which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Child Nutrition Act of 1966 to permit video or telephone certifications under the special supplemental nutrition program for women, infants, and children, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>More Options to Develop and Enhance Remote Nutrition in WIC Act of 2021</short-title></quote> or the <quote><short-title>MODERN WIC Act of 2021</short-title></quote>.</text></section><section id="idb5ce0b0b64654f7ab013517c943a5e7e"><enum>2.</enum><header>Presence at certification</header><subsection id="id89D41121DE344DC0A801CF7F796BADDC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 17(d)(3)(C) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(d)(3)(C)</external-xref>) is amended—</text><paragraph id="id5d8dbd88b03e4de39d546b1378caa23f"><enum>(1)</enum><text>in the subparagraph heading, by striking <quote><header-in-text style="OLC" level="subparagraph">Physical presence</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subparagraph">Presence</header-in-text></quote>;</text></paragraph><paragraph id="ide0433e3cf3374c0b8453ec59505d30d6"><enum>(2)</enum><text>in clause (i), by striking <quote>physically present at each certification or recertification determination</quote> and inserting <quote>present at each certification or recertification, either in person or through video technology permitting 2-way, real-time interactive communications,</quote>; and</text></paragraph><paragraph id="id9be0ebfa719745698d98f7bec8023262"><enum>(3)</enum><text>in clause (ii)—</text><subparagraph id="id16C8DA141E65432C803F1E9A9C24B3A0"><enum>(A)</enum><text>in subclause (I), in the matter preceding item (aa), by striking <quote>an infant or child</quote> and inserting <quote>any eligible individual</quote>;</text></subparagraph><subparagraph id="idecb4a6bfc68b4fd69453cf2327491c9e" commented="no"><enum>(B)</enum><text>by redesignating subclauses (I) through (III) as subclauses (II) through (IV), respectively; and</text></subparagraph><subparagraph commented="no" id="idB5495C864F374810BA7FD491F1BC7E78"><enum>(C)</enum><text>by inserting before subclause (II) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2724c4b7217341908a33962f9a82f3af"><subclause id="ided1a9cb4fc2d45c7a6e0b50c3fad97aa"><enum>(I)</enum><text>any eligible individual—</text><item id="id26da5d6352244d08b56ef1a850d153ea"><enum>(aa)</enum><text>who completes the certification process through a telephone appointment or other remote technology; and</text></item><item id="id4936d1671eaa4eef8ae6169fd393fbcf"><enum>(bb)</enum><text>for whom all necessary certification information is obtained not more than 90 days before or after the certification appointment;</text></item></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id74DDE29E9CCD42108F3E9480209B8FD7"><enum>(b)</enum><header>Technical amendment</header><text>Section 17(d)(3) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(d)(3)</external-xref>) is amended by conforming the margin of subparagraph (B) to the margin of subparagraph (C). </text></subsection></section><section id="id6fdc86d460544233a47efa4f8ac9b377"><enum>3.</enum><header>Remote benefit issuance</header><subsection id="id0a0291e26af64f41b5bba7658a4b1cc7"><enum>(a)</enum><header>In general</header><text>Section 17(f)(6)(B) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(f)(6)(B)</external-xref>) is amended—</text><paragraph id="id72AFDCF91F2449269001B2D0E3F5C53D"><enum>(1)</enum><text>in the third sentence—</text><subparagraph id="idA9C1A8FBC23E4919AD18191A015F6092"><enum>(A)</enum><text>by striking <quote>vouchers by mail</quote> and inserting <quote>food instruments</quote>; and</text></subparagraph><subparagraph id="idD9D5314404F94E48981907DE11C3095E"><enum>(B)</enum><text>by striking <quote>The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id15a5ddacfe1b4328807e88bd71e72ea3"><clause id="idCDB83045FDF54D718BCA4EEAFE8D3DFF"><enum>(iii)</enum><header>Disapproval of State plan</header><text>The Secretary</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idA4C3FEF5F753448BB802BEC40B561EDF"><enum>(2)</enum><text>in the second sentence—</text><subparagraph id="id5E61EB6622044E3B80B6F63BBD845DE0"><enum>(A)</enum><text>by striking <quote>vouchers by mail in its plan</quote> and inserting <quote>food instruments by mail, remote issuance, or other means in the State plan</quote>; and</text></subparagraph><subparagraph id="id7FA65DE458C34D45B8F65393A1D20CEC"><enum>(B)</enum><text>by striking <quote>The State</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4B393461B2124051973FB96D991B9E69"><clause id="id4221ED9356924E8895A78324555346B6"><enum>(ii)</enum><header>State plan</header><text>The State</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id94B0C2B6872F440AAC76F8B386591F57"><enum>(3)</enum><text>by striking <quote>(B) State agencies</quote> and all that follows through <quote>to obtain vouchers.