which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Bill Emerson Good Samaritan Food Donation Act to clarify and expand food donation, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Food Donation Improvement Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="H055CE81D9D974F7BA909ECAA3D338A14"><enum>2.</enum><header>Bill Emerson Good Samaritan Food Donation Act</header><text display-inline="no-display-inline">The Bill Emerson Good Samaritan Food Donation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1791">42 U.S.C. 1791</external-xref>) is amended—</text><paragraph id="HF5A05CB23B8E4A2ABEDECDACA0500295"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H9A148AD131AA448B9F7058A6B12E88AD"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (3), by inserting <quote>or is charged a good Samaritan reduced price</quote> before the period at the end;</text></subparagraph><subparagraph id="H937E7CCD34F04C8583855A8117BA74BC"><enum>(B)</enum><text>by redesignating paragraphs (6) through (10) as paragraphs (7) through (11), respectively;</text></subparagraph><subparagraph id="H69FAA88A3E3C4684B463EF433FFA176A"><enum>(C)</enum><text>by inserting after paragraph (5) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1E5F4B4681404658832BDBCC3BAB7586"><paragraph id="H62C29FF8E38A4497B2519E632019FE98"><enum>(6)</enum><header>Good Samaritan reduced price</header><text display-inline="yes-display-inline">The term <term>good Samaritan reduced price</term> means, with respect to the price of an apparently wholesome food or apparently fit grocery product, a price that is an amount not greater than the cost of handling, administering, and distributing the apparently wholesome food or apparently fit grocery product.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idE8A23F9AB7C2461DA5CB18BABF892F48"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id10A905CA88454CAC88BA0FB99B1CF4E9"><paragraph id="id9BE397C01656424B8BC37220CF4FB0A6"><enum>(12)</enum><header>Qualified direct donor</header><text>The term <term>qualified direct donor</term> means a retail grocer, wholesaler, agricultural producer, restaurant, caterer, school food authority, and institution of higher education (as defined in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>)).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H7830B4FD0CBA4094BFC03125DAB2E0AC"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph display-inline="no-display-inline" id="H9A8B6C1DABB644AB8186E8E2B35EA0F5"><enum>(A)</enum><text>in paragraphs (1) and (2), by inserting <quote>at zero cost or at a good Samaritan reduced price</quote> after <quote>needy individuals</quote> each place it appears;</text></subparagraph><subparagraph id="H262817C08E204A07B3072E4BC22F6EF1"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating paragraph (3) as paragraph (4);</text></subparagraph><subparagraph id="HAD168E64066242BD9DEFB14CB0570A14"><enum>(C)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5BEB8674DD0946C8A1ED140E184122F2"><paragraph commented="no" id="HFEB72009A7E64C8CA576D25B55E1D152"><enum>(3)</enum><header>Direct donations to needy individuals</header><text>A qualified direct donor shall not be subject to civil or criminal liability arising from the nature, age, packaging, or condition of apparently wholesome food or an apparently fit grocery product that the qualified direct donor donates in good faith to a needy individual.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDFF9594375504B44A7C80D1A7209F1DC"><enum>(D)</enum><text>in paragraph (4) (as so redesignated), by striking <quote>and (2)</quote> and inserting <quote>through (3)</quote>.</text></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="HDE30A435E5794EC1811F104D5812B35F"><enum>3.</enum><header>Regulations</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Agriculture shall issue regulations that clarify the quality and labeling standards that food products donated under the Bill Emerson Good Samaritan Food Donation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1791">42 U.S.C. 1791</external-xref>) must meet to be eligible for liability protection under that Act.</text></section></legis-body></bill>
