<official-title>To amend the Federal Funding Accountability and Transparency Act of 2006 to require the Director of the Office of Management and Budget and the Secretary of the Treasury to track and disclose funding and outlays relating to disasters and emergencies on a centralized website, and for other purposes.</official-title>

<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disclosing All Spending That Ensures Relief Act</short-title></quote> or the <quote><short-title>DISASTER Act</short-title></quote>.</text></section> <section id="id7ce7959107e048a18df81427af68f5ca"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
<paragraph id="idFA65F741D8C64C01818C34ABE0C30C9E"><enum>(1)</enum><text display-inline="yes-display-inline">At a time of constrained budgets, it is fiscally prudent to understand the amount and the scope of the Federal Government’s funding and outlays relating to disasters and emergencies affecting communities in need.</text></paragraph> <paragraph id="id43A988F96DC34E7FAB5160A0B2CFF9AA"><enum>(2)</enum><text display-inline="yes-display-inline">Understanding the funding and outlays of Federal agencies relating to disasters and emergencies will help better inform the congressional funding process and presidential budget requests.</text></paragraph>
<paragraph id="id8B785289280E4664AECBAE9C4C8D179D"><enum>(3)</enum><text display-inline="yes-display-inline">Knowledge about funding and outlay trends relating to disasters and emergencies will guide mitigation efforts that reduce vulnerabilities to future disasters and emergencies.</text></paragraph> <paragraph id="idB827AB1E7CDD46C79AC3F00C4CADE4EB"><enum>(4)</enum><text>Any accounting mechanism to track outlays relating to disasters and emergencies should account for all funding sources, including both procurement and financial assistance funding, regardless of how that funding is appropriated.</text></paragraph>
<paragraph id="id066abeb3f6d24b6db1b42ea4bbf70a90"><enum>(5)</enum><text>The Federal Government’s fiscal exposure to disasters and emergencies is not limited to the funding and outlays of Federal agencies and should also include financial damages associated with disasters and emergencies. For example, financial damages associated with wildfires may exceed the amount that Federal agencies actually spend in response to wildfires. The difference in damages and outlays illustrates the Federal Government’s fiscal exposure to wildfires. Although some Federal agencies currently track financial damages associated with disasters and emergencies, this tracking should be consistent and standardized across all relevant Federal agencies.</text></paragraph> <paragraph id="idACEDA59CB7DF48898B9DE400FFF369D5"><enum>(6)</enum><text display-inline="yes-display-inline">Data quality issues in business systems used by Federal agencies and recipients of Federal awards hinder analysis and learning opportunities about funding and outlays relating to disasters and emergencies.</text></paragraph></section>
<section id="idc1db06cb20f64d48a2386a96c8b0aea9"><enum>3.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to require—</text> <paragraph id="id0d420ea5ea9448838c43ffdd73bf2ffc"><enum>(1)</enum><text>relevant Federal agencies and components of Federal agencies to track and report to the Director of the Office of Management and Budget and the Secretary of the Treasury data on funding, outlays, and, to the extent practicable, financial damages relating to disasters and emergencies for publication on a centralized website;</text></paragraph>
<paragraph id="id6730AEDA9DD4486E8466D5D2268C59AD"><enum>(2)</enum><text>the Comptroller General to study and recommend data quality remediation measures for the data sources of the website described in paragraph (1); and</text></paragraph> <paragraph id="id9A8C9E8408AE45DFA3CB0FA37C733718"><enum>(3)</enum><text>if applicable, the Director of the Office of Management and Budget and the Secretary of the Treasury to implement the data quality remediation measures described in paragraph (2).</text></paragraph></section>
