106 Stat. 3533) is amended—</text><paragraph id="id0F80C6E59FC148F6B15014DDF6154FCE"><enum>(1)</enum><text>by striking <quote>1992 and</quote> and inserting <quote>1992,</quote>; and</text></paragraph><paragraph id="id6904D56391D14B15B059F66CC70D29BA"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>and $52,831,000 for each of fiscal years 2022 and 2023,</quote> after <quote>1993,</quote>.</text></paragraph></section><section id="id5ECC10FE890B4ECE93A7D408DE12AD70"><enum>102.</enum><header>Under Secretary of Commerce for Communications and Information</header><subsection id="idF96F44A48B5D4426BA03A38BE79ADCC9"><enum>(a)</enum><header>In general</header><text>Section 103(a)(2) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/902">47 U.S.C. 902(a)(2)</external-xref>) is amended by striking <quote>Assistant Secretary of Commerce for Communications and Information</quote> and inserting <quote>Under Secretary of Commerce for Communications and Information</quote>.</text></subsection><subsection id="id5CC963FE4E7548709130E6D76438D0F0"><enum>(b)</enum><header>Pay</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, is amended—</text><paragraph id="idA04C26B6927F4E8C83B8BC02E6D2990B"><enum>(1)</enum><text>in section 5314, by striking <quote>and Under Secretary of Commerce for Travel and Tourism</quote> and inserting <quote>Under Secretary of Commerce for Travel and Tourism, and Under Secretary of Commerce for Communications and Information</quote>; and</text></paragraph><paragraph id="id36A21893EB3449BBA93829C6A9776015"><enum>(2)</enum><text>in section 5315, by striking <quote>(11)</quote> after <quote>Assistant Secretaries of Commerce</quote> and inserting <quote>(10)</quote>.</text></paragraph></subsection><subsection id="id4CEECF3FC5894AFEB1775F3DB58726AC"><enum>(c)</enum><header>Deputy Under Secretary</header><paragraph commented="no" display-inline="no-display-inline" id="idDC685B5A0BD6462A91D275406F708CC4"><enum>(1)</enum><header>In general</header><text>Section 103(a) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/902">47 U.S.C. 902(a)</external-xref>), as amended by subsection (a) of this section, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD129FEC38DED40F2BD52E240FF36256E"><paragraph id="id9FDFD7D9DBA6444287F53238B8F9F6E9"><enum>(3)</enum><header>Deputy Under Secretary</header><text>The Deputy Under Secretary of Commerce for Communications and Information—</text><subparagraph id="id4689355CC4854E88B89B519CFB782CB2"><enum>(A)</enum><text>shall be the principal policy advisor of the Under Secretary;</text></subparagraph><subparagraph id="idD74EBE7143AD4A8F92D19373DBFC6247"><enum>(B)</enum><text>shall perform such other functions as the Under Secretary shall from time to time assign or delegate; and</text></subparagraph><subparagraph id="id2226DCBDAF2D47DAB12938F4423D7C82"><enum>(C)</enum><text>shall act as Under Secretary during the absence or disability of the Under Secretary or in the event of a vacancy in the office of the Under Secretary.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8D2753DA6C5847AA8AA133A8A97A50E5"><enum>(2)</enum><header>Technical and conforming amendment</header><text>Section 106(c) of the Public Telecommunications Financing Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/5/5316">5 U.S.C. 5316</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/95/567">Public Law 95–567</external-xref>) is amended by striking <quote>The position of Deputy Assistant Secretary of Commerce for Communications and Information, established in Department of Commerce Organization Order Numbered 10-10 (effective March 26, 1978),</quote> and inserting <quote>The position of Deputy Under Secretary of Commerce for Communications and Information, established under section 103(a) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/902">47 U.S.C. 902(a)</external-xref>),</quote>.</text></paragraph></subsection><subsection id="id4700e1756fe04c9388e5be0f60bf9dd5"><enum>(d)</enum><header>Continuation in office</header><text>The individual serving as the Assistant Secretary of Commerce for Communications and Information and the individual serving as the Deputy Assistant Secretary of Commerce for Communications and Information on the day before the effective date under section 301 of this Act may serve as the Under Secretary of Commerce for Communications and Information and the Deputy Under Secretary of Commerce for Communications and Information, respectively, on and after that effective date without the need for renomination or reappointment.