which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To report data on COVID–19 in Federal, State, and local correctional facilities, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>COVID–19 in Corrections Data Transparency Act</short-title></quote>.</text></section><section id="idc68b951fffc34916a31c1ae25af66018"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id13dc4d6aeb044c68a5eca338e8c2c7ec"><enum>(1)</enum><header>COVID–<enum-in-header>19</enum-in-header></header><text>The term <term>COVID–19</term> means Coronavirus Disease 2019.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4413787D13C24A168EEE611FB038317B"><enum>(2)</enum><header>COVID–19 diagnostic test</header><text>The term <term>COVID–19 diagnostic test</term> means a test—</text><subparagraph commented="no" display-inline="no-display-inline" id="id874BB81767DB4698BBCC07D3A3ED5DE4"><enum>(A)</enum><text>that is an in vitro diagnostic product (as defined in section 809.3 of title 21, Code of Federal Regulations, or any successor thereto) for the detection of SARS–CoV–2 or the diagnosis of the virus that causes COVID–19; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE6A6842C0A464E54B60113FD0E0FBCC1"><enum>(B)</enum><text>the administration of which— </text><clause id="id6bb44d2bb087487e83868c085cf0f8fd"><enum>(i)</enum><text>is approved, cleared, or authorized under section 510(k), 513, 515, or 564 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360">21 U.S.C. 360(k)</external-xref>, 360c, 360e, 360bbb–3);</text></clause><clause id="id2c8a09c23a3e4e0ba81f3efc71a18160"><enum>(ii)</enum><text>the developer has requested, or intends to request, emergency use authorization under section 564 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360bbb-3">21 U.S.C. 360bbb–3</external-xref>), unless and until the emergency use authorization request under such section 564 has been denied or the developer of such test does not submit a request under such section within a reasonable timeframe;</text></clause><clause id="idb9f72c3f8d454f229f73a770b23c7542"><enum>(iii)</enum><text>is developed in and authorized by a State that has notified the Secretary of Health and Human Services of its intention to review tests intended to diagnose COVID–19; or</text></clause><clause id="id67d19b614e0b4e388767eaad03fde9e8"><enum>(iv)</enum><text>is another test that the Secretary determines appropriate in guidance. </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc530cb84d37f4b0ca63bbbcadb04caed"><enum>(3)</enum><header>COVID–19 emergency data collection period</header><text>The term <term>COVID–19 emergency data collection period</term> means the period beginning on the date of enactment of this Act and ending on the date that is 1 year after the date on which the public health emergency declaration under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>), with respect to COVID–19, terminates. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8C89E71DD3314D36A4C619F73B5792B1"><enum>(4)</enum><header>State or local correctional facility</header><text>The term <term>State or local correctional facility</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7BEB21A51BAF45FEAEB2654EAD97B180"><enum>(A)</enum><text>means a correctional facility within the jurisdiction of a State or unit of local government; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id89E140CC4EF14FCFB01431A036D3A598"><enum>(B)</enum><text>includes—</text><clause commented="no" display-inline="no-display-inline" id="id76B986FE7A3D437BB26D420BA5E6643E"><enum>(i)</enum><text>a municipal, regional, or county jail; </text></clause><clause commented="no" display-inline="no-display-inline" id="id1F02ECC66F4A4406B772997B0DCEBFBB"><enum>(ii)</enum><text>a State prison;</text></clause><clause commented="no" display-inline="no-display-inline" id="id46D5967ED0DD41C1BE1D2DBF7878468B"><enum>(iii)</enum><text>a State-run boot camp prison; </text></clause><clause commented="no" display-inline="no-display-inline" id="id2E8EDBF262F94C71B3845458B135805D"><enum>(iv)</enum><text>a boot camp prison that is contracted out by the State; </text></clause><clause commented="no" display-inline="no-display-inline" id="id08B5C7628B574C5BAB82883FB0762F8E"><enum>(v)</enum><text>a State or local contract facility; </text></clause><clause commented="no" display-inline="no-display-inline" id="idB8FDFEA0BBD84331A736A87A0D4B8D8B"><enum>(vi)</enum><text>a juvenile detention facility; </text></clause><clause commented="no" display-inline="no-display-inline" id="id1591DE641006465D9A8D1B5DACEAE9D5"><enum>(vii)</enum><text>a juvenile secure correctional facility; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id4CFBC38282B1407286CB48BB7139C086"><enum>(viii)</enum><text>any other local or State correctional facility, including any juvenile facility. </text></clause></subparagraph></paragraph></section><section id="id80002768831248b88f591222b9c10f1c"><enum>3.