BILL</legis-type><official-title>To amend the Animal Welfare Act to restrict the use of exotic and wild animals in traveling performances.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H59DC6789C38B4652B53271FD8DD1A43A"><section section-type="section-one" id="H0AEC1F4D1A8E49439CD2E2150A4D59D2"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Traveling Exotic Animal and Public Safety Protection Act of 2021</short-title></quote>.</text></section><section id="H8D76DC1E0A1D4A3ABF4C51156548CD2D"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="HC984DA786C8B4E0EADCF664192EA4271"><enum>(1)</enum><text>conditions inherent to traveling performances, including constant travel, temporary and collapsible facilities, and the prolonged confinement and physical coercion of animals, subject exotic and wild animals to compromised welfare and chronic stress, and present public and worker health and safety risks not adequately addressed by current regulations;</text></paragraph><paragraph id="HD893E029EB4944AEA64A1814296E7DE3"><enum>(2)</enum><text>current regulatory oversight of traveling performances is complex and costly, and those costs are not typically recouped via licensing fees but are left to the taxpayer;</text></paragraph><paragraph id="H52B24F8712094C5DB710CD974781956C"><enum>(3)</enum><text>the frequent mobility of traveling performances complicates oversight such that agencies and authorities cannot properly monitor, evaluate, or follow through regarding the condition of animals or facilities, or their history of potential injuries, incidents, illnesses, violations, or other issues, and so cannot properly protect animals, workers, or the public;</text></paragraph><paragraph id="H62B36D61A17C40E4936F0049C33A1548"><enum>(4)</enum><text>traveling exotic and wild animal performances use collapsible, temporary, mobile facilities, which risk escape and serious harm to animals, workers, and the public;</text></paragraph><paragraph id="H960591ABFEAD4E328A5B4B85868ABE25"><enum>(5)</enum><text>traveling exotic and wild animal performances present safety risks by permitting or not preventing public contact and by displaying animals in inappropriate, uncontrolled areas in dangerous proximity to humans and other animals;</text></paragraph><paragraph id="H1622E998608B4A168FB9641241EAE65C"><enum>(6)</enum><text>exotic and wild animals have intrinsic value;</text></paragraph><paragraph id="idB7F676DC7D7C424A91AB7AB063137150"><enum>(7)</enum><text>the wild instincts and needs of exotic and wild animals are unpredictable and not naturally suited to traveling performances, and exotic and wild animals thus suffer as a result of being unable to fulfill instinctive natural behaviors;</text></paragraph><paragraph id="HC46FCA8CCE18433288A487679A622B83"><enum>(8)</enum><text>exotic and wild animals used in traveling performances suffer severe and extended confinement, and, deprived of natural movements and behaviors, are prone to chronic stress and behavioral, health, and psychological problems;</text></paragraph><paragraph id="H55ACB1E9CDA041AA9E9E038DD4778569"><enum>(9)</enum><text>exotic and wild animals are forced to perform unnatural tricks requiring extreme physical coercion, including the use of food and water restrictions, electric shock devices, bullhooks, metal bars, whips, shovels, pitchforks, and other abuses;</text></paragraph><paragraph id="HC03EC6F966D141529B8C550ABF29100A"><enum>(10)</enum><text>it is not necessary to use exotic or wild animals in traveling performances to experience the circus or similar events;</text></paragraph><paragraph id="H8C2E9398060B49FE96C0A503F5350E18"><enum>(11)</enum><text>using exotic or wild animals as commodities traded for traveling performances adds nothing to the understanding and conservation of those animals and the natural environment, and actually undermines conservation efforts necessary to protect threatened and endangered species;</text></paragraph><paragraph id="H34A0BD262E77443F8EB0B8497B8D0E96"><enum>(12)</enum><text>it