</text></subsection><subsection id="id5CA373EE5ACA420498DA4DDDEC6FAA3D"><enum>(e)</enum><header>Technical and conforming amendments</header><paragraph id="id1A1A9971B5C64C629D097207DD141C94"><enum>(1)</enum><header>Communications Act of 1934</header><text>Section 344(d)(2) of the Communications Act of 1934 (as added by section 60602(a) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>)) is amended by striking <quote>Assistant Secretary</quote> and inserting <quote>Under Secretary</quote>.</text></paragraph><paragraph id="id4C625E1DD81544D291A70D6098BA04F1"><enum>(2)</enum><header>National Telecommunications and Information Administration Organization Act</header><text>The National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/901">47 U.S.C. 901 et seq.</external-xref>) is amended by striking <quote>Assistant Secretary</quote> each place the term appears and inserting <quote>Under Secretary</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id58983F7392D34B419FB6C48CBE5B05EF"><enum>(3)</enum><header>Homeland Security Act of 2002</header><text>Section 1805(d)(2) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/575">6 U.S.C. 575(d)(2)</external-xref>) is amended by striking <quote>Assistant Secretary for Communications and Information of the Department of Commerce</quote> and inserting <quote>Under Secretary of Commerce for Communications and Information</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id51BD0D39C24C4472BAB351A4FBA003F0"><enum>(4)</enum><header>Agriculture Improvement Act of 2018</header><text>Section 6212 of the Agriculture Improvement Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb-6">7 U.S.C. 950bb–6</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id143DEFE24DB94531B731A4EC15819A1B"><enum>(A)</enum><text>in subsection (d)(1), in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">Assistant secretary</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Under Secretary</header-in-text></quote>; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEC9D3672CBB540CBB7E6300319BC62FC"><enum>(B)</enum><text>by striking <quote>Assistant Secretary</quote> each place the term appears and inserting <quote>Under Secretary</quote>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0BFF271830AB446E980A44D0D464B0FB"><enum>(5)</enum><header>Emergency Supplemental Appropriations Act for Defense, the Global War on Terror, and Tsunami Relief, 2005</header><text>Section 303 of the Emergency Supplemental Appropriations Act for Defense, the Global War on Terror, and Tsunami Relief, 2005 (<external-xref legal-doc="usc" parsable-cite="usc/8/1721">8 U.S.C. 1721</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/13">Public Law 109–13</external-xref>) is repealed.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEA59FACA22A0441696031C3EC60A13EE"><enum>(6)</enum><header>Broadband Data Improvement Act</header><text>Section 214 of the Broadband Data Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6554">15 U.S.C. 6554</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idC4EC10BBD0164CBA917BFC1E1A91FDCD"><enum>(A)</enum><text>in subsection (a), in the matter preceding paragraph (1), by striking <quote>Assistant Secretary</quote> and inserting <quote>Under Secretary</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA433CF4DF1EE43CDB236FBEB8D53A81A"><enum>(B)</enum><text>by striking subsection (b); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA4AB0693FE2B4BF29FC35A9D0A1231A2"><enum>(C)</enum><text>by redesignating subsection (c) as subsection (b).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB9BFA4919B864EDF95F37039EB707ED0"><enum>(7)</enum><header>Electronic Signatures in Global and National Commerce Act</header><text>Section 103(c) of the Electronic Signatures in Global and National Commerce Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7003">15 U.S.C. 7003(c)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idD78E86F90701468C898ECB5E535E1E39"><enum>(A)</enum><text>by striking <quote><header-in-text level="subsection" style="OLC">Exceptions</header-in-text>.