</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC9F56E16A36F4E91933C756D4F1F7504"><subparagraph id="id6e37d9a0537b45a7a55fab5cfa5a0dbb"><enum>(B)</enum><header>Delivery of vouchers</header><clause id="id624296810E3F418F9A9C0ABBA2B0321C"><enum>(i)</enum><header>In general</header><text>State agencies may provide for the delivery of food instruments, including electronic benefit transfer cards, to any participant through means that do not require the participant to travel to the local agency to obtain food instruments, such as through mailing or remote issuance.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idfdde44b8983842d481bfcf7ea1dcf384"><enum>(b)</enum><header>Regulations</header><text>The Secretary shall revise section 246.12(r) of title 7, Code of Federal Regulations, by striking paragraph (4).</text></subsection></section><section id="id1e3cd5fa444648b590f655064e26ec75"><enum>4.</enum><header>Annual investment in WIC technologies</header><text display-inline="no-display-inline">Section 17(h) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(h)</external-xref>) is amended—</text><paragraph id="id131E770778484408BB86119A6D9D4260"><enum>(1)</enum><text>in paragraph (2)(B)—</text><subparagraph id="idB41C719F0697494DB9E41195FB5F8E01"><enum>(A)</enum><text>by striking clause (ii); and</text></subparagraph><subparagraph id="idE42CF7824372410493E4B361FDBD807A"><enum>(B)</enum><text>by striking the subparagraph designation and all that follows through <quote>clause (ii) and</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id16A78BE2286749FFBCB3B5C0BBF31CFE"><subparagraph id="idAD5888193F984C1E98CFDC38E18FDC32"><enum>(B)</enum><header>Allocation for nutrition services and administration</header><text>Except as provided in</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="ide35025be10c54f29a82e4f3e9d089b55"><enum>(2)</enum><text>in paragraph (10)—</text><subparagraph id="idE4F6FE9DF7764F81B685C6491291A317"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>2010 through 2015</quote> and inserting <quote>2023 through 2028</quote>; and</text></subparagraph><subparagraph id="idDCE994E09F68439DBA31562A2A217F68" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking clause (ii) and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="ide7d0ab66d3ef4167b78525e3a4f95b5b"><clause id="idbed241144bb646f69792c267c4d15b18"><enum>(ii)</enum><text>$60,000,000 shall be used to establish, develop, improve, replace, or administer technology platforms, including management information systems, that enhance program services, access to the program, or redemption of benefits, of which up to $5,000,000 may be used for Federal administrative costs; and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="id44cb5a092e8e4c8f9d053c5556363976"><enum>5.</enum><header>Report to Congress</header><subsection id="idec32bc19696e46b7b14eb2dcc9908d0c"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Education and Labor of the House of Representatives a report on the use of remote technologies under the special supplemental nutrition program for women, infants, and children established by section 17 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>) (referred to in this section as the <quote>program</quote>).</text></subsection><subsection id="idd0efd7e38e0a40cf8923258ba1841e63"><enum>(b)</enum><header>Content of report</header><text>The report submitted under subsection (a) shall include a description of—</text><paragraph id="id4cb91c1b5ecd46a99ba636abc91e77c2"><enum>(1)</enum><text>the use of remote technologies and other digital tools, including video, telephone, and online platforms—</text><subparagraph id="idebfb9e313b284a729da7c741ae5137dc"><enum>(A)</enum><text>to certify eligible individuals for program services; and</text></subparagraph><subparagraph id="id30e94a1ff6074daf8d9fd6e7c2500757"><enum>(B)</enum><text>to provide nutrition education and breastfeeding support to program participants;</text></subparagraph></paragraph><paragraph id="id6694b4af5efd44f9a5cd0428badddbb8"><enum>(2)</enum><text>the impact of remote technologies, including video, telephone, and online platforms, on certifications, appointments, and participant satisfaction under the program; and</text></paragraph><paragraph id="id72405c13ea9b4442a1d3daf48891bd19"><enum>(3)</enum><text>best practices—</text><subparagraph id="id79405b8ad7154bf7a73c91ac56040621"><enum>(A)</enum><text>to certify program participants for program services using remote technologies;</text></subparagraph><subparagraph id="id448D9689EA744304AC47AC7836F1E405"><enum>(B)</enum><text>to incorporate the use of digital tools into the program certification process;</text></subparagraph><subparagraph id="id1f2e6fa8a6214b739a731edcc2cb017b"><enum>(C)</enum><text>to integrate nutrition education and breastfeeding support services for program participants into remote technologies and platforms; and</text></subparagraph><subparagraph id="id9ea628d20f424a808c37621bb26d4472"><enum>(D)</enum><text>to securely manage program participant data. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
