<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3231</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211118">November 18, 2021</action-date><action-desc><sponsor name-id="S247">Mr. Wyden</sponsor> (for himself and <cosponsor name-id="S410">Ms. Lummis</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to require law enforcement officials to obtain a warrant before accessing data stored in cars, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H18A776533CF54D05B33AF534F1DB5E1C"><section section-type="section-one" id="H8FBEB8FC83E9489589358DC9FC378320"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Closing the Warrantless Digital Car Search Loophole Act of 2021</short-title></quote>.</text></section><section id="HA9FF2C8D1DB945929BEA862A6FE65FB1"><enum>2.</enum><header>Vehicle data</header><subsection id="H7A0678ED25EF4CB4B68ED8A4259EAFF7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part I of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HAE9F86BFCB704F4FAD9F678EB9479D46"><chapter id="HA6267699954F4E0AAD349CE29A1EF1A9"><enum>124</enum><header>Accessing vehicle data.</header><toc><toc-entry level="section">Sec. </toc-entry><toc-entry idref="HE5449BC603DE482BBD992057100EE430" level="section">2730. Definitions. </toc-entry><toc-entry idref="idBCB065E1689B4C2290180268DE08C493" level="section">2731. Prohibition on access to vehicle data. </toc-entry><toc-entry idref="HCA93CF0329184D578760F99CACFAD1EA" level="section">2732. Prohibition on use of acquired information as evidence. </toc-entry></toc><section id="HE5449BC603DE482BBD992057100EE430"><enum>2730.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter:</text><paragraph id="HD494C7A805D24EB6B866C3CEB4F213A5"><enum>(1)</enum><header>Access</header><text display-inline="yes-display-inline">The term <term>access</term>—</text><subparagraph id="id0AA750997E55499FAB75AF15AA983FD8"><enum>(A)</enum><text display-inline="yes-display-inline">means any retrieval of covered vehicle data, regardless of—</text><clause id="idABB0A86F82484089A2277C9EFE4C7B66"><enum>(i)</enum><text display-inline="yes-display-inline">whether the data is obtained as the information is being produced or from digital storage; and</text></clause><clause id="id8F6F2877F5094A17B6C8442CBC361723"><enum>(ii)</enum><text display-inline="yes-display-inline">where the vehicle data is stored or transmitted, including by wire or radio; and</text></clause></subparagraph><subparagraph id="id42B4950679A04895B96BCE996D6986A3"><enum>(B)</enum><text>does not include data covered by chapter 119 of this title or section 104 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1804">50 U.S.C. 1804</external-xref>). </text></subparagraph></paragraph><paragraph id="H877EEAAF33464CDEA89CE2CEC23B2DC0"><enum>(2)</enum><header>Consent</header><text>The term <term>consent</term>—</text><subparagraph id="id6A82DEE35F9646FDA28A070C17160999"><enum>(A)</enum><text>means an affirmative, express, and voluntary agreement that—</text><clause id="HFFEE5185C7B847E18FA2884D974F3A0C"><enum>(i)</enum><text display-inline="yes-display-inline">states that the person providing the consent is providing consent to a government official to access the digital contents, access credential, or online account information, or other information being sought;</text></clause><clause id="HA23335FEF0E2471496DC63E982A84360"><enum>(ii)</enum><text display-inline="yes-display-inline">specifies the type of content, access credential, or online account information the person is providing access to;</text></clause><clause id="idd0a2761c14ee441db75eb9f4af5e0d83"><enum>(iii)</enum><text>specifies the time period of the covered vehicle data to be accessed; </text></clause><clause id="H098A8C0F81F74587AAE376A68FCBDC8D"><enum>(iv)</enum><text display-inline="yes-display-inline">informs the person providing consent that consent is optional and that the government official attempting to obtain consent must otherwise acquire a warrant if consent is not obtained;</text></clause><clause id="id84bcb52c12a044e7b0977f06d5e9122f"><enum>(v)</enum><text>does not involve sanctions or the threat of sanctions for withholding consent; and </text></clause><clause id="H6393802EF14246F399BEF43499B7B8CC"><enum>(vi)</enum><text display-inline="yes-display-inline">uses clear, simple, and comprehensible language that is presented in a way that is accessible to the person providing consent; and</text></clause></subparagraph><subparagraph id="id8E80BF5091ED49E8848EF976B01B1798"><enum>(B)</enum><text>does not include consent obtained through agreement to a generic privacy policy.