<section id="ida6fab877a9a84330aa0b73dbf5afdb52"><enum>4.</enum><header>Enhanced disclosure of funding relating to disasters or emergencies</header>
<subsection id="idE53E51DACD7C44A3A0BB135CA47D86EE"><enum>(a)</enum><header>Definition</header>
<paragraph id="id1C29283074A94B40B54F92BA2D79DD76"><enum>(1)</enum><header>In general</header><text>Section 2(a) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note) is amended—</text> <subparagraph id="id6DB09CA0308E4E1B8CF527F1382C038E"><enum>(A)</enum><text>by redesignating paragraphs (2) through (8) as paragraphs (4) through (10), respectively;</text></subparagraph>
<subparagraph id="id34B85DD159F94B1C9E3B91552D9F8B49"><enum>(B)</enum><text>by inserting after paragraph (1) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idC539DF98B84C4C2894B2A5811DD3910D"> <paragraph id="id0D682D51AB754CBBB19724AB0CE1E998"><enum>(2)</enum><header>Disaster or emergency</header><text>The term <term>disaster or emergency</term> means—</text>
<subparagraph id="id0C47073BED1C437AA41209BF40A952D0"><enum>(A)</enum><text>any major disaster or emergency declared by the President under section 401 or 501, respectively, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>, 5191);</text></subparagraph> <subparagraph id="id75A5FF4FC35845DF998FCFCAA6BD5FFB"><enum>(B)</enum><text>any fire for which assistance is provided under section 420 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5187">42 U.S.C. 5187</external-xref>);</text></subparagraph>
<subparagraph id="idD8BD49933E58472AA460F4259535EEA1"><enum>(C)</enum><text>any fire for which fire suppression activities are carried out by the Department of the Interior or the Department of Agriculture;</text></subparagraph> <subparagraph id="id4BFA605ED4404AB5851A2F614EBC46B9"><enum>(D)</enum><text>any national emergency declared by the President under section 201 of the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1621">50 U.S.C. 1621</external-xref>);</text></subparagraph>
<subparagraph id="idCE3530BAE6ED4C84B99D251B661DD88B"><enum>(E)</enum><text>any disaster or emergency relating to assistance provided under section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>);</text></subparagraph> <subparagraph id="id38097A679DA74ADAB4150542EB87AB5E"><enum>(F)</enum><text>any natural disaster declared by the Secretary of Agriculture under section 321(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1961">7 U.S.C. 1961(a)</external-xref>);</text></subparagraph>
<subparagraph id="id056AE9DDA17F4FB8B894595C0FC6D04B"><enum>(G)</enum><text>any public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>);</text></subparagraph> <subparagraph id="idE7A8777791DE41EAA0D08078415EE26A"><enum>(H)</enum><text>any commercial fishery failure due to a fishery resource disaster or catastrophic regional fishery disaster determined by the Secretary of Commerce under section 312(a) or 315(a), respectively, of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1861a">16 U.S.C. 1861a(a)</external-xref>, 1864(a)); and</text></subparagraph>
<subparagraph id="id2480C88E35BD43E981BEA89927F2835E" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text>any other potential or actual disaster or emergency identified by the Director, in consultation with the head of any relevant Federal agency.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id0A2B5EBE0F2D4E9E84284384794E93EC"><enum>(3)</enum><header>Disaster-related financial damages</header><text>The term <term>disaster-related financial damages</term> means any financial or economic loss determined by the Director that may inform necessary Federal outlays relating to any disaster or emergency.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph>
<subparagraph id="idB63E6E529CF04CD7B96BC635E8E6BA11"><enum>(C)</enum><text>in paragraph (9), as so redesignated—</text> <clause id="id04D7B7B2F5D647C389CEF6C1B2B2D8C6" commented="no"><enum>(i)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end;</text></clause>
<clause commented="no" id="idE858047B522441B49CD146C7306C9F23"><enum>(ii)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause> <clause id="id44DA367E1AA94A809242ADB95A051532" commented="no"><enum>(iii)</enum><text>by adding at the end the following:</text>

