which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20221212">December 12, 2022</action-date><action-desc>Reported by <sponsor name-id="S275">Ms. Cantwell</sponsor>, with an amendment</action-desc><action-instruction>Omit the part struck through and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To improve the efficient movement of freight at ports in the United States, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Facilitating Relief for Efficient Intermodal Gateways to Handle Transportation Act</short-title></quote> or the <quote><short-title>FREIGHT Act</short-title></quote>.</text></section><section id="idcd798984392e4f29807bbc53c8a6baed" changed="deleted" reported-display-style="strikethrough"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id366012D40C7941A0B621C5E1585E4214"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Maritime Commission.</text></paragraph><paragraph id="id91F11133163D4A2A850838EC98460801"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph></section><section id="id3F20B1EC9E444568A4949D6D74CEE1BB" changed="deleted" reported-display-style="strikethrough"><enum>3.</enum><header>Grant program to improve movement of freight</header><subsection id="id74c69b10462b4b7d96ab34d666f0da8a"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idcc3083125382497f84c1b1934775d413"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="id225ecb7d447c438da90e1f3bde13a847"><enum>(A)</enum><text>a port authority;</text></subparagraph><subparagraph id="idb6987d766d48463ebd15a60d1c2618a0"><enum>(B)</enum><text>a State entity; and</text></subparagraph><subparagraph id="id50ee4633459d430a87de7fe3616523f1"><enum>(C)</enum><text>a local entity.</text></subparagraph></paragraph><paragraph id="id061a099c1e6d416282a959eeea8ca919"><enum>(2)</enum><header>Program</header><text>The term <term>program</term> means the discretionary grant program established under subsection (b).</text></paragraph></subsection><subsection id="idd53b0befa730424dada7a02d52eaa4a8"><enum>(b)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish, within the Office of the Secretary, a discretionary grant program relating to improving the efficient movement of freight at ports.</text></subsection><subsection id="id79669b31182044e8813d5724cefb2ac9"><enum>(c)</enum><header>Goals</header><text>The goals of the program shall be to fund, through the provision of 1 or more grants, planning projects that—</text><paragraph id="id7515b9e78e284674a3362dad1f02ad0c"><enum>(1)</enum><text>identify what would be needed for eligible entities—</text><subparagraph id="id9f479411aed647f38609e7aeffec4cd4"><enum>(A)</enum><text>to standardize the definitions of terms used in port operations and related documentation, including—</text><clause id="id4754f26da8b848d1a38e359eea88e117"><enum>(i)</enum><text>terms used in bills of lading;</text></clause><clause id="id4cd0fb0d9b9341ca925ccaddf6ab143d"><enum>(ii)</enum><text>the terms used to identify various port call processes; and</text></clause><clause id="id493e5ecd87684ba091f1c60c9d279c77"><enum>(iii)</enum><text>terms used to notify relevant stakeholders that the freight of those stakeholders is available; or</text></clause></subparagraph><subparagraph id="id0791ecc746e94d868656eb042a0e1ddd"><enum>(B)</enum><text>to develop the technology needed to improve communication of eligible entities with respect to freight location, availability, and equipment among—</text><clause id="ida6276a2fe67940edb585f8438ba9e5d0"><enum>(i)</enum><text>port authorities;</text></clause><clause id="id61cd2f36f2e74498b0f60e3dffc2eab8"><enum>(ii)</enum><text>marine terminal operators;</text></clause><clause id="id9289a8bce4374c3c96332f77b7610171"><enum>(iii)</enum><text>shippers;</text></clause><clause id="idd2a022af65b245f48dd938db95b6668b"><enum>(iv)</enum><text>rail carriers;</text></clause><clause id="id6a2a2f928a664bedab66dfea8e3ecaf3"><enum>(v)</enum><text>motor carriers and drayage providers; and</text></clause><clause id="idd03f0e0f72a64856ada081c43181111c"><enum>(vi)</enum><text>other relevant stakeholders; and</text></clause></subparagraph></paragraph><paragraph id="id5fa15850da024db283ef90835688111b"><enum>(2)</enum><text>result in a planning document described in subsection (e).</text></paragraph></subsection><subsection id="id40dfdb9f10d2499eaa9889c981374c12"><enum>(d)</enum><header>Application</header><text>To be eligible to receive a grant under the program, an eligible entity shall submit to the Secretary an application, at such time, in such manner, and containing such information as the Secretary may require, including a description of the means by which the eligible entity will incorporate the views and input of other port stakeholders in identifying what would be needed to standardize the definitions described in subsection (c)(1)(A) and develop the technology described in subsection (c)(1)(B).</text></subsection><subsection id="idda1f10a32db04ff89386c167fa724a4c"><enum>(e)</enum><header>Planning document</header><text>Each eligible entity that receives a grant under the program shall develop and submit to the Secretary, at such time as the Secretary determines to be appropriate, a planning document that—</text><paragraph id="id2fd2cf35745c413b9208ed41ba06da1b"><enum>(1)</enum><text>identifies what would be necessary to standardize the applicable definitions;</text></paragraph><paragraph id="id55bf6190730a4e8e82529837f667c752"><enum>(2)</enum><text>identifies what would be necessary to develop the applicable technology;</text></paragraph><paragraph id="id7ef24929589746d4ac25083c11ea3614"><enum>(3)</enum><text>includes input from relevant stakeholders, such as marine terminal operators, port authorities, State and local governments, ocean carriers, barge operators, motor carriers, rail carriers, drayage providers, chassis providers, and freight forwarders and brokers; and</text></paragraph><paragraph id="id6d2b389309bb49918906a44e323cbc78"><enum>(4)</enum><text>addresses concerns regarding data privacy.</text></paragraph></subsection><subsection id="id700f20ca0d944500be5f0a0cf35175bb"><enum>(f)</enum><header>Project requirements</header><paragraph id="id4bf672d30a484494a4c1d818b0bd7ea7"><enum>(1)</enum><header>Federal share</header><text>The Federal share of the total costs of a project for which a grant is provided under the program shall be not more than 50 percent.</text></paragraph><paragraph id="idfc9c5258c59d41a5949e2c8069b72dd0"><enum>(2)</enum><header>Maximum grant amount</header><text>The maximum amount of a grant provided under the program shall be $1,000,000.</text></paragraph><paragraph id="id218f109871ec45319d5b3f1f666cbbeb"><enum>(3)</enum><header>Eligible expenses</header><text>A grant provided under the program may be used for eligible project expenses, including—</text><subparagraph id="ide513d5d6e3cf4594b8f666f17911ff70"><enum>(A)</enum><text>communications hardware and software;</text></subparagraph><subparagraph id="id8314675ad073456f8bc5249e42d769ef"><enum>(B)</enum><text>data management hardware and software; and</text></subparagraph><subparagraph id="id5df1ad6d736142d096e348c9047db2f9"><enum>(C)</enum><text>planning and engineering costs.</text></subparagraph></paragraph></subsection><subsection id="ide4ced2daffb44601b289b040b582df46"><enum>(g)</enum><header>Grant information</header><text>At the request of an eligible entity that receives a grant under the program, the Secretary shall provide to the eligible entity information relating to other grant programs offered through the Department of Transportation under which the planning projects of the eligible entity under the program may be considered to be an eligible activity.</text></subsection><subsection id="id4df1a5b18c8142d3803eb1edfb919806"><enum>(h)</enum><header>Lessons learned</header><text>The Secretary shall—</text><paragraph id="idaf8be64d74ca4d0fa8969f1023132722"><enum>(1)</enum><text>analyze the information contained in each planning document submitted under subsection (e); and</text></paragraph><paragraph id="id5f2ea50a54fe4b308e3756d921a89ec8"><enum>(2)</enum><text>develop and make publicly available lessons learned with respect to standardizing port definitions and communications technology based on that information.