20b60a98"><enum>7.</enum><header>Report to Congress</header><text display-inline="no-display-inline">Not later than 60 days after the date of enactment of this Act, the Attorney General shall submit to Congress a report on prevention, mitigation, and control activities relating to the spread of COVID–19 in prisons conducted by the Department of Justice and the Bureau of Prisons, disaggregated by facility when applicable, that includes information on—</text><paragraph commented="no" id="id480938e246df4538848399ac7068e56b"><enum>(1)</enum><text>efforts of correctional facilities to comply with the Interim Guidance on Management of Coronavirus Disease 2019 (COVID–19) in Correctional and Detention Facilities issued by the Centers for Disease Control and Prevention (referred to in this section as the <quote>Interim Guidelines</quote>), including—</text><subparagraph commented="no" id="id03c7242653734c45b347219cf20ec0ab"><enum>(A)</enum><text>information on steps that have been and continue to be taken with respect to operational preparedness, including—</text><clause commented="no" id="id2BB1B53BB3E7413C9E9E6EEE18F4C5BD"><enum>(i)</enum><text>with respect to communication and coordination—</text><subclause commented="no" id="id5c668f9c663a4ad1adabd939839f7607"><enum>(I)</enum><text>developing information sharing systems with partners;</text></subclause><subclause commented="no" id="id1389b3cb8f7a44e99344868c93557292"><enum>(II)</enum><text>reviewing and revising for COVID–19 existing influenza, all-hazards, and disaster plans;</text></subclause><subclause commented="no" id="idf7c8a9ac2a1d44cd96d1ac6e4bd436df"><enum>(III)</enum><text>coordinating with local law enforcement and court officials as necessary; and</text></subclause><subclause commented="no" id="id68e111950bb741639581c4314790337e"><enum>(IV)</enum><text>encouraging all persons in the facility, including through posting signs, to take action to protect themselves from COVID–19;</text></subclause></clause><clause commented="no" id="id02542932D91A48DFA59F9D0D500B6BEF"><enum>(ii)</enum><text>with respect to personnel practices—</text><subclause commented="no" id="ida5d0a615dabe4d6baa70c568f9769a8f"><enum>(I)</enum><text>reviewing sick leave policies of each employer that operates within the facility;</text></subclause><subclause commented="no" id="id714b6cf108e142e08c470be63396e4c1"><enum>(II)</enum><text>identifying duties that can be performed remotely;</text></subclause><subclause commented="no" id="ideabfd8e09b484fed82e7a3ff4445eb03"><enum>(III)</enum><text>planning for staff absences;</text></subclause><subclause commented="no" id="id4f845f072d7c4009880dbbe511dd4f22"><enum>(IV)</enum><text>offering revised duties to staff at increased risk for severe illness from COVID–19;</text></subclause><subclause commented="no" id="id8b35e89b04bf4b899206b00c770b0f7b"><enum>(V)</enum><text>making plans to change staff duty assignments to prevent unnecessary movement between housing units during a COVID–19 outbreak;</text></subclause><subclause commented="no" id="id7fd6cf6088e54bb9a6325acc0eac5dda"><enum>(VI)</enum><text>offering the seasonal influenza vaccines to all incarcerated persons and correctional facility staff; and</text></subclause><subclause id="id841a3f810e6647b8938b0b4e738ee877"><enum>(VII)</enum><text>offering and administering COVID-19 vaccines to all incarcerated persons and correctional facility staff; and</text></subclause></clause><clause commented="no" id="id67D3C66015A44B7496127886309FF305"><enum>(iii)</enum><text>with respect to operations, supplies, and personal protective equipment (referred to in this clause as <quote>PPE</quote>) preparations—</text><subclause commented="no" id="idbc6f7bb22e4d4f58ad17a732cb3e6825"><enum>(I)</enum><text>ensuring that sufficient stocks of hygiene supplies, cleaning supplies, PPE, and medical supplies (consistent with the healthcare capabilities of the facility) are on hand and available, and having a plan in place to restock as needed;</text></subclause><subclause commented="no" id="id0b60cd963e59448c801e32b54a54cee3"><enum>(II)</enum><text>making contingency plans for possible PPE shortages during the COVID–19 pandemic;</text></subclause><subclause commented="no" id="id636179cadaa944d6b8f54f14ea1f763a"><enum>(III)</enum><text>relaxing restrictions on allowing alcohol-based hand sanitizer;</text></subclause><subclause commented="no" id="ide8641ef0cb274244982aec6221dc7b2b"><enum>(IV)</enum><text>providing a no-cost supply of soap to incarcerated persons sufficient to allow frequent hand washing;</text></subclause><subclause commented="no" id="id9cd6240a3c7a4a94abf44bf333d9c94f"><enum>(V)</enum><text>establishing a respiratory protection program, if not already in place;</text></subclause><subclause