and</text></subparagraph><subparagraph id="id7045309cb44c483aa2b6b6524456c63b"><enum>(B)</enum><text>National Forest System land.</text></subparagraph></paragraph><paragraph id="idb0f4ac68b27d45878bdbd30ac62c71ed"><enum>(2)</enum><header>Indian tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>). </text></paragraph><paragraph id="id5bbb4830d75943d3aa610841c3158966"><enum>(3)</enum><header>Secretaries</header><text>The term <term>Secretaries</term> means each of—</text><subparagraph id="id3ecaf41fd7af4b959a6bee804b25d8e5"><enum>(A)</enum><text>the Secretary; and</text></subparagraph><subparagraph id="idf854a95a7ba6438a85ecfaca5de6fc3d" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>the Secretary of Agriculture. </text></subparagraph></paragraph><paragraph id="id4790727e0ab84a0b8c2df6737ef3c04f"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="id1d7c3d493a4246b6a034269465d41ca4"><enum>(5)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><subparagraph id="id43ea2a39856a4dbb8c399d1772da94d8"><enum>(A)</enum><text>the Secretary, with respect to land under the jurisdiction of the Secretary; or</text></subparagraph><subparagraph id="id98e0b4146db84e40955bc27a9c8a4f95"><enum>(B)</enum><text>the Secretary of Agriculture, with respect to National Forest System land.</text></subparagraph></paragraph></section><title id="id8940a62c1f12451396c74034772479c9"><enum>I</enum><header>Increasing recreation opportunities</header><section id="idc5fb1b65c5aa45a79f0888d2378b11cc"><enum>101.</enum><header>Permit relief</header><subsection id="idc4994170ed594e16bd287d25654e6501"><enum>(a)</enum><header>Definition of youth group</header><text>In this section, the term <term>youth group</term> means any of the following that serves individuals not older than 25 years of age:</text><paragraph id="id903e2ade6b1d43ceb24ffa437be29560"><enum>(1)</enum><text>A nonprofit organization.</text></paragraph><paragraph id="id91f346dfa957407bb22d08ca194cf226"><enum>(2)</enum><text>A youth service organization.</text></paragraph><paragraph id="idd4b71d3017c34a208079fcc08b51fc96"><enum>(3)</enum><text>An educational institution.</text></paragraph><paragraph id="idc122fbcb75b54878b48426a9eaae936a"><enum>(4)</enum><text>A faith-based organization.</text></paragraph></subsection><subsection id="id8eec0bc1e6e74ceb8091ad058928d337"><enum>(b)</enum><header>Removal of permit requirements for certain areas</header><text>If the Secretary concerned does not require the public to obtain a permit or reservation to access an existing picnic area, the Secretary concerned may not require an outfitter or guide serving fewer than 40 clients to obtain a permit to access that site.</text></subsection><subsection id="id75c9c3105a084478aa56310ef794bbf2"><enum>(c)</enum><header>Study on access for youth groups to federal land and permits</header><paragraph id="id02e21708b9fd422881aff0c5feb0ac33"><enum>(1)</enum><header>In general</header><text>Not later than 4 years after the date of enactment of this Act, the Secretaries shall—</text><subparagraph id="idab3d465ec3c348c8a159ac0d76e00368"><enum>(A)</enum><text>conduct a study on impediments relating to permitting that are hindering the ability of youth groups to access and recreate on Federal land; and</text></subparagraph><subparagraph id="id1cb0351aec534c1b9061d7edad056acf"><enum>(B)</enum><text>submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report that describes the findings of the study under subparagraph (A).</text></subparagraph></paragraph><paragraph id="id5fba0a6b0ff441cb84b4e1c9dfe7623b"><enum>(2)</enum><header>Temporary permits and de minimis use permits</header><text>For purposes of the study conducted under paragraph (1)(A), for the 4-year period beginning on the date that is 1 year before the date of enactment of this Act, the Secretaries shall—</text><subparagraph id="id5373fdedcd7c4ef2a635fec627967179"><enum>(A)</enum><text>assess the frequency and appropriateness of the issuance of temporary permits or other special recreation permits for youth groups on Federal land; </text></subparagraph><subparagraph id="id49011c99345d4dbca99d21c6c17aece9"><enum>(B)</enum><text>assess the quantity of requests made by youth groups to access a publicly accessible site on a unit of the National Forest System, Federal land administered by the Bureau of Reclamation, or Federal land administered by the Bureau of Land Management; </text></subparagraph><subparagraph id="id1036a03f662b4e4c9ef6ec556736e158"><enum>(C)</enum><text>provide any recommendations to facilitate and streamline access and recreation by youth groups; and</text></subparagraph><subparagraph id="id4c73ed0e5c22426bb69ed2dc691c56f9"><enum>(D)</enum><text>consider any implications regarding the health and safety of participants and liability exposure of the Secretaries and the youth groups. </text></subparagraph></paragraph></subsection><subsection id="id34460d1e0abf452985ce62f8e2dd63bf"><enum>(d)</enum><header>Voluntary return of surplus service days</header><paragraph id="id5360547cf2c44f949fad9b438d3903d4"><enum>(1)</enum><header>In general</header><text>The Secretary concerned shall establish a program to allow a permittee issued a special recreation permit for a public land unit to voluntarily and temporarily return to the Secretary concerned 1 or more service days, to be made available to any other existing or potential permittee.</text></paragraph><paragraph id="id5b9c704b8f984f73b6e590f5093c54b6"><enum>(2)</enum><header>Effect</header><text>The return of surplus service days shall not affect future-year special recreation permits or the number of service days available to the permittee in future years. </text></paragraph></subsection></section><section id="id0065732921d1433ebc97dd0c45f0338d"><enum>102.</enum><header>Planning and managing for recreation</header><subsection id="id5c1c9c690aa14a36853af4300ae9e9ec"><enum>(a)</enum><header>Policy</header><paragraph id="id2a9a9081426d44e4965fae9060f79796"><enum>(1)</enum><header>In general</header><text>It is the policy of the Federal Government to foster and encourage recreation on Federal land, consistent with—</text><subparagraph id="id7a46be062abe459b8040511994743393"><enum>(A)</enum><text>the multiple-use mission of the applicable Federal land management agency; and</text></subparagraph><subparagraph id="idf49137cca2d74b20bd1f978801f04813"><enum>(B)</enum><text>the laws applicable to specific areas of Federal land.</text></subparagraph></paragraph><paragraph id="id6fd9321b12a94ffda2748392f8c7ca95"><enum>(2)</enum><header>Administration</header><text>The Secretary concerned shall carry out the policy described in paragraph (1) in administering programs and activities authorized by law.</text></paragraph></subsection><subsection id="id9eed08975094498fb28a6431b9a9701b"><enum>(b)</enum><header>Definition of land management plan</header><text>In this section, the term <term>land management plan</term> means—</text><paragraph id="idc0b75edaf37347be9e18e959220426e3"><enum>(1)</enum><text>a land use plan prepared by the Secretary pursuant to section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>); and</text></paragraph><paragraph id="id99770e534fce46beb42a3e82be39806e"><enum>(2)</enum><text>a land management plan prepared by the Forest Service for a unit of the National Forest Service pursuant to section 6 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604</external-xref>).</text></paragraph></subsection><subsection id="idedf9a2f22b1d424b848fc6898555153d"><enum>(c)</enum><header>Inventory and assessment</header><paragraph id="idb7cf24a891e24eed8ec7c36adb0aead8"><enum>(1)</enum><header>In general</header><text>In developing or revising a land management plan, the Secretary concerned shall conduct, using public outreach, an inventory and assessment of recreation resources for the Federal land subject to the land management plan.</text></paragraph><paragraph id="idf607fcafb46d4cfa8ceedf4bd97f3512"><enum>(2)</enum><header>Unique recreation values</header><text>An inventory and assessment conducted under paragraph (1) shall recognize—</text><subparagraph id="id88caaa33701a445eb86e9c928f5822d5"><enum>(A)</enum><text>any unique recreation values and uses of each landscape that make a landscape, or a portion of a landscape, desirable for a particular type of recreation opportunity; and</text></subparagraph><subparagraph id="id065c3e2271684d5d956f759a4bfd6e78"><enum>(B)</enum><text>points of concentrated use by recreationists.