which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Public Health Service Act to establish a Bio-Preparedness and Infectious Diseases Workforce Loan Repayment Program.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bolstering Infectious Outbreaks Preparedness Workforce Act of 2021</short-title></quote> or the <quote><short-title>BIO Preparedness Workforce Act of 2021</short-title></quote>.</text></section><section id="id3055DA8BD43D4637A4295194BC7BCB46"><enum>2.</enum><header>Establishment of a Bio-Preparedness and Infectious Diseases Workforce Loan Repayment Program</header><text display-inline="no-display-inline">Subpart 3 of part E of title VII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/295f">42 U.S.C. 295f et seq.</external-xref>) is amended by inserting after section 776 (<external-xref legal-doc="usc" parsable-cite="usc/42/295f-1">42 U.S.C. 295f–1</external-xref>) the following:</text><quoted-block id="id949F671206C34A0ABEE3AA8A9ED34FF1" style="OLC" act-name=""><section section-type="subsequent-section" id="id08840B73498140BE9F61A3BA8351B3A2"><enum>776A</enum><header>Bio-Preparedness and Infectious Diseases Workforce Loan Repayment Program</header><subsection id="id1910E5DAEBEE4CB09A94D117F15E31C3"><enum>(a)</enum><header>Establishment</header><text>The Secretary, acting through the Administrator of the Health Resources and Services Administration, shall establish the Bio-Preparedness and Infectious Diseases Workforce Loan Repayment Program (referred to in this section as the <quote>Program</quote>) to ensure an adequate supply of health care professionals engaged in bio-preparedness and response activities described in subsection (c)(2)(A)(1) and health care professionals engaged in infectious disease care described in subsection (c)(2)(A)(ii).</text></subsection><subsection id="id7FB9E6832F6A439E90639FCDFE22E09F"><enum>(b)</enum><header>Eligibility</header><paragraph id="id1B21B025D22946529960B23E15E07E0A"><enum>(1)</enum><header>In general</header><text>To be eligible to participate in the Program, an individual shall—</text><subparagraph id="idC5B14CEDEBDC4D298CB623BF1359ECF0"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id83B7468B9D2F46A58BB2BFB782601D13"><enum>(i)</enum><text>be accepted for enrollment, or be enrolled, as a student in an accredited academic educational institution in a State or territory in the final year of a course of study or program leading to a health professions degree or certificate described in paragraph (2); or</text></clause><clause id="id5512CF326A5741AA848688DE223A5874" indent="up1"><enum>(ii)</enum><text>have graduated, during the preceding 10-year period, from an accredited educational institution in a State or territory and received a health professions degree or certificate described in paragraph (2);</text></clause></subparagraph><subparagraph id="id5CB6D0F90D984972B914C674ED16E143"><enum>(B)</enum><text>be a United States citizen;</text></subparagraph><subparagraph id="id6A41B20D46004B73845999523F67E620"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="id807A3586C0B045CD89D26E042A5E61DA"><enum>(i)</enum><text>submit an application to the Secretary to participate in the Program; and</text></clause><clause id="id94ED12ACC8974319B57ABCF31A9EF3BE" indent="up1"><enum>(ii)</enum><text>execute a written contract as required in subsection (c); and</text></clause></subparagraph><subparagraph id="id7926222FF2FE4670BDC6C2EBACE180CA"><enum>(D)</enum><text>not have received, for the same service, a reduction of loan obligations under—</text><clause id="id21461108AB074CFC9C814CE3088B8DF5"><enum>(i)</enum><text>section 338B, 338I, 776, or 846; or</text></clause><clause id="id78E491D2208746D2B01D99B7D8313AB5"><enum>(ii)</enum><text>section 428K or 428L of the Higher Education Act of 1965.