commented="no" id="id25787f8af8b54ff5833cc8f5a9edb315"><enum>(VI)</enum><text>ensuring that correctional facility staff and incarcerated persons are trained to correctly don, doff, and dispose of PPE that they will need to use within the scope of their responsibilities; and</text></subclause><subclause commented="no" id="id6b48dba002a140478fa8b044ceef7e8f"><enum>(VII)</enum><text>setting up designated PPE donning and doffing areas outside all spaces where PPE will be used;</text></subclause></clause></subparagraph><subparagraph commented="no" id="id997159d40e8c4224b3adc63b7c451b59"><enum>(B)</enum><text>information on steps that have been and continue to be taken with respect to prevention, including—</text><clause commented="no" id="id79337d8a7c63419a862ef0a2b537c9d3"><enum>(i)</enum><text>to prevent COVID–19 cases among incarcerated persons—</text><subclause commented="no" id="id27508547f46f4a519f0035e2f97396a4"><enum>(I)</enum><text>implementing social dis­tanc­ing strategies to increase the physical space between incarcerated persons, which, to the extent practicable, shall be 6 feet between all individuals, regardless of symptoms;</text></subclause><subclause commented="no" id="id483988bd6cf74cacb57f83ec2b5acd65"><enum>(II)</enum><text>minimizing the mixing of individuals from different housing units; and</text></subclause><subclause commented="no" id="id1de818deb34d445c921d9154f75c2d5e"><enum>(III)</enum><text>providing up-to-date information about COVID–19 to incarcerated persons;</text></subclause></clause><clause commented="no" id="id4dfe4ee2815d4901a6f92874a46e580c"><enum>(ii)</enum><text>to prevent COVID–19 cases among correctional facility staff—</text><subclause commented="no" id="idf82f401a8ea04f23be776d196d3db074"><enum>(I)</enum><text>reminding staff to stay at home if they are sick;</text></subclause><subclause commented="no" id="id013919acac454fd09f6ef4941211b1f0"><enum>(II)</enum><text>performing verbal screening and temperature checks for all staff daily upon entry; and</text></subclause><subclause commented="no" id="idd334faa947f04da282eddd3f502ca3e1"><enum>(III)</enum><text>providing up-to-date information about COVID–19 to staff, including information about sick leave policies; and</text></subclause></clause><clause commented="no" id="ide09b95356c44496ba915beb602159924"><enum>(iii)</enum><text>to prevent COVID–19 cases among visitors—</text><subclause commented="no" id="id0e66c9302e7b416c920a00af652df62c"><enum>(I)</enum><text>communicating with potential visitors to discourage contact visits;</text></subclause><subclause commented="no" id="id7d6ea669574848e5a2dd888acc788941"><enum>(II)</enum><text>conducting verbal screenings and temperature checks for visitors, and requiring face coverings; and</text></subclause><subclause commented="no" id="ida6c4c8c690994dbb8449f5b212532d74"><enum>(III)</enum><text>promoting non-contact visits and providing access to free virtual visitation options;</text></subclause></clause></subparagraph><subparagraph commented="no" id="id95e70ee396c246f9a68b381c8c3d2552"><enum>(C)</enum><text>information on steps that have been and continue to be taken with respect to COVID–19 case management, including—</text><clause commented="no" id="id675e789780d14ff9ae537f010b36db29"><enum>(i)</enum><text>with respect to infection control, ensuring proper infection control protocols are in place;</text></clause><clause commented="no" id="ide9261f9d81984be6a5a5bb764b1c451e"><enum>(ii)</enum><text>with respect to medical isolation—</text><subclause commented="no" id="idc7ec1b091e1d47698e3bae6eb77d03c3"><enum>(I)</enum><text>placing incarcerated individuals with confirmed or suspected cases of COVID–19 in medical isolation;</text></subclause><subclause commented="no" id="id7f4ebb50899f41b6a49360f73dcaef07"><enum>(II)</enum><text>ensuring that medical isolation for COVID–19 is distinct from punitive solitary confinement;</text></subclause><subclause commented="no" id="id9c56a3a5607646ec96338fd22d8693ad"><enum>(III)</enum><text>keeping to an absolute minimum the movement outside the medical isolation space of incarcerated individuals with confirmed or suspected cases of COVID–19; and</text></subclause><subclause commented="no" id="id7617988cc2414357bb97b57061abd643"><enum>(IV)</enum><text>safely cohorting, if necessary, COVID–19-infected incarcerated individuals; and</text></subclause></clause><clause commented="no" id="id30d113b5080449c6a7d177980cba3ec0"><enum>(iii)</enum><text>with respect to provision of care—</text><subclause commented="no" id="idf49d5b15528f48b2ac4a5b0ff24c14b4"><enum>(I)</enum><text>ensuring that incarcerated persons receive medical evaluation and treatment at the first signs of COVID–19 symptoms, including in cases where a facility is not able to provide such evaluation and treatment onsite;</text></subclause><subclause