</text></subparagraph></paragraph><paragraph id="id42b94fb4c3764565935084da8486d8fb"><enum>(3)</enum><header>Inventory</header><text>The inventory under paragraph (1) shall identify and list recreation resources by—</text><subparagraph id="id7948a51d94d049079655ce4b2f5196ba"><enum>(A)</enum><text>type of recreation and type of natural or manmade recreation infrastructure;</text></subparagraph><subparagraph id="id19bd1082c18944dca971ddf194cd2f99"><enum>(B)</enum><text>to the extent available, the level and demographics of use of the recreation resource as of the date of the inventory; and</text></subparagraph><subparagraph id="idb0c9b6b6bb534aa6ba780084b5c64eb7"><enum>(C)</enum><text>any trend relating to recreation opportunities or use.</text></subparagraph></paragraph><paragraph id="id05da6294ab5f41c6938ae2c163509097"><enum>(4)</enum><header>Assessment</header><text>For any recreation resource inventoried under paragraph (1), the Secretary concerned shall assess—</text><subparagraph id="id96592943b55a429ca2aa68dba91050f4"><enum>(A)</enum><text>the level of demand for the recreation resource;</text></subparagraph><subparagraph id="id0cf979018bac40fe9c900dbed2163d9e"><enum>(B)</enum><text>the maintenance needs of, and expenses necessary to administer, the recreation resource;</text></subparagraph><subparagraph id="idd96dd005cd124e7083139c5a0e3290db"><enum>(C)</enum><text>the benefits of current and projected future recreation use, including to the local economy;</text></subparagraph><subparagraph id="idb725a24ebdaa4901af745da6c760494e"><enum>(D)</enum><text>the impacts of current and projected future recreation use on—</text><clause id="id13c35891857d4457ab8b302982ff4751"><enum>(i)</enum><text>natural, cultural, and other resources; and</text></clause><clause id="id48fb3079a78d4a3bbba0ee40f0813e65"><enum>(ii)</enum><text>other authorized uses and activities on the Federal land subject to the land management plan; and</text></clause></subparagraph><subparagraph id="ide220639d01684d84a35393935ea9f613"><enum>(E)</enum><text>the suitability for developing, expanding, or enhancing the recreation resource.</text></subparagraph></paragraph></subsection><subsection id="id61b6403924634289a9c31e51e29b9732"><enum>(d)</enum><header>Future recreation needs and management</header><paragraph id="idaca6ffba2ec8414aaeddd1083f65efcb"><enum>(1)</enum><header>Future needs</header><text>Based on the inventory and assessment under subsection (c)(1), the Secretary concerned shall—</text><subparagraph id="id2b7f7e550c7f49e3a1f143d938a3594e"><enum>(A)</enum><text>consider future recreation needs;</text></subparagraph><subparagraph id="id63bfa1093581487d95fdc025d8744864"><enum>(B)</enum><text>identify underutilized locations that are suitable for developing, expanding, or enhancing recreation use; and</text></subparagraph><subparagraph id="idc8752e5195f347588790d3e3c5f7beca"><enum>(C)</enum><text>select additional high-value recreation resources at which to encourage recreation use.</text></subparagraph></paragraph><paragraph id="idaa40b1bd8c684779a71d145c9e02a2c0"><enum>(2)</enum><header>Savings clause</header><text>The Secretary concerned shall manage any high-value recreation resource identified under paragraph (1)(C) in a manner that—</text><subparagraph id="idc6bc6e0c21b045f798382a767153639f"><enum>(A)</enum><text>is consistent with applicable law;</text></subparagraph><subparagraph id="iddbcae2ca11b84652ab8379e2ef49a432"><enum>(B)</enum><text>recognizes other uses and activities in the area of the high-value recreation resource;</text></subparagraph><subparagraph id="id2e4e2505e713468cbb98fe3d982c6e7c"><enum>(C)</enum><text>seeks input from the public, including adjacent landowners and individuals or entities with existing permits and leases; and</text></subparagraph><subparagraph id="id921d480f93074475b39bc6ef5ae71087"><enum>(D)</enum><text>protects and enhances the recreation values of the high-value recreation resource.</text></subparagraph></paragraph><paragraph id="iddad4098f9b394431bba27b26177414a7"><enum>(3)</enum><header>Forecasts</header><text>In developing or revising a land management plan, the Secretary concerned shall predict the manner in which the following would change under the desired future conditions identified in the applicable land management plan:</text><subparagraph id="id7d33edf859be4dfdad06720916315781"><enum>(A)</enum><text>The number of visitors to the respective unit of Federal land.</text></subparagraph><subparagraph id="id4d9761cd327c4161a5a8e3ab6cbc317b"><enum>(B)</enum><text>The maintenance needs of, and the expenses necessary to administer, the recreation resources on the respective unit of Federal land.</text></subparagraph><subparagraph id="idde9e9fd80d63458f9b7c38a45662cf3a"><enum>(C)</enum><text>The benefits of recreation use, including to the local economy.</text></subparagraph><subparagraph id="ideb3d6d6fbf8c4d959b078664e081ba31"><enum>(D)</enum><text>The impacts of recreation use on—</text><clause id="id494171bf56544b349b1d211f6044c1cc"><enum>(i)</enum><text>natural, cultural, or other resources; and</text></clause><clause id="idf2c944e9c57a48d48ac743edf48253db"><enum>(ii)</enum><text>other authorized uses and activities on the Federal land subject to the land management plan.</text></clause></subparagraph></paragraph></subsection></section><section id="idb74a17ee4b4f4a5695ec5465df8908c2"><enum>103.</enum><header>Forest Service climbing guidance</header><subsection id="idb1019bc85b59408f9b838609335cb673"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text><paragraph id="id94e3fa608fb344b39ddc5ee121242275"><enum>(1)</enum><text>recreational climbing in wilderness areas on National Forest System land is being managed inconsistently; and</text></paragraph><paragraph id="id5f7aad5b7b58490a85c35e0f83205963"><enum>(2)</enum><text> recreational climbing is a legitimate and appropriate use of wilderness areas on National Forest System land if the recreational climbing is conducted and managed in accordance with—</text><subparagraph id="idd59a39bfac5e4ba0982fe62ef097cae1"><enum>(A)</enum><text>the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>);</text></subparagraph><subparagraph id="id186a92b1e2034d9d941627424ce17562"><enum>(B)</enum><text>other applicable laws (including regulations); and</text></subparagraph><subparagraph id="id3c03cfcea8e04d8b872db8e8fd478ea8"><enum>(C)</enum><text>any reasonable terms and conditions that are determined to be necessary by the Secretary of Agriculture.</text></subparagraph></paragraph></subsection><subsection id="id06fc843e15c34b82bd91edc985b7c348"><enum>(b)</enum><header>Climbing guidance in wilderness</header><text>Not later than 18 months after the date of enactment of this Act, the Secretary of Agriculture shall issue guidance on climbing management for National Forest System land, including the placement, maintenance, or removal of fixed anchors and the appropriate use of other equipment in designated wilderness areas on National Forest System land under the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>). </text></subsection><subsection id="id530bff4fba7d4967acf96d97a1f2a043"><enum>(c)</enum><header>Public notice and comment</header><text>Prior to taking any significant management action affecting recreational climbing on National Forest System land, the Secretary of Agriculture shall provide the public with notice and an opportunity to comment on the proposed action.</text></subsection></section><section id="id2f2bb1040fde43c28b18944cf183fd84"><enum>104.</enum><header>Target shooting ranges</header><subsection id="id43760a5bb1684fcf901eda7a213d5eb5"><enum>(a)</enum><header>Definition of designated shooting range</header><text>In this section, the term <term>designated shooting range</term> means a developed and managed area on Federal land that is designed and operated specifically for the purposeful discharge of legal firearms, firearms training, archery, or other associated activities.</text></subsection><subsection id="id0f5e70f7153a40c9978d3c7ecddceed6"><enum>(b)</enum><header>Identification of designated shooting range</header><paragraph id="id617bf0403a19417291beed16eee0a0e9"><enum>(1)</enum><header>In general</header><text>The Secretaries shall identify a suitable location for, and construct, designated shooting ranges on National Forest System land and public land administered by the Bureau of Land Management for the public to use for recreational target shooting.