</text></paragraph></subsection><subsection id="id747ba4dac5a84161865abbcec97c7316"><enum>(i)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this section $2,500,000 for fiscal year 2023.</text></subsection></section><section id="ide2b6075c073d4276bb39b5b6fc2fbe9e" changed="deleted" reported-display-style="strikethrough"><enum>4.</enum><header>Study on documentation and terms used in freight transportation</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall enter into an agreement with the National Academy of Sciences under which the National Academy of Sciences shall carry out a study—</text><paragraph id="idccaa22080c45423590c45ef6fcb94e48"><enum>(1)</enum><text>to identify and document—</text><subparagraph id="idfb21cdbf7dfe461f943397f307cb2929"><enum>(A)</enum><text>the documentation, the data and information exchange, and other actions necessary to transport freight from a point of origin overseas to a destination in the United States, or from a point of origin in the United States to a destination overseas, including transportation of the freight—</text><clause id="idaaccd6bd92264cb8bc30e403d5003f93"><enum>(i)</enum><text>from the point of origin to an ocean carrier;</text></clause><clause id="id49c1c5acd8c249ee802ddcb3258a0750"><enum>(ii)</enum><text>on an ocean carrier;</text></clause><clause id="id5ca6701f8d384014b1899a78d312068a"><enum>(iii)</enum><text>through any port; and</text></clause><clause id="idd41c5178c5df4b0c8f3387fa9beeaae3"><enum>(iv)</enum><text>by rail or truck from a port to the destination;</text></clause></subparagraph><subparagraph id="id12a6dcfce3bc47b0be8f7845398d6b8b"><enum>(B)</enum><text>whether and how the key terms used in that documentation or the data and information exchanged, or to describe various actions to move freight, vary depending on—</text><clause id="idb039840a2ab541c1a8a8d7058fba1df5"><enum>(i)</enum><text>the type of freight being moved;</text></clause><clause id="idcd5b1b689139437b9913a643a440c6ec"><enum>(ii)</enum><text>the mode by which the freight moves;</text></clause><clause id="id1c8dce71a5e24969953564cf1c10cd1f"><enum>(iii)</enum><text>whether the freight is required to be moved by multiple modes;</text></clause><clause id="id90bb67306e784f008d6064cbd6d0f3ee"><enum>(iv)</enum><text>the State or region in the United States from, through, or to which the freight moves;</text></clause><clause id="id443dd2fab022492ea07ab372464e144d"><enum>(v)</enum><text>the port or marine terminal operator;</text></clause><clause id="id626e3719b6e04505a41b550ef14a056d"><enum>(vi)</enum><text>the origination or destination of the freight; and</text></clause><clause id="idf45a0bc273d24d4fa22ce263da906f66"><enum>(vii)</enum><text>other relevant criteria; and</text></clause></subparagraph><subparagraph id="id8dfba5da5c714d38b9f572422ed463c1"><enum>(C)</enum><text>recommendations with respect to means to rationalize existing terms, documentation, and data and information exchanged to enable port stakeholders to better track and manage freight transfer and delivery; and</text></subparagraph></paragraph><paragraph id="id00584964c8af4a049aa81b85e4bec7c6"><enum>(2)</enum><text>to assess and determine—</text><subparagraph id="id2b29af8b923f433b90c8e7e386e04dd1"><enum>(A)</enum><text>the data held and shared across existing, separate data systems used in international transportation across different modes of transportation, with respect to methods to link those data across the existing, separate data systems;</text></subparagraph><subparagraph id="id2fdf19f68f6d467f8b6afa42ee081ee7"><enum>(B)</enum><text>the best methods to link and enable effective exchange of those data across existing systems, both domestically and internationally;</text></subparagraph><subparagraph id="id879673226ef24298a5d1534db5e69736"><enum>(C)</enum><text>methods to standardize data obtained from long-standing separate data systems; and</text></subparagraph><subparagraph id="id026bd6d1914743fe8faafadf3a3eec0e"><enum>(D)</enum><text>gaps in existing data and technology standards that would be necessary to address the development of systems to allow port stakeholders to better track and predict—</text><clause id="id81c45c26c0a24f0e9cb54e0252ac31c6"><enum>(i)</enum><text>the location of freight at ports;</text></clause><clause id="idb367f9e209104dcfb98e34ea28a0f1d1"><enum>(ii)</enum><text>the availability of freight for pickup; and</text></clause><clause id="id0e336148e61545b2bc2dd587c84b29e8"><enum>(iii)</enum><text>the ability to receive and return equipment at ports.</text></clause></subparagraph></paragraph></section><section id="idb38d854b370245c08c959b9fe8806077" changed="deleted" reported-display-style="strikethrough"><enum>5.</enum><header>Dwell time statistics</header><subsection id="id1a1e1d337dfb4399aaab6719acca3b93"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id764c0b07f9174f489b1a8c2299d049e4"><enum>(1)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Bureau of Transportation Statistics.</text></paragraph><paragraph id="ida0a25570305d4957a6de4f9b89ccd8cc"><enum>(2)</enum><header>Dwell time</header><text>The term <term>dwell time</term>, with respect to a piece of equipment, means the quantity of time during which the piece of equipment is—</text><subparagraph id="id515f2e88908d41e9a1a0115d59c7f0f9"><enum>(A)</enum><text>subject to maintenance; or</text></subparagraph><subparagraph id="idec5deeab6086495e96fe7f0da0dfcad9"><enum>(B)</enum><text>in use.</text></subparagraph></paragraph><paragraph id="idf78e63aead36445fba59669bafd4ef87"><enum>(3)</enum><header>Marine container</header><text>The term <term>marine container</term> means an intermodal container with a length of—</text><subparagraph id="id3453daf45cee4b379134fccbaa98ac08"><enum>(A)</enum><text>not less than 20 feet; and</text></subparagraph><subparagraph id="idbae1a8e0958c44fb9dbbde182a1db800"><enum>(B)</enum><text>not greater than 45 feet.</text></subparagraph></paragraph></subsection><subsection id="idfc0600fe01c3446c9a05c4eb1a92a00c"><enum>(b)</enum><header>Authority To collect data</header><paragraph id="ida04a6364893447058fbb72167281258f"><enum>(1)</enum><header>In general</header><text>Each port, marine terminal operator, and chassis provider shall submit to the Director such data as the Director determines to be necessary for the implementation of this section, subject to subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code.</text></paragraph><paragraph id="id46c6165725464c6ca9b6d83878f0db2b"><enum>(2)</enum><header>Approval by OMB</header><text>The Director of the Office of Management and Budget shall approve an information collection for purposes of this section by not later than 60 days after the date of enactment of this Act.</text></paragraph></subsection><subsection id="id48ec5b796cd94ebf8c86cce426a1a961"><enum>(c)</enum><header>Publication</header><text>Not later than 240 days after the date of enactment of this Act, and not less frequently than monthly thereafter, the Director shall publish statistics relating to the dwell time of equipment used in intermodal transportation, including—</text><paragraph id="idc38691f441db4d1b9faef898bf57286f"><enum>(1)</enum><text>total dwell time, from all causes, of marine containers and marine container chassis; and</text></paragraph><paragraph id="ide2b211124a1b43b490b463941f46d832"><enum>(2)</enum><text>at a minimum, maintenance dwell time and in-use dwell time of marine containers and marine container chassis.</text></paragraph></subsection><subsection id="id594272c650354ccb8fa76e7e5273e11d"><enum>(d)</enum><header>Factors</header><text>To the maximum extent practicable, the Director shall publish the statistics described in subsection (c)—</text><paragraph id="id827247be133f4a1c8efc4d68dec29ed0"><enum>(1)</enum><text>on a local, regional, and national basis; and</text></paragraph><paragraph id="iddcedcdc64eba4c34b8c4fb116c23ea4a"><enum>(2)</enum><text>at major coastal and inland port facilities.