is not possible to provide or ensure public and worker safety or appropriate physical and mental welfare of exotic and wild animals under the traveling performance business model, which inherently and significantly restricts the natural movements and behaviors of animals, and in which abuse is prevalent and oversight problematic;</text></paragraph><paragraph id="H02624DACDBAD49A6B7FAD7D210A099B2"><enum>(13)</enum><text>the use of exotic or wild animals in traveling performances is or substantially affects interstate or foreign commerce and the free flow of interstate or foreign commerce;</text></paragraph><paragraph id="idB2719DFCB2EC48109DCCFB02E98F7AE4"><enum>(14)</enum><text>it is essential to regulate the use of exotic or wild animals in traveling performances to ensure the humane care and treatment of animals; and</text></paragraph><paragraph id="H27B5F91983514B27A4276094F20A6480"><enum>(15)</enum><text>restricting the use of exotic and wild animals in traveling performances is the most cost-effective and efficient way to safeguard animals, workers, and the public.</text></paragraph></section><section id="H15D522C070274E55AD33AC1245C736C2"><enum>3.</enum><header>Use of exotic or wild animals in traveling performances prohibited</header><text display-inline="no-display-inline">Section 13 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2143">7 U.S.C. 2143</external-xref>) is amended—</text><paragraph id="id71b94fe465ef46a599d4cf74dc886146"><enum>(1)</enum><text>by redesignating subsections (g) and (h) as subsections (h) and (i), respectively;</text></paragraph><paragraph id="idcb0f6697c5d14ee0a0451ec2c6aa009d"><enum>(2)</enum><text>by redesignating the second subsection (f) (relating to delivery of animals by a dealer, research facility, exhibitor, or government) as subsection (g); and</text></paragraph><paragraph id="id649EA1E8613540FE97DDEFADDF8AD7BB"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" id="HA425F2EAF595436984AB9036CB658298"><subsection id="HFC2E6E0C06F34FFDA05D1A838CB0A488"><enum>(j)</enum><header>Prohibition of exotic and wild animals in traveling performances</header><paragraph id="id070330327323461A81CA3C9F4729E9C4"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id348FA9C895EA44C2B9C47DD8E8A06BBF"><enum>(A)</enum><header>Cause a performance</header><text>The term <term>cause a performance</term> means—</text><clause id="idF03366DE00184446B0409B777F2CF052"><enum>(i)</enum><text>to be responsible for a performance;</text></clause><clause id="id1BCF3FB6EA6D4FE5B735D9E6F8147C0E"><enum>(ii)</enum><text>to financially benefit as an owner or operator from a performance; or</text></clause><clause id="id63BCA9FADF434617A3657A9055485D9D"><enum>(iii)</enum><text>to sponsor a performance.</text></clause></subparagraph><subparagraph id="idCD89BAE1C7E64672B49D6C89E7CD0024"><enum>(B)</enum><header>Domestic animal</header><text>The term <term>domestic animal</term> means any animal that is normally maintained as a companion or pet animal in or near the household of the owner or person who cares for the animal, such as a domestic dog (including a service dog), domestic cat, ferret, gerbil, horse, mouse, rat, guinea pig, rabbit, or hamster.</text></subparagraph><subparagraph id="idA295E75AAA4D4E00B5F46FDD6071685E"><enum>(C)</enum><header>Environmental education program</header><text>The term <term>environmental education program</term> means a program, which may be an animal exhibition, that—</text><clause id="idFD3AF2391B0748B0A877B4E9AC987AC1"><enum>(i)</enum><text>is professionally designed to impart knowledge or information for educational or conservation purposes about the natural behavior, habitat, and life cycle of an animal, or similar pedagogical information, by an individual qualified to impart that information; and</text></clause><clause id="idDB0FCCEB642D41198FD0FBB057BD6494"><enum>(ii)</enum><text>does not include any performance of behavior of an animal that does not naturally occur for that animal in the wild.