</text></paragraph><paragraph id="id72cc746d2a874c14b55efcc17ff6d5ef"><enum>(2)</enum><header>Minimum number of ranges</header><text>To the maximum extent practicable—</text><subparagraph id="id9d13727a772745a4a85bb870dccbbc42"><enum>(A)</enum><text>the Secretary of Agriculture shall ensure that each National Forest has not fewer than 1 designated shooting range; and</text></subparagraph><subparagraph id="id7d4aa1ea1d2e449aa14c12f59b6bc726"><enum>(B)</enum><text>the Secretary shall ensure each Bureau of Land Management district has not fewer than 1 designated shooting range.</text></subparagraph></paragraph><paragraph id="id9ea42076674f45f4a6eff5acac545662"><enum>(3)</enum><header>Requirements</header><text>A designated shooting range under paragraph (1)—</text><subparagraph id="id58435d62ac7647fcbfc1aa46e0175523"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id62b447146fc343b494520e62e2286fb4"><enum>(i)</enum><text>shall be able to accommodate rifles, pistols, and shotguns; and</text></clause><clause id="id88ebb48bb5634996a255ad7f870d16db" indent="up1"><enum>(ii)</enum><text>may accommodate archery;</text></clause></subparagraph><subparagraph id="id022eb3f7d27e4b5c833f407228bae271"><enum>(B)</enum><text>shall include—</text><clause id="id7d4d5911a6d1480cb8871b8c476bb429"><enum>(i)</enum><text>significantly modified landscapes, including berms, buffer distances, or other public safety designs or features;</text></clause><clause id="id1559aa2becd6480b8bd044ea084d22c2"><enum>(ii)</enum><text>a designated firing line; and</text></clause><clause id="id8ea1325ad1a640928b14e98b88410448"><enum>(iii)</enum><text>benches; and</text></clause></subparagraph><subparagraph id="id18a323497176454e8742f1ed85298939"><enum>(C)</enum><text>may include—</text><clause id="id4859fe8393e440d083eab1c6c7c164fa"><enum>(i)</enum><text>shade structures;</text></clause><clause id="id260cc7b5a9ce48588086ab8f7f32c176"><enum>(ii)</enum><text>trash containers;</text></clause><clause id="id5c0951860d25462883e29cd7b6b70b18"><enum>(iii)</enum><text>restrooms; and</text></clause><clause id="id5c61d5903206442ea6ebf90fbe898caf"><enum>(iv)</enum><text>any other features that the Secretary concerned determines to be necessary.</text></clause></subparagraph></paragraph></subsection><subsection id="id4272de02985c495aa6746c68e21eb7e5"><enum>(c)</enum><header>Requirements</header><paragraph id="id53c2984a6bdf4fdaa22513f12950518b"><enum>(1)</enum><header>Existing use</header><text>The Secretaries, in cooperation with the entities described in subsection (d), shall—</text><subparagraph id="id722a498efe0c401ab4cfae5a7cb7d25b"><enum>(A)</enum><text>consider the proximity of areas frequently used by recreational shooters when identifying a suitable location for a designated shooting range; and</text></subparagraph><subparagraph id="idfdaeb1e92ed74dc6b0eccf66cbd7508b"><enum>(B)</enum><text>ensure a designated shooting range would not impact a non-Federal target shooting range, including a target shooting range located on private land.</text></subparagraph></paragraph><paragraph id="id22ee512b4429445e93942993094a59e9"><enum>(2)</enum><header>Closures</header><text>Except in emergency situations, the Secretary concerned shall seek to ensure that a designated shooting range, or an equivalent shooting range adjacent to a National Forest or Bureau of Land Management district, is available to the public prior to closing Federal land to recreational shooting.</text></paragraph></subsection><subsection id="idf647e322977e4901abab78c6fb27b7ed"><enum>(d)</enum><header>Cooperation</header><text>In carrying out this section, the Secretaries shall cooperate, as applicable, with—</text><paragraph id="idc36687b78eda47529310a8b2bd8f3ce9"><enum>(1)</enum><text>local and Tribal governments;</text></paragraph><paragraph id="idb8696104a97f4d95ac9a21a96d057660"><enum>(2)</enum><text>nonprofit organizations;</text></paragraph><paragraph id="id76005d1e03f84cc5a1e4a5d0a0b8ac8b"><enum>(3)</enum><text>State fish and wildlife agencies;</text></paragraph><paragraph id="id525e9f4d680f416e93d9005072c07c41"><enum>(4)</enum><text>shooting clubs;</text></paragraph><paragraph id="idfedd0cd81e0b457ab8272d206d7c9c17"><enum>(5)</enum><text>Federal advisory councils relating to hunting and shooting sports;</text></paragraph><paragraph id="id9cc41dddb8ec443b9a9260bda11b162e"><enum>(6)</enum><text>nongovernmental organizations that, as of the date of enactment of this Act, are signatories to the memorandum of understanding entitled <quote>Federal Lands Hunting, Fishing, and Shooting Sports Roundtable Memorandum of Understanding</quote> and signed by the Forest Service and the Bureau of Land Management on August 17, 2006; </text></paragraph><paragraph id="ida638c654f9b6422da1239229f5cffb05"><enum>(7)</enum><text>individuals or entities with authorized leases or permits in an area under consideration for a designated shooting range; and</text></paragraph><paragraph id="id71635a640c1e4d6e8958502c7596a555"><enum>(8)</enum><text>the public.</text></paragraph></subsection><subsection id="id997e683eff0d4071be6554ceca3b1e2b"><enum>(e)</enum><header>Restrictions</header><paragraph id="id1732fbc9a43543bc99e84606f304fcc3"><enum>(1)</enum><header>In general</header><text>The management of a designated shooting range shall be subject to such conditions as the Secretary concerned determines are necessary for the safe, responsible use of—</text><subparagraph id="idd3317887b06645239acafb09d26fed29"><enum>(A)</enum><text>the designated shooting range; and</text></subparagraph><subparagraph id="id92a42fc818af490a91dbbd71d28bf5ad"><enum>(B)</enum><text>the adjacent resources.</text></subparagraph></paragraph><paragraph id="idaf1b0d8a499043c8aa8221f26f8efbbd"><enum>(2)</enum><header>Fees</header><text>The Secretary concerned may not require a user to pay a fee to use a designated shooting range established under this section.</text></paragraph></subsection><subsection id="idc7700f825bf1465580909a9f871bd654"><enum>(f)</enum><header>Annual reports</header><text>Not later than 1 year after the date of enactment of this Act and annually thereafter, the Secretaries shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report describing the progress made with respect to the implementation of this section.</text></subsection></section></title><title id="idbb1a38e01ed249e0a08c584a0d39a9d8"><enum>II</enum><header>Improving recreation opportunities</header><section id="id370755279f0843fa818d47358e23fc64"><enum>201.</enum><header>Broadband internet connectivity at recreation sites</header><subsection id="id3d042c4f1fa7459782679c92760f404a"><enum>(a)</enum><header>In general</header><text>The Secretary and the Chief of the Forest Service shall enter into an agreement with the Administrator of the Rural Utilities Service to install or construct broadband internet infrastructure at recreation sites on Federal land to establish broadband internet connectivity—</text><paragraph id="id7575F16D34DE41A6B44D84C8A9CC31E2"><enum>(1)</enum><text>subject to the availability of appropriations; and</text></paragraph><paragraph id="id837731E759B54040AD05A2EC1D6B081B"><enum>(2)</enum><text>consistent with applicable law.</text></paragraph></subsection><subsection id="id01b647154eb04093ae2ea28c85e3b8fe"><enum>(b)</enum><header>Identification</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary and the Chief of the Forest Service, in coordination with States, shall make publically available—</text><paragraph id="id1f29efa1adc14e3ebade209bc69ab776"><enum>(1)</enum><text>a list of the highest priority recreation sites on Federal land that lack broadband internet; and</text></paragraph><paragraph id="id53a04510a2d6439598757f7c31df1429"><enum>(2)</enum><text>an estimate of the cost to equip each of those sites with broadband internet infrastructure.</text></paragraph></subsection><subsection id="id669a008d29c148b1962364208cc2a153"><enum>(c)</enum><header>Priorities</header><text>In selecting recreation sites for the list described in subsection (b)(1), the Secretary and the Chief of the Forest Service shall give priority to recreation sites—</text><paragraph id="id380dad8018ff493bb8bc16298d779f96"><enum>(1)</enum><text>at which broadband internet infrastructure has not been constructed by traditional utilities due to—</text><subparagraph id="idf3e1e3ffd3ff47488f7d617c6098f34b"><enum>(A)</enum><text>geographic challenges; or</text></subparagraph><subparagraph id="idbe8ba36bc7f34df78d82a72bf6b5eb03"><enum>(B)</enum><text>the location having an insufficient number of permanent residents, despite high seasonal or daily visitation levels; or</text></subparagraph></paragraph><paragraph id="id0db69600f40d415291aa5c719613babb"><enum>(2)</enum><text>that are located in an economically distressed county that could benefit significantly from developing the outdoor recreation economy of the county.