<official-title>To extend certain expiring provisions of law relating to benefits provided under Department of Veterans Affairs educational assistance programs during the COVID–19 pandemic, and for other purposes.</official-title>

<section section-type="section-one" id="H3EB8FCB0BC2C4F06BB2AF4847F72C0EF"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Responsible Education Mitigating Options and Technical Extensions Act of 2021</short-title></quote> or the <quote><short-title>REMOTE Act of 2021</short-title></quote>.</text></section> <section id="H2DA486082466438699324CC9967100AE"><enum>2.</enum><header>Extensions of certain provisions of law relating to benefits provided under Department of Veterans Affairs educational assistance programs during COVID–19 pandemic</header> <subsection id="H0260370BF5584FF1A4685863F6C25559"><enum>(a)</enum><header>Extension of student veteran coronavirus response act of 2020</header><text display-inline="yes-display-inline">Section 2 of the Student Veteran Coronavirus Response Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/140">Public Law 116–140</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/3031">38 U.S.C. 3031</external-xref> note), as amended by section 5202(a) of the Department of Veterans Affairs Expiring Authorities Act of 2020 (division E of <external-xref legal-doc="public-law" parsable-cite="pl/116/159">Public Law 116–159</external-xref>), is further amended by striking <quote>December 21, 2021</quote> and inserting <quote>June 1, 2022</quote>.</text></subsection>
<subsection id="HD2B6230CCDF04F94AFAE9B0DA7EA3FAB"><enum>(b)</enum><header>Extension of payment of work-Study allowances during emergency situation</header><text display-inline="yes-display-inline">Section 3 of the Student Veteran Coronavirus Response Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/38/3485">38 U.S.C. 3485</external-xref> note) is amended by striking <quote>During the covered period</quote> and inserting <quote>During the period beginning on March 1, 2020, and ending on June 1, 2022</quote>.</text></subsection> <subsection id="H64BE2181A2FE4F63A60B4CF51546848B"><enum>(c)</enum><header>Extension of period for continuation of Department of Veterans Affairs educational assistance benefits for certain programs of education converted to distance learning by reason of emergencies and health-Related situations</header><text display-inline="yes-display-inline">Section 1(b) of <external-xref legal-doc="public-law" parsable-cite="pl/116/128">Public Law 116–128</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/38/3001">38 U.S.C. 3001</external-xref> note prec.), as amended by section 5202(b) of the Department of Veterans Affairs Expiring Authorities Act of 2020 (division E of <external-xref legal-doc="public-law" parsable-cite="pl/116/159">Public Law 116–159</external-xref>), is further amended by striking <quote>December 21, 2021</quote> and inserting <quote>June 1, 2022</quote>.</text></subsection>
<subsection commented="no" id="H6CE4DBA4DD374364A47E8702C4991C79"><enum>(d)</enum><header>Extension of modification of time limitations on use of entitlement to Montgomery GI bill and vocational rehabilitation and training</header><text>Section 1105 of the Johnny Isakson and David P. Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/315">Public Law 116–315</external-xref>) is amended by striking <quote>December 21, 2021</quote> each place it appears and inserting <quote>June 1, 2022</quote>.</text></subsection> <subsection id="H725DE4CAE98649E68ECC596A4C68CC3E"><enum>(e)</enum><header>Extension of continuation of Department of Veterans Affairs educational assistance benefits during COVID–19 emergency</header><text>Section 1102(e) of the Johnny Isakson and David P. Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/315">Public Law 116–315</external-xref>) is amended by striking <quote>December 21, 2021</quote> and inserting <quote>June 1, 2022</quote>.</text></subsection>
<subsection id="H58CEA1C5AB5C4DD28E2F9E499993C446"><enum>(f)</enum><header>Extension of provisions relating to effects of closure of educational institution and modification of courses by reason of COVID–19 emergency</header><text>Section 1103(h) of such Act is amended by striking <quote>December 21, 2021</quote> and inserting <quote>June 1, 2022</quote>.</text></subsection> <subsection id="H8AB93157C36147E5BF146972DD466DD3"><enum>(g)</enum><header>Extension of provision relating to payment of educational assistance in cases of withdrawal</header><text>Section 1104(a) of such Act is amended by striking <quote>December 21, 2021</quote> and inserting <quote>June 1, 2022</quote>.</text></subsection>
<subsection id="H5C110CB4A2344ED7B145EAB1396EC8C8"><enum>(h)</enum><header>Extension of provision relating to apprenticeship or on-Job training requirements</header><text>Section 1106(b) of such Act is amended by striking <quote>December 21, 2021</quote> and inserting <quote>June 1, 2022</quote>.</text></subsection></section> <section id="HFA6463D281B84E55A57EEC9B62B0E32F"><enum>3.</enum><header>Modifications to requirements for educational institutions participating in the educational assistance programs of the Department of Veterans Affairs</header> <subsection id="H639EF3DF2F8546759AAF827455A6B056"><enum>(a)</enum><header>Waiver of verification of enrollment for certain educational institutions</header><text display-inline="yes-display-inline">Section 3313(l) of title 38, United States Code, is amended by adding at the end the following new paragraph:</text>