<subparagraph id="id8b55fd69f9ee4b19a467b45bdd17d891"><enum>(E)</enum><text>search and aggregate Federal funding and outlays relating to disasters or emergencies and other relevant information.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph> <paragraph id="id7F604ECC65CB4C3BABEE2D1E58810F10"><enum>(2)</enum><header>Conforming amendments</header><text>Section 2 of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note), as amended by paragraph (1), is further amended—</text>
<subparagraph id="idA23CB192E18C44BF9359072EE081EF0A"><enum>(A)</enum><text>in subsection (a)(9)—</text> <clause id="idF93ECFC90179413B9BDC4751A0689C8E"><enum>(i)</enum><text>in subparagraph (B), by striking <quote>paragraph (2)(A)(i)</quote> and inserting <quote>paragraph (6)(A)(i)</quote>; and</text></clause>
<clause id="idB446DACA9A904E8FB60039B311326D41"><enum>(ii)</enum><text>in subparagraph (C), by striking <quote>paragraph (2)(A)(ii)</quote> and inserting <quote>paragraph (6)(A)(ii)</quote>; and</text></clause></subparagraph> <subparagraph id="id7AA42B1AD1E34E14B0CE2DFDC28167AA"><enum>(B)</enum><text>in subsection (c)(5), by striking <quote>subsection (a)(2)(A)(i) and those described in subsection (a)(2)(A)(ii)</quote> and inserting <quote>subsection (a)(6)(A)(i) and those described in subsection (a)(6)(A)(ii)</quote>.</text></subparagraph></paragraph></subsection>
<subsection id="id1012CB15E7394D029706C66110BE3B9E"><enum>(b)</enum><header>Funding relating to disasters and emergencies</header><text display-inline="yes-display-inline">Section 3 of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note) is amended—</text> <paragraph id="id316B7B670CF84C4AB815B521C967AB00"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(1)—</text>
<subparagraph id="idFBC1794EF66B4869A08058E2D1880878"><enum>(A)</enum><text>in subparagraph (C)(ii), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="id4C9A600BEB3F43369462BD0C7DE86CEE"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (D) as subparagraph (E); and</text></subparagraph>
<subparagraph id="id21BAD92A19504F209A3CB1F706E6E88D"><enum>(C)</enum><text>by inserting after subparagraph (C) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idB5D2C411B9B2446A9DF5957587453C9E"> <subparagraph id="idE86B50457131482682D4B70DE03647F7"><enum>(D)</enum><text>from which accounts and in what amount—</text>
<clause id="id0DC3082B7B774BA6967683135E6DB2B5" commented="no"><enum>(i)</enum><text>appropriations are obligated relating to any disaster or emergency, which shall be accompanied by the information described in subsection (c)(2)(A); and</text></clause> <clause id="idF05B3B4CED6C4A8685D7A5A28D54BC62" commented="no"><enum>(ii)</enum><text>outlays are made relating to any disaster or emergency, which shall be accompanied by the information described in subsection (c)(2)(A); and</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="id8E7CF859EF91407FBDF875FC4743AFEA"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id6D7EC9F3F56D40B4A7C1ED0D2502C508"> <subsection id="id3507E611FBD24BE787728AD2FCDE06FE"><enum>(c)</enum><header>Full disclosure of funding and outlays relating to disasters and emergencies</header> <paragraph id="id65a2fc2c8745430a96323820a55fc14d"><enum>(1)</enum><header>Pilot program</header> <subparagraph id="idB2BA77D0FB6047C1ACA4D68F9B6C44B0"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of the <short-title>DISASTER Act</short-title>, the Director and the Secretary shall establish a pilot program to—</text>
<clause id="id3df86b3de4864d8da81543fcd4842c1b" commented="no"><enum>(i)</enum><text>test and evaluate the collection and accession of data involving and associated with amounts obligated or outlayed relating to any disaster or emergency, as those data are reported under subsection (b)(1)(D), which may include—</text> <subclause commented="no" id="id4A4F7246A9B844A3AD0983948EB52990"><enum>(I)</enum><text>outlays in the wake of any disaster or emergency;</text></subclause>