</text></clause></subparagraph><subparagraph id="idC756556A37164C52AF683D117B4E790A"><enum>(D)</enum><header>Exotic or wild animal</header><clause id="idA85F5D1878634539A321111BEB4ACC2B"><enum>(i)</enum><header>In general</header><text>The term <term>exotic or wild animal</term> means—</text><subclause id="idF9686B0D83F04FCC858937BD0FE242B3"><enum>(I)</enum><text>any animal that is or has historically been found in the wild or in the wild state, regardless of whether the animal was bred or born in the wild or in captivity; and</text></subclause><subclause id="idDF7E2E650BA5450CABB345C19C7348B7"><enum>(II)</enum><text>any hybrid of an animal described in subclause (I), including a hybrid cross with a domestic animal or farm animal.</text></subclause></clause><clause id="idD0A81BA65BAC4C14811E510824D73F76"><enum>(ii)</enum><header>Inclusions</header><text>The term <term>exotic or wild animal</term> includes—</text><subclause id="H55923EDD0ABC4271BA6FEA6F47F2AC81"><enum>(I)</enum><text>canidae (except domestic dogs);</text></subclause><subclause id="H395DCE31F8934CB894D5507E812D437B"><enum>(II)</enum><text>cetartiodactyla (except alpacas, bison, cattle, deer, elk, goats, llamas, reindeer, swine, and sheep);</text></subclause><subclause id="H1EC747F8242E4412A9496D0448887A2F"><enum>(III)</enum><text>crocodilia;</text></subclause><subclause id="H98BE17D7FCC44541B20605DDA73ADABA"><enum>(IV)</enum><text>edentata;</text></subclause><subclause id="H7BFBCF39B6AE45ECBF55F83333393020"><enum>(V)</enum><text>elasmobranchii;</text></subclause><subclause id="H39A2D4CD152643B38FA044F7EFC47CF5"><enum>(VI)</enum><text>felidae (except domestic cats);</text></subclause><subclause id="H71B909EAACBF4DDF83DC34C751C9CF18"><enum>(VII)</enum><text>hyaenidae;</text></subclause><subclause id="H802EFB66566F4CE1A577B79B29BF1FD9"><enum>(VIII)</enum><text>marsupialia;</text></subclause><subclause id="HFA9660C0ACDD42968E2DED96B6B724A7"><enum>(IX)</enum><text>mustelidae;</text></subclause><subclause id="H10982FCDCB024AD5A6AA06D6B1AF196E"><enum>(X)</enum><text>nonhuman primates;</text></subclause><subclause id="H49C97F57B9234655AF547480124E6BB7"><enum>(XI)</enum><text>perissodactyla (except horses, donkeys, and mules);</text></subclause><subclause id="H8BDD2E3C724C4425957EABD057131908"><enum>(XII)</enum><text>pinnipedia;</text></subclause><subclause id="HD51C10F7FFC943078A2BD6AD673FE65E"><enum>(XIII)</enum><text>proboscidea;</text></subclause><subclause id="H6A629EFEFC1F4C0988808D13B603C52D"><enum>(XIV)</enum><text>procyonidae;</text></subclause><subclause id="H8FAE630EA1994B8F80EBA03611692510"><enum>(XV)</enum><text>ratites;</text></subclause><subclause id="HBFD907F905AF48D9926D80FDA17C62FA"><enum>(XVI)</enum><text>spheniscidae;</text></subclause><subclause id="H307068A1673B475FA291CE636D2520A4"><enum>(XVII)</enum><text>testudinidae;</text></subclause><subclause id="HCF021604C6C2432AB2C4D528B0AB7D3D"><enum>(XVIII)</enum><text>ursidae;</text></subclause><subclause id="H9A2069AC30DF4D45A6943057FED502B7"><enum>(XIX)</enum><text>varanidae; and</text></subclause><subclause id="H2D55B7F23C3A4C3295977E6302C5F65C"><enum>(XX)</enum><text>viverridae.</text></subclause></clause><clause id="idAC5BA80C2AE6416F95427D35766742A5"><enum>(iii)</enum><header>Exclusion</header><text>The term <term>exotic or wild animal</term> does not include any animal that is a domestic animal or farm animal.</text></clause></subparagraph><subparagraph id="id5D8783E571C24FD9BA8CE13873A8CA94"><enum>(E)</enum><header>Farm animal</header><text>The term <term>farm animal</term> means an alpaca, cow, sheep, swine, goat, llama, poultry, rabbit, horse, mule, or donkey.</text></subparagraph><subparagraph id="id9A000FA5A6AA4CCE9F3A285C95E88834"><enum>(F)</enum><header>Mobile or traveling housing facility</header><text>The term <term>mobile or traveling housing facility</term> means a transporting vehicle, such as a truck, car, trailer, airplane, ship, or railway car, used to transport or house an animal while traveling to, from, or between locations for performance purposes.