—</quote> and all that follows through <quote><header-in-text level="paragraph" style="OLC">Determinations</header-in-text>.—If</quote> and inserting <quote><header-in-text level="subsection" style="OLC">Exceptions</header-in-text>.—If</quote>; and</text></subclause><subclause id="idA1FE13419A4A4F55A42AD9FC79432485"><enum>(II)</enum><text>by inserting after subsection (a) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2A354A713ABE4F64BE7A5C89F8D6623F"><subsection id="idD8E937094A1E41999868D86A3551273E"><enum>(b)</enum><header>Definition</header><text>In this section, the term <term>5350-5470 MHz band</term> means the portion of the electromagnetic spectrum between the frequencies from 5350 megahertz to 5470 megahertz.</text></subsection><after-quoted-block>; and</text></subparagraph><subparagraph id="id0D18D86BDBCC4EE6955F9E4BB8C82613"><enum>(B)</enum><text>by inserting before the period at the end the following: <quote>, and concerning policy issues relating to communications, information, and the digital economy, including (but not limited to) considerations of interoperability, privacy, security, spectrum use, emergency readiness, intermediaries, universal service, and the flow of information</quote>.</text></subparagraph></paragraph></subsection></section></title><title style="OLC" id="idE683B988F3B440D4A7D2FDC86B554F4D"><enum>II</enum><header>Other matters</header><section id="id6BAB0CB3AF5849DAAF5CD599B64EFBFB"><enum>201.</enum><header>Promotion of workforce programs</header><text display-inline="no-display-inline">The NTIA, under the Broadband USA program, shall coordinate with the heads of other Federal agencies, including the Secretary of Labor and the Secretary of Education, to promote, and share information with States and the public regarding, workforce development programs, such as apprenticeships, internships, externships, and other skills training programs, tailored to the telecommunications industry.</text></section><section id="idaba2798c7226448398cdabcd21cfd361"><enum>202.</enum><header>Improved coordination between the FCC and the NTIA</header><subsection id="id90A1B9484D0E46A9B9FBD6979749D977"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>Memorandum</term> means the Memorandum of Understanding on Spectrum Coordination executed by the Commission and the Administration on January 31, 2003.</text></subsection><subsection id="idDE065EE26DF349DFA7A454D31A5B9C2E"><enum>(b)</enum><header>Updates</header><text>Not later than 120 days after the date of enactment of this Act, the Commission and the NTIA shall update the Memorandum to—</text><paragraph id="idad16197bc9004342a966a6eb7f469975"><enum>(1)</enum><text>outline general processes for addressing technical, procedural, and policy differences regarding frequency allocation and related conditions and standards;</text></paragraph><paragraph id="id940b662be7914c93ad497e9590aa5419"><enum>(2)</enum><text>create a process for the resolution of non-routine policy disputes between the Commission and the NTIA, including specific timelines for an expeditious resolution;</text></paragraph><paragraph id="id6004b8da63dc49b48e80121f8aa4f708"><enum>(3)</enum><text>clarify that—</text><subparagraph id="id82A7B1A82A6E4225AB8E7F167F95DE1E"><enum>(A)</enum><text>Congress designated the NTIA to serve as the sole agency responsible for managing spectrum assigned to Federal agencies, and that, as a result, the NTIA represents Federal agencies in addressing technical, procedural, and policy differences regarding frequency allocation with the Commission, consistent with section 103(b) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/902">47 U.S.C. 902(b)</external-xref>); and </text></subparagraph><subparagraph id="idDA4D3F28506546A7B63B421711E6B62E"><enum>(B)</enum><text>the representation by the NTIA described in subparagraph (A) should involve the expertise of the NTIA in technical, engineering, and policy matters;</text></subparagraph></paragraph><paragraph id="ida3a8f79b36184ab59c0b353fa05e9443"><enum>(4)</enum><text>ensure that scientific analyses and testing are considered in actions involving spectrum allocation and standards;</text></paragraph><paragraph id="id07e649c014024f39a594407c95805ae8"><enum>(5)</enum><text>ensure that short-, medium-, and long-term implications of spectrum policy and strategy are