<subclause commented="no" id="idE8EC4FE1DD754DE58120EA9246C83AE5"><enum>(II)</enum><text>outlays in advance of any potential or actual disaster or emergency;</text></subclause> <subclause commented="no" id="id47B0C48D33284F29BB49B35314B80DC8"><enum>(III)</enum><text>administrative outlays associated with outlays described in subclause (I) or (II); or</text></subclause>
<subclause commented="no" id="id4EF7475C8A4E4866BA0A91A72A236345"><enum>(IV)</enum><text>any other category of outlays relating to any disaster or emergency determined by the Director and the Secretary;</text></subclause></clause> <clause commented="no" id="id8905FF2A361546D0B30E8E42981CC577"><enum>(ii)</enum><text>test and evaluate the collection and accession of data involving and associated with disaster-related financial damages, as those data are reported under paragraph (2)(A)(iii), which shall be provided as ancillary data to the data described in clause (i);</text></clause>
<clause commented="no" id="id63BFFF6FDEA740B0A540733A69A03560"><enum>(iii)</enum><text>determine the proper scope and standardization of data elements for the data described in clauses (i) and (ii);</text></clause> <clause commented="no" id="id85B963187399471F9133D00D9622BFFB"><enum>(iv)</enum><text>determine the proper frequency of reporting for the data described in clauses (i) and (ii), which shall be not less frequently than once every 2 weeks;</text></clause>
<clause id="idbd3f9b0f08cc4042a20104668046ce1b"><enum>(v)</enum><text>produce a strategic plan, which shall be made publicly available not later than 90 days after the date on which the pilot program terminates, for implementing a program across the Federal Government for reporting the data described in clauses (i) and (ii) using the scope and standardization determined under clause (iii) and the frequency determined under clause (iv); and</text></clause> <clause id="id034e6b3e95fa4acd8593bad432f90d02"><enum>(vi)</enum><text>identify and propose solutions for any challenges in implementing the program described in clause (v), including—</text>
<subclause id="id19DD6555423A412AB68E08A8BFDA74B1"><enum>(I)</enum><text>as appropriate, recommendations for proposed legislation; and</text></subclause> <subclause id="id9B844817694C400C848FC44CCEFA5E9F"><enum>(II)</enum><text>challenges in reporting funding or outlays that—</text>
<item id="idA54F6F7E66194228B124A29B53189EB6" commented="no"><enum>(aa)</enum><text>have been reprogrammed from an existing program;</text></item> <item id="idC633860DA3BB4C7CA2A402998598C78A" commented="no"><enum>(bb)</enum><text>have been subject to a reporting requirement waiver;</text></item>
<item id="id9D56DC72AC6C437AB10194DA89C804F9" commented="no"><enum>(cc)</enum><text>involve a need for cost allocation methodology within any individual appropriations account in order to identify outlays associated with any disaster or emergency, such as an outlay for salaries of Federal employees who are engaged in response to any disaster or emergency; or</text></item> <item commented="no" id="idBDC2EE25736B417F9F73889840BD24E7"><enum>(dd)</enum><text>relate to any disaster or emergency that lacks a clear start or end date.</text></item></subclause></clause></subparagraph>
<subparagraph id="id798E4206424941E68157C56BC0BA2A94"><enum>(B)</enum><header>Consultation with experts</header><text>In establishing the pilot program under subparagraph (A), the Director and the Secretary shall consult with individuals who are—</text> <clause id="idA72E04F10A824CF784EB16EF01469589"><enum>(i)</enum><text>representatives of relevant governmental and nongovernmental organizations, including Federal agencies and components of Federal agencies of diverse sizes and missions; and</text></clause>
<clause id="id5618FC2303964F82BD86DA461D447676"><enum>(ii)</enum><text>experts in—</text> <subclause id="id1682A2ABC891415CBFF5D2667BB7072C"><enum>(I)</enum><text>disaster relief and preparedness; or</text></subclause>