</enum><header>Bureau of prisons and United States Marshals Service data collection</header><subsection id="id4C7E80AF0A2F48EE8E2E67CE448938AD"><enum>(a)</enum><header>Bureau of Prisons</header><text display-inline="yes-display-inline">The Director of the Bureau of Prisons shall—</text><paragraph id="id5879EFA65CDD4FBC8467A613FCDBFFB2"><enum>(1)</enum><text>on a daily basis during the COVID–19 emergency data collection period, make available to the public on the website of the Bureau of Prisons a report on the information described in section 6, with respect to incarcerated persons and staff; and</text></paragraph><paragraph id="id4D4387885FEE43CE8A9BD1129BBD88D8"><enum>(2)</enum><text>not later than 14 days after the date on which the Director of the Centers for Disease Control and Prevention publishes the guidance required under section 5(a), but in no case later than 45 days after the date of enactment of this Act, and not less frequently than once every 7 days thereafter until the date on which the COVID–19 emergency data collection period ends, submit to the Director of the Centers for Disease Control and Prevention every 7 days, a report on the information described in section 6, with respect to incarcerated persons and staff. </text></paragraph></subsection><subsection id="id270E30F68C62482186815582E564486D"><enum>(b)</enum><header>United States Marshals Service</header><text>The Director of the United States Marshals Service shall—</text><paragraph id="id31d0de475ee74a49ba4d37d28090a20e"><enum>(1)</enum><text>on a daily basis during the COVID–19 emergency data collection period, make available to the public on the website of the United States Marshals Service a report on the information described in section 6, with respect to incarcerated persons in the custody of the United States Marshals Service, including individuals held at or employed by a State or local correctional facility contracted by Federal entities; and</text></paragraph><paragraph id="idbbfc60392a044e25b8b6eef6efd769ee"><enum>(2)</enum><text>not later than 14 days after the date on which the Director of the Centers for Disease Control and Prevention publishes the guidance required under section 5(a), but in no case later than 45 days after the date of enactment of this Act, and not less frequently than once every 7 days thereafter until the date on which the COVID–19 emergency data collection period ends, submit to the Director of the Centers for Disease Control and Prevention every 7 days, a report on the information described in section 6, with respect to incarcerated persons and staff. </text></paragraph></subsection></section><section id="ida15154d07d4e46028ff1d5ba81d0ff05"><enum>4.</enum><header>State and local correctional facility data collection</header><subsection id="idE863A237F3C94899BC527E42D51E9C89"><enum>(a)</enum><header>State and local reports</header><paragraph id="idfd14d3142b464384b5ee78c426f8aa90"><enum>(1)</enum><header>In general</header><text>Not later than 14 days after the date on which the Director of the Centers for Disease Control and Prevention publishes the guidance required under section 5(a), but in no case later than 45 days after the date of enactment of this Act, and not less frequently than once every 7 days thereafter until the date on which the COVID–19 emergency data collection period ends—</text><subparagraph id="id5C38E7DFDA5D4C5B8F1CC2D3EA6BEDAA"><enum>(A)</enum><text>the head of each State department of corrections and the head of each State juvenile justice agency shall make available to the public on the website of the department, and submit to the public health authority of the State, the data described in section 6, with respect to incarcerated persons and staff; and</text></subparagraph><subparagraph id="id3EF86DFB612E49D88B0A3BD39208B28F"><enum>(B)</enum><text>the head of each State or local correctional facility shall submit to the public health authority of the State or unit of local government, as the case may be, the data described in section 6, with respect to incarcerated persons and staff.</text></subparagraph></paragraph><paragraph id="id3CE839C3640D46EAA37550E1F48C3C49"><enum>(2)</enum><header>Submission of information to the CDC</header><text>Not later than 24 hours after a State or local public health authority receives data under paragraph (1), the head of the State or local public health authority shall submit the data to the Director of the Centers for Disease Control and Prevention.