</text></paragraph></subsection></section><section id="idb887fd518ea7438aa8d939d3cc6d2953" changed="deleted" reported-display-style="strikethrough"><enum>6.</enum><header>Federal Maritime Commission activities</header><subsection id="idcd40d3ee6d7e497fa9ed52419aad02c7"><enum>(a)</enum><header>Public submissions to Commission</header><text>The Chairperson of the Commission shall—</text><paragraph id="id039eca22277d46738978dd2fa92065d5"><enum>(1)</enum><text>establish on the public website of the Commission a webpage that allows for the submission of comments, complaints, concerns, reports of noncompliance, requests for investigation, and requests for alternative dispute resolution; and</text></paragraph><paragraph id="id93e0b697845d43a69a278bea4334479c"><enum>(2)</enum><text>direct each submission under the link established under paragraph (1) to the appropriate component office of the Commission.</text></paragraph></subsection><subsection id="id91554f7f85c14f1c973a844eca72714a"><enum>(b)</enum><header>Authorization of Office of Consumer Affairs and Dispute Resolution Services</header><text>The Commission shall maintain an Office of Consumer Affairs and Dispute Resolution Services to provide nonadjudicative ombuds assistance, mediation, facilitation, and arbitration to resolve challenges and disputes involving cargo shipments, household good shipments, and cruises subject to the jurisdiction of the Commission.</text></subsection><subsection id="id5fe3e48ccf434a64ba736e833aae3474"><enum>(c)</enum><header>Enhancing capacity for investigations</header><paragraph id="id40ac964a9174420bb820cd1520ce9626"><enum>(1)</enum><header>In general</header><text>Pursuant to section 41302 of title 46, United States Code, not later than 18 months after the date of enactment of this Act, the Chairperson of the Commission shall staff within the Bureau of Enforcement, the Bureau of Certification and Licensing, the Office of the Managing Director, the Office of Consumer Affairs and Dispute Resolution Services, and the Bureau of Trade Analysis not fewer than 7 total positions to assist in investigations and oversight, in addition to the positions within the Bureau of Enforcement, the Bureau of Certification and Licensing, the Office of the Managing Director, the Office of Consumer Affairs and Dispute Resolution Services, and the Bureau of Trade Analysis on that date of enactment.</text></paragraph><paragraph id="iddff6c90b22c048459c7ddbc7a5177d15"><enum>(2)</enum><header>Duties</header><text>The additional staff appointed under paragraph (1) shall provide support—</text><subparagraph id="id80bab2e05f06430eba3ccd877e8146be"><enum>(A)</enum><text>to Area Representatives of the Bureau of Enforcement;</text></subparagraph><subparagraph id="idb2c0d39c19d94ad28824d49cd41a3fea"><enum>(B)</enum><text>to attorneys of the Bureau of Enforcement in enforcing the laws and regulations subject to the jurisdiction of the Commission;</text></subparagraph><subparagraph id="id5934a964ccaa4be3b984dfae2d2dacba"><enum>(C)</enum><text>for the alternative dispute resolution services of the Commission; or</text></subparagraph><subparagraph id="id66b032deec3e4f85b76d92d8b1d3d8a8"><enum>(D)</enum><text>for the review of agreements and activities subject to the authority of the Commission.</text></subparagraph></paragraph></subsection></section><section id="id8ee2be9b640c46ea88ac79e470033ee3" changed="deleted" reported-display-style="strikethrough"><enum>7.</enum><header>Best practices for chassis pools</header><subsection id="idf6673e03e6e34a28b1c0c0447e6fef8b"><enum>(a)</enum><header>In general</header><text>Not later than April 1, 2023, the Commission shall enter into an agreement with the Transportation Research Board of the National Academies of Sciences, Engineering, and Medicine under which the Transportation Research Board shall carry out a study and develop best practices for on-terminal or near-terminal chassis pools that provide service to marine terminal operators, motor carriers, railroads, and other stakeholders that use the chassis pools, with the goal of optimizing supply chain efficiency and effectiveness.</text></subsection><subsection id="id4b9a41e1c635490cb6b6129fcb9e64eb"><enum>(b)</enum><header>Requirements</header><text>In developing best practices under subsection (a), the Transportation Research Board shall—</text><paragraph id="id3c27e29ce3dc4d89baa988ca7d4e9d35"><enum>(1)</enum><text>take into consideration—</text><subparagraph id="ide2dc1d5e6c9e4bdebd4124eedc7dcd9f"><enum>(A)</enum><text>practical obstacles to the implementation of chassis pools; and</text></subparagraph><subparagraph id="id1b3e3c40481f4ce7a0862c3e5e9ae7eb"><enum>(B)</enum><text>potential solutions to those obstacles; and</text></subparagraph></paragraph><paragraph id="ideba9acd0c420405eb3fbcf74cc38ca7c"><enum>(2)</enum><text>address relevant communication practices, information sharing, and knowledge management.</text></paragraph></subsection><subsection id="idf5a9ee4435b4496183a9c0627275c385"><enum>(c)</enum><header>Publication</header><text>The Commission shall publish the best practices developed under this section on a publicly available website by not later than April 1, 2024.</text></subsection><subsection id="idca00fe2b94614a1ca382f985ac6a1bca"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Commission to carry out this section $500,000.</text></subsection></section><section id="id6753a03179e84a11a1d941f6c11f9e2f" changed="deleted" reported-display-style="strikethrough"><enum>8.</enum><header>Enhancing anti-retaliation protections</header><subsection id="id731ca64295bc4ed6810ae462db9cc213"><enum>(a)</enum><header>General prohibitions</header><text>Section 41102 of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf0e28222feaa46a28c3d0c354ab4e094" changed="deleted" reported-display-style="strikethrough"><subsection id="idd0556da7f1ae4037865b516d4bec3e6a"><enum>(d)</enum><header>Retaliation and other discriminatory actions</header><text>A common carrier, marine terminal operator, or ocean transportation intermediary, acting alone or in conjunction with any other person, directly or indirectly, may not—</text><paragraph id="id136533c772b847fa9bc17f620d9d3cce"><enum>(1)</enum><text>retaliate against a shipper, an agent of a shipper, an ocean transportation intermediary, or a motor carrier by refusing, or threatening to refuse, an otherwise-available cargo space accommodation; or</text></paragraph><paragraph id="idee38e19b4d1146d898ab8ddae2fae05b"><enum>(2)</enum><text>resort to any other unfair or unjustly discriminatory action for—</text><subparagraph id="id9fd9effc6e9f4d378b2ba547a42494f7"><enum>(A)</enum><text>the reason that a shipper, an agent of a shipper, an ocean transportation intermediary, or motor carrier has—</text><clause id="idc001d47e349140b49636ef91f390f9ac"><enum>(i)</enum><text>patronized another carrier; or</text></clause><clause id="id48b2d55028524689bf558ad9e65ea7c2"><enum>(ii)</enum><text>filed a complaint against the common carrier, marine terminal operator, or ocean transportation intermediary; or</text></clause></subparagraph><subparagraph id="id171826c733254ee995084f5edd2d3db9"><enum>(B)</enum><text>any other reason.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idddebb70d8a4846228a760e9e79d9e73c"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="idccbc8cde7a394b698a6d276114c64dff"><enum>(1)</enum><text>Section 41104 of title 46, United States Code, is amended—</text><subparagraph id="ide7e19a31369a4d31a35a69f6f3b8dcd0"><enum>(A)</enum><text>in subsection (a)—</text><clause id="idaa210c8914d94badbddcb959166258a2"><enum>(i)</enum><text>by striking paragraph (3); or</text></subparagraph><subparagraph id="id36296843fa904a96b6ba80d17a1a004f"><enum>(B)</enum><text>in addition to, or in lieu of, assessing a civil penalty under subparagraph (A), order a refund of money (including additional amounts in accordance with section 41305(c)), subject to subsection (b)(2); and</text></subparagraph></paragraph><paragraph id="id7b19c909196b4a8ba83564387c73e88b"><enum>(2)</enum><text>compromise, modify, or remit, with or without conditions, a civil penalty or refund imposed under paragraph (1).