</text></subparagraph></paragraph><paragraph id="id4babb7b138e042e8a591501058112f12"><enum>(3)</enum><header>Covered vehicle data</header><text>The term <term>covered vehicle data</term>—</text><subparagraph id="id12c944edbee846b880ec480a8b983b32"><enum>(A)</enum><text>means all onboard and telematics data generated by, processed by, or stored on a noncommercial vehicle using computing, storage and communication systems installed, attached to, or carried in the vehicle, including diagnostic data, entertainment system data, navigation data, images or data captured by onboard sensors, or cameras, including images or data used to support automated features or autonomous driving, internet access, and communication to and from vehicle occupants;</text></subparagraph><subparagraph id="ida0d37a4eb4fe47559a716488788b4ca2"><enum>(B)</enum><text>includes data gathered by event data recorders; and</text></subparagraph><subparagraph id="id2B4657545CA44BB1B4E7DF71A48F8E5B"><enum>(C)</enum><text>does not include—</text><clause id="id662e02e643c14681b0520bd8890f1385"><enum>(i)</enum><text>automotive software installed by the manufacturer, as defined by applicable industry standards or regulations;</text></clause><clause id="id3E3705E8E4304A408FFA4989383027EB"><enum>(ii)</enum><text>any data subject to chapter 119 of this title or section 104 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1804">50 U.S.C. 1804</external-xref>); or</text></clause><clause id="idb5582879e3ff442181c45ddbaaeb136b"><enum>(iii)</enum><text>data that is collected from outside the vehicle, including speed data and geolocation data, for purposes of traffic, law enforcement, or toll collection. </text></clause></subparagraph></paragraph><paragraph id="id7ABD5EBF63234444897271BD4CA4AD3F"><enum>(4)</enum><header>Event data recorder</header><text>The term <term>event data recorder</term> has the meaning given the term in section 563.5 of title 49, Code of Federal Regulations (as in effect on March 5, 2019).</text></paragraph><paragraph id="H3A82773A4D43473CAF09F2EEB701F849"><enum>(5)</enum><header>Investigative or law enforcement officer</header><text display-inline="yes-display-inline">The term <term>investigative or law enforcement officer</term> means any officer of the United States or of a State or political subdivision thereof and any Tribal justice official, who is empowered by law to execute searches, to seize evidence, or to make arrests for a violation of Federal or State law.</text></paragraph><paragraph id="id78eadf146c5e41a38b46b10937b3879f"><enum>(6)</enum><header>Noncommercial vehicle</header><text>The term <term>noncommercial vehicle</term> has the meaning given the term <term>non-CMV</term> in section 383.5 of title 49, Code of Federal Regulations.</text></paragraph><paragraph id="H0521C65F64EA44CEB1E44BC09212DEBB"><enum>(7)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means any State of the United States, the District of Columbia, and any territory or possession of the United States.</text></paragraph><paragraph id="idD82DD42765B64D939C2321A1A428F7B9"><enum>(8)</enum><header>Vehicle operator</header><text>The term <term>vehicle operator</term> means—</text><subparagraph id="idB170A0E7E5944EF180DDB8884C73DD2A"><enum>(A)</enum><text>a person who controls the operation of a vehicle at the time consent is sought; and</text></subparagraph><subparagraph id="idF66BD635D74F413B8FDDB1ABA973DFC5"><enum>(B)</enum><text>with respect to a vehicle that is not classified as a highly autonomous vehicle by the Secretary of Transportation, the driver of the vehicle. </text></subparagraph></paragraph></section><section id="idBCB065E1689B4C2290180268DE08C493"><enum>2731.