Stafford Disaster Relief and Emergency Assistance Act to improve
 accountability of disaster contracts, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disaster Contract Transparency Act of 2021</short-title></quote>.</text></section><section id="id78DDE7EAED5842229970FBC9F9AA6C58"><enum>2.</enum><header>Debris removal contract oversight</header><subsection id="id547ECC41A1AC492E8882B465A35EB656"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title IV of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id8735DC0D1D9C4F72BF9C3ACC8E4C6AAC" style="OLC"><section id="idAFEE502BD24644C9AB094398BF214ED4"><enum>431.</enum><header>Public assistance grant program eligibility and oversight for debris removal</header><subsection id="id9DECE2DB25AB4DEE892CF1DCB1BCEED8"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="id8229CF64B7E64B16BF417D9664A76FEB"><enum>(1)</enum><text>the term <term>Administrator</term> means the Administrator of the Federal Emergency Management Agency;</text></paragraph><paragraph id="idDD506E00466948C79030DD8DF46069AF"><enum>(2)</enum><text>the term <term>Agency</term> means the Federal Emergency Management Agency;</text></paragraph><paragraph id="idE576325C2E884CACAB5D36920BD4499E"><enum>(3)</enum><text>the term <term>covered State</term> means a State for which a major disaster or emergency was declared under this Act during the 5-year period preceding the date on which the State requests assistance for debris removal under the public assistance grant program;</text></paragraph><paragraph id="id01E09D72BE2044C59C185CFAC6438587"><enum>(4)</enum><text>the term <term>covered unit of local government</term> means a unit of local government for which a major disaster or emergency was declared under this Act during the 5-year period preceding the date on which the State requests assistance for debris removal under the public assistance grant program; and</text></paragraph><paragraph id="id7A148DB9AE424C878921E91BA07275AA"><enum>(5)</enum><text>the term <term>public assistance grant program</term> means the public assistance grant program authorized under sections 403, 406, 407, 418, 419, 428, and 502(a).</text></paragraph></subsection><subsection id="id48C9FD1F8504457C9E471E734101959A"><enum>(b)</enum><header>Eligibility</header><paragraph id="idD42AFC14A8A541DC99AE21C165187261"><enum>(1)</enum><header>In general</header><subparagraph id="id1308E656B5384D3CA77308A1C9DF93EC"><enum>(A)</enum><header>Advance contact required</header><text>Except as provided in subparagraph (B), a covered State or covered unit of local government shall not be eligible for assistance for debris removal under the public assistance grant program, including direct Federal assistance for debris removal provided by the Corps of Engineers, unless the covered State or covered unit of local government has in effect, prior to the major disaster or emergency declaration under this Act for which the covered State or covered unit of local government is seeking debris removal assistance, an advance contract for debris removal services that collectively provides adequate coverage, as determined by the Administrator, for debris removal for the entire State.</text></subparagraph><subparagraph id="id05E9189900EB4EC6871977FEDCA57963"><enum>(B)</enum><header>Grace period</header><text>Subparagraph (A) shall not apply during the 1-year period beginning on the date on which a State or unit of local government becomes a covered State or covered unit of local government.</text></subparagraph></paragraph><paragraph id="idE6FCE3974029487D9B9CFF8D9B33AB53"><enum>(2)</enum><header>Reporting</header><text>For purposes of determining eligibility under paragraph (1), each covered State shall submit, on an annual basis, a report to the Administrator on all advanced contracts in effect for the covered State or covered units of local government within the State, including, for each advanced contract—</text><subparagraph id="idb76f551321894bc0b20c14b14278f8ac"><enum>(A)</enum><text>the name of the contractor;</text></subparagraph><subparagraph id="id0F918AD3DD8D4B40A3791214D20E07F3"><enum>(B)</enum><text>the contract terms and conditions;</text></subparagraph><subparagraph id="id015111187E3B4DF6ADD072EE8EC49C45"><enum>(C)</enum><text>the reimbursement rates;</text></subparagraph><subparagraph id="idB2D8726311B945438AF73AC12DB8A155"><enum>(D)</enum><text>verification and oversight agreements;</text></subparagraph><subparagraph id="id356A265FFD8B44EF88A9C48DD76D8002"><enum>(E)</enum><text>geographic coverage of the contract;</text></subparagraph><subparagraph id="id7FEDE2C04CEC484E9634D459E5C3A170"><enum>(F)</enum><text>capacity of contractor; and</text></subparagraph><subparagraph id="id38F8A87D15BC432E96A6574DEDC40DFD"><enum>(G)</enum><text>debris removal assets owned by the contractor.