</text></paragraph></subsection><subsection id="ide891681478e04d8fb60ed9aa2b7639f8"><enum>(b)</enum><header>Determination of amount</header><paragraph id="id5b7e95a2a9d44639942b56173856d4c8"><enum>(1)</enum><header>Factors for consideration</header><text>In determining the amount of a civil penalty assessed or refund of money ordered pursuant to subsection (a), the Federal Maritime Commission shall take into consideration—</text><subparagraph id="id20864b73b5e445acb32764fbf3279dad"><enum>(A)</enum><text>the nature, circumstances, extent, and gravity of the violation committed;</text></subparagraph><subparagraph id="idcf18d90d832d4a4b9914233b489717d5"><enum>(B)</enum><text>with respect to the violator—</text><clause id="idfd9388c55ce44b9082f3eb97d2d5005c"><enum>(i)</enum><text>the degree of culpability;</text></clause><clause id="idaf07db35b4884a279fb634f4280cdfaa"><enum>(ii)</enum><text>any history of prior offenses;</text></clause><clause id="idd61f6a3404d240a19e364ca8fd061102"><enum>(iii)</enum><text>the ability to pay; and</text></clause><clause id="id09e969102a5f4a0dbb61dbb4d02bcf7b"><enum>(iv)</enum><text>such other matters as justice may require; and</text></clause></subparagraph><subparagraph id="idd9becb3140f04b4c9c0379354d9ed5d2"><enum>(C)</enum><text>the amount of any refund of money ordered pursuant to subsection (a)(1)(B).</text></subparagraph></paragraph><paragraph id="id48ca31bf5a1f4d83b4b250c1694965b1"><enum>(2)</enum><header>Commensurate reduction in civil penalty</header><subparagraph id="idef3a624a2ef548d19c1293950c3d93c6"><enum>(A)</enum><header>In general</header><text>In any case in which the Federal Maritime Commission orders a refund of money pursuant to subsection (a)(1)(B) in addition to assessing a civil penalty pursuant to subsection (a)(1)(A), the amount of the civil penalty assessed shall be decreased by any additional amounts included in the refund of money in excess of the actual injury (as defined in section 41305(a)).</text></subparagraph><subparagraph id="idD876FE5196B6458487C20126BFFEFB09"><enum>(B)</enum><header>Treatment of refunds</header><text>A refund of money ordered pursuant to subsection (a)(1)(B) shall be—</text><clause id="id4575f78069a04ca3b00a5384a130c221"><enum>(i)</enum><text>considered to be compensation paid to the applicable claimant; and</text></clause><clause id="ide3619b5c8bce44d7a020f63a151be379"><enum>(ii)</enum><text>deducted from the total amount of damages awarded to that claimant in a civil action against the violator relating to the applicable violation.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id47ff0a3e4f564c5ca48d71f6a245e751"><enum>(2)</enum><text>in subsection (c), by striking <quote>may not be imposed</quote> and inserting <quote>or refund of money under subparagraph (A) or (B), respectively, of subsection (a)(1) may not be imposed</quote>;</text></paragraph><paragraph id="id443284d5c3bd42199846c69fea1d6bfa"><enum>(3)</enum><text>in subsection (e), by inserting <quote>or order a refund of money</quote> after <quote>penalty</quote>;</text></paragraph><paragraph id="id49a77a5e51ad42e59a9610693c70564a"><enum>(4)</enum><text>in subsection (f), by inserting <quote>, or that is ordered to refund money,</quote> after <quote>assessed</quote>; and</text></paragraph><paragraph id="idf54efe2ef5794f919509658f1f0f41a2"><enum>(5)</enum><text>in subsection (g), in the first sentence, by inserting <quote>or a refund required under this section</quote> after <quote>penalty</quote>.</text></paragraph></subsection><subsection id="id1791743a1567438d841e69701e44e36b"><enum>(b)</enum><header>Enforcement of reparation orders</header><text>Section 41309 of title 46, United States Code, is amended—</text><paragraph id="idae58d93a93814ec38887b7fdc57525ae"><enum>(1)</enum><text>in subsection (a), by striking <quote>reparation, the person to whom the award was made</quote> and inserting <quote>a refund of money or reparation, the person to which the refund or reparation was awarded</quote>; and</text></paragraph><paragraph id="id9c715d6101b6451ebedb5fa0814d0f30"><enum>(2)</enum><text>in subsection (b), in the first sentence—</text><subparagraph id="id70dfbe373ff04da4b7ffd70006fbebef"><enum>(A)</enum><text>by striking <quote>made an award of reparation</quote> and inserting <quote>ordered a refund of money or any other award of reparation</quote>; and</text></subparagraph><subparagraph id="idc8f194a0178443b6b576e6903476c68f"><enum>(B)</enum><text>by inserting <quote>(except for the Commission or any component of the Commission)</quote> after <quote>parties in the order</quote>.</text></subparagraph></paragraph></subsection></section><section id="idd039ac08cba74a28b5cc3cc980f4467e" changed="deleted" reported-display-style="strikethrough"><enum>10.</enum><header>Port infrastructure performance</header><subsection id="id19706393d1194af7986249ce7675cd26"><enum>(a)</enum><header>Port and intermodal improvement program</header><paragraph id="idc02ef9c8d3294d5cb2d661992f56a78a"><enum>(1)</enum><header>Definition of qualifying port authority</header><text>In this subsection, the term <term>qualifying port authority</term> means a container port that is included in the top 10 container ports with respect to the handling of 20-foot equivalent units of containerized cargo, as determined in accordance with the most recent documentation published by the Secretary.</text></paragraph><paragraph id="id69dae5da5be94ca6bb49a1ca67ced2c3"><enum>(2)</enum><header>Data-sharing agreement</header><subparagraph id="id13B1D44E085A490F81055162A7E46BD7"><enum>(A)</enum><header>In general</header><text>As a condition of receipt of a grant under title 23 or 49, United States Code, a qualifying port authority shall enter into a data-sharing agreement under which the qualifying port authority shall submit to the Secretary the data described in paragraph (3), with a particular emphasis on cargo throughput data, subject to subparagraphs (B) and (C).</text></subparagraph><subparagraph id="id323e26b27fed441c94fd5e0dcb1394df"><enum>(B)</enum><header>Consultation</header><text>To the maximum extent practicable, to avoid duplicative reporting of data, the Secretary shall coordinate with the Commissioner of U.S. Customs and Border Protection to receive data previously collected by U.S. Customs and Border Protection for purposes of this subsection. </text></subparagraph><subparagraph id="id60084728f06843239e755fe0a39362a8"><enum>(C)</enum><header>Discretion of Secretary</header><text>If the Secretary determines that any data referred to in subparagraph (A) are not feasible to collect, the Secretary may exclude a qualifying port authority from the requirement to submit those data.