<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3286</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211130">November 30, 2021</action-date><action-desc><sponsor name-id="S370">Mr. Booker</sponsor> (for himself and <cosponsor name-id="S253">Mr. Durbin</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To include a Federal defender as a nonvoting member of the United States Sentencing Commission.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sentencing Commission Improvements Act</short-title></quote>.</text></section><section id="idbc389bf1b44145779738331dc73c4b54"><enum>2.</enum><header>Federal defender as a nonvoting member of the United States Sentencing Commission</header><subsection id="id6a24dcf6dd0f49ec9f352f8b3282902a"><enum>(a)</enum><header>In general</header><text>Section 991(a) of title 28, United States Code, is amended—</text><paragraph id="id921f7b01d26247749cf361c3bc0c50c2"><enum>(1)</enum><text>in the first sentence, by striking <quote>one nonvoting member.</quote> and inserting <quote>2 nonvoting members.</quote>; and</text></paragraph><paragraph id="id07712a1faaf0492fbcafeb60eb56011a"><enum>(2)</enum><text>in the fifth sentence, by striking <quote>shall be an ex officio, nonvoting member</quote> and inserting <quote>and a Federal Public or Community Defender designated by the Defender Services Advisory Group, shall be ex officio, nonvoting members of the Commission.</quote>.</text></paragraph></subsection><subsection id="id3a5d806900184a58a0327504e2b857cf"><enum>(b)</enum><header>Conforming amendment</header><text>Section 235(b)(5) of the Sentencing Reform Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/18/3551">18 U.S.C. 3551</external-xref> note) is amended, in the last sentence, by striking <quote>nine members, including two ex officio, nonvoting members</quote> and inserting <quote>10 members, including 3 ex officio, nonvoting members.</quote>. </text></subsection></section></legis-body></bill>