</text></clause></subparagraph></paragraph><paragraph id="id18DFE5CD8E0C433C907862DF26F5D952"><enum>(2)</enum><header>Health professions degree or certificate</header><text>A health professions degree or certificate described in this paragraph is a degree or certificate for—</text><subparagraph id="idE15F73BD2B194B6F8FD916E7397D8268"><enum>(A)</enum><text>a doctor of medicine;</text></subparagraph><subparagraph id="id1C03F1134D09491A8831D0E410AF4D24"><enum>(B)</enum><text>a doctor of osteopathic medicine;</text></subparagraph><subparagraph id="idB15E3461BAFE4A22944B747B12D7F416"><enum>(C)</enum><text>a doctor of philosophy;</text></subparagraph><subparagraph id="idBA0DBEDB8DA447169C4A7379F65EB547"><enum>(D)</enum><text>a doctor of pharmacy;</text></subparagraph><subparagraph id="idB447656B9BA740A3B0472C09C7920007"><enum>(E)</enum><text>certification as a registered nurse;</text></subparagraph><subparagraph id="id6d668b8a154144ea8ccb4557c6bf414c"><enum>(F)</enum><text>a bachelor of science in nursing;</text></subparagraph><subparagraph id="ideffb55034f484e23b57187c2281de5d3"><enum>(G)</enum><text>a master of science in nursing;</text></subparagraph><subparagraph id="id376604dda3624a04bb4957c1b889b773"><enum>(H)</enum><text>certification as a nurse practitioner;</text></subparagraph><subparagraph id="id92055ae4eb6e4c4ea94f6b08869aa038"><enum>(I)</enum><text>certification as a physician assistant;</text></subparagraph><subparagraph id="id323bf6a870884830b52e2b3df0baa640"><enum>(J)</enum><text>a doctor of public health; </text></subparagraph><subparagraph id="ida3c43efeeb4e4113978532c13f17c700"><enum>(K)</enum><text>a master of public health;</text></subparagraph><subparagraph id="ided3c45de7d2a407eb10b410d7d9953b7"><enum>(L)</enum><text>a master of science in epidemiology;</text></subparagraph><subparagraph id="id684ca70c5b404009a1a15fc35d828a47"><enum>(M)</enum><text>a bachelor of science in medical technology;</text></subparagraph><subparagraph id="id73b1872093124d01a493fcf201262584"><enum>(N)</enum><text>certification in medical technology or as a medical lab scientist;</text></subparagraph><subparagraph id="id0ae96ab6333d457d8d0e56830e44b44c"><enum>(O)</enum><text>a doctor of dental surgery, doctor of medicine in dentistry, or doctor of dental medicine; and</text></subparagraph><subparagraph id="id4a43d664ec74437ea3b09decaecc7eae"><enum>(P)</enum><text>completion of any other program determined appropriate by the Secretary.</text></subparagraph></paragraph></subsection><subsection id="id066E80105802435A9E5037ECE5A63B4D"><enum>(c)</enum><header>Contract</header><paragraph id="id7A6218EE73864C948F0F7E151583613F"><enum>(1)</enum><header>In general</header><text>The written contract (referred to in this section as the <quote>written contract</quote>) between the Secretary and an individual shall contain—</text><subparagraph id="idCFFEB4D2CA1C44FFACAC2B9427770F58"><enum>(A)</enum><text>an agreement on the part of the Secretary that the Secretary will repay on behalf of the individual loans incurred by the individual in the pursuit of the relevant degree or certificate in accordance with the terms of the contract;</text></subparagraph><subparagraph id="idCF46196485D94316988FFA818213C163"><enum>(B)</enum><text>an agreement on the part of the individual that the individual will serve as a health care professional engaged in a qualified role for a period of time (referred to in this section as the <quote>period of obligated service</quote>) equal to the greater of—</text><clause id="id62C8D7B6DB2F437985AB772E16CCA4A4" commented="no"><enum>(i)</enum><text>3 years; or</text></clause><clause id="id19D5915471884B88AD613FF86933D589" commented="no"><enum>(ii)</enum><text>such longer period of time as determined appropriate by the Secretary and the individual;</text></clause></subparagraph><subparagraph id="IDA40F5E4216574FCC8D6253557065F46F"><enum>(C)</enum><text>a provision that any financial obligation of the United States arising out of a contract entered into under this section and any obligation of the individual that is conditioned thereon, is contingent on funds being appropriated for loan repayments under this section;</text></subparagraph><subparagraph id="ID30AB4F7217994771A0D90ECB8AF72859"><enum>(D)</enum><text>a statement of the damages to which the United States is entitled, under this section for the individual's breach of the contract; and</text></subparagraph><subparagraph id="ID0645AD51CAA04C7AB757B1DAEF6F56C5"><enum>(E)</enum><text>such other statements of the rights and liabilities of the Secretary and of the individual, not inconsistent with this section.