</text></subparagraph></paragraph><paragraph id="id5899488069694c6c80a724a5ca5728f8"><enum>(3)</enum><header>Inclusions</header><text>The data referred to in paragraph (2)(A) include data collected by a qualifying port authority relating to—</text><subparagraph id="idd2d9f603a93b4bc4b3ba1a2bcc1c9995"><enum>(A)</enum><text>the total capacity of inbound and outbound cargo;</text></subparagraph><subparagraph id="idbd401e596a104559a1d3b1ef97fa6739"><enum>(B)</enum><text>the total volume of inbound and outbound cargo;</text></subparagraph><subparagraph id="idd61ffcfe61344b6e8bfd9cf717cba430"><enum>(C)</enum><text>the average number of lifts per hour of containers by crane;</text></subparagraph><subparagraph id="idbf56cf220cff4bb2bccb1d7a665ecb16"><enum>(D)</enum><text>the average vessel turn time, expressed by vessel type;</text></subparagraph><subparagraph id="id6b79b52b59e842e2a329888e609d7cc9"><enum>(E)</enum><text>the average cargo, container, and intermodal equipment dwell time;</text></subparagraph><subparagraph id="id003628443d2e458d90e7def5ccbb5c1a"><enum>(F)</enum><text>port storage capacity and utilization;</text></subparagraph><subparagraph id="idf0ffee8f84524420be5d79e7fb8abe4e"><enum>(G)</enum><text>modal throughput statistics, including—</text><clause id="id83eb8380f4ff4e9c868b08485f868938"><enum>(i)</enum><text>rail statistics; and</text></clause><clause id="id8800354e6e27416b9039a2d375e59895"><enum>(ii)</enum><text>statistics relating to the time required for any single individual or truck trailer to return to the same port or port terminal (commonly known as <quote>truck turn time</quote>);</text></clause></subparagraph><subparagraph id="idae2a8b08713d481a91c482838cc9cf74"><enum>(H)</enum><text>the types of cargo moved;</text></subparagraph><subparagraph id="id7b3fb14a680241768895839cd82347eb"><enum>(I)</enum><text>the presence and location of any intermodal connectors;</text></subparagraph><subparagraph id="id64feffd876174154ac8ffd544f0b6304"><enum>(J)</enum><text>the physical size of each terminal within applicable port boundaries;</text></subparagraph><subparagraph id="idb0fd7cda58904af3abc7112ebf13995d"><enum>(K)</enum><text>maximum authorized channel depth and maximum actual and current channel depth;</text></subparagraph><subparagraph id="idc364fc6338504e79915c3857c076f86a"><enum>(L)</enum><text>the schedule of vessel arrivals, for use in determining vessel on-time performance;</text></subparagraph><subparagraph id="id2130d96a12c24a1dae8ff9d3c0880268"><enum>(M)</enum><text>berth utilization; and</text></subparagraph><subparagraph id="ida281c37fb35046858b9158c6ab458a59"><enum>(N)</enum><text>any additional metrics, as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="id76569ad1876943ada1e459689dedbf99"><enum>(4)</enum><header>Origin requirement</header><text>The data required to be submitted under this subsection shall originate from a port authority of a qualifying port authority grant recipient.</text></paragraph><paragraph id="id5ac5297cf2444f7aa8ff40ddd7d65e1a"><enum>(5)</enum><header>Public access to data</header><text>The Secretary shall ensure that the data compiled under this subsection are readily accessible to the public, in accordance with applicable security constraints and confidentiality requirements.</text></paragraph><paragraph id="id9dfdb71a0ad448348771c3028f9a5439"><enum>(6)</enum><header>Authorization of appropriations for voluntary data-sharing pilot program</header><text>There is authorized to be appropriated $150,000 for fiscal year 2023 to the Administrator of the Maritime Administration to carry out, in consultation with the Director of the Bureau of Transportation Statistics, a voluntary data-sharing pilot program that involves not less than a majority of the types of data described in paragraph (3).</text></paragraph></subsection><subsection id="ideb0b79ee98fb462bb44a12395bec0938"><enum>(b)</enum><header>Administration of policies and programs by Office of Multimodal Freight Infrastructure and Policy</header><text>Section 118(d)(3) of title 49, United States Code (as added by section 21101(a) of the Infrastructure Investment and Jobs Act), is amended—</text><paragraph id="id68fb8d3fdaca445e8992d649f96c0e8e"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id62e6ae459c9944e0bfa193764a0831e2"><enum>(2)</enum><text>by redesignating subparagraph (B) as subparagraph (C); and</text></paragraph><paragraph id="id5b1ec7d9e76c4788b9448aeb95bb5af8"><enum>(3)</enum><text>by inserting after subparagraph (A) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1247f56b524949bc9303076f9923813c" changed="deleted" reported-display-style="strikethrough"><subparagraph id="id3bdd910dc4c24215b26f3d1e60a25fe8" indent="up1"><enum>(B)</enum><text>administer the port and intermodal improvement program under section 50302(c) of title 46; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id9c9d10cdfa184c929e970d78d735ea5b" changed="deleted" reported-display-style="strikethrough"><enum>11.</enum><header>Temporary emergency authority</header><subsection id="id02b1377a33c645778cc2758ad5c959fd"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id2948347de071412bb4691f7d465ce2b5"><enum>(1)</enum><header>Common carrier</header><text>The term <term>common carrier</term> has the meaning given the term in section 40102 of title 46, United States Code.</text></paragraph><paragraph id="id9b5f08c7a5aa4035a2eb3ec624f60a9a"><enum>(2)</enum><header>Motor carrier</header><text>The term <term>motor carrier</term> has the meaning given the term in section 13102 of title 49, United States Code.</text></paragraph><paragraph id="id3f7953ba226744bbb8197e7ffb120343"><enum>(3)</enum><header>Rail carrier</header><text>The term <term>rail carrier</term> has the meaning given the term in section 10102 of title 49, United States Code.</text></paragraph><paragraph id="idf058bd1691564b3d83c237495784609b"><enum>(4)</enum><header>Shipper</header><text>The term <term>shipper</term> has the meaning given the term in section 40102 of title 46, United States Code.</text></paragraph></subsection><subsection id="idf65d1399e0224b548f00e0a1d2ea6fbc"><enum>(b)</enum><header>Public input on information sharing</header><paragraph id="id9e01730b40b24ce880774205ee7f0324"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date of enactment of this Act, the Commission shall issue a request for information, seeking public comment regarding—</text><subparagraph id="idc4cb8d18dfab46e8ab74dd7c6dcafe57"><enum>(A)</enum><text>whether congestion of the common carriage of goods has created an emergency situation of a magnitude such that there exists a substantial, adverse effect on the competitiveness and reliability of the international ocean transportation supply system;</text></subparagraph><subparagraph id="id83ff51cfc3bb42158bfa5bc21acef0d9"><enum>(B)</enum><text>whether an emergency order under this section would alleviate such an emergency situation; and</text></subparagraph><subparagraph id="ida7c1c53c02d2479ba1abdc1cc2db2316"><enum>(C)</enum><text>the appropriate scope of such an emergency order, if applicable.</text></subparagraph></paragraph><paragraph id="idb5eccbc360ae4030a3b96d41e39eb393"><enum>(2)</enum><header>Consultation</header><text>During the public comment period under paragraph (1), the Commission may consult, as the Commission determines to be appropriate, with—</text><subparagraph id="idc1a0ebee2e3e40c9af1ffa7d86e54b3e"><enum>(A)</enum><text>other Federal departments and agencies; and</text></subparagraph><subparagraph id="idd35721de02824c0e9f474bb4106d1efe"><enum>(B)</enum><text>persons with expertise relating to maritime and freight operations.</text></subparagraph></paragraph></subsection><subsection id="idafb4d194500b4467b2d02250eef51129"><enum>(c)</enum><header>Authority To require information sharing</header><text>On making a unanimous determination described in subsection (d), the Commission may issue an emergency order requiring any common carrier or marine terminal operator to share directly with relevant shippers, rail carriers, or motor carriers information relating to cargo throughput and availability, in order to ensure the efficient transportation, loading, and unloading of cargo to or from—</text><paragraph id="idf4731cc0f12d4a1f93578ba002be1499"><enum>(1)</enum><text>any inland destination or point of origin;</text></paragraph><paragraph id="idbf423f49e2e24a9fb7373fbb91195211"><enum>(2)</enum><text>any vessel; or</text></paragraph><paragraph id="id5848f8713778430abc26522dd1255458"><enum>(3)</enum><text>any point on a wharf or terminal.