</text></paragraph><paragraph id="id2a963f3001a44de08dd5bdf4b937de64"><enum>(3)</enum><header>Byrne grant amounts</header><subparagraph id="idF3158D29181E4ACBAA9A61059C753054"><enum>(A)</enum><header>In general</header><text>If a State or jurisdiction within a State fails to comply with the requirements under paragraphs (1) and (2) in a fiscal year, the amount the State would otherwise be awarded in the following fiscal year under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10151">34 U.S.C. 10151</external-xref> et seq.) shall be reduced by 10 percent.</text></subparagraph><subparagraph id="id704D39D08A9F4CF69AB7C407707F6C06"><enum>(B)</enum><header>Report on compliance to DOJ</header><text>For purposes of carrying out this paragraph, the Director of the Centers for Disease Control and Prevention shall, not later than 30 days after the date on which the Director first receives data from a State or local public health authority and once every 30 days thereafter, submit to the Attorney General a report detailing which States, if any, are not in compliance with this Act. </text></subparagraph></paragraph></subsection><subsection id="id745f26f2e1894ea08c32315eb38eea57"><enum>(b)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Director of the Centers for Disease Control and Prevention such sums as are necessary to carry out this section.</text></subsection></section><section id="idD06F8E7F2AE444ABB693AAE1D5640E67"><enum>5.</enum><header>CDC Reports</header><subsection id="idA8874E0E6D3B46059B126B38CD21B29F"><enum>(a)</enum><header>Guidance</header><text>Not later than 30 days after the date of enactment of this Act, the Director of the Centers for Disease Control and Prevention shall issue guidance for Federal, State, and local correctional facilities on—</text><paragraph id="id77fd055de66242dda1f71ba8ad973b50"><enum>(1)</enum><text>the categories of data required to be reported under this Act; and</text></paragraph><paragraph id="id24da2065ba0f491fbf0a54c5ca767cc8"><enum>(2)</enum><text>how the Director will determine whether a State is in compliance with this Act.</text></paragraph></subsection><subsection id="id594316639472414EBF7F4C5D8B8173C9"><enum>(b)</enum><header>Publication on website</header><text>Not later than 7 days after data is reported to the Centers for Disease Control and Prevention under section 3 or 4, the Director of the Centers for Disease Control and Prevention shall make the data available to the public on the website of the Centers for Disease Control and Prevention, including all data reported by the Bureau of Prisons, the United States Marshals Service, and State and local correctional facilities. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id543189E536CE42BAA3DF3B7D84D89975"><enum>(c)</enum><header>Reports to Congress</header><text>Not later than 60 days after the date of enactment of this Act, and every 30 days thereafter until the date on which the COVID–19 emergency data collection period ends, the Director of the Centers for Disease Control and Prevention shall compile and submit to Congress, including the Committees on the Judiciary and Health, Education, Labor, and Pensions of the Senate and the Committees on the Judiciary and Energy and Commerce of the House of Representatives, a report on the information submitted by the Bureau of Prisons, the United States Marshals Service, and the head of each State department of corrections under sections 3 and 4, respectively. </text></subsection></section><section id="id48524d63d4ba4aeda447c0e74d543950"><enum>6.</enum><header>COVID–19 data</header><subsection id="id92fb5e0d4ad4407786d66bbd22e946a6"><enum>(a)</enum><header>In general</header><text>The data described in this section is the following data for each Federal, State, or local correctional facility within a State:</text><paragraph id="id5ebf40879cd0479d9a20f784746148e7"><enum>(1)</enum><header>Test numbers</header><text>COVID–19 diagnostic testing, including cumulative and new (since the previous report) counts of—</text><subparagraph id="id05fab0152775445faa03ca4c236d2b9c"><enum>(A)</enum><text>the number of incarcerated persons tested for COVID–19, disaggregated by first-time COVID–19 diagnostic tests and retests;</text></subparagraph><subparagraph id="ideced7645ee954a13afb87ab842858127"><enum>(B)</enum><text>the number of correctional facility staff tested for COVID–19, disaggregated by first-time COVID–19 diagnostic tests and retests; and</text></subparagraph><subparagraph id="ida7e008e2360849478a79fb6d8cd71a75"><enum>(C)</enum><text>the COVID–19 diagnostic test developer and test name for each COVID–19 diagnostic test conducted.