</text></paragraph></subsection></section><section id="id05807bccf6f64c1db4c5df8c6285e9b0"><enum>202.</enum><header>Federal land and aquatic resource activities assistance</header><subsection id="id1f148aae081e4701bb744d77e351eda9"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id09000687e2544cb893606c48846ce04d"><enum>(1)</enum><header>Aquatic Nuisance Species Task Force</header><text>The term <term>Aquatic Nuisance Species Task Force</term> means the Aquatic Nuisance Species Task Force established by section 1201(a) of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4721">16 U.S.C. 4721(a)</external-xref>).</text></paragraph><paragraph id="idb575c1935de8400bbc3ee2e7907d37c8"><enum>(2)</enum><header>Federal land and water</header><text>The term <term>Federal land and water</term> means Federal land and water operated and maintained by the Bureau of Land Management or the National Park Service, as applicable.</text></paragraph><paragraph id="id12bfab3bdf8840d98d5fca52daeee365"><enum>(3)</enum><header>Inspection</header><text>The term <term>inspection</term> means an inspection to prevent and respond to biological invasions of an aquatic ecosystem.</text></paragraph><paragraph id="id454aebc8aef94dd09fbb1c5ce513719c"><enum>(4)</enum><header>Partner</header><text>The term <term>partner</term> means—</text><subparagraph id="idD7081CC61E634CEAA2728A53AB7F1927"><enum>(A)</enum><text>a Reclamation State;</text></subparagraph><subparagraph id="idB476F8697089415B84313BBCFD9FFC01"><enum>(B)</enum><text>an Indian Tribe in a Reclamation State;</text></subparagraph><subparagraph id="id9B4D914B29BA42A587F02788174D2D59"><enum>(C)</enum><text>an applicable nonprofit organization in a Reclamation State; or</text></subparagraph><subparagraph id="id5DFD8C3B1002468BA564E577DAAE2B58"><enum>(D)</enum><text>a unit of local government in a Reclamation State.</text></subparagraph></paragraph><paragraph id="id4398e78442094200b16ae81c7100c3cd"><enum>(5)</enum><header>Reclamation State</header><subparagraph id="ide977488da0ac435496dc62e8170bc2b1"><enum>(A)</enum><header>In general</header><text>The term <term>Reclamation State</term> means any State in which a Bureau of Reclamation reservoir is located.</text></subparagraph><subparagraph id="idfb10be0a053a4ef0b3ac49e23f80b07a"><enum>(B)</enum><header>Inclusions</header><text>The term <term>Reclamation State</term> includes any of the States of—</text><clause id="id20961f1dc7c04bb8bd083f19995e0cd0"><enum>(i)</enum><text>Alaska;</text></clause><clause id="id2b4474a645134b3a97dc85ad79aa94d3"><enum>(ii)</enum><text>Arizona;</text></clause><clause id="id71459d5f362b4fdfb5400c7d6ef2786e"><enum>(iii)</enum><text>California;</text></clause><clause id="id54ab2bf67c8345e18f2bbc4abc5dc6b5"><enum>(iv)</enum><text>Colorado;</text></clause><clause id="ide3c748bf5be64041a1103f4af2985926"><enum>(v)</enum><text>Idaho;</text></clause><clause id="idbe3c4964ffa9462b86099fd0fdaee1ff"><enum>(vi)</enum><text>Kansas;</text></clause><clause id="id97cb08dc18b0453b8de4956e90d79dbd"><enum>(vii)</enum><text>Montana;</text></clause><clause id="id567a692b8e5245ad95ce0081501f22d2"><enum>(viii)</enum><text>Nebraska;</text></clause><clause id="id75e3292b0f7146b1b0376b7083519144"><enum>(ix)</enum><text>Nevada;</text></clause><clause id="id055fd2c5ed784bc789aa54075b976fa2"><enum>(x)</enum><text>New Mexico;</text></clause><clause id="idd5f1f5680d3c479bbd6223e931f147f7"><enum>(xi)</enum><text>North Dakota;</text></clause><clause id="id573a48b1683c48d2a48127e822dab6ad"><enum>(xii)</enum><text>Oklahoma;</text></clause><clause id="id4137a2f0823543789347d781bf834c25"><enum>(xiii)</enum><text>Oregon;</text></clause><clause id="id2a42d157cb0b4e0ea3eb05e31a0e72ee"><enum>(xiv)</enum><text>South Dakota;</text></clause><clause id="ide0f1ab2396ed4217b9122404a73231bf"><enum>(xv)</enum><text>Texas;</text></clause><clause id="id52e92a5f1fa1410db0ef33cae00b75b9"><enum>(xvi)</enum><text>Utah;</text></clause><clause id="ide34b4774cb4646efbf0641eb2e853c84"><enum>(xvii)</enum><text>Washington; and</text></clause><clause id="id27322eede5474bc8b7795889bad6e2f6"><enum>(xviii)</enum><text>Wyoming.</text></clause></subparagraph></paragraph></subsection><subsection id="idf3ed9ead5edf435da77e7e223a89c11a"><enum>(b)</enum><header>Authority of Bureau of Land Management and National Park Service with respect to certain aquatic resource activities on Federal land and water</header><paragraph id="id7d24cd27379549b29666fc29eeb9a24a"><enum>(1)</enum><header>In general</header><text>The Secretary may inspect and decontaminate watercraft entering and leaving Federal land and water located within a river basin that contains a Bureau of Reclamation water project.</text></paragraph><paragraph id="ida3c29a7116934f798e52c085237b14a4"><enum>(2)</enum><header>Requirements</header><text>The Secretary, acting through the Director of the Bureau of Land Management and the Director of the National Park Service, shall—</text><subparagraph id="id9142051c39dd42cfb9706f053905153b"><enum>(A)</enum><text>in carrying out an inspection under paragraph (1), coordinate with 1 or more partners; </text></subparagraph><subparagraph id="id9673e8b9a00844db86f47047183f2642"><enum>(B)</enum><text>consult with the Aquatic Nuisance Species Task Force to identify potential improvements in the detection and management of invasive species on Federal land and water; and</text></subparagraph><subparagraph id="idf770d0bc30d940e2aebcd341b17864ab"><enum>(C)</enum><text>to the maximum extent practicable, inspect watercraft in a manner that minimizes disruptions to public access for boating and recreation in noncontaminated watercraft. </text></subparagraph></paragraph><paragraph id="id053bd2facc3948e6998ddd2bafc32ee5"><enum>(3)</enum><header>Partnerships</header><text>The Secretary, acting through the Director of the Bureau of Land Management and the Director of the National Park Service, may enter into a partnership to provide technical assistance to a partner—</text><subparagraph id="idacebd5d9ab714072b67ae5dc327bf571"><enum>(A)</enum><text>to carry out an inspection or decontamination of watercraft; or</text></subparagraph><subparagraph id="idcaabf277a6c8493e98ab89f6c125c0d5"><enum>(B)</enum><text>to establish an inspection and decontamination station for watercraft.</text></subparagraph></paragraph></subsection><subsection id="id7531778a5cca42a7bdd3554cc2600a38"><enum>(c)</enum><header>Grant program for reclamation states for watercraft inspection and decontamination stations</header><paragraph id="id178f1388e77f4c349785af798d699346"><enum>(1)</enum><header>Watercraft inspection in Reclamation States</header><text>Subject to the availability of appropriations, the Secretary, acting through the Commissioner of Reclamation, shall establish a competitive grant program to provide grants to partners to conduct inspections and decontamination of watercraft in reservoirs operated and maintained by the Secretary, including to purchase, establish, operate, or maintain a watercraft inspection and decontamination station.</text></paragraph><paragraph id="id17d038d2a07d4d0f9b5a63efd81dfbce"><enum>(2)</enum><header>Cost share</header><text>The Federal share of the cost of a grant under paragraph (1), including personnel costs, shall not exceed 75 percent.</text></paragraph><paragraph id="id8a37672201e24247bca7b92a2098558e"><enum>(3)</enum><header>Standards</header><text>Before awarding a grant under paragraph (1), the Secretary shall determine that the project is technically and financially feasible.</text></paragraph><paragraph id="ida53a98998d3947f2b31f269df9aa500c"><enum>(4)</enum><header>Coordination</header><text>In carrying out this subsection, the Secretary shall coordinate with—</text><subparagraph id="id040c051ca6d4479580b828cefbbc7a79"><enum>(A)</enum><text>each of the Reclamation States;</text></subparagraph><subparagraph id="idcba48a415e5d4b91bad4b155d20b9924"><enum>(B)</enum><text>affected Indian Tribes; and</text></subparagraph><subparagraph id="id0112c49103eb49a4839e19b2ec4e6bcd"><enum>(C)</enum><text>the Aquatic Nuisance Species Task Force.