<subclause id="id3F274D73E6284906B6A3196B2B982BE1"><enum>(II)</enum><text>Federal Government accounting.</text></subclause></clause></subparagraph> <subparagraph id="id3BD57C8B7C21400799050C2FB8BADC64"><enum>(C)</enum><header>Termination</header><text>The pilot program established under subparagraph (A) shall terminate not later than 2 years after the date of the establishment of the pilot program.</text></subparagraph></paragraph>
<paragraph id="id891e98abe7884353b223e55a621e4fdc"><enum>(2)</enum><header>Reporting of disaster- and emergency-related funding</header><text>Using information learned from the pilot program established under paragraph (1)(A) and not later than 1 year after the date of the termination of the pilot program, the Director and the Secretary shall—</text> <subparagraph id="idd80fad6c0eee4df3a3e17b9a0de6f6bc" commented="no"><enum>(A)</enum><text>establish data standards by which to identify, categorize, and describe each disaster or emergency, including—</text>
<clause id="id8e36917cb23c4cd49fe94f8d1e1509e1" commented="no"><enum>(i)</enum><text>a label for the identification and categorization of the disaster or emergency;</text></clause> <clause id="id82c61ca470f44523b507a3e6d7c1c44e" commented="no"><enum>(ii)</enum><text>to the extent practicable—</text>
<subclause commented="no" id="idDD8C23D7CAC2494C91C56F0ECE69B354"><enum>(I)</enum><text>each State or locality affected by the disaster or emergency; and</text></subclause> <subclause id="ida1704b46e2134d6994c048455a4a07b3" commented="no"><enum>(II)</enum><text>the start and end dates of the disaster or emergency;</text></subclause></clause>
<clause id="ide357e6f86a904d97bf2ab124cbb685f2" commented="no"><enum>(iii)</enum><text>to the extent practicable, the estimated disaster-related financial damages, which shall be—</text> <subclause commented="no" id="id2515F409705B4A27AF341428612607F6"><enum>(I)</enum><text>disaggregated by affected States or localities;</text></subclause>
<subclause commented="no" id="id86C2675AD16946A9BAEB3EEA3BC2A443"><enum>(II)</enum><text>itemized by standardized categories to demonstrate the need for specific types of Federal outlays; and</text></subclause> <subclause commented="no" id="id83327BAD1E80434BA36D627EA6ABE989"><enum>(III)</enum><text>collected on an ongoing basis; and</text></subclause></clause>
<clause commented="no" id="idE7AFD7B378AC4B79BACC303E18916A1A"><enum>(iv)</enum><text>any other information or category determined by the Director and the Secretary; and</text></clause></subparagraph> <subparagraph id="id548e37fea9e34ec89eda04681f0815b9"><enum>(B)</enum><text>issue guidance to Federal agencies and components of Federal agencies to—</text>
<clause id="id7BC6474DE3014393A1CEC3D14E162073"><enum>(i)</enum><text>require the tracking and reporting of funds obligated or outlayed relating to any disaster or emergency in accordance with subsection (b)(1)(D);</text></clause> <clause id="id5E6C3B89DCF24C97A210E408549D8B29"><enum>(ii)</enum><text>require the tracking and publishing on the website established under section 2(b)(1) of—</text>
<subclause id="id3294A5F8E6E1499684AF44CCCA5FE032"><enum>(I)</enum><text>to the extent practicable, any disaster-related financial damages, which shall be provided as ancillary data to the data described in clause (i); and</text></subclause> <subclause id="id607507BA764A4149AE4A9EB95492F357"><enum>(II)</enum><text>information relating to any disaster or emergency identified, categorized, and described under subsection (c)(2)(A);</text></subclause></clause>
<clause id="idF3CD95A1189E4F15B20992C18CC33B48"><enum>(iii)</enum><text>eliminate any tracking, publishing, or reporting that would be duplicative of the information tracked under clauses (i) and (ii); and</text></clause> <clause id="id4C231B1A660B4D3EA52892CEBF4C8439"><enum>(iv)</enum><text>not less frequently than annually, give feedback to, and receive updated guidance from, the Director and the Secretary relating to any outlays by Federal agencies and components of Federal agencies that—</text>
<subclause id="idF96227DB82FE4C959C24545C81F251C1"><enum>(I)</enum><text>are not tracked under clause (i); and</text></subclause> <subclause id="idAC479711A5204CA79790C661228B52D4"><enum>(II)</enum><text>may qualify as outlays relating to any disaster or emergency.</text></subclause></clause></subparagraph></paragraph>