commented="no" id="idcad091c65fb64f7fb60125f0e84172c8"><enum>(II)</enum><text>providing incarcerated individuals with onsite healthcare; and</text></subclause><subclause commented="no" id="id6a134768676042dd8df0d1db454ec69b"><enum>(III)</enum><text>providing incarcerated individuals with healthcare services in the community, as necessary; and</text></subclause></clause></subparagraph><subparagraph commented="no" id="id3dc255f8c3b24537aa593814f99e79f8"><enum>(D)</enum><text>all other aspects of the Interim Guidance;</text></subparagraph></paragraph><paragraph id="id3a7ae3ac29354d2da4f27f899b4b9d63"><enum>(2)</enum><text>the process for determining which incarcerated persons qualify for home confinement, including listing every factor that is taken into consideration, and how the factors are weighed to determine qualification, including—</text><subparagraph id="id273555af77ef473bb3ceb32d544f0144"><enum>(A)</enum><text>how many incarcerated persons have been reviewed for home confinement;</text></subparagraph><subparagraph id="ideb63b481214342babbfff98f408a40b3"><enum>(B)</enum><text>how many incarcerated persons have qualified for and have been moved into home confinement, and the average length of time between review, approval, and transfer;</text></subparagraph><subparagraph id="idc52f0d5277e6422d84689e532a8d4f6a"><enum>(C)</enum><text>how the prior convictions of an incarcerated person are used to determine who qualifies for home confinement, including whether certain convictions are weighed more heavily than others, and whether a prior conviction regardless of severity automatically bars an incarcerated person from qualifying for home confinement; and</text></subparagraph><subparagraph id="idae12e5f778a744fc8fc186d27d134b62"><enum>(D)</enum><text>demographic data of the incarcerated persons who are considered for home confinement and of the incarcerated persons who are ultimately chosen for home confinement, dis­ag­gre­gat­ed by age, race, gender, ethnicity, level of offense, how much time remains on their sentence, and whether the individual is high risk for COVID–19;</text></subparagraph></paragraph><paragraph id="idafced5eb9a0449f4ab84abc99087cbba"><enum>(3)</enum><text>the process for determining which incarcerated persons qualify for compassionate release, including listing every factor that is taken into consideration, and how the factors are weighed to determine qualification, including—</text><subparagraph id="idfb9bea9a467e4fa7bff4ce23766c2cda"><enum>(A)</enum><text>how many incarcerated persons have been reviewed for compassionate release;</text></subparagraph><subparagraph id="id3ec681e7e9034f3796ec8a5c082092e8"><enum>(B)</enum><text>how many incarcerated persons have qualified for compassionate release, dis­ag­gre­gat­ed by compassionate releases approved by the Bureau of Prisons and compassionate releases granted by courts, and the average length of time between review, approval, and release;</text></subparagraph><subparagraph id="id554fa4253cd9416bbc3f42faa100eb17"><enum>(C)</enum><text>how the prior convictions of an incarcerated person are used to determine who qualifies for compassionate release, including whether certain convictions are weighed more heavily than others, and whether a prior conviction regardless of severity automatically bars an incarcerated person from qualifying for compassionate release; and</text></subparagraph><subparagraph id="idbe4669dc4e7a4f4c970f03bd65f26eea"><enum>(D)</enum><text>demographic data of the incarcerated persons who are considered for compassionate release and of the incarcerated persons who are ultimately chosen for compassionate release, dis­ag­gre­gat­ed by age, race, gender, ethnicity, level of offense, and how much time remains on their sentence;</text></subparagraph></paragraph><paragraph id="idfc6d646a4a094130ac915fddf4e05543"><enum>(4)</enum><text>the process of providing information to families and emergency contacts of incarcerated persons who have tested positive for COVID–19, including how long it takes on average for families and emergency contacts to be notified after initial diagnosis, and how often facilities follow up with families and emergency contacts to update them on the health condition of the incarcerated person;</text></paragraph><paragraph id="id0d5ee21233c34ef5b72f01d5f9ba1f2e"><enum>(5)</enum><text>resource limitations, if any, that have inhibited the ability of the Department of Justice and Bureau of Prisons to fully implement the Centers for Disease Control and Prevention's Interim Guidelines; and</text></paragraph><paragraph id="id6c65c156d9324a74b81af3d3d1e891b1"><enum>(6)</enum><text>what actions are being taken to modernize the electronic health records systems of the Bureau of Prisons.</text></paragraph></section></legis-body></bill>