</text></subparagraph></paragraph></subsection></section><section id="ide98fd5d1987b4f44b3ab9cdb8bd74fcd"><enum>203.</enum><header>Improved recreation visitation data</header><subsection id="ida73f7419ad1543ad93ac76ff3a1a6955"><enum>(a)</enum><header>In general</header><text>The Secretaries shall establish a single visitation data management and modeling system for public recreation to provide accurate, real-time visitation data, at a site-specific level and in a consistent manner, with respect to Federal land managed by each of—</text><paragraph id="id2d5aeae7939f4221814c8a67cf063b79"><enum>(1)</enum><text>the Chief of the Forest Service;</text></paragraph><paragraph id="id39238567ded143c1abb6880da231f240"><enum>(2)</enum><text>the Director of the Bureau of Land Management;</text></paragraph><paragraph id="id9c1ea924365446c5bccf124863578b71"><enum>(3)</enum><text>the Director of the Bureau of Indian Affairs, in coordination with Indian Tribes;</text></paragraph><paragraph id="id319f2eb8ed5f451c89fec3f27e274886"><enum>(4)</enum><text>the Director of the National Park Service;</text></paragraph><paragraph id="id80df246fc6464e4d8c23b0114c812706"><enum>(5)</enum><text>the Director of the United States Fish and Wildlife Service; and</text></paragraph><paragraph id="id882f9b7d45d24667a580a073c273ffa3"><enum>(6)</enum><text>the Commissioner of Reclamation.</text></paragraph></subsection><subsection id="id330e4f27749d47dfa18a4166d474ffa0" commented="no"><enum>(b)</enum><header>Third-Party providers and partners</header><text>For purposes of carrying out this section, the Secretary concerned shall coordinate or contract with private sector partners, including—</text><paragraph id="id4947430B74FD4E93B9D2039AA1AA6441" commented="no"><enum>(1)</enum><text>technology companies;</text></paragraph><paragraph id="id76E9EFB029A24253865EE2CDEEE15865" commented="no"><enum>(2)</enum><text>mapping companies;</text></paragraph><paragraph id="id70D83275954F4C8AB8F7D839A0D3A49F" commented="no"><enum>(3)</enum><text>experts in data science, analytics, and operations research; or</text></paragraph><paragraph id="id9BB3061D98BF498A8F7FCE54A85F09B9" commented="no"><enum>(4)</enum><text>data companies.</text></paragraph></subsection><subsection id="id1b83120e68594cadbe237606835eb11a"><enum>(c)</enum><header>Interface</header><text>The Secretaries shall coordinate with trade associations, State outdoor recreation offices, offices of tourism, and local outdoor recreation marketing organizations to design and deploy, for purposes of making data available under subsection (a), the optimum user interface that balances ease of use by the public with the available resources of the Secretaries.</text></subsection><subsection id="idf96a397e777f4af9972040d23dc2841e"><enum>(d)</enum><header>Smart phone technology</header><text>The Secretaries and any partner described in subsection (b) may make use of smart phone technology for purposes of making data available under subsection (a).</text></subsection><subsection id="id574599455fca4aad8cb1f9ddae48fa87"><enum>(e)</enum><header>Privacy clause</header><text>Nothing in this section provides authority to the Secretaries—</text><paragraph id="id0c8c2ac3fa1c4eeb899230e6b9d03d61"><enum>(1)</enum><text>to monitor or record the movements of a visitor to Federal land;</text></paragraph><paragraph id="id2de18e5e9d8a4e078d9bf4c090ca2071"><enum>(2)</enum><text>to restrict, interfere with, or monitor a private communication of a visitor to Federal land; </text></paragraph><paragraph id="id266b3a2ae08f433281754d6c28e07f4b"><enum>(3)</enum><text>to take possession of any documents, data, or other personal effects of a visitor to Federal land; or</text></paragraph><paragraph id="ide5c91c364f674e2baa51b792a83d5c31"><enum>(4)</enum><text>to collect—</text><subparagraph id="idA24592902B13480DAB82E1E025B0E18C"><enum>(A)</enum><text>information from owners of land adjacent to Federal land; or</text></subparagraph><subparagraph id="idF450D43A06EF4DBFAC2EE219E864F1A7"><enum>(B)</enum><text>information on non-Federal land. </text></subparagraph></paragraph></subsection><subsection id="id4e076655963949fba8157171901887cc"><enum>(f)</enum><header>Categories of use</header><text>To the maximum extent practicable, the Secretaries shall categorize the data collected under subsection (a) by recreational activity.</text></subsection><subsection id="ide819180190fb4dd4a2f5330286d5b26b"><enum>(g)</enum><header>Limitation</header><text>Information or data collected under this section shall be limited only to actual recreation visitation information for recreation sites managed by the Secretary concerned. </text></subsection><subsection id="id97055e36cf3a4e2b8795236814022c17"><enum>(h)</enum><header>Report</header><text>Not later than January 1, 2024, and annually thereafter, the Secretaries shall publish on a website of the Secretaries a report that describes the annual visitation of each unit of Federal land, including, to the maximum extent practicable, visitation categorized by recreational activity.</text></subsection></section><section id="id658f818378974a2982901d2756966925"><enum>204.</enum><header>Travel management</header><subsection id="id1166cec66e4d4b959ba6bf068f839ae9"><enum>(a)</enum><header>In general</header><text>The Secretaries shall—</text><paragraph id="id63d5b7f81017428992d18986519bb471"><enum>(1)</enum><text>prioritize finalizing travel management planning activities of the Bureau of Land Management and the Forest Service, as applicable, including evaluating and designating as open, limited, or closed applicable Federal land areas or routes, roads, trails, or staging areas on applicable Federal land for nonmotorized or motorized use, including for over-snow vehicles; and </text></paragraph><paragraph id="id7a5f96bad6ce46c7bef4039610de85fa"><enum>(2)</enum><text>not later than 5 years after the date of enactment of this Act, develop a ground transportation linear feature or motor vehicle use map and over-snow vehicle use map for each district administered by the Bureau of Land Management and each unit of the National Forest System, in a printed and publically available format that is compliant with the format for geographic information systems. </text></paragraph></subsection><subsection id="id1bee821a5f7648cdb64787f884aaffc2"><enum>(b)</enum><header>Procedures</header><text>For purposes of meeting the requirements of subsection (a), the Secretary concerned—</text><paragraph id="id471d0069bf7f4133be667d896292d7e4"><enum>(1)</enum><text>may use an existing evaluation or designation;</text></paragraph><paragraph id="idd4bdc795d88b445480a724e8d725973c"><enum>(2)</enum><text>may evaluate and alter an existing designation for applicable Federal land areas or routes, roads, trails, or staging areas on applicable Federal land in accordance with applicable laws (including regulations); </text></paragraph><paragraph id="id3a997749e565451db24993ad0920a317"><enum>(3)</enum><text>shall consider—</text><subparagraph id="idd04b44e4ab3f45c898c00c785b779139"><enum>(A)</enum><text>the protection of the resources of the Federal land;</text></subparagraph><subparagraph id="id19fd3523ec494a41b548e9363d12259e"><enum>(B)</enum><text>the promotion of the safety of the users of the Federal land;</text></subparagraph><subparagraph id="ide1efa48fe75740de9f4103165f1eeba6"><enum>(C)</enum><text>the minimization of conflicts among various uses of the Federal land; and</text></subparagraph><subparagraph id="id5eb33b7aad864d818fdc965158113af3"><enum>(D)</enum><text>other designation criteria or route options developed by the Secretaries at the local level, such as seasonal restrictions, temporary or seasonal access, minimization of impacts to wildlife, and other appropriate criteria or options;</text></subparagraph></paragraph><paragraph id="idd7ca1474734a4115a9f6ed298c9449a3"><enum>(4)</enum><text>shall increase—</text><subparagraph id="ide2d0cb25128b44e3b3384eb2a8463de2"><enum>(A)</enum><text>multiple-use recreation opportunities; and</text></subparagraph><subparagraph id="id6a16af805b594af4a57217d9ef9b5ded"><enum>(B)</enum><text>opportunities for nonmotorized and motorized access and experiences on Federal land; </text></subparagraph></paragraph><paragraph id="id5dcf80ff005f47dea7495e5981f436ab"><enum>(5)</enum><text>shall coordinate with States, local governments, Indian Tribes, other stakeholders, adjoining landowners, businesses that use the features on Federal land, and the public; and</text></paragraph><paragraph id="idac7d13d7ab204e468cec94ee75053f15"><enum>(6)</enum><text>shall update any travel management plan that was finalized before the date that is 15 years before the date of enactment of this Act. </text></paragraph></subsection><subsection id="idf437973c971745fbbf88b3edcd09d520"><enum>(c)</enum><header>Rulemaking</header><text>The Secretaries may revise existing regulations to implement this section.