<paragraph id="idE12F3ADA10F64967803CEEE49EAB629F" commented="no"><enum>(3)</enum><header>Comptroller general report</header><text>Not later than 3 years after the date on which the Director and the Secretary issue guidance under paragraph (2)(B), the Comptroller General of the United States shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Reform of the House of Representatives a report that—</text> <subparagraph commented="no" id="idD303F353A4D743E196C4422B050E38E4"><enum>(A)</enum><text>assesses the completeness, timeliness, quality, accuracy, and usefulness of the information described in paragraph (2)(B); and</text></subparagraph>
<subparagraph commented="no" id="id154B3E77F0A846D4825131396FADD15C"><enum>(B)</enum><text>if appropriate, includes any recommendations to improve the information described in paragraph (2)(B).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> <section id="idf1b134a7c0dc4b1385637fccb365b89d"><enum>5.</enum><header>Data quality reports and remediation plans</header> <subsection id="idCD4AF00D8A5F4C59BEA59D07F42271DF"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
<paragraph id="idC2D32F420D5D4E49AF78FB503C23291B"><enum>(1)</enum><header>Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means—</text> <subparagraph id="id12FBA3F6B0C94F68BCBEBC9D9920BB46"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and Governmental Affairs of the Senate; and</text></subparagraph>
<subparagraph id="id7AAC849AE735412DA4F1CEF7BD81FADC"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Oversight and Reform of the House of Representatives.</text></subparagraph></paragraph> <paragraph id="id0fed0bfaf2074fa5bbc0ed721aa71155"><enum>(2)</enum><header>Comptroller General</header><text>The term <term>Comptroller General</term> means the Comptroller General of the United States. </text></paragraph>
<paragraph id="idAD8886D836F1477EACB963562B85A522"><enum>(3)</enum><header>Data quality issue</header><text display-inline="yes-display-inline">The term <term>data quality issue</term> means a situation in which a collection of quantitative or qualitative data represent or suggest inaccurate, misleading, or insufficiently clear information in a common way.</text></paragraph> <paragraph id="id8114c66f8a0e4e68a0386082d6506f63"><enum>(4)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph>
<paragraph id="iddf82ecd72f1746eca73227b78de900f1"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Treasury. </text></paragraph></subsection> <subsection id="idD8BDD3CCBA0E492BB0182DBF43A56C16"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Comptroller General shall submit a publicly available report to the appropriate congressional committees relating to current and ongoing data quality issues in the data sources of the website established under section 2(b)(1) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note), including data quality issues of—</text>
<paragraph id="id71D8B92A8A834799A4CAF4DB4FC6244D"><enum>(1)</enum><text display-inline="yes-display-inline">the Federal Funding Accountability and Transparency Act Subaward Reporting System;</text></paragraph> <paragraph id="idA5779549A5B64EE6B78A0D826F8487E7"><enum>(2)</enum><text display-inline="yes-display-inline">the Federal Procurement Data System;</text></paragraph>
<paragraph id="id994CA88C4FD5468CBD9D5CFA8817715F"><enum>(3)</enum><text display-inline="yes-display-inline">any business system operated by a Federal agency or a component of a Federal agency identified by the Comptroller General;</text></paragraph> <paragraph id="id25B5845231964A368CF9A1E01F268C16"><enum>(4)</enum><text display-inline="yes-display-inline">any successor system of a system described in this subsection; and</text></paragraph>
<paragraph id="idB88E406920EC4EC59D56F5C08CA4BEBE"><enum>(5)</enum><text display-inline="yes-display-inline">any other data source identified by the Comptroller General.</text></paragraph></subsection> <subsection id="idEA83C7ADAE52416CAFCA9B2F0B428D07"><enum>(c)</enum><header>Contents</header><text display-inline="yes-display-inline">The report submitted under subsection (b) shall include—</text>