</enum><header>Prohibition on access to vehicle data</header><subsection id="H659505F5E21B44EB9516B89C0F9420B7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), an investigative or law enforcement officer may not access covered vehicle data unless pursuant to a warrant issued in accordance with the procedures described in rule 41 of the Federal Rules of Criminal Procedure (or, in the case of a State court, issued using State warrant procedures) by a court of competent jurisdiction, or as otherwise provided in this chapter or sections 104 and 303 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1804">50 U.S.C. 1804</external-xref>, 1823).</text></subsection><subsection id="H7A7D9C87F57C460BB63E306F90A553D9"><enum>(b)</enum><header>Exceptions</header><paragraph id="H9775A08007F0490592B3342943906889"><enum>(1)</enum><header>Consent</header><subparagraph id="id1E39E11CCE774037A94F840B36D4411F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An investigative or law enforcement officer may access covered vehicle data if—</text><clause id="id63029C19B663467491FDEFD7406BC4F5"><enum>(i)</enum><text display-inline="yes-display-inline">the vehicle operator provides prior consent to such access; and</text></clause><clause id="id4C2748C5DCE2434087551FFDAA8A2069"><enum>(ii)</enum><text>no passenger 14 years of age or older objects to the access.</text></clause></subparagraph><subparagraph id="id89645A3F2B024838A6B1C380C8CB430F"><enum>(B)</enum><header>Vehicle owner</header><text>If the vehicle operator cannot be located with reasonable effort, the vehicle owner or, in the case of a leased vehicle, the lessee, may provide consent under this paragraph.</text></subparagraph><subparagraph id="idbfb1e049c08a465ebf7971f1c7c07797"><enum>(C)</enum><header>Unlawful possession</header><text>No individual may provide or withhold consent under this paragraph or object to another individual accessing covered vehicle data if the individual—</text><clause id="id3abd392d30df4c419c17a03b7e379014"><enum>(i)</enum><text>is the vehicle operator who is in unlawful possession of the vehicle; or</text></clause><clause id="ida6c892d5c3864c819099c1a616173204"><enum>(ii)</enum><text>is a passenger who unlawfully obtained access to the vehicle.</text></clause></subparagraph><subparagraph id="id549F1F8664824B7282A63FD7CBA5EEA8"><enum>(D)</enum><header>Oral consent</header><text>Consent provided under this paragraph shall be in writing unless—</text><clause id="id17EBD6602B044B47A7681A16F244EC22"><enum>(i)</enum><text display-inline="yes-display-inline">the person providing the consent requests that the consent be made orally; and</text></clause><clause id="id848A9C68CE1D497F85FE6712704247CE"><enum>(ii)</enum><text display-inline="yes-display-inline">the request for consent and the consent are recorded.</text></clause></subparagraph><subparagraph id="id50b26988766c423fa1a1d071f73326c6"><enum>(E)</enum><header>Consent of vehicle operator</header><text>If the vehicle operator is not the owner of the vehicle and provides consent under this paragraph, the consent is valid only with respect to covered vehicle data generated during the lawful possession and use of the vehicle by the vehicle operator. </text></subparagraph></paragraph><paragraph id="H17D5704F8E22490F9AB47478E6D7EDFA"><enum>(2)</enum><header>Emergency</header><subparagraph id="H59FFEFECEAD04E7E844A7EFDD4DA944A"><enum>(A)</enum><header>In general</header><text>An investigative or law enforcement officer, the Attorney General, the Deputy Attorney General, the Associate Attorney General, or the principal prosecuting attorney of any State or subdivision thereof acting pursuant to a statute of that State, may access covered vehicle data if—</text><clause id="HCCE254E25EDD4C989D68F19340B96F94"><enum>(i)</enum><text>such officer reasonably determines that an emergency situation exists that—</text><subclause id="H19F73161DD8C4038881DE049A8AB7463"><enum>(I)</enum><text>involves immediate danger of death or serious physical injury to any person; and</text></subclause><subclause id="idd2b3345d8f2947f8b703d0fdb2f71b5f"><enum>(II)</enum><text>requires access to covered vehicle data before such officer can, with due diligence, obtain a warrant;</text></subclause></clause><clause id="HA2547785AF934A8FA0AD2AC3E6C1DCA9"><enum>(ii)</enum><text display-inline="yes-display-inline">there are grounds upon which a warrant could be granted to authorize such access; and</text></clause><clause id="HE45618CBA7734219A495489C16ECDC11"><enum>(iii)</enum><text display-inline="yes-display-inline">an application for a warrant approving such access is submitted to a court within 48 hours after the access has occurred or begins to occur.