</text></subparagraph></paragraph><paragraph id="id78fbc277594f48f5b02b501df7b2db6f"><enum>(2)</enum><header>Test results</header><text>COVID–19 diagnostic testing outcomes, including cumulative and new (since the previous report) counts of—</text><subparagraph id="id251d7eb6b6c040bf8de64c48804e09b8"><enum>(A)</enum><text>the number of confirmed positive tests of COVID–19 among incarcerated persons, disaggregated by first-time COVID–19 diagnostic tests and retests;</text></subparagraph><subparagraph id="id648ed362c0cc40cda4c1bd97d359922d"><enum>(B)</enum><text>the number of confirmed negative tests of COVID–19 among incarcerated persons, disaggregated by first-time COVID–19 diagnostic tests and retests;</text></subparagraph><subparagraph id="id79268ca9ca4e484993f279c641277dde"><enum>(C)</enum><text>the number of confirmed positive tests of COVID–19 among correctional facility staff, disaggregated by first-time COVID–19 diagnostic tests and retests;</text></subparagraph><subparagraph id="ida3259482f4514095a26e6cf4b760559a"><enum>(D)</enum><text>the number of confirmed negative tests of COVID–19 among correctional facility staff, disaggregated by first-time COVID–19 diagnostic tests and retests;</text></subparagraph><subparagraph id="idcff0995de07349969401413aacb13494"><enum>(E)</enum><text>the number of COVID–19 diagnostic tests pending results, disaggregated by incarcerated persons and correctional facility staff;</text></subparagraph><subparagraph id="idf57182a7978a4ac6875d088b98383aa3"><enum>(F)</enum><text>the average time between testing an incarcerated person for COVID–19 and receiving the results of the COVID–19 diagnostic test; and</text></subparagraph><subparagraph id="id1a2469bcf7bd4ff09cdf0b273887298b"><enum>(G)</enum><text>the average time between testing a correctional facility employee for COVID–19 and receiving the results of the COVID–19 diagnostic test.</text></subparagraph></paragraph><paragraph id="idce6f3ae59d774079bad337b155dbc67f"><enum>(3)</enum><header>Case outcomes</header><text>COVID–19 case outcomes, including cumulative and new (since the previous report) counts of—</text><subparagraph id="id1b7c7fd7bb764a999be3fc0f1f670f37"><enum>(A)</enum><text>the number of incarcerated persons hospitalized with COVID–19;</text></subparagraph><subparagraph id="id21b7ad58622647bea7a5515582edd100"><enum>(B)</enum><text>the number of incarcerated persons who have recovered from COVID–19;</text></subparagraph><subparagraph id="id8de13a6d62634f279e4703e44178d991"><enum>(C)</enum><text>the number of incarcerated persons currently in quarantine or medical isolation for exposure to or infection with COVID–19; </text></subparagraph><subparagraph id="id0C5894705FC6421EB0959F6BF762D617"><enum>(D)</enum><text>the number of incarcerated persons who have completed quarantine or been released from medical isolation;</text></subparagraph><subparagraph id="id426a6fd691324156af795e023044b16f"><enum>(E)</enum><text>the number of incarcerated persons who have died from a case of COVID–19;</text></subparagraph><subparagraph id="id86e0a6cee17d46fb8b7a585ebd054122"><enum>(F)</enum><text>the number of correctional facility staff hospitalized with COVID–19;</text></subparagraph><subparagraph id="id5b899ac22f2840e7ae97105665107b18"><enum>(G)</enum><text>the number of correctional facility staff who have recovered from COVID–19; and</text></subparagraph><subparagraph id="ide34d249743ca4a8db710fc6551c40a95"><enum>(H)</enum><text>the number of correctional facility staff who have died from a case of COVID–19. </text></subparagraph></paragraph><paragraph id="id079a5e2dd96c4dbe8e3356c2cfc9b210"><enum>(4)</enum><header>Release of incarcerated persons</header><text>In the case of incarcerated persons, data related to the release of such incarcerated persons, including individuals released to home confinement and pursuant to compassionate release, as a result of the COVID–19 public health emergency.</text></paragraph><paragraph id="id2841abfe52494904b82a38e4f1b436ff"><enum>(5)</enum><header>Daily population</header><text>Average daily population, the number of individuals who were newly admitted to the facility, and the number of individuals who were released from the facility for the week preceding the COVID–19 emergency data collection period and for all weeks during this period.</text></paragraph><paragraph id="idF2BE9EBBDC7A4CDF815291D16E2382DD"><enum>(6)</enum><header>Vaccinations</header><text>Data related to distribution of the COVID–19 vaccine, including—</text><subparagraph id="ida855f93868354fbd9de9258e167f1a64"><enum>(A)</enum><text>the policies of the facility relating to the distribution of the COVID–19 vaccination to incarcerated persons and correctional facility staff, including how the facility is prioritizing distribution, both among correctional facility staff and incarcerated persons, and any changes or updates made to the policies; </text></subparagraph><subparagraph id="id004596530f9841fe838ed76112568583"><enum>(B)</enum><text>the total number of COVID–19 vaccine doses that the facility has received up to the date of the