considered;</text></paragraph><paragraph id="id8d132f603e4143e899a3064ae9232339"><enum>(6)</enum><text>outline general processes for how the Commission and the NTIA will form staff standing working groups with regular meetings to discuss spectrum planning by the Commission and the NTIA;</text></paragraph><paragraph id="idf94c4fa53cf447b39aeac4e10a1c136f"><enum>(7)</enum><text>outline general processes for how the Commission and the NTIA will jointly interact and consult with the Department of State in matters regarding international spectrum coordination proceedings; and</text></paragraph><paragraph id="idcff3e24cc0f84ca3b944080e337dc87e"><enum>(8)</enum><text>endeavor to ensure—</text><subparagraph id="id8CAB19B41C1740C78ADACBFA3D6460EC"><enum>(A)</enum><text>the efficient use of frequencies assigned to Federal agencies, consistent with the responsibilities of the NTIA under section 103(b)(2)(U) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/902">47 U.S.C. 902(b)(2)(U)</external-xref>); and</text></subparagraph><subparagraph id="id174DCF9F550B4639AF75D79CC1009B4B"><enum>(B)</enum><text>that frequencies not required for the present or identifiable future needs of the Federal Government are reallocated to non-Federal Government users wherever possible.</text></subparagraph></paragraph></subsection><subsection id="idd0b6e30c86604f99b3e8b2aef956030d"><enum>(c)</enum><header>Periodic updates</header><text>Not later than 3 years after the date on which the Commission and the NTIA update the Memorandum under subsection (b), and every 4 years thereafter, the Commission and the NTIA shall update the Memorandum to reflect changing technological, procedural, and policy circumstances.</text></subsection><subsection id="idb5ca40c0f8c74902aa258507549062db" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, and every year thereafter, the Commission and the NTIA shall submit to Congress a report on joint spectrum planning activities.</text></subsection></section><section id="idf27cc3ef370c40c5a5449610d6b14b6b"><enum>203.</enum><header>World Radiocommunication Conference ambassador</header><subsection id="idd6214588028349649ec91b149a339074"><enum>(a)</enum><header>In general</header><text>Section 103(b)(3) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/902">47 U.S.C. 902(b)(3)</external-xref>) is amended—</text><paragraph id="id82ddddc1834849f1b455781cc6e24529"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id75b29f5b76234986ad7e0daceec350cf"><enum>(2)</enum><text>in subparagraph (C), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id7b4f561342cd4e14a8c31c38cb39cf53"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idade17636e3474361b64b5057dca55258"><subparagraph id="ida815f062ffb74ad69beeb4e8e5a328ca"><enum>(D)</enum><text>shall assign to the NTIA responsibility for providing advice and recommendations to the Secretary of State regarding candidates to serve as United States head of delegation and ambassador to the quadrennial World Radiocommunication Conference of the International Telecommunication Union, not later than 30 months before the first plenary meeting of a conference.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id0c770c86c6004b9f91a46cc18547ad91"><enum>(b)</enum><header>Rank</header><text>Section 302(a)(2) of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3942">22 U.S.C. 3942(a)(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb121e08abd2841cda7642c8e9b4e1100"><subparagraph id="id2d758a1f22324878bdcc9aaf401fe677" indent="up2"><enum>(D)</enum><text>Notwithstanding subparagraph (B)(i), the President may confer the personal rank of ambassador to the United States head of delegation to the quadrennial World Radiocommunication Conference for a temporary term not exceeding 2 years in duration.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></title><title id="id317D7019B045426CAFBBBE53C0AA9515" style="OLC"><enum>III</enum><header>Effective date</header><section id="idCC5795A1C4024A209B038CC88FFB29EB"><enum>301.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect on the first day of the first pay period applicable to the Under Secretary of Commerce for Communications and Information (as so redesignated by section 102(a)) beginning on or after the date of enactment of this Act.</text></section></title></legis-body></bill>