</text></subparagraph></paragraph></subsection><subsection id="id2FDF87673A014F78A5BBB3BE8FFF7889"><enum>(c)</enum><header>Reimbursement of debris removal contracts</header><text>With respect to reimbursing advance contracts for debris removal services described in subsection (b), the Administrator shall reimburse for such services at the lower of—</text><paragraph id="id98760AF3883A46D7B0CE239D8303CA3B"><enum>(1)</enum><text>the rate of the Federal contract, if any;</text></paragraph><paragraph id="idB8751E1CE1634C3C8A225FE0D18BB251"><enum>(2)</enum><text>the rate of the State advance contract, if any; or</text></paragraph><paragraph id="idD32F94A6A60A42E0BB302ECA9C84ECCB"><enum>(3)</enum><text>the rate of the unit of local government advance contract.</text></paragraph></subsection><subsection id="id3A59676B98D040F48B2995934CB36110"><enum>(d)</enum><header>Penalties for contractors</header><paragraph id="idD2D26706476C4DB8863494676DB13034"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (3), any contractor who breaches or otherwise fails to honor an advance contract for debris removal service entered into with a State or unit of local government shall not be eligible for any Federal reimbursement funds for debris removal services for not less than 10 years after the date on which the advance contract is breached.</text></paragraph><paragraph id="idA5A581E6C5DC42F1BE009CF140BC22B7"><enum>(2)</enum><header>Determination of breach</header><text>A determination of whether an advance contract for debris removal service is breached or otherwise not honored under paragraph (1) shall be made by a court of competent jurisdiction.</text></paragraph><paragraph id="id3BCE7B0BAC1846A88B472732CA145D2D"><enum>(3)</enum><header>Waiver of penalty</header><text>The Administrator may waive paragraph (1) if the Administrator determines such waiver is necessary due to—</text><subparagraph id="id017a1bd52c2c45c5936cd77c5c21742f"><enum>(A)</enum><text>a labor or supply shortage; or</text></subparagraph><subparagraph id="id03E24509139C450C909042CB09A080DF"><enum>(B)</enum><text>no alternative contractors being available to perform the necessary services.</text></subparagraph></paragraph></subsection><subsection id="idBE9795DC175B418BB74A65AFBB300CC2"><enum>(e)</enum><header>Oversight</header><paragraph id="id96675F99FAB34F78AEAF21C1CC22144E"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this section, the Administrator shall develop and implement guidance and procedures, including clear and unambiguous rules, with respect to the oversight of debris removal contracts entered into under the public assistance grant program, including, at a minimum—</text><subparagraph id="id18ebb5554160473692d856f896801ddf"><enum>(A)</enum><text>a requirement that—</text><clause id="id4F7A7FC5CC204C5A972AED3BDC1A396E"><enum>(i)</enum><text>all States and units of local government receiving debris removal assistance under the public assistance grant program take the primary role in the oversight function of debris removal; and</text></clause><clause id="id9C88E6EB418F4461ADD2E618993FE16E"><enum>(ii)</enum><text>the Agency shall verify compliance with the requirements of this section and any regulations promulgated under this section;</text></clause></subparagraph><subparagraph id="id8dcf011a62ad4ec084452c6e68dc7eb0"><enum>(B)</enum><text>guidance for State and local debris monitors regarding debris removal operations, debris operations oversight, and contractor oversight, including contractor monitoring;</text></subparagraph><subparagraph id="id70a0867ea05f43b49b00d0b4bc71f344"><enum>(C)</enum><text>checklists, job aids, eligibility requirements, contract requirements, debris management planning guidance, and other items, as determined necessary by the Administrator, for State and local debris monitors;</text></subparagraph><subparagraph id="idf84c187da5bf4dac977c3579aaff3798"><enum>(D)</enum><text>guidance for State and local debris monitors on how to ensure that subgrant recipients meet the grant requirements and eligibility criteria for the public assistance grant program under which the grant was awarded in all areas of the debris removal operation;</text></subparagraph><subparagraph id="id887a377f042b47fda5b3dc1e50ed47f2"><enum>(E)</enum><text>a list of the specific debris removal monitoring responsibilities expected to be completed by a State for which a public assistance grant program grant is awarded; and</text></subparagraph><subparagraph id="ida5ac91c315a748f98b5f9a67665e6a66"><enum>(F)</enum><text>a list of the specific debris removal monitoring responsibilities expected to be completed by recipients of a subgrant of a grant from a public assistance grant program.