report; </text></subparagraph><subparagraph id="id34158c8416034e90aa06a795f27ed3ce"><enum>(C)</enum><text>the total number and percentage of incarcerated persons who—</text><clause id="idF9E1AE1761564387935D5FF4BABABC89"><enum>(i)</enum><text>have been offered a COVID–19 vaccine; </text></clause><clause id="idF5A84314B5274BB38CAC6A47FF7185B4"><enum>(ii)</enum><text>have received a first dose of the COVID–19 vaccine up to the date of the report; </text></clause><clause id="id2263135A9D5648EAB4578D0D4337AF82"><enum>(iii)</enum><text>are fully vaccinated, either because the person received a second dose of the COVID–19 vaccine or because the COVID–19 vaccine the person received required only 1 dose; </text></clause><clause id="id947D3177718F490E84EA54084B8C6C14"><enum>(iv)</enum><text>declined the COVID–19 vaccine; and</text></clause><clause id="id231388E7D24A4871B049521A183A104A"><enum>(v)</enum><text>are housed in a skilled nursing level housing unit or hospice and have—</text><subclause id="id36FA31D9756F43A8BA5BF2E3F67F9BCF"><enum>(I)</enum><text>not received the COVID–19 vaccine; </text></subclause><subclause id="idE62C5C0402C64660809E7211D3F26698"><enum>(II)</enum><text>accepted the COVID–19 vaccine; and</text></subclause><subclause id="id509E93DA2BF443659F41CDDE3ECAEC53"><enum>(III)</enum><text>decline the COVID–19 vaccine; </text></subclause></clause></subparagraph><subparagraph id="idBE373A30357E48AD8DB40B49522EA406"><enum>(D)</enum><text>the total number and percentage of correctional facility staff—</text><clause id="idD81DDAE686F3405C94F6726EA8A1B11B"><enum>(i)</enum><text>have been offered a COVID–19 vaccine; </text></clause><clause id="id74D20408F6874EDEB6CC5515A62FCF67"><enum>(ii)</enum><text>have received a first dose of the COVID–19 vaccine in up to the date of the report; </text></clause><clause id="id3EE16DBEB9DD4537A670CC90E11A1561"><enum>(iii)</enum><text>are fully vaccinated, either because the person received a second dose of the COVID–19 vaccine or because the COVID–19 vaccine the person received required only 1 dose; and</text></clause><clause id="idC0BF5F44659147159254A1CA9B7BC1F7" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text>declined the COVID–19 vaccine; and</text></clause></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idB12C52CE73334317B4CCB3FD96B910B0"><enum>(E)</enum><text>in the case of incarcerated persons and correctional facility staff described in subparagraph (C)(iv) or (D)(iv), respectively, the 3 most common reasons given for declining the COVID–19 vaccine.</text></subparagraph></paragraph></subsection><subsection id="ideea354a8c5ef450cb8a5795e8df306b7"><enum>(b)</enum><header>Disaggregation of data</header><text>The data described in this section shall be disaggregated by sex (including sexual orientation and gender identity), age, race, ethnicity, disability, and geography (including county and State).</text></subsection><subsection id="id1365c291e1a44c7d841569856e87c7fa"><enum>(c)</enum><header>Incarcerated persons data</header><text>The data described in this section with respect to incarcerated persons who are serving a term of imprisonment and who are infected with COVID–19 shall include, to the extent practicable, the term of imprisonment imposed on such incarcerated persons and the time served on such term of imprisonment.</text></subsection></section><section id="id59cb164df6354f1fa299f215f2428ce0"><enum>7.</enum><header>Privacy protections</header><text display-inline="no-display-inline">Any data collected, stored, received, or published under this Act shall—</text><paragraph id="ida7c2ea89bc0b4450bc2ae0c9e8728714"><enum>(1)</enum><text>be so collected, stored, received, or published in a manner that protects the privacy of individuals whose information is included in such data;</text></paragraph><paragraph id="idA5A34CBA5C9743CC9256563DD0A2A4D4"><enum>(2)</enum><text>be de-identified or anonymized in a manner that protects the identity of all individuals whose information is included in such data; </text></paragraph><paragraph id="idbaa5796da5704b65bcbf2e03660bb76e"><enum>(3)</enum><text>comply with privacy protections provided under the regulations promulgated under section 264(c) of the Health Insurance Portability and Accountability Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/1320d-2">42 U.S.C. 1320d–2</external-xref> note); and </text></paragraph><paragraph id="id6342bdf5994e444ca600e6d802c7376a"><enum>(4)</enum><text>be limited in use for the purpose of public health and be protected from all other internal use by any entity that collects, stores, or receives the data, including use of such data in determinations of eligibility (or continued eligibility) in health plans, and from any other inappropriate uses.</text></paragraph></section></legis-body></bill>