</text></subparagraph></paragraph><paragraph id="id71B4F2CF2BDF400C9654C76512745E56"><enum>(2)</enum><header>Qualified role</header><subparagraph id="idC7EC6C79D17342A68ABDBFD9D1BDB430"><enum>(A)</enum><header>In general</header><text>In this subsection, the term <term>qualified role</term> means either of the following:</text><clause id="id22AFBBF190CA425FBD2B1E218A241295"><enum>(i)</enum><header>Bio-preparedness health care professional</header><text>A role in which the health care professional spends not less than 50 percent of their time engaged in bio-preparedness and response activities, including—</text><subclause id="id6940AFD9FA7B45038B4930D5DBAF5D0C"><enum>(I)</enum><text>developing and updating response, surge, and isolation capacity plans and protocols;</text></subclause><subclause id="idC5C018F50D22490BB5F1C0363E4388D4"><enum>(II)</enum><text>collaborating with State, local, and Tribal health departments on preparedness and response efforts;</text></subclause><subclause id="id779A35157AA84F2C987CBBFD371A0030"><enum>(III)</enum><text>training health care facility personnel in matters related to bio-preparedness;</text></subclause><subclause id="id43B415D1879E4BE39F5EED19D551481C"><enum>(IV)</enum><text>purchasing and managing equipment (such as personal protective equipment) for public health emergencies, including those declared under section 319; </text></subclause><subclause id="id4540F78C464845CBA294C085C1A7EE62"><enum>(V)</enum><text>executing readiness assessments for public health emergencies, including those declared under section 319;</text></subclause><subclause id="id8C8C177DF58E4566BB473B4742E2A0EA"><enum>(VI)</enum><text>repurposing areas of a health care facility to manage patient influx;</text></subclause><subclause id="idEA45C1A318004D2F8C7CAD6C56841658"><enum>(VII)</enum><text>communicating with the public regarding preventing or responding to public health emergencies, including those declared under section 319;</text></subclause><subclause id="id878A4863A77F44488A8D1C316093D347"><enum>(VIII)</enum><text>performing infection prevention and control and environmental disinfection; </text></subclause><subclause id="idCC1013ABBA4D4BC0AB16D0FD0D7896D9"><enum>(IX)</enum><text>conducting epidemiologic surveillance and investigations; and</text></subclause><subclause id="idA1F48FE1EF464D41AACDE86266A4EFC3"><enum>(X)</enum><text>conducting antimicrobial stewardship. </text></subclause></clause><clause id="id375246D5EEAD472CA78E80EDA782E3B4"><enum>(ii)</enum><header>Infectious diseases health care professional</header><text>A role (including through a fellowship) in which the health care professional spends not less than 50 percent of their time engaging in infectious disease care—</text><subclause id="id5A0C8925B09442FE9B4E9BED599D7A54"><enum>(I)</enum><text>in a medically underserved community;</text></subclause><subclause id="id9486CFAA1DE34DB2943A45EE29576E9B"><enum>(II)</enum><text>for a medically underserved population as defined in section 330(b)(3);</text></subclause><subclause id="id8BE3F680066D4951A3CC0127D64D6254"><enum>(III)</enum><text>at a Federally qualified health center or rural health clinic (as those terms are defined in section 1861(aa) of the Social Security Act);</text></subclause><subclause id="id1B839AEAA3E242EEA7A4E9D7D5D1D0A6"><enum>(IV)</enum><text>at a health center receiving assistance under section 330;</text></subclause><subclause id="id03091C0FF9A945A7AF5CDD63EB9CA464"><enum>(V)</enum><text>at a Federal medical facility;</text></subclause><subclause id="idB86A1E83DF4F48789C37B83D8B52231D"><enum>(VI)</enum><text>in a health program, or at a facility operated, by an Indian Tribe or Tribal organization (as those terms are defined in section 4 of the Indian Self-Determination and Education Assistance Act) or by an urban Indian organization as defined in section 4 of the Indian Health Care Improvement Act;</text></subclause><subclause id="id3051AE3A587D4598863C478969CB3F37"><enum>(VII)</enum><text>in a health professional shortage area as designated under section 332;</text></subclause><subclause id="id2E8A929472F14F70A46DB60458B07006"><enum>(VIII)</enum><text>at an entity receiving assistance under title XXVI for the provision of clinical services;</text></subclause><subclause id="idC99F5024694B430BBE17C07B6C36A3D7"><enum>(IX)</enum><text>at a critical access hospital (as defined in section 1861(mm)(1) of the Social Security Act);</text></subclause><subclause id="idFE8D8D4BA89B4F7293B7244D35030555"><enum>(X)</enum><text>in a frontier health professional shortage area; or</text></subclause><subclause id="id6B8AA186E00A4A2FBDC4D146C6DC3800"><enum>(XI)</enum><text>at an accredited public academic educational institution in a State or territory or health care setting affiliated with such an institution.