<paragraph id="id4C6F5E65BC6A4905935751D8D49DD851"><enum>(1)</enum><text display-inline="yes-display-inline">an identification of data quality issues of the data systems described in subsection (b), as applicable, including situations in which—</text> <subparagraph id="idB9F7BE893B674FBE89F145F077D07F38"><enum>(A)</enum><text display-inline="yes-display-inline">outlayed amounts exceed obligated amounts;</text></subparagraph>
<subparagraph id="id2139A71C371A40758C1942AAE6B951B5"><enum>(B)</enum><text display-inline="yes-display-inline">subaward amounts exceed prime award amounts;</text></subparagraph> <subparagraph id="id242F8F7FCAAA4F369D97A4D1984D37A3"><enum>(C)</enum><text display-inline="yes-display-inline">inappropriate variations exist for how a single entity or location is identified, such as a situation in which—</text>
<clause id="id834D896E112F4619BAF7650A9073178A"><enum>(i)</enum><text display-inline="yes-display-inline">the same legal entity possesses multiple different unique identifiers; or</text></clause> <clause id="idDD99EBE286A4458A9CC5329FC5353DEB"><enum>(ii)</enum><text>the same geographic location possesses intentional or unintentional variations in spelling;</text></clause></subparagraph>
<subparagraph id="idBA42620D1D6540AABFBF744A3BA6A592"><enum>(D)</enum><text display-inline="yes-display-inline">open text fields are insufficiently informative, such as in award descriptions;</text></subparagraph> <subparagraph id="id623FFA9D1C8A47EE88A62B1152D222A9"><enum>(E)</enum><text display-inline="yes-display-inline">required or relevant information is missing, including—</text>
<clause id="id4B3E997B1832464F9FBB3DC33E898D10"><enum>(i)</enum><text display-inline="yes-display-inline">as a result of a reporting requirement waiver; and</text></clause> <clause id="id59B2CF1DDB28458BAAAB58FAD24D29E8"><enum>(ii)</enum><text>any information that is collected inconsistently across Federal award types or Federal program types, such an industry information or demographic information;</text></clause></subparagraph>
<subparagraph id="idE3684C36B78B41C4BC1832BD888B2B3D"><enum>(F)</enum><text>labels and other identifiers are incorrectly or inappropriately assigned, including—</text> <clause id="id27EA81086C104938B27E9F3801127080"><enum>(i)</enum><text>any failure to produce or update labels and other identifiers for funding that has been reprogrammed from an existing program; and</text></clause>
<clause id="id635AF054DA864A77BA0E52782ADC5F80"><enum>(ii)</enum><text>any inaccurate identification of funds obligated or outlayed relating to any disaster or emergency; and</text></clause></subparagraph> <subparagraph id="id5C5BB6335B4F449AA09F05B9ECE4CC48"><enum>(G)</enum><text>any other potential or actual problem is identified by the Comptroller General; and</text></subparagraph></paragraph>
<paragraph id="idD7FD6C143DF24E08AD8400C609709C06"><enum>(2)</enum><text display-inline="yes-display-inline">for each data quality issue identified under paragraph (1)—</text> <subparagraph id="id9E57DE05DC274201BE878B4F75A1FB1D"><enum>(A)</enum><text display-inline="yes-display-inline">a list of each relevant system in which the data quality issue is created and propagated;</text></subparagraph>
<subparagraph id="id33A07D90294D4DC2811855EDD3B7044E"><enum>(B)</enum><text display-inline="yes-display-inline">a list of the stakeholder groups involved in creating and reviewing the data in which the data quality issue is found;</text></subparagraph> <subparagraph id="id5C1C69CA39244EF69755CDB679AB8AF8"><enum>(C)</enum><text display-inline="yes-display-inline">an explanation of known and accepted exceptions to instances of the data quality issue that—</text>
<clause id="id563D10B2332C420B87C4E82F2648CC73"><enum>(i)</enum><text display-inline="yes-display-inline">may appear problematic; and</text></clause> <clause id="id97E311B5E836448680DC059E383D8FB9"><enum>(ii)</enum><text>are justified in some cases;</text></clause></subparagraph>