</text></subsection><subsection id="id7614ca7fa49a44139c8d95d2324ebac2"><enum>(d)</enum><header>Effect</header><text>Nothing in this section limits or restricts—</text><paragraph id="id9ac64e339bf443ca97eb9fcb335963a1"><enum>(1)</enum><text>emergency access use or the administrative use of the Federal land by the Secretary concerned by motorized or nonmotorized means, including any use or activity necessary to carry out terms and conditions associated with an authorized permit, lease, or contract with respect to the Federal land; or</text></paragraph><paragraph id="idc8d7631672fa495b829752d52fd2730d"><enum>(2)</enum><text>any other motorized or nonmotorized use or activity on the Federal land that is authorized on the applicable Federal land, as determined by the Secretary concerned.</text></paragraph></subsection><subsection id="id27d615077cc9403e9434a12bb3931b66"><enum>(e)</enum><header>Report</header><text>Not later than 3 years after the date of enactment of this Act, the Secretaries shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report that describes the progress of the Secretaries in carrying out this section.</text></subsection></section></title><title id="ide388b307bda14ed1b0de20a35cb09ea7"><enum>III</enum><header>Investing in recreation infrastructure and rural communities</header><section id="idd886b762a0a94bdab3f62eed084fccf5"><enum>301.</enum><header>Gateway communities</header><subsection id="id58fc8468baf34cc69f96754af78598b7"><enum>(a)</enum><header>In general</header><text>The Secretary of Agriculture (acting through the Administrator of the Rural Business-Cooperative Service), in coordination with the Secretary and the Secretary of Commerce, shall provide to businesses in rural communities that are adjacent to recreation destinations (including recreation destinations on Federal land) the assistance described in subsection (b) to establish, operate, or expand infrastructure to accommodate and manage sustainable visitation, including hotels, campgrounds, and restaurants. </text></subsection><subsection id="id8212eb45c38a48bfae92aed64eb5182b"><enum>(b)</enum><header>Assistance</header><text>The Secretary of Agriculture may provide assistance under subsection (a) through the use of existing, or the establishment of new, entrepreneur and vocational training programs, technical assistance programs, low-interest business loan programs, and loan guarantee programs.</text></subsection></section><section id="iddf95d9a3e5cf42e580185013f033c343"><enum>302.</enum><header>Forest Service conservation finance partnerships</header><subsection id="id6c8f1200b29643da8e8dcc208667f4f0"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text><paragraph id="idd65a7fb263244617a70ff0844a8cbfc6"><enum>(1)</enum><text>innovative funding models are an appropriate way to develop and maintain recreation infrastructure on Federal land; and</text></paragraph><paragraph id="id36a8c945fe2e4dc7b2450d30e96d69c9"><enum>(2)</enum><text>in carrying out this section, the Secretary of Agriculture should build on the successes of the Baileys Mountain Bike Trail System project on the Wayne National Forest, which was designed specifically to make Athens County, Ohio, a more popular recreation destination.</text></paragraph></subsection><subsection id="id0a979001c5ce459eb9726bb68c99c440"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id78f2c251b03548968c15391d3c689511"><enum>(1)</enum><header>Conservation partner</header><text>The term <term>conservation partner</term> means—</text><subparagraph id="id59cddb3f646d4ee49b6d571c52559f45"><enum>(A)</enum><text>a private nonprofit, for-profit, or charitable entity or other person; or</text></subparagraph><subparagraph id="idd6a3e1caeb124c5da47a0f1a6c33df7b"><enum>(B)</enum><text>a unit of State, local, or Tribal government.</text></subparagraph></paragraph><paragraph id="id0038e221d4004471b8e44b9243074bb2"><enum>(2)</enum><header>Independent evaluator</header><text>The term <term>independent evaluator</term> means an individual or entity, including an institution of higher education, that is selected by the Secretary of Agriculture, in consultation with a conservation partner, to make the determinations and prepare the reports required under subsection (f).</text></paragraph><paragraph id="id19b79c02c5fe4cc08ccfd01d0c01fc1f"><enum>(3)</enum><header>Project</header><text>The term <term>project</term> means 1 or more activities conducted on National Forest System land, or on other land if the activities would benefit National Forest System land, to enhance a recreational opportunity for which the Secretary of Agriculture has approved a record of decision, decision notice, or decision memo.</text></paragraph><paragraph id="id333f78e5ec8d4293a5db966d29612349"><enum>(4)</enum><header>Project agreement</header><text>The term <term>project agreement</term> means a cooperative agreement, a mutual benefit agreement, or a contract, as appropriate, executed by the Secretary of Agriculture and a project broker or a conservation partner in accordance with applicable law.</text></paragraph><paragraph id="id074c0666491d485aaca7954a1647823b"><enum>(5)</enum><header>Project broker</header><text>The term <term>project broker</term> means a nonprofit or for-profit intermediary that assists in establishing or implementing a project agreement.</text></paragraph></subsection><subsection id="id201d196544b54a8e95eb25a758999057"><enum>(c)</enum><header>Establishment of pilot program</header><text>The Secretary of Agriculture shall establish a pilot program in accordance with this section to carry out 1 or more projects that are financed by conservation partners. </text></subsection><subsection id="id7068850801e4463ea7a461a8a7e09526"><enum>(d)</enum><header>Project agreements</header><paragraph id="ide1b2467dd28b43e3aa494dfe909c0ee6"><enum>(1)</enum><header>In general</header><text>Notwithstanding the Act of June 30, 1914 (commonly known as the <quote>Cooperative Funds Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/498">16 U.S.C. 498</external-xref>), or subtitle C of title XX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397n">42 U.S.C. 1397n et seq.</external-xref>), in carrying out the pilot program under this section, the Secretary of Agriculture may enter into a project agreement with a conservation partner or a project broker under which the conservation partner or project broker agrees to pay for all or part of a project. </text></paragraph><paragraph id="idc26dda14e22e41e79b1a92f5968fffb8"><enum>(2)</enum><header>Term</header><text>The term of a project agreement shall be not longer than 20 years.</text></paragraph><paragraph id="id9ce7d76ba6d9443691ab1e8b34527e7d"><enum>(3)</enum><header>Size limitation</header><text>The Secretary of Agriculture may not enter into a project agreement under the pilot program under this section for a project valued at more than $10,000,000. </text></paragraph><paragraph id="id25fbd53b960543f3842f2971f9b1d2e1"><enum>(4)</enum><header>Structure of agreements</header><text>Notwithstanding any other provision of law, funds may be exchanged between non-Federal parties under a project agreement, if—</text><subparagraph id="id7a8d51d45c3140309532ba81c74c1cd5"><enum>(A)</enum><text>the project agreement uses an innovative funding model, such as pay-for-performance, or pay-for-success, under which payments are paid when specified recreation-related outcomes are met; and</text></subparagraph><subparagraph id="id8c915c3a02d64dc7badd016a7f0adf5d"><enum>(B)</enum><text>an independent evaluator determines pursuant to subsection (f) that the outcome specified in the project agreement has been met.