</text></subclause></clause></subparagraph><subparagraph id="id54BACBBD7B1240BE8C505F6CD71E7FD1"><enum>(B)</enum><header>Employment by public health agency</header><text>The term <term>qualified role</term> does not include a role in which the health care professional is employed by a Federal, State, local, or Tribal public health agency or is in a related training fellowship, as recognized by the Secretary, excluding—</text><clause id="idf82e9a09d72a4eb38f45dd0bf3c6634b"><enum>(i)</enum><text>a role under clause (i) of subparagraph (A) in which the health care professional is employed at a medical facility described in subclause (XI) of subparagraph (A)(ii);</text></clause><clause id="id48db15fb80fc47cb997ba9d8c08c2db7"><enum>(ii)</enum><text>a role under clause (ii) of subparagraph (A) in which the health care professional is employed at a medical facility described in subclause (V), (VI), or (XI) of subparagraph (A)(ii); or</text></clause><clause id="id69e45b9ade0d4c7ca3d04db7385261f6"><enum>(iii)</enum><text>a role under clause (i) or (ii) of subparagraph (A) in which the health care professional is employed in any other setting specified by the Secretary. </text></clause></subparagraph></paragraph><paragraph id="idD19DA0E738CE475D899C290A6434DF1F"><enum>(3)</enum><header>Health care professional</header><text>In this section, the term <term>health care professional</term> includes—</text><subparagraph id="idEA8C71813622417C9A061EFDB309C1C6"><enum>(A)</enum><text>with respect to an individual in a role described in paragraph (2)(A)(i), an individual who is—</text><clause id="id9cfdc4f297964d1fb5eca7ab552f4b12"><enum>(i)</enum><text>a physician;</text></clause><clause id="id8e664a81e79d4a04a773d2ca76bf96e2"><enum>(ii)</enum><text>a clinical pharmacist;</text></clause><clause id="idb691c88ab79547508ee973e5248cf591"><enum>(iii)</enum><text>a physician assistant;</text></clause><clause id="id31a8e519bae84c6c847b0be7913bb12b"><enum>(iv)</enum><text>an advanced practice registered nurse; </text></clause><clause id="id35E5718CC68F460DB264612246FF3693"><enum>(v)</enum><text>an infection preventionist; or</text></clause><clause id="idaef3189fc82d4e1dac99170ef0eaf916"><enum>(vi)</enum><text>a laboratory professional; or</text></clause></subparagraph><subparagraph id="idFD6836030BDB4A89BBDE6868BB732347"><enum>(B)</enum><text>with respect to an individual in a role described in paragraph (2)(A)(ii), an individual who is—</text><clause id="idF52F1083F1FC411B8EFFA353578B8A22"><enum>(i)</enum><text>a physician;</text></clause><clause id="id348FF8179ECB49418B25CB5E3D307DD9"><enum>(ii)</enum><text>a clinical pharmacist;</text></clause><clause id="id5CF913AC779B4CB6ADA13CF4EC5FBCE6"><enum>(iii)</enum><text>a physician assistant;</text></clause><clause id="idC51C412D1433490AAFB0C1AFDCE434BD"><enum>(iv)</enum><text>a dentist; or</text></clause><clause id="idC151A53126BB4F998CD34E42AAFC40C4"><enum>(v)</enum><text>an advanced practice registered nurse.</text></clause></subparagraph></paragraph></subsection><subsection id="ID660A4ED8E6034893B425388B14F16CC4"><enum>(d)</enum><header>Payments</header><paragraph id="ID7717D48A71454D75A88524470E5B80ED"><enum>(1)</enum><header>In general</header><text>A loan repayment provided for an individual under a written contract under the Program shall consist of payment, in accordance with paragraph (2), on behalf of the individual of the principal, interest, and related expenses on government and commercial loans received by the individual regarding the undergraduate or graduate education of the individual (or both), which loans were made for tuition expenses incurred by the individual.