<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3241</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211118">November 18, 2021</action-date><action-desc><sponsor name-id="S389">Mr. Kennedy</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 28, United States Code, to allow claims against foreign states for unlawful computer intrusion, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H407EC50137B040499B639605E4DCDFB7"><section section-type="section-one" id="HD42902D6F64343FD9FCC8D9D8F89F232"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Homeland And Cyber Threat Act</short-title></quote> or the <quote><short-title>HACT Act</short-title></quote>.</text></section><section id="HD6DE7BB6A0F14916A6A599D6D4D95645"><enum>2.</enum><header>Foreign state computer intrusions</header><subsection id="HD25F0730BDE64C43962E53711E43832B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/97">Chapter 97</external-xref> of title 28, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/28/1605B">section 1605B</external-xref> the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H7D7170CA68C6458C969DC4EAF9DA50E5"><section id="H9C94C231B9F7453B8A77A0CF49895095"><enum>1605C.</enum><header>Computer intrusions by a foreign state</header><text display-inline="no-display-inline">A foreign state shall not be immune from the jurisdiction of the courts of the United States or of the States in any case not otherwise covered by this chapter in which money damages are sought against a foreign state by a national of the United States for personal injury, harm to reputation, or damage to or loss of property resulting from any of the following activities, whether occurring in the United States or a foreign state:</text><paragraph id="H9CE3DB0A6E33407DBD675566B2CE76D8"><enum>(1)</enum><text display-inline="yes-display-inline">Unauthorized access to or access exceeding authorization to a computer located in the United States.</text></paragraph><paragraph id="HB5DCA8F4DB554DB4925129DBA1BB571A"><enum>(2)</enum><text display-inline="yes-display-inline">Unauthorized access to confidential, electronic stored information located in the United States.</text></paragraph><paragraph id="H2D6E593611DC4F64B03B025C4E0BB596"><enum>(3)</enum><text display-inline="yes-display-inline">The transmission of a program, information, code, or command to a computer located in the United States, which, as a result of such conduct, causes damage without authorization.</text></paragraph><paragraph id="H82C34923D574400187997DA15731FA19"><enum>(4)</enum><text display-inline="yes-display-inline">The use, dissemination, or disclosure, without consent, of any information obtained by means of any activity described in paragraph (1), (2), or (3).</text></paragraph><paragraph id="H35BECAB4514347D39A1D48081D828316"><enum>(5)</enum><text display-inline="yes-display-inline">The provision of material support or resources for any activity described in paragraph (1), (2), (3), or (4), including by an official, employee, or agent of such foreign state.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idbad6ee8870a0494cb839943cfe5a018f"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/97">chapter 97</external-xref> of title 28, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/28/1605B">section 1605B</external-xref> the following:</text><quoted-block style="USC" id="id642d94cc-d802-4bc5-882d-2cb35bc93b85"><toc><toc-entry level="section" idref="H9C94C231B9F7453B8A77A0CF49895095">1605C. Computer intrusions by a foreign state.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H60413F45A9EB46B38BCF470EBE39378D"><enum>(c)</enum><header>Application</header><text>This Act and the amendments made by this Act shall apply to any action pending on or filed on or after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