</text></subparagraph></paragraph><paragraph id="id7fa126eed9bf4b04bbcaf65877c8e533"><enum>(5)</enum><header>Maintenance and decommissioning</header><text>A project agreement shall—</text><subparagraph id="idcfa3f8f5a42a4066b7f5bf99f54ba97b"><enum>(A)</enum><text>include a plan for maintaining any capital improvement made as part of a project after the date on which the project is completed; and</text></subparagraph><subparagraph id="ide2f22a321e0d454fa698cea4af5ac51c"><enum>(B)</enum><text>specify the party that will be responsible for decommissioning the improvements associated with the project—</text><clause id="id9a20d022ddcf44fa91ce74f89146f552"><enum>(i)</enum><text>at the end of the useful life of the improvements; or</text></clause><clause id="id81548987e1c44fe79b5368a24f9eae2a"><enum>(ii)</enum><text>if the project fails.</text></clause></subparagraph></paragraph><paragraph id="id2050becad3ac4eaabec5d2567da3956a"><enum>(6)</enum><header>Eligible payments</header><text>Under a project agreement, a conservation partner, a project broker, or the Secretary of Agriculture shall agree to pay to the other party to the project agreement any of the following:</text><subparagraph id="id2db1a90099304bfd9abbf3f05713e7cf"><enum>(A)</enum><text>A percentage of the estimated value of the outcomes achieved by the applicable project.</text></subparagraph><subparagraph id="ida905c2c3e93a43bfac47d4f76dd8413f"><enum>(B)</enum><text>A percentage of the estimated cost savings to the conservation partner or the Secretary of Agriculture as a result of the project.</text></subparagraph><subparagraph id="idf0d7eab0279c4bf097ece95acb531ad8"><enum>(C)</enum><text>A percentage of the enhanced revenue to the conservation partner or the Secretary of Agriculture as a result of the project.</text></subparagraph><subparagraph id="id40cc223b1cda45ba9fb063f32ac8e974"><enum>(D)</enum><text>The cost of the project.</text></subparagraph></paragraph><paragraph id="id1ff1f89a920a4e76983b4cb986ae1b85"><enum>(7)</enum><header>Cost-share</header><text>Subject to the availability of appropriations, the Secretary of Agriculture may only contribute funding for a project if—</text><subparagraph id="id1af50a77fa894508a6dee74897e4f01c"><enum>(A)</enum><text>the Secretary of Agriculture demonstrates the project will provide a cost savings to the United States; and</text></subparagraph><subparagraph id="idd206ae861e204717b57c82518b5c938a"><enum>(B)</enum><text>the contribution of the Secretary of Agriculture is in an amount equal to less than 50 percent of the total cost of the project.</text></subparagraph></paragraph><paragraph id="idb204301939b84f3ca03397b3df7e9148"><enum>(8)</enum><header>Consultants</header><text>Subject to the availability of appropriations, the Secretary of Agriculture may hire a contractor—</text><subparagraph id="idd6d85ece8d21405690756305d9999be1"><enum>(A)</enum><text>to conduct a feasibility analysis of a proposed project; or</text></subparagraph><subparagraph id="idd11eb2abed814ddcb707d51a5c62bbaa"><enum>(B)</enum><text>to assist in the formation or evaluation of a proposed project.</text></subparagraph></paragraph></subsection><subsection id="id986912e3883942e6b481b1adbb1fe112"><enum>(e)</enum><header>Projects</header><paragraph id="id1320db372f944a479cb3d53a5604d536"><enum>(1)</enum><header>In general</header><text>All or any portion of a project may be implemented by—</text><subparagraph id="idf4808a878bc9464c8e7da8568b92a161"><enum>(A)</enum><text>the Secretary of Agriculture; or</text></subparagraph><subparagraph id="idd2b71038c2ca40628c1e27c0d3101a05"><enum>(B)</enum><text>a conservation partner or third party, subject to the conditions that—</text><clause id="id5d484a78334540a3b93f65cd3d706e84"><enum>(i)</enum><text>the Secretary of Agriculture shall approve the implementation by the conservation partner or third party; and</text></clause><clause id="id91ec27cbd8c949d98346aa9e6a49ba25"><enum>(ii)</enum><text>the implementation shall be in accordance with applicable law.</text></clause></subparagraph></paragraph><paragraph id="id70a7849a92af4e79b44c799a95b822c5"><enum>(2)</enum><header>Relation to land and resource management plans</header><text>A project carried out under this section shall be consistent with any applicable land and resource management plan developed under section 6 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604</external-xref>).</text></paragraph><paragraph id="id9205e49bd02b4dceae9cdfe2e4e727e4"><enum>(3)</enum><header>Ownership</header><subparagraph id="idc6fd76e3801d414dbf993e1ae9b82f69"><enum>(A)</enum><header>In general</header><text>Each project shall be vested to the United States.</text></subparagraph><subparagraph id="id3d275d881d9245c9b5710c4b7e6e94fb"><enum>(B)</enum><header>Treatment</header><text>The carrying out of any action for a project does not provide any right to any party to a project agreement.</text></subparagraph></paragraph><paragraph id="id8d400ce8604444de8f6230b7ee51382f"><enum>(4)</enum><header>Potential conflicts</header><text>Before approving a project under this section, the Secretary of Agriculture shall consider and seek to avoid potential conflicts (including economic competition) with an existing authorization. </text></paragraph></subsection><subsection id="idfd14e00589ef472eb117c9283041314d"><enum>(f)</enum><header>Independent evaluations</header><paragraph id="id629cdfcc09294ce4884b55ae070a64a0"><enum>(1)</enum><header>Progress reports</header><text>An independent evaluator shall submit to the Secretary of Agriculture and each party to the relevant project agreement a written report—</text><subparagraph id="id41348f51c8db416ebd353e98aeea2293"><enum>(A)</enum><text>by not later than 2 years after the date on which a project agreement is executed, and not less frequently than once every 2 years thereafter, summarizing the progress that has been made in achieving each outcome specified in the project agreement; and</text></subparagraph><subparagraph id="id465d68e95e9340569637415bf6ee93fe"><enum>(B)</enum><text>before the first scheduled outcome payment date, and each subsequent payment date, summarizing the results of the evaluation conducted to determine whether an outcome payment should be made, together with information relating to the factors contributing to the conservation partner achieving, or failing to achieve, an outcome.</text></subparagraph></paragraph><paragraph id="idf6ef95b2fbea49769383493c04f29f37"><enum>(2)</enum><header>Final report</header><text>Not later than 180 days after the date on which a project is completed, the applicable independent evaluator shall submit to the Secretary of Agriculture and each party to the relevant project agreement a written report that includes—</text><subparagraph id="id2487df96c362475f8ea8486879c45806"><enum>(A)</enum><text>an evaluation of the effects of the project with respect to each outcome specified in the project agreement; and</text></subparagraph><subparagraph id="id2f77ed3b89a249f38009bb909e7c7ba9"><enum>(B)</enum><text>a determination of whether the conservation partner has met each outcome specified in the project agreement.</text></subparagraph></paragraph></subsection><subsection id="iddd836d245c5d42eb96ffa76ab914e008"><enum>(g)</enum><header>Termination of project agreements</header><text>The Secretary of Agriculture may unilaterally terminate a project agreement, in whole or in part, for any program year beginning after the program year during which the Secretary of Agriculture provides to each party to the project agreement a notice of the termination.</text></subsection><subsection id="idac44ddf312cd473aa54dad7c8a8b3ede"><enum>(h)</enum><header>Duration of pilot program</header><paragraph id="ida9ff3949957b4ebfa8317e16a4e78d45"><enum>(1)</enum><header>Sunset</header><text>The authority to enter into project agreements under this section terminates on September 30, 2032.</text></paragraph><paragraph id="id89303b8600244c3c98631948f4f24cfd"><enum>(2)</enum><header>Savings clause</header><text>Nothing in paragraph (1) affects any project agreement entered into by the Secretary of Agriculture pursuant to this section before the date described in that paragraph.</text></paragraph></subsection></section><section id="id91477ae395ef430aaa4b80c11c410b8c"><enum>303.