</text></subparagraph></paragraph><paragraph id="idAAFB6C0226634741A589EF6BFED5F713"><enum>(2)</enum><header>Review and update of guidance and procedures</header><text>The Administrator shall review and update the guidance and procedures required under paragraph (1) as appropriate, but not less frequently than once every 3 years.</text></paragraph><paragraph id="idB2334BD296CA434C9C793897334F3B10"><enum>(3)</enum><header>Requirements</header><subparagraph id="id074ED81D845A4CD7AB35D7B1E89CCC8B"><enum>(A)</enum><header>In general</header><text>In developing the guidance and procedures required under paragraph (1), the Administrator shall—</text><clause id="id286460169B7D4F298393C0E3B2592E69"><enum>(i)</enum><text>except as provided in subparagraph (B), require that not later than 45 days after a grant is awarded under the public assistance grant program for debris removal, and once every 45 days thereafter for the duration of the grant, the State shall submit a report to the Administrator on the progress of the debris removal; and</text></clause><clause id="id34816EDD73F84F8AA7D26449DD261F02"><enum>(ii)</enum><text>ensure that oversight of debris removal operations can be accomplished in all units of local government of a State in which debris removal operations are being carried out, such as through real-time reporting on operations.</text></clause></subparagraph><subparagraph id="id17995F7F614A4C86A61EB1D474A164A3"><enum>(B)</enum><header>Waiver of reporting requirement</header><text>The Administrator may waive the reporting requirement described in subparagraph (A)(i), if the Administrator determines, on a case-by-case basis, that such reporting requirement would negatively impact disaster recovery efforts.</text></subparagraph></paragraph></subsection><subsection id="id6e2725a213bd4df4a777724ad76dce13"><enum>(f)</enum><header>Training</header><text>The Administrator shall provide training on appropriate debris removal guidance and procedures to—</text><paragraph id="idB8D856B9D1E44AB4A5441181DD4BA25F"><enum>(1)</enum><text>Agency debris monitors; and</text></paragraph><paragraph id="id3FB03B5FC6AF4F909D65F2F1B596C157"><enum>(2)</enum><text>appropriate State and private entities.</text></paragraph></subsection><subsection id="id42db8f59ecd2406cabdabf2abc9afd5f"><enum>(g)</enum><header>Field presence of Federal coordinating officers</header><paragraph id="id6969816d60e24bf9a93a155a8f4bd7d8"><enum>(1)</enum><header>In general</header><text>The Administrator shall develop a documented risk-based approach for grants awarded under the public assistance grant program that Federal coordinating officers appointed under section 302 can use to determine appropriate cost-effective field presence required for debris removal oversight.</text></paragraph><paragraph id="id91FBAAA445A6483FB1929F3EB078CA4B"><enum>(2)</enum><header>Verifying debris amounts and reimbursement</header><subparagraph id="idadda6489d0eb480eb9cd875ac9619a60"><enum>(A)</enum><header>In general</header><text>The Administrator shall require that any entity applying for debris removal assistance under the public assistance grant program shall, as part of the assistance application, enter into a debris removal monitoring contract to conduct oversight and verification of debris removal by contractors, which shall require that one of the verification methods approved by the Administrator under subparagraph (B) be used to conduct the oversight and verification.</text></subparagraph><subparagraph id="idFA3EB4EF7D404258AEF82CC18CB46C7E"><enum>(B)</enum><header>Verification methods</header><text>For purposes of subparagraph (A), the Administrator shall, on an annual basis, develop and publish a list of approved verification methods, which may include—</text><clause id="id1D14C425F1C04F14AB8F762E488A8F6A"><enum>(i)</enum><text>a digital photograph of each load of debris to validate load tickets;</text></clause><clause id="idB7154D81F3104B34B2C5A2D40F043F02"><enum>(ii)</enum><text>a digital photograph of each truck used to haul debris to verify truck certifications; and</text></clause><clause id="id8993EF5F86F94A23B9D482DC4704DA51"><enum>(iii)</enum><text>measurements of debris piles and mulch piles for comparison and verification against a photograph described in clauses (i) and (ii).