</text></clause></subparagraph><subparagraph id="H6D3C41390A454C5BA7C1485404A2466B"><enum>(B)</enum><header>Denial</header><text display-inline="yes-display-inline">If an application for a warrant submitted pursuant to subparagraph (A)(iii) is denied, any covered vehicle data accessed under this paragraph shall be treated as having been obtained in violation of this chapter.</text></subparagraph></paragraph><paragraph id="HCC0C0567891243838D205AE923D7F2D7"><enum>(3)</enum><header>Event data recorder for motor vehicle safety</header><text display-inline="yes-display-inline">In addition to the exceptions in paragraphs (1) and (2), data recorded or transmitted by an event data recorder may be accessed from a noncommercial vehicle if authorized by paragraph (3), (4), or (5) of section 24302(b) of the Driver Privacy Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/49/30101">49 U.S.C. 30101</external-xref> note).</text></paragraph><paragraph id="idd7db1d017da94e9db3f80543a5eb7dd3"><enum>(4)</enum><header>Rule of construction</header><text>Nothing in this section shall be interpreted to require the transmission or storage of data that is not otherwise transmitted or stored, or the retrieval of data that is not generally retrievable. </text></paragraph></subsection></section><section id="HCA93CF0329184D578760F99CACFAD1EA"><enum>2732.</enum><header>Prohibition on use of acquired information as evidence</header><subsection id="id16EF155FA52F4A049A649B3CCA7D7BB1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">If any covered vehicle data has been acquired in violation of this chapter, no part of such information and no evidence derived therefrom may be received in evidence in any trial, hearing, or other proceeding in or before any court, grand jury, department, officer, agency, regulatory body, legislative committee, or other authority of the United States, a State, or a political subdivision thereof.</text></subsection><subsection id="idBFA3EF51EFEC451F85386A02D01128DA"><enum>(b)</enum><header>Probable cause</header><text display-inline="yes-display-inline">No data described in section 2731(b)(3) may be used to establish probable cause.</text></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8642840D5B57456193FF256448FCA9C8"><enum>(b)</enum><header>Technical and conforming amendments</header><paragraph id="idE91A5726DE364874B552B8DF8C04FCBB"><enum>(1)</enum><header>Driver Privacy Act of 2015</header><text>Section 24302 of the Driver Privacy Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/49/30101">49 U.S.C. 30101</external-xref> note) is amended—</text><subparagraph id="id6E58608BF6364978BC413A006DD7F44D"><enum>(A)</enum><text>in subsection (b), in the matter preceding paragraph (1), by striking <quote>Data</quote> and inserting <quote>Except as provided in subsection (c), data</quote>; and</text></subparagraph><subparagraph id="id0BC1E84CD108432C8395DB20C1ED67F6"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8EED9C34D473449CAAB59AE89BAF1884"><subsection id="idF8E7F1181FF64D548142E22C5687BB3C"><enum>(c)</enum><header>Investigative or law enforcement officers</header><text>An investigative or law enforcement officer may only access or retrieve data recorded or transmitted by an event data recorder described in subsection (a) in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/124">chapter 124</external-xref> of title 18, United States Code.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H6C43DE52505749F69CDAF521526D7B59"><enum>(2)</enum><header>Table of chapters</header><text display-inline="yes-display-inline">The table of chapters for part 1 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id558C60D5316D4BF8B94B3220B73A4509"><toc><multi-column-toc-entry bold="on" level="chapter"><toc-enum>124.</toc-enum><level-header level="chapter">Accessing vehicle data</level-header><target>2730</target></multi-column-toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
