which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Consumer Product Safety Commission to promulgate a consumer product safety rule for free-standing clothing storage units to protect children from tip-over related death or injury, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6DE76A64C3234A7599E8FE40210B9966"><section section-type="section-one" id="HFDA9AFBAEC4A43C2B4CBABCF06856757"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Tip-overs of Unstable, Risky Dressers on Youth Act</short-title></quote> or the <quote><short-title>STURDY Act</short-title></quote>.</text></section><section id="H54FDE37D63D04AB7B74617E143FDF887"><enum>2.</enum><header>Consumer product safety standard to protect against tip-over of clothing storage units</header><subsection id="H58C279CCF75B4E998C5CB02F54426237"><enum>(a)</enum><header>Clothing storage unit defined</header><text display-inline="yes-display-inline">In this section, the term <quote>clothing storage unit</quote> means any free-standing furniture item manufactured in the United States or imported for use in the United States that is intended for the storage of clothing, typical of bedroom furniture.</text></subsection><subsection id="id1EF99F006CA8417DA83C1A72369F61D3"><enum>(b)</enum><header>CPSC determination of scope</header><text>The Consumer Product Safety Commission shall specify the types of furniture items within the scope of subsection (a) for purposes of the standard promulgated under subsection (c) based on tip-over data as reasonably necessary to protect children up to 72 months of age from injury or death.</text></subsection><subsection id="H2D97E8DB3C0E40D0B8A97262387FA2BA"><enum>(c)</enum><header>Consumer product safety standard required</header><paragraph id="HF1E2822C15DA41CAA00EA94D44695986"><enum>(1)</enum><header>In general</header><text>Except as provided in subsection (d)(1), not later than 1 year after the date of the enactment of this Act, the Consumer Product Safety Commission shall—</text><subparagraph id="H4E4C0109826140E2BAD464E47C2E0B3B"><enum>(A)</enum><text>in consultation with representatives of consumer groups, clothing storage unit manufacturers, craft or handmade furniture manufacturers, and independent child product engineers and experts, examine and assess the effectiveness of any voluntary consumer product safety standards for clothing storage units; and</text></subparagraph><subparagraph id="HFD01B17BC71E4F8DAB9E4C0258242B95"><enum>(B)</enum><text>in accordance with section 553 of title 5, United States Code, promulgate a final consumer product safety standard for clothing storage units to protect children from tip-over-related death or injury that includes—</text><clause id="HC1BA30A707824607B5F0BE95F0538FF9"><enum>(i)</enum><text display-inline="yes-display-inline">tests that simulate the weight of children up to 60 pounds;</text></clause><clause id="HF19DC2437C904BBD8F36E1D4D3BA61F2"><enum>(ii)</enum><text>objective, repeatable, and measurable tests that simulate real world use and account for any impact on clothing storage unit stability that may result from placement on carpeted surfaces, drawers with items in them, multiple open drawers, or dynamic force;</text></clause><clause id="H90140DE77D8D4BFBA85830352D405AE3"><enum>(iii)</enum><text>testing of all clothing storage units, including those 27 inches and above in height;</text></clause><clause id="id825A637805ED4ACC8B37B5E6E07D58FE"><enum>(iv)</enum><text>tests that permit incorporated safety features (excluding tip restraints) to work as intended if the features cannot be overridden by consumers in normal use and provide an equivalent or greater level of safety as tests developed pursuant to clauses (i) through (iii); and</text></clause><clause id="HA4A1BD13C950445EA3B3FCE65FC5DCB4"><enum>(v)</enum><text display-inline="yes-display-inline">warning requirements based on ASTM F2057–19, or its successor at the time of enactment, provided that the Consumer Product Safety Commission shall strengthen the requirements of ASTM F2057–19, or its successor, if reasonably necessary to protect children from tip-over-related death or injury.</text></clause></subparagraph></paragraph><paragraph id="H0CE2F987111E4F36B95D528B483563F9"><enum>(2)</enum><header>Treatment of standard</header><text>A consumer product safety standard promulgated under paragraph (1) shall be treated as a consumer product safety rule promulgated under section 9 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2058">15 U.S.C. 2058</external-xref>).</text></paragraph></subsection><subsection id="H17494C9EC9F54C29B0EC55D6E890266B"><enum>(d)</enum><header>Subsequent rulemaking</header><paragraph id="H33B3953151FC49B4AE369DD9674DD8D1"><enum>(1)</enum><header>In general</header><text>At any time subsequent to the publication of a consumer product safety standard under subsection (c)(1), the Commission shall initiate a rulemaking, in accordance with section 553 of title 5, United States Code to modify the requirements of the consumer product safety standard described in subsection (c)(1) if the Commission determines that such modifications are reasonably necessary to protect children from tip-over-related death or injury.</text></paragraph><paragraph display-inline="no-display-inline" id="H0250A386B1444EE499DC724D7D708B7B"><enum>(2)</enum><header>Revision of rule</header><subparagraph display-inline="no-display-inline" id="id5FAD8BE39FAF4B7CB0AB9BCEA5F563A6"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If the Commission receives a petition for a new or revised test under subsection (c)(1)(B)(iv), the Commission shall determine within 120 days—</text><clause display-inline="no-display-inline" id="id876809CCC2D7470CAD0B75F5E07EBA19"><enum>(i)</enum><text display-inline="yes-display-inline">whether the petition meets the requirements for petitions set forth in section 1051.5 of title 16, Code of Federal Regulations, or any successor regulation implementing section 9(i) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2058">15 U.S.C. 2058(i)</external-xref>); and</text></clause><clause display-inline="no-display-inline" id="id6C110879B41344079A0E45E79203A78E"><enum>(ii)</enum><text>whether the petition demonstrates that the test could reasonably meet the requirements of subsection (c)(1)(B)(iv), and if so, the Commission shall determine by recorded vote, within 60 days after the determination, whether to initiate a rulemaking, in accordance with section 553 of title 5, United States Code, to revise the consumer product safety standard described in subsection (c)(1) to include the new or revised text.</text></clause></subparagraph><subparagraph display-inline="no-display-inline" id="idC09437EA15A7454D92D4C5B2E09E8503"><enum>(B)</enum><header>Revisions based on growth charts</header><text display-inline="yes-display-inline">If, after the date of the enactment of this Act, the Centers for Disease Control and Prevention revises its Clinical Growth Charts, the consumer product safety standard described in subsection (c)(1) shall, on the date that is 180 days after such revision, be revised to include tests that simulate the weight of children up to the 95th percentile weight of children 72 months in age, as depicted in the revised Centers for Disease Control and Prevention Clinical Growth Charts, unless the Commission determines the modification is not reasonably necessary to protect children from tip-over-related death or injury.</text></subparagraph></paragraph><paragraph id="H237BA8AE11704EE88D3ECDDDD05EA41D"><enum>(3)</enum><header>Treatment of rules</header><text display-inline="yes-display-inline">Any rule promulgated under paragraph (1) or revision made pursuant to paragraph (2) shall be treated as a consumer product safety rule promulgated under section 9 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2058">15 U.S.C. 2058</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