</text></paragraph></subsection><subsection id="id1a69cd373fbe474e88f3546daa3d0a68"><enum>(d)</enum><header>Description of determination</header><paragraph id="idf01d34890bca43a79606ac0044ea0a3a"><enum>(1)</enum><header>In general</header><text>A determination referred to in subsection (c) is a unanimous determination by the commissioners on the Commission that congestion of common carriage of goods has created an emergency situation of a magnitude such that there exists a substantial, adverse effect on the competitiveness and reliability of the international ocean transportation supply system.</text></paragraph><paragraph id="id8df4dbfa054a4af9a3d4c40cca54e5c8"><enum>(2)</enum><header>Factors for consideration</header><text>In issuing an emergency order pursuant to subsection (c), the Commission shall tailor the emergency order with respect to temporal and geographic scope, taking into consideration the likely burdens on ocean carriers and marine terminal operators and the likely benefits on congestion relating to the purposes described in section 40101 of title 46, United States Code.</text></paragraph></subsection><subsection id="id87ee6fbf272248b7b94737c6db820328"><enum>(e)</enum><header>Petitions for exception</header><paragraph id="id4c6f7b25bbd542f5970d6009ac545af6"><enum>(1)</enum><header>In general</header><text>A common carrier or marine terminal operator subject to an emergency order issued pursuant to this section may submit to the Commission a petition for exception from 1 or more requirements of the emergency order, based on a showing of undue hardship or other condition rendering compliance with such a requirement impracticable.</text></paragraph><paragraph id="idd8739744346f47feb053e2e1ce6eae13"><enum>(2)</enum><header>Determination</header><text>The Commission shall make a determination regarding a petition for exception under paragraph (1) by—</text><subparagraph id="id4c08a8880f24443297c6849579cb8df4"><enum>(A)</enum><text>majority vote; and</text></subparagraph><subparagraph id="id4cf3c954c0da43f69d7c4b3028864188"><enum>(B)</enum><text>not later than 21 days after the date on which the petition is submitted.</text></subparagraph></paragraph><paragraph id="id86fb63db8619439a8761fb4fbd5cad28"><enum>(3)</enum><header>Inapplicability pending review</header><text>The requirements of an emergency order that is the subject of a petition for exception under this subsection shall not apply to the petitioner during the period for which the petition is pending.</text></paragraph></subsection><subsection id="idd77e41877a724f36aea9c7622e56345d"><enum>(f)</enum><header>Limitations</header><paragraph id="id3a9aaa79f23d41bf80fb9fc53760a2c5"><enum>(1)</enum><header>Term</header><text>An emergency order issued pursuant to this section—</text><subparagraph id="idfba83d7f7656410a9e1c3fd6e9dea306"><enum>(A)</enum><text>shall remain in effect for a period of not longer than 60 days; but</text></subparagraph><subparagraph id="id1c0508362b6849a1859ce73ce09809b3"><enum>(B)</enum><text>may be renewed by a unanimous determination of the Commission.</text></subparagraph></paragraph><paragraph id="id5dc929b76cb54f6483075af5df0712aa"><enum>(2)</enum><header>Sunset</header><text>The authority provided by this section shall terminate on the date that is 1 year after the date of enactment of this Act.</text></paragraph></subsection></section><section id="idd90c503cb0ce4a1cb3dc4822ebb3024e" changed="deleted" reported-display-style="strikethrough"><enum>12.</enum><header>Additional transportation representation</header><text display-inline="no-display-inline">Section 1325(a) of title 49, United States Code, is amended—</text><paragraph id="idda14b36ad3c1418eaf1f8197f6a3e31f"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>19 members, of which 15 members</quote> and inserting <quote>24 members, of whom 18</quote>; and</text></paragraph><paragraph id="id43ca42e7111147aeb5191867a01f6d00"><enum>(2)</enum><text>in paragraph (3)—</text><subparagraph id="idCA7A0CF747E94099A65B673D5B3EF15B"><enum>(A)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and indenting appropriately; and</quote>; and</text></clause><clause id="idD128294E09B64E21A635755E6D117ED5"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE00ABB7B26CD4BA7A0649F6AEA7CB9CA" changed="deleted" reported-display-style="strikethrough"><clause id="idca395a7a5af046989198a10573bd16e1"><enum>(iii)</enum><text>at least 1 shall be a representative of marine terminal operators or ports.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id83F97C69BAF240339F1769673799A461"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8BBD004DB55E4E7BAC116303D0F193D4" changed="deleted" reported-display-style="strikethrough"><subparagraph id="idcf59815c098243e1aabd048d3566c627" indent="up1"><enum>(B)</enum><text>Nothing in this paragraph limits any provision relating to the appointment of the members under paragraph (2).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="id8e1bbf319fba4b8bb8db905c2677aa9c" changed="deleted" reported-display-style="strikethrough"><enum>13.</enum><header>Permanent waiver</header><subsection id="id296e4209b20a4c8988a34e11f5245887"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, the Administrator of the Federal Motor Carrier Safety Administration shall make permanent the waiver described in the document issued by the Administrator entitled <quote>Waiver for States Concerning Third Party CDL Skills Test Examiners In Response to the COVID–19 Emergency</quote> and dated August 31, 2021.</text></subsection><subsection id="id85112ab38d9747ea983fd94b45d24a0a" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Rulemaking</header><text>Not later than 90 days after the date of enactment of this Act, the Administrator of the Federal Motor Carrier Safety Administration shall revise section 384.228 of title 49, Code of Federal Regulations, to provide that the waiver referred to in subsection (a) shall be permanent.</text></subsection></section><section id="id73aa8beaa6714a15a25fa1f1a889770c" changed="added" reported-display-style="italic"><enum>2.</enum><header>Dwell time statistics</header><subsection id="id7db6a30f901e42079ecf74fb43d77e42"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id1e5e536fdfe3468895f75f9044ea2a40"><enum>(1)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Bureau of Transportation Statistics.</text></paragraph><paragraph id="id362d66814db64617a54c2be76ed8fb27"><enum>(2)</enum><header>Marine container</header><text>The term <term>marine container</term> means an intermodal container with a length of—</text><subparagraph id="idee1701d089e041028fce88abdf804aec"><enum>(A)</enum><text>not less than 20 feet; and</text></subparagraph><subparagraph id="idb771000aa389433fb4e492d7d05f82bf"><enum>(B)</enum><text>not greater than 45 feet.</text></subparagraph></paragraph><paragraph id="id04cdef769aed4815a0afae1196806daa" commented="no"><enum>(3)</enum><header>Out of service percentage</header><text>The term <term><added-phrase>out of service</added-phrase> percentage</term> means the proportion of the chassis fleet for any defined geographical area that is out of service at any one time.</text></paragraph><paragraph id="idd5a23813c48241e9aff52e141bf76224"><enum>(4)</enum><header>Street dwell time</header><text>The term <term>street dwell time</term>, with respect to a piece of equipment, means the quantity of time during which the piece of equipment is in use outside of the terminal. </text></paragraph></subsection><subsection id="id0e6e4cba975444bc8d3b14777adc0e8a"><enum>(b)</enum><header>Authority to collect data</header><paragraph id="id4b72775e008d4369a5b27c4653b98715"><enum>(1)</enum><header>In general</header><text>Each port, marine terminal operator, and chassis owner or provider with a fleet of over 50 chassis that supply chassis for a fee shall submit to the Director such data as the Director determines to be necessary for the implementation of this section, subject to subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code.</text></paragraph><paragraph id="id205cf73eda0241bea918d0ac047f481d"><enum>(2)</enum><header>Approval by OMB</header><text>Subject to the availability of appropriations, not later than 60 days after the date of enactment of this Act, the Director of the Office of Management and Budget shall approve an information collection for purposes of this section.