</text></paragraph><paragraph id="ID613979E4D7CA4EBC87AFC35053DFEAED"><enum>(2)</enum><header>Payments for years served</header><text>For each year of obligated service that an individual contracts to serve under subsection (c), the Secretary may pay up to $50,000 on behalf of the individual for loans described in paragraph (1). With respect to participants under the Program whose total eligible loans are less than $150,000, the Secretary shall pay an amount that does not exceed <fraction>1/3</fraction> of the eligible loan balance for each year of obligated service of the individual.</text></paragraph><paragraph id="IDDC21AA354BE24B1B9CFB51CD725FA33E"><enum>(3)</enum><header>Tax liability</header><text>For the purpose of providing reimbursements for tax liability resulting from payments under paragraph (2) on behalf of an individual, the Secretary shall, in addition to such payments, make payments to the individual in an amount not to exceed 39 percent of the total amount of loan repayments made for the taxable year involved.</text></paragraph></subsection><subsection id="IDF0D6006267914DDDAC8D4D464060DE46"><enum>(e)</enum><header>Postponing obligated service</header><text>With respect to any individual participating in the Program, the date of the initiation of the period of obligated service may be postponed as approved by the Secretary.</text></subsection><subsection id="ID53951231783F47B5BB621E4289BC26B5"><enum>(f)</enum><header>Breach of contract</header><text>An individual who fails to comply with the contract entered into under subsection (c) shall be subject to the same financial penalties as provided for under section 338E for breaches of loan repayment contracts under section 338B.</text></subsection><subsection id="id8f6e2f93c3c4465d83e381ca2e936450"><enum>(g)</enum><header>Considerations</header><text>In awarding contracts under this section, the Secretary may—</text><paragraph id="id48C2E4430AA74688B511EAE3946467BC"><enum>(1)</enum><text>distribute contracts under this section equitably among geographic areas of the United States; and</text></paragraph><paragraph id="idE6BD538042DF4C7F870B366026B7C7B0"><enum>(2)</enum><text>ensure that contracts under this section help to increase the number of underrepresented minority individuals (as defined in section 738(b)(5)) serving as heath care professionals in roles described in clauses (i) and (ii) of subsection (c)(2)(A).</text></paragraph></subsection><subsection id="idAEC40340985C4A5A9456F8D6E9C21198"><enum>(h)</enum><header>Additional criteria</header><text>The Secretary—</text><paragraph id="id50E8B414F8FB46F789AFA0F3862B6F56"><enum>(1)</enum><text>may establish, in addition to the criteria and rules specified in this section, such criteria and rules to carry out this section as the Secretary determines are needed; and</text></paragraph><paragraph id="id5201902bdfdb4a18bcb50e528e7f5c0a"><enum>(2)</enum><text>shall give notice to the committees specified in subsection (i) of any criteria and rules so established. </text></paragraph></subsection><subsection id="id516cd0dfe4ec44a18b21a93758a8153e"><enum>(i)</enum><header>Report to congress</header><text>Not later than 3 years after the date of enactment of this section, and every other year thereafter, the Secretary shall prepare and submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a report on—</text><paragraph id="idca27d843ceb14161aca9b93764e5aac6"><enum>(1)</enum><text>the number and location of borrowers who have qualified for loan repayments under this section; and </text></paragraph><paragraph id="id19450de783b041968babec6e25e614c9"><enum>(2)</enum><text>the impact of this section on the availability of—</text><subparagraph id="id6a729b9bcf354569a0499df418624981"><enum>(A)</enum><text>health care professionals engaged in bio-preparedness and response activities described in subsection (c)(2)(A)(i), and health care professionals engaged in infectious disease care described in subsection (c)(2)(A)(ii), nationally; and</text></subparagraph><subparagraph id="id3c9e0cfeba8e4ef596b5a8a8a1432b13"><enum>(B)</enum><text>health care professionals engaged in infectious disease care described in subsection (c)(2)(A)(ii) in the areas and settings listed in such subsection.</text></subparagraph></paragraph></subsection><subsection id="ID311446A665424F11A08EAB3C7046D987"><enum>(j)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $50,000,000 for each of fiscal years 2023 through 2027.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