<quoted-block style="USC" display-inline="no-display-inline" id="H58C26B686692453CBE27CE65A5EDE752">
<paragraph id="HB14887714FC84C77A06F8D987DFF2738"><enum>(4)</enum><header>Waiver</header><text display-inline="yes-display-inline">The Secretary may waive the requirements of this subsection for an educational institution that the Secretary has determined uses a flat tuition and fee structure that would make the use of a second verification under this subsection unnecessary.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H21E1413D26F6451B9F0C46DF99AB4447"><enum>(b)</enum><header>Limitations on authority To disapprove of courses</header> <paragraph id="H9A05CD4D6EB6431F869F13E5DE0EC730"><enum>(1)</enum><header>In general</header><text>Subsection (f) of section 3679 of title 38, United States Code, is amended—</text>
<subparagraph id="H1051E386B0464A4D97872B656F4860A7"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (2)(B),</text> <clause id="HFB352F5316A140FF92D79AF34D7CCDF5"><enum>(i)</enum><text>by inserting <quote>, except for the recruitment of foreign students residing in foreign countries who are not eligible to receive Federal student assistance</quote> after <quote>assistance</quote>; and</text></clause>
<clause id="HC96BA7B80508408ABB854551D9711487"><enum>(ii)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block style="USC" display-inline="no-display-inline" id="H32912039A1C745A99E52D2C004C356CA"> <subparagraph display-inline="no-display-inline" id="H4278318FFBC54BA89C14C075BAAC190D" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">In determining whether a violation of subparagraph (B) has occurred, the State approving agency, or the Secretary when acting in the place of the State approving agency, shall construe the requirements of this paragraph in accordance with the regulations and guidance prescribed by the Secretary of Education under section 487(a)(20) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(a)(20)</external-xref>).</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph>
<subparagraph id="H17E37894766B44759E068EEFDA15D43A"><enum>(B)</enum><text>by redesignating paragraph (7) as paragraph (8); and</text></subparagraph> <subparagraph id="H3C8FCD9AAAE5483EBDF22553FB871F6B"><enum>(C)</enum><text>by inserting after paragraph (6) the following new paragraph (7): </text>
<quoted-block style="USC" display-inline="no-display-inline" id="H28CA611F667B48AD9C65AA7350683DA5">
<paragraph id="H075FEDC692194436A6DAF93FD0D39CD5" indent="up1"><enum>(7)</enum><text display-inline="yes-display-inline">This subsection shall not apply to an educational institution—</text> <subparagraph id="H19760369720B4EC5B57678CCF7C24721"><enum>(A)</enum><text>located in a foreign country; or</text></subparagraph>
<subparagraph id="H4E9088118039453B8B3AD421A9FC9A65"><enum>(B)</enum><text display-inline="yes-display-inline">that provides to a covered individual consumer information regarding costs of the program of education (including financial aid available to such covered individual) using a form or template developed by the Secretary of Education.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H0B44AF7986994574B09DD6AA9CF1770A"><enum>(2)</enum><header>Application date</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs may not carry out subsection (f) of section 3679 of title 38, United States Code, until August 1, 2022, except that, beginning on June 15, 2022, an educational institution may submit an application for a waiver under paragraph (5) of such subsection.</text></paragraph>
<paragraph id="H5B2D064E43084F089D7D20D0B96D1C8B"><enum>(3)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Subsection (c) of section 3696 of such title is amended—</text> <subparagraph id="HDF89CAE5D1FA4FE0B79574E745383F7A"><enum>(A)</enum><text>by inserting <quote>(1)</quote> before <quote>An educational</quote>; </text></subparagraph>
<subparagraph id="HB5CD04D255A54E8A938F9074B67F0035"><enum>(B)</enum><text>by inserting <quote>, except for the recruitment of foreign students residing in foreign countries who are not eligible to receive Federal student assistance</quote> after <quote>assistance</quote>; and</text></subparagraph> <subparagraph id="H6E4E898FCC6A430BA288732FA163F49D"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="HA069E4BA748847BEA1B4D0D704220F9B" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In determining whether a violation of paragraph (1) has occurred, the Under Secretary for Benefits shall construe the requirements of this paragraph in accordance with the regulations and guidance prescribed by the Secretary of Education under section 487(a)(20) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(a)(20)</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> <subsection commented="no" id="H7E1C19AFD6DE4EDDB666476E63A33E3F"><enum>(c)</enum><header>Exemption of foreign schools from certain requirements</header> <paragraph commented="no" id="H15695604B56C48E296E69B3B5FB77B93"><enum>(1)</enum><header>Information relating to tests</header><text>Section 3689(c) of title 38, United States Code, is amended by adding at the end the following new paragraph:</text>