</text></paragraph></subsection><subsection id="id4f45997fc85948a3a98d9eebffd26416"><enum>(c)</enum><header>Publication</header><text>Subject to the availability of appropriations, not later than 240 days after the date of enactment of this Act, and not less frequently than monthly thereafter, the Director shall publish statistics relating to the dwell time of equipment used in intermodal transportation at the top 25 intermodal freight facilities, including—</text><paragraph id="idda5158ac413c40b5aca4233c9a31686a"><enum>(1)</enum><text>total street dwell time, from all causes, of marine containers and marine container chassis; and</text></paragraph><paragraph id="id8b313ac2d28041139a63aa33fa2f4ab4"><enum>(2)</enum><text>the average out of service percentage, which shall not be identifiable with any particular port, marine terminal operators, or chassis provider.</text></paragraph></subsection><subsection id="id4d7895868f1f4f7481569cd691629a5e"><enum>(d)</enum><header>Factors</header><text>Subject to the availability of appropriations, to the maximum extent practicable, the Director shall publish the statistics described in subsection (c) on a local, regional, and national basis.</text></subsection><subsection id="id4f90ec39e8134078a3758352860bb2ca"><enum>(e)</enum><header>Sunset</header><text>The authority under this section shall expire December 31, 2026. </text></subsection></section><section id="id869349a9e14049258de175fab8d3f95d" commented="no" changed="added" reported-display-style="italic"><enum>3.</enum><header>Federal Maritime Commission activities</header><subsection id="id28a885ab316d4a8c92985224d3944f4f"><enum>(a)</enum><header>Public submissions to Commission</header><text>The Federal Maritime Commission (referred to in this Act as the <term>Commission</term>) shall—</text><paragraph id="id1fa439e971c74c6d94203c6279fe205d"><enum>(1)</enum><text>establish on the public website of the Commission a webpage that allows for the submission of comments, complaints, concerns, reports of noncompliance, requests for investigation, and requests for alternative dispute resolution; and</text></paragraph><paragraph id="id0d2b337971b4466ba147610123654f5e"><enum>(2)</enum><text>direct each submission under the link established under paragraph (1) to the appropriate component office of the Commission.</text></paragraph></subsection><subsection id="id92273034cb66438c83c42f6b588faee5"><enum>(b)</enum><header>Authorization of Office of Consumer Affairs and Dispute Resolution Services</header><text>The Commission shall maintain an Office of Consumer Affairs and Dispute Resolution Services to provide nonadjudicative ombuds assistance, mediation, facilitation, and arbitration to resolve challenges and disputes involving cargo shipments, household good shipments, and cruises subject to the jurisdiction of the Commission.</text></subsection><subsection id="id0538e8a79c35496bbc95a18048b26b22"><enum>(c)</enum><header>Enhancing capacity for investigations</header><paragraph id="id33147ad4020f4453aa83655947a8fcae"><enum>(1)</enum><header>In general</header><text>Pursuant to section 41302 of title 46, United States Code, not later than 18 months after the date of enactment of this Act, the Chairperson of the Commission shall staff within the Bureau of Enforcement, the Bureau of Certification and Licensing, the Office of the Managing Director, the Office of Consumer Affairs and Dispute Resolution Services, and the Bureau of Trade Analysis not fewer than 7 total positions to assist in investigations and oversight, in addition to the positions within the Bureau of Enforcement, the Bureau of Certification and Licensing, the Office of the Managing Director, the Office of Consumer Affairs and Dispute Resolution Services, and the Bureau of Trade Analysis on that date of enactment.</text></paragraph><paragraph id="id3778627a34164538bd05761e686a353e"><enum>(2)</enum><header>Duties</header><text>The additional staff appointed under paragraph (1) shall provide support—</text><subparagraph id="id120f4af8504f46dc9e62f881e2633f19"><enum>(A)</enum><text>to Area Representatives of the Bureau of Enforcement;</text></subparagraph><subparagraph id="idcc15d51d263343d7b422b01b211a4eab"><enum>(B)</enum><text>to attorneys of the Bureau of Enforcement in enforcing the laws and regulations subject to the jurisdiction of the Commission;</text></subparagraph><subparagraph id="idbd52e195548f48b8a69138638c963540"><enum>(C)</enum><text>for the alternative dispute resolution services of the Commission; or</text></subparagraph><subparagraph id="id41d01ff75b56494a8bfd39fb701e88a4"><enum>(D)</enum><text>for the review of agreements and activities subject to the authority of the Commission.</text></subparagraph></paragraph></subsection></section><section id="id7d04e3e19fba4372ac773ec72e979832" commented="no" changed="added" reported-display-style="italic"><enum>4.</enum><header>Temporary emergency authority</header><subsection id="id1223829056ce48ffa94e3968f999bfee"><enum>(a)</enum><header>Definitions</header><text>In this section: </text><paragraph id="id6d055a6b600e4bc78763f5918916d6fd"><enum>(1)</enum><header>Common carrier</header><text>The term <term>common carrier</term> has the meaning given the term in section 40102 of title 46, United States Code.</text></paragraph><paragraph id="id00b5d6f1bf6c4cb3ae27ace260a323c8"><enum>(2)</enum><header>Motor carrier</header><text>The term <term>motor carrier</term> has the meaning given the term in section 13102 of title 49, United States Code.</text></paragraph><paragraph id="id38fd12a7d1fe4c43af9c933bee59142f"><enum>(3)</enum><header>Rail carrier</header><text>The term <term>rail carrier</term> has the meaning given the term in section 10102 of title 49, United States Code.</text></paragraph><paragraph id="id86edd95246234c6faacd0d6f76f3476f"><enum>(4)</enum><header>Shipper</header><text>The term <term>shipper</term> has the meaning given the term in section 40102 of title 46, United States Code.</text></paragraph></subsection><subsection id="idc7288f9e621845408f667fe7a4b814c5"><enum>(b)</enum><header>Public input on information sharing</header><paragraph id="ida89d939f019143a18efb37465279dcee"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of this Act, the Commission shall issue a request for information, seeking public comment regarding—</text><subparagraph id="id15ad45d1c82b4f9a89c06d00259c4e49"><enum>(A)</enum><text>whether congestion of the carriage of goods has created an emergency situation of a magnitude such that there exists a substantial, adverse effect on the competitiveness and reliability of the international ocean transportation supply system;</text></subparagraph><subparagraph id="id8d39cc8635be4f2ca68e86cc0674f490"><enum>(B)</enum><text>whether an emergency order under this section would alleviate such an emergency situation; and</text></subparagraph><subparagraph id="id8508e1af97ac424e9c63ab91604da5f3"><enum>(C)</enum><text>the appropriate scope of such an emergency order, if applicable.</text></subparagraph></paragraph><paragraph id="id33b7648a6c944828aa14964a180241f7"><enum>(2)</enum><header>Consultation</header><text>During the public comment period under paragraph (1), the Commission may consult, as the Commission determines to be appropriate, with—</text><subparagraph id="id47a14a3d9a414d16b71656e45569039d"><enum>(A)</enum><text>other Federal departments and agencies; and</text></subparagraph><subparagraph id="id2dfebfe5eeec437fb155ead7679cb363"><enum>(B)</enum><text>persons with expertise relating to maritime and freight operations.