</text></clause></subparagraph></paragraph><paragraph id="id323E50F11974400387FADBD3B88ECD64"><enum>(3)</enum><header>Penalties for inaccurate accounting of debris removal amounts</header><text>Any discrepancy between the reported amount of debris collected by a contractor and the verified amount, as determined using an approved verification method under paragraph (2)(B), shall incur a penalty at 2 times the reimbursement rate of the documented discrepancy.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id2EE898539D794E459BB581686B7B37B0"><enum>(b)</enum><header>Advance contracting</header><text>Section 691 of the Post-Katrina Emergency Management Reform Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/6/791">6 U.S.C. 791</external-xref>) is amended—</text><paragraph id="id517D2669C58B41118428EF069D885C37"><enum>(1)</enum><text>in subsection (b), by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id046CC992943B41F6993CB79C87C70F46" style="OLC"><paragraph id="idB41D44F6AE1A438EAED5283A80F785F3"><enum>(5)</enum><header>Additional contracts</header><text>If it is determined under subsection (e)(2) that an advanced contract is needed for a good or service described in such subsection, the Administrator shall, to the greatest extent possible, enter into 1 or more advance contracts for that good or service.</text></paragraph><paragraph id="idB846F89633D7411382715999C6CB2A31"><enum>(6)</enum><header>Priority</header><text>To the greatest extent possible, the Administrator shall use advance contracts for goods and services before making new post-disaster contract awards for the same or similar goods and services.</text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="idD1A6CF58ED154CED8B32F5FABB5BBA2D"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id5EEEF9A2851A4987A17DD2D2938F8E38" style="OLC"><subsection id="id62C6B3B481D14472A0FE504D700B5A7F"><enum>(e)</enum><header>Annual reports</header><text>Not later than 180 days after the date of enactment of this subsection, the Administrator shall submit to the appropriate committees of Congress a report on advanced contracts that contains—</text><paragraph id="idaf52639af4474fcd878981f3b9c28b25"><enum>(1)</enum><text>a comprehensive list of advance contracts in effect as of the date the report, which shall include—</text><subparagraph id="id4C5B6479859E45FBA12EC0C94FE15B74"><enum>(A)</enum><text>the contracting entity;</text></subparagraph><subparagraph id="idA0D89927DFF8428FB13168B0AF58EE47"><enum>(B)</enum><text>the award amount;</text></subparagraph><subparagraph id="id905D085FB43646AF82E18EA825E5C0EE"><enum>(C)</enum><text>the good or service being provided under the contract; and</text></subparagraph><subparagraph id="id12E9BCD34EC94CBFA15F0B715B40B969"><enum>(D)</enum><text>the duration of the contract; and</text></subparagraph></paragraph><paragraph id="id9767549B52E746FCB7B396B2A48DA98E"><enum>(2)</enum><text>a review of the need for advance contracts that may be lacking as of the date of the report for—</text><subparagraph id="idfea1b67d3d7843e5a99a81e8a33720c2"><enum>(A)</enum><text>debris removal services;</text></subparagraph><subparagraph id="idcac903e19da34503a94eade3f31e1051"><enum>(B)</enum><text>prefabricated and portable buildings;</text></subparagraph><subparagraph id="id8dd0443122eb494089c9843c386755eb"><enum>(C)</enum><text>inspection services;</text></subparagraph><subparagraph id="iddfdaac7ac60844e0a16fea9cd9581699"><enum>(D)</enum><text>installation of power transmission equipment; and</text></subparagraph><subparagraph id="idc62128ebb43844aeb6a4aad4aef5cb4a"><enum>(E)</enum><text>other goods and services determined by the Administrator to be appropriate for advance contracts.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idEE7213A92B624CF1B1F3E634DA1B7B97"><enum>(c)</enum><header>Effective date</header><text>Subsections (b) and (c) of section 431 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act, as added by subsection (a) of this section, shall not take effect until the date that is 1 year after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