</enum><header>Availability of Federal land infrastructure during shoulder seasons</header><subsection id="id0e66a0b955744f2cb70de78d785b4620"><enum>(a)</enum><header>Coordination</header><text>The Secretaries shall consult and coordinate with outdoor recreation-related businesses operating on or adjacent to Federal land, State offices of outdoor recreation, local destination marketing organizations, Indian Tribes, local governments, and institutions of higher education—</text><paragraph id="idb4b9bed372e74ec8a74b103bbd265e29"><enum>(1)</enum><text>to better understand trends with respect to visitors to the Federal land;</text></paragraph><paragraph id="id0c6de468b4af4307b640b6aa69ecf625"><enum>(2)</enum><text>to coordinate with outdoor recreation marketing campaigns; and</text></paragraph><paragraph id="idd0f661bbcf7a4aada95d97041ad4716b"><enum>(3)</enum><text>to better understand—</text><subparagraph id="id0da722a6fa1444a69f379f8bcb025b38"><enum>(A)</enum><text>the effect of seasonal closures of areas of, or infrastructure on, Federal land on outdoor recreation opportunities, adjacent businesses, and local tax revenue; and</text></subparagraph><subparagraph id="idb0353066c19d4955abca97c69f8d379e"><enum>(B)</enum><text>opportunities to extend the period of time during which areas of, or infrastructure on, Federal land are open to the public to increase outdoor recreation opportunities and associated revenues for businesses and local governments.</text></subparagraph></paragraph></subsection><subsection id="idfe981fdf81f24e93bb110cda4fa8ed76"><enum>(b)</enum><header>Availability of infrastructure</header><text>The Secretaries shall make efforts to make infrastructure available to accommodate increased visitation to the Federal land during shoulder seasons—</text><paragraph id="id36a641c0d5cd4041a3be4f5300c06ae9"><enum>(1)</enum><text>to extend the outdoor recreation season and the duration of income to gateway communities; and</text></paragraph><paragraph id="ide9ad06acbac741a99e3f9c8ad60d4e28"><enum>(2)</enum><text>to provide more opportunities to visit resources on Federal land to reduce crowding during peak seasons.</text></paragraph></subsection><subsection id="id9a2de7578f3a4ba89bf696e6735fda9e"><enum>(c)</enum><header>Agreements</header><paragraph id="id36bac753bdd54208a533bb19941430a2"><enum>(1)</enum><header>In general</header><text>The Secretaries may enter into agreements with businesses, local governments, or other entities to share the cost of additional expenses necessary to extend the period of time during which an area of, or infrastructure on, Federal land is made open to the public.</text></paragraph><paragraph id="ida48a00fffe6a4a8f8a7a3b58a3a06faa"><enum>(2)</enum><header>In-kind contributions</header><text>The Secretaries may accept in-kind contributions of goods and services provided by businesses, local governments, or other entities for purposes of paragraph (1).</text></paragraph></subsection></section><section id="id5fc8dcea490541759a70e636c7c0089d"><enum>304.</enum><header>Public-private partnerships to modernize campgrounds on Federal land</header><subsection id="id834bd57cc25e4dd6be128d6a47060e6f"><enum>(a)</enum><header>In general</header><text>The Secretaries shall establish a pilot program under which the Secretary concerned may enter into an agreement with a private entity providing for capital improvements (including the construction of structures and improvements), management, and maintenance by the private entity of a campground, in existence on the date of enactment of this Act, on Federal land, subject to the requirements of this section.</text></subsection><subsection id="idbb7ef50d91ca409ea1144b799323f398"><enum>(b)</enum><header>Minimum number of agreements</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary concerned shall enter into at least 1 agreement under subsection (a) in—</text><paragraph id="id46512a9756994a0eb0ae82aefd0c61e1"><enum>(1)</enum><text>a unit of the National Forest System in each region of the National Forest System; and</text></paragraph><paragraph id="id2a879f25357146dc9199830ccef4ae08"><enum>(2)</enum><text>Federal land administered by the Bureau of Land Management in not fewer than 5 States in which the Bureau of Land Management administers Federal land.</text></paragraph></subsection><subsection id="id41b045abe12649be805e13ca764ea56b"><enum>(c)</enum><header>Requirements</header><paragraph id="ided0d82685b8a42c6b6129e7385345136"><enum>(1)</enum><header>Plans</header><text>Before entering into an agreement under subsection (a), the private entity shall submit to the Secretary concerned a development plan that—</text><subparagraph id="id0d3bca3d9c964fa69fc8bcc20530f169"><enum>(A)</enum><text>describes investments in the campground to be made by the private entity during the first 3 years of the agreement;</text></subparagraph><subparagraph id="id26c7371060dd42deafd734fd3535ba0d"><enum>(B)</enum><text>describes annual maintenance spending for each year of the agreement; and</text></subparagraph><subparagraph id="id876de6e3fbf04ecdadf45b490ecd0d54"><enum>(C)</enum><text>includes any other terms and conditions determined to be necessary by the Secretary concerned.</text></subparagraph></paragraph><paragraph id="idff8d036863394c64a956bc9e28e57115"><enum>(2)</enum><header>Agreements</header><text>An agreement entered into under subsection (a) shall—</text><subparagraph id="id60457a11acec45a191647cce081130d9"><enum>(A)</enum><text>be for a term of not more than 30 years;</text></subparagraph><subparagraph id="id2745569063b2478192b3ea50d6e48e7a"><enum>(B)</enum><text>require that, not later than 3 years after the date on which the Secretary concerned enters into an agreement the private entity expend, or place in an escrow account for expenditure, for the construction or improvement of structures and infrastructure relating to the operation of, or access to, the applicable campground, not less than $2,000,000, or a specified percentage, as determined by the Secretary concerned, of the anticipated receipts for the period of the agreement;</text></subparagraph><subparagraph id="ided4753dee2b641c5b59fe8a467c0622b"><enum>(C)</enum><text>require the private entity to maintain the campground facility and any associated infrastructure designated by the Secretary concerned in a manner acceptable to the Secretary concerned and the private entity;</text></subparagraph><subparagraph id="id6f9d774d2cfb4bb2ab764e8ce37127f5"><enum>(D)</enum><text>include any terms and conditions that the Secretary concerned determines to be necessary for a recreational special use permit issued under section 7 of the Act of April 24, 1950 (commonly known as the <quote>Granger-Thye Act</quote>) (64 Stat. 84, chapter 97; <external-xref legal-doc="usc" parsable-cite="usc/16/580d">16 U.S.C. 580d</external-xref>), including the payment described in subparagraph (E); </text></subparagraph><subparagraph id="id3e3c4b6fcfba4b79a50718a712b6ee42"><enum>(E)</enum><text>provide for payment to the Federal Government of a fee consistent with a special use permit under section 7 of the Act of April 24, 1950 (commonly known as the <quote>Granger-Thye Act</quote>) (64 Stat. 84, chapter 97; <external-xref legal-doc="usc" parsable-cite="usc/16/580d">16 U.S.C. 580d</external-xref>), including a fee offset agreement for work to be performed that is separate from maintaining the campground facility and any associated infrastructure designated by the Secretary concerned, if determined to be appropriate by the Secretary concerned, on consideration of the probable value to the private entity of the rights provided by the agreement, taking into account the capital invested by, and obligations of, the private entity under the agreement;</text></subparagraph><subparagraph id="id9095c6ea5f2945218e73f3cd30da1dfc"><enum>(F)</enum><text>include provisions that state—</text><clause id="id7609d9dffff345788649241a6750f184"><enum>(i)</enum><text>the private entity shall obtain no property interest pursuant to the expenditures of the private entity, as required by the agreement; and</text></clause><clause id="id4d974a59d6e542bba5ff0c6f5b7f4271"><enum>(ii)</enum><text>all structures and improvements constructed by the private entity under the agreement shall be the property of the United States; and</text></clause></subparagraph><subparagraph id="id418fb69ed08d4ddbafa33d2e91add697"><enum>(G)</enum><text>be subject to any other terms and conditions determined to be necessary by the Secretary concerned.</text></subparagraph></paragraph></subsection><subsection id="id777d18cc46d64c009f27baa3d9d8b6af" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Fee retention</header><text>A fee or revenue shared with the Secretary concerned under an agreement authorized by this section shall be available for expenditure by the Secretary concerned for recreation-related purposes on the unit of Federal land at which the fee or revenue is collected, without further appropriation. </text></subsection></section></title></legis-body></bill>