</text></subparagraph></paragraph></subsection><subsection id="id4a10ab60dce84e0f9adf3ffc84a4371a"><enum>(c)</enum><header>Authority to require information sharing</header><text>On making a unanimous determination described in subsection (d), the Commission may issue an emergency order requiring any common carrier or marine terminal operator to share directly with relevant shippers, rail carriers, or motor carriers information relating to cargo throughput and availability, in order to ensure the efficient transportation, loading, and unloading of cargo to or from—</text><paragraph id="id0fa8e5a0f9cb4d86bea01d77003b357d"><enum>(1)</enum><text>any inland destination or point of origin;</text></paragraph><paragraph id="ida0bbb22569c74385bbb83ce35f35d603"><enum>(2)</enum><text>any vessel; or</text></paragraph><paragraph id="id437d840bcfad4ebf9aa2bcbd418ac697"><enum>(3)</enum><text>any point on a wharf or terminal.</text></paragraph></subsection><subsection id="id2e40a99d314441f6836364846da76964"><enum>(d)</enum><header>Description of determination</header><paragraph id="ida860c11b37b44c53a3ea26174aa8d848"><enum>(1)</enum><header>In general</header><text>A determination referred to in subsection (c) is a unanimous determination by the commissioners on the Commission that congestion of common carriage of goods has created an emergency situation of a magnitude such that there exists a substantial, adverse effect on the competitiveness and reliability of the international ocean transportation supply system.</text></paragraph><paragraph id="id1706b0e0db2c4917999f5a29cc1d10fc"><enum>(2)</enum><header>Factors for consideration</header><text>In issuing an emergency order pursuant to subsection (c), the Commission shall tailor the emergency order with respect to temporal and geographic scope, taking into consideration the likely burdens on ocean carriers and marine terminal operators and the likely benefits on congestion relating to the purposes described in section 40101 of title 46, United States Code.</text></paragraph></subsection><subsection id="id7068e38d4e0a4c76a7032af126e25a43"><enum>(e)</enum><header>Petitions for exception</header><paragraph id="id05e6b45c87c4456ba1fe4ef5c4a4999e"><enum>(1)</enum><header>In general</header><text>A common carrier or marine terminal operator subject to an emergency order issued pursuant to this section may submit to the Commission a petition for exception from 1 or more requirements of the emergency order, based on a showing of undue hardship or other condition rendering compliance with such a requirement impracticable.</text></paragraph><paragraph id="id0cac5eec9f3148d6988445a9b37ca8d0"><enum>(2)</enum><header>Determination</header><text>The Commission shall make a determination regarding a petition for exception under paragraph (1) by—</text><subparagraph id="id33d1350918e74e44a547466739c55285"><enum>(A)</enum><text>majority vote; and</text></subparagraph><subparagraph id="iddd75f18e5ecd4282ae3f85a6ced8fdb6"><enum>(B)</enum><text>not later than 21 days after the date on which the petition is submitted.</text></subparagraph></paragraph><paragraph id="ida78961b9f4a243439d24abd01e189cae"><enum>(3)</enum><header>Inapplicability pending review</header><text>The requirements of an emergency order that is the subject of a petition for exception under this subsection shall not apply to the petitioner during the period for which the petition is pending.</text></paragraph></subsection><subsection id="ide97251a632a546c2b3fb26aec8a5f2d2"><enum>(f)</enum><header>Limitations</header><paragraph id="id1c742a811869455ab9eb3d9f91da7ec6"><enum>(1)</enum><header>Term</header><text>An emergency order issued pursuant to this section—</text><subparagraph id="idf0049472bd434a7c8bafcfe48cce86a4"><enum>(A)</enum><text>shall remain in effect for a period of not longer than 60 days; but</text></subparagraph><subparagraph id="id2c007d53d2534859ae80b34b8d1ed590"><enum>(B)</enum><text>may be renewed by a unanimous determination of the Commission.</text></subparagraph></paragraph><paragraph id="idcdda08213951482587471e36c1c98605"><enum>(2)</enum><header>Sunset</header><text>The authority provided by this section shall terminate on the date that is 18 months after the date of enactment of this Act.</text></paragraph><paragraph id="idfc3e1b6909c84423bf121a9c7022611a"><enum>(3)</enum><header>Investigative authority unaffected</header><text>Nothing in this section shall affect the investigative authorities of the Commission as described in subpart R of part 502 of title 46, Code of Federal Regulations. </text></paragraph></subsection></section><section id="idf7288d1a3f6c433f84da361cb4bb7b69" changed="added" reported-display-style="italic"><enum>5.</enum><header>Best practices for chassis pools</header><subsection id="id0cb59a1d7d67410083cb2ff82c54986a"><enum>(a)</enum><header>In general</header><text>Not later than April 1, 2023, the Commission shall enter into an agreement with the Transportation Research Board of the National Academies of Sciences, Engineering, and Medicine under which the Transportation Research Board shall carry out a study and develop best practices for on-terminal or near-terminal chassis pools that provide service to marine terminal operators, motor carriers, railroads, and other stakeholders that use the chassis pools, with the goal of optimizing supply chain efficiency and effectiveness.</text></subsection><subsection id="id158023b95dcb4231bfad113368312f78"><enum>(b)</enum><header>Requirements</header><text>In developing best practices under subsection (a), the Transportation Research Board shall—</text><paragraph id="ide14244b0d0a64e3987a87d5eba72e67f"><enum>(1)</enum><text>take into consideration—</text><subparagraph id="idca3c17edcb924c8c9cd3f1b47acb83cb"><enum>(A)</enum><text>practical obstacles to the implementation of chassis pools; and</text></subparagraph><subparagraph id="id59b48ba62be04d4eb51ade09f86b896f"><enum>(B)</enum><text>potential solutions to those obstacles; and</text></subparagraph></paragraph><paragraph id="id510011e4c31c49e09683f5eb01086f35"><enum>(2)</enum><text>address relevant communication practices, information sharing, and knowledge management.</text></paragraph></subsection><subsection id="id590d8b4f4eb142f491237c3289582cfc"><enum>(c)</enum><header>Publication</header><text>The Commission shall publish the best practices developed under this section on a publicly available website by not later than April 1, 2024.</text></subsection><subsection id="idEDA82CAE4ED541A3880094C76CCE9368"><enum>(d)</enum><header>Funding</header><text>Subject to appropriations, the Commission may expend such sums as are necessary, but not to exceed $500,000, to carry out this section. </text></subsection></section><section id="idcd897777816c4f9fa1b728f8ca5778eb" commented="no" changed="added" reported-display-style="italic"><enum>6.</enum><header>Licensing testing</header><subsection id="ideeed3bd8d91a47c88c8a53912132c3f6"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Administrator of the Federal Motor Carrier Safety Administration (referred to in this section as the <quote>Administrator</quote>) shall conduct a review of the discretionary waiver authority described in the document issued by the Administrator entitled <quote>Waiver for States Concerning Third Party CDL Skills Test Examiners In Response to the COVID–19 Emergency</quote> and dated August 31, 2021, for safety concerns.</text></subsection><subsection id="id88f72c91d7d44e92aa21233fe32bf71a"><enum>(b)</enum><header>Permanent waiver</header><text>If the Administrator finds no safety concerns after conducting a review under subsection (a), the Administrator shall, notwithstanding any other provision of law, make the waiver permanent.</text></subsection><subsection id="id2e25fde0067846368afd09db23411af5"><enum>(c)</enum><header>Rulemaking</header><text>Not later than 90 days after completing the review under subsection (a), the Administrator shall revise section 384.228 of title 49, Code of Federal Regulations, to provide that the discretionary waiver authority referred to in subsection (a) shall be permanent.</text></subsection></section></legis-body><endorsement><action-date date="20221212">December 12, 2022</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
