<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3248</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211118">November 18, 2021</action-date><action-desc><sponsor name-id="S350">Mr. Rubio</sponsor> (for himself, <cosponsor name-id="S397">Mr. Braun</cosponsor>, <cosponsor name-id="S398">Mr. Cramer</cosponsor>, and <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To allow States and Tribal entities to use unexpended COVID–19 relief funds to pay fines on behalf of employers for violating the emergency temporary standard issued by the Department of Labor relating to COVID–19 Vaccination and Testing and any final rule issued with respect to such emergency temporary standard, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Working Families from Federal Overreach Act</short-title></quote>.</text></section><section id="id809EF40DB6AD46529B34C6D7D7F5B241"><enum>2.</enum><header>Violations of COVID–19 vaccination and testing requirements</header><subsection id="id1CF0782A3F144BD79CF239DEFF876A31"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a State or Tribal entity may use unexpended COVID–19 relief funds distributed to the State or Tribal entity in order to pay, on behalf of an employer operating in the State or on land under the jurisdiction of the Tribal entity, any fine imposed on the employer for violating the emergency temporary standard issued by the Department of Labor relating to <quote>COVID–19 Vaccination and Testing; Emergency Temporary Standard</quote> (86 Fed. Reg. 61402 (November 5, 2021)), or any final rule issued with respect to such emergency temporary standard.</text></subsection><subsection id="id93C9AD87BE4B4CCD939765CD23497450"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idC0BD2D2C93C04A11A4C9441F428B0E96"><enum>(1)</enum><header>COVID–19 relief funds</header><text>The term <term>COVID–19 relief funds</term> means amounts appropriated by the Federal Government for COVID–19 response or relief, including such amounts appropriated under—</text><subparagraph id="id87123AC9A7084B25BAE8F2BD6785E8F5"><enum>(A)</enum><text>the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>);</text></subparagraph><subparagraph id="idF80F5B719EA741B5A87B8EC837F99F55"><enum>(B)</enum><text>the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>); or</text></subparagraph><subparagraph id="idF6110251759944689888D2C0E24EDA04"><enum>(C)</enum><text>the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>).</text></subparagraph></paragraph><paragraph id="id1AF1FC768EAA4E119613FFE2C2985A2D"><enum>(2)</enum><header>Employer</header><text>The term <term>employer</term> has the meaning given such term in section 3 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/652">29 U.S.C. 652</external-xref>).</text></paragraph><paragraph id="id03108E6A65064BB08712E7D6B1512E96"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means each of the 50 States, the District of Columbia, and any territory of the United States. </text></paragraph></subsection></section></legis-body></bill>