<quoted-block style="USC" display-inline="no-display-inline" id="H51ADBCDBA11F43548E34B38A6C9CB85A">
<paragraph commented="no" id="HECF9C9FD683A49019897148E6045623F" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Subparagraph (G) of paragraph (1) shall not apply with respect to an educational institution located in a foreign country.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph commented="no" id="H38F80BDA929140D79C388004F7E06BC4"><enum>(2)</enum><header>Examination of records</header><text display-inline="yes-display-inline">Section 3690(c) of title 38, United States Code, is amended—</text>
<subparagraph commented="no" id="H68ADDABD143F41A0A7C75FD4EE985032"><enum>(A)</enum><text>by striking <quote>Notwithstanding</quote> and inserting <quote>(1) Except as provided in paragraph (2), notwithstanding</quote>; and</text></subparagraph> <subparagraph commented="no" id="HAC72C7B9E9BA4FA489D6D40B3A444C13"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text>
<quoted-block style="USC" display-inline="no-display-inline" id="HD89E8A6D1EBC44DA957CE1883CF5E1FD">
<paragraph commented="no" id="HBC735466F0524B14B9232EAE688FEF3E" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Paragraph (1) does not apply to the records and accounts—</text> <subparagraph commented="no" id="H8F4E0C7B62B946D48990DFE201AE0C38"><enum>(A)</enum><text>of an educational institution located in a foreign country; and</text></subparagraph>
<subparagraph commented="no" id="H08FDD94545E24C9997537393ACFAC0C4"><enum>(B)</enum><text>that pertain to an individual who is not receiving educational assistance under this chapter.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section> <section display-inline="no-display-inline" section-type="subsequent-section" id="H0A6532C732C34BD6B7339847FC85530B"><enum>4.</enum><header>Continuation of Department of Veterans Affairs educational assistance benefits for certain programs of education converted to distance learning by reason of emergencies and health-related situations</header> <subsection id="H361D5C58DC6B483CA2C3B43B0E4ED65C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a program of education approved by a State approving agency, or the Secretary of Veterans Affairs when acting in the role of a State approving agency, that is converted from being offered on-site at an educational institution to being offered by distance learning by reason of an emergency or health-related situation, as determined by the Secretary, the Secretary may continue to provide educational assistance under the laws administered by the Secretary without regard to such conversion, including with respect to paying any—</text>
<paragraph id="HA97CDE2181314F97B531CF96D9354798"><enum>(1)</enum><text>monthly housing stipends under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/33">chapter 33</external-xref> of title 38, United States Code; or</text></paragraph> <paragraph id="HE48680014A464FEEB858BD90AFBECBCA"><enum>(2)</enum><text>payments or subsistence allowances under chapters 30, 31, 32, and 35 of such title and chapters 1606 and 1607 of title 10, United States Code.</text></paragraph></subsection>
<subsection id="H68F94C397A324009AEC859F5CB27444E"><enum>(b)</enum><header>Applicability period</header><text display-inline="yes-display-inline">Subsection (a) shall apply during the period beginning on December 21, 2021, and ending on June 1, 2022.</text></subsection> <subsection id="HA930E9DA6B4F4E9FAC1FCE3CF67C09CC"><enum>(c)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H9BD01AA647714010A45A446F2D64C8B5"><enum>(1)</enum><header>Educational institution</header><text display-inline="yes-display-inline">The term <term>educational institution</term> has the meaning given that term in section 3452 of title 38, United States Code, and includes an institution of higher learning (as defined in such section).</text></paragraph> <paragraph id="H9B92A9847EFE49EC90951FE56F40DD72"><enum>(2)</enum><header>Program of education</header><text>The term <term>program of education</term> has the meaning given that term in section 3002 of title 38, United States Code. </text></paragraph>
<paragraph id="HA02C3A16C9714918BEBDDC88E900E3F2"><enum>(3)</enum><header>State approving agency</header><text>The term <term>State approving agency</term> has the meaning given that term in section 3671 of title 38, United States Code.</text></paragraph></subsection></section> <section id="H49FED689791646D3A32D6362285CDF04"><enum>5.</enum><header>Budgetary effects</header> <subsection id="H2E5D20D0B80A4B7CAB7A24407FC3C806"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Amounts provided to carry out the amendments made by this Act are designated as an emergency requirement pursuant to section 4(g) of the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/933">2 U.S.C. 933(g)</external-xref>).</text></subsection>
<subsection id="H9EDE7B9B6B1D45B68AF3A7FE530916CB"><enum>(b)</enum><header>Designation in Senate</header><text>In the Senate, amounts provided to carry out the amendments made by this Act are designated as an emergency requirement pursuant to section 4112(a) of H. Con. Res. 71 (115th Congress), the concurrent resolution on the budget for fiscal year 2018.</text></subsection></section> </legis-body> </bill>