<subparagraph id="id7032E1E1C25D40C79719F3A8F42FB58D"><enum>(D)</enum><text display-inline="yes-display-inline">an assessment of the root cause of the data quality issue;</text></subparagraph> <subparagraph id="id86868618B79C44B6A7BDB2DFC3378762"><enum>(E)</enum><text>a discussion of any tradeoffs on data quality versus cost or effort;</text></subparagraph>
<subparagraph id="id8D2DDF7521DD41EAB8063CAF7DB2E7A4"><enum>(F)</enum><text display-inline="yes-display-inline">a list of existing mechanisms to detect or prevent instances of the data quality issue; and</text></subparagraph> <subparagraph id="idC3954E5F6B894E95A03B96716EDA9923"><enum>(G)</enum><text display-inline="yes-display-inline">any recommendations for relevant business systems and stakeholder groups to remediate the data quality issue and explain to public data consumers the known and accepted exceptions, including—</text>
<clause id="id0F557B0320AF48FD97622261C1A04188"><enum>(i)</enum><text display-inline="yes-display-inline">a proposed timeline for implementation and evaluation by relevant stakeholder groups, which shall not exceed 2 years from the date of the submission of the report, unless justified in writing;</text></clause> <clause id="idB945469974C049ACB85A3B1E158DC8A2"><enum>(ii)</enum><text display-inline="yes-display-inline">metrics to determine success; </text></clause>
<clause id="idD63FF85161294E4D9F201E4F5BA5CB2C"><enum>(iii)</enum><text display-inline="yes-display-inline">proposed solutions that may involve technological, behavioral, institutional, cultural, educational, regulatory, legislative, or resource allocation changes; and</text></clause> <clause id="idF2A4F48F040145AA88A416CCDA1D4939"><enum>(iv)</enum><text>any other recommendation relating to the efficiency or effectiveness of the data systems described in subsection (b).</text></clause></subparagraph></paragraph></subsection>
<subsection id="id9C98C60DC4FE49019F92C8CD257B276C"><enum>(d)</enum><header>Updates</header><text display-inline="yes-display-inline">Not later than 2 years after the date on which the report required under subsection (b) is submitted, and every 2 years thereafter until not less than 6 years after such date, the Comptroller General shall submit to the appropriate congressional committees an updated and publicly available report that includes—</text> <paragraph id="id76AD0FA3D8BA4197A84CEA1EE4007266"><enum>(1)</enum><text>the information required to be included in the report under subsection (c);</text></paragraph>
<paragraph id="idAD4AE8002B6B4245ADA7D4503A472D56"><enum>(2)</enum><text display-inline="yes-display-inline">any newly identified data quality issues;</text></paragraph> <paragraph id="id6F1A3CA8FCAB46C6AC6F6A67DCB2A17D"><enum>(3)</enum><text display-inline="yes-display-inline">information relating to the success of the remediation recommendations included in previous reports; and</text></paragraph>
<paragraph id="idC6E68FAE22FC485B9D4C8145D1DD0538"><enum>(4)</enum><text>a determination of whether any additional updated reports with the same submission schedule and requirements as the report required under this subsection are needed.</text></paragraph></subsection> <subsection id="id6F5365384CD94A108BAD929CF5BE5A19"><enum>(e)</enum><header>Implementation plans</header><text>Not later than 90 days after the date on which the Comptroller General submits a report required under subsection (b) or (d), the Director and the Secretary shall submit to the appropriate congressional committees a publicly available report that explains, with respect to a recommendation described in subsection (c)(2)(G)—</text>
<paragraph id="id50aa161d09814de19c9be0ef29b1ffa4"><enum>(1)</enum><text>whether and how each relevant stakeholder group should implement the recommendation, including any comments on the recommendation; and</text></paragraph> <paragraph id="idd307e4a2dc8045e0a54ad62461d0f514"><enum>(2)</enum><text>if applicable, any challenges and related solutions to implementing the recommendation.</text></paragraph></subsection></section>