</text></subparagraph><subparagraph id="HFA728C7FE534440EADA1C0F701B1EEF1"><enum>(G)</enum><header>Performance</header><text>The term <term>performance</term> means any animal act, circus, ride, carnival, display, exhibition, fair, parade, petting zoo, race, performance, or similar undertaking in which an animal is required to perform tricks, give rides, or participate as an accompaniment for the entertainment, amusement, or benefit of an audience.</text></subparagraph><subparagraph id="HBA08905472764DDB9BE59AAA95B66714"><enum>(H)</enum><header>Traveling animal act</header><text>The term <term>traveling animal act</term> means any performance of an animal for which the animal is transported in a mobile or traveling housing facility to, from, or between locations for the purpose of a performance.</text></subparagraph><subparagraph id="H69A1577D833043EF8F9147A0C09E8159"><enum>(I)</enum><header>Wildlife sanctuary</header><text>The term <term>wildlife sanctuary</term> means an organization that—</text><clause id="idA4F59C6A3A8C41A58D7A0460583879E6"><enum>(i)</enum><text>is described in sections 170(b)(1)(A)(vi) and 501(c)(3) of the Internal Revenue Code of 1986;</text></clause><clause id="id36ECCC901FC04A5594FE95A96BD9C82F"><enum>(ii)</enum><text>is a place of refuge that provides care for abused, neglected, unwanted, impounded, abandoned, orphaned, or displaced exotic or wild animals for the lifetime of the exotic or wild animals; and</text></clause><clause id="id59698E7D9C344CCAAD2DA478F5B09E8C"><enum>(iii)</enum><text>does not—</text><subclause id="HE1718B0EB49F4688B34508147ECA68D9"><enum>(I)</enum><text>engage in commercial trade in any exotic or wild animal, including—</text><item id="idF26EB901B8194B65AD5AD3FFEC8D367F"><enum>(aa)</enum><text>the sale of any animal, animal part, or derivative offspring;</text></item><item id="id71BC2728A24B4A65B167822575CF17E2"><enum>(bb)</enum><text>photographic opportunities; and</text></item><item id="idC298B7AF6F204BF9A2C2F2191E61FC5C"><enum>(cc)</enum><text>public events for financial profit or an entertainment purpose;</text></item></subclause><subclause id="HF95638EE2E8F4D12A89F94392228698B"><enum>(II)</enum><text>breed any exotic or wild animal;</text></subclause><subclause id="H3C8F2206A1DE4C17868CC302CCAC9174"><enum>(III)</enum><text>permit unescorted public visitation;</text></subclause><subclause id="H4CC81DCE84E04ABF8E013971BB838DC6"><enum>(IV)</enum><text>permit direct contact between the public and any exotic or wild animal; or</text></subclause><subclause id="H973A6F7FCE184752BEC896553F6DEE59"><enum>(V)</enum><text>remove any exotic or wild animal from a sanctuary or enclosure for exhibition or performance.</text></subclause></clause></subparagraph></paragraph><paragraph id="id433052D213C748908FDEA4662770ABD4"><enum>(2)</enum><header>Prohibited use of exotic and wild animals</header><text>Subject to paragraph (3), no person shall cause a performance of, or allow for the participation of, an exotic or wild animal in a traveling animal act.</text></paragraph><paragraph id="id41E27F2D195640939970EDA102F15477"><enum>(3)</enum><header>Exceptions</header><text>Paragraph (2) shall not apply to—</text><subparagraph id="H0A56E568CFE5423DA12EDACEAC363885"><enum>(A)</enum><text>the use of an exotic or wild animal—</text><clause id="H0D01BC5E8CC2409B992C6068BFC4E5A7"><enum>(i)</enum><text>in an exhibition at a nonmobile, permanent institution, zoo, or aquarium accredited by the Association of Zoos and Aquariums, the World Association of Zoos and Aquariums, the Global Federation of Animal Sanctuaries, or the Alliance of Marine Mammal Parks and Aquariums; </text></clause><clause id="HA2AF537A5E2C48939B9F1472F9D839C8"><enum>(ii)</enum><text>as part of an environmental education program by a facility accredited by the Association of Zoos and Aquariums or the Alliance of Marine Mammal Parks and Aquariums, if the animal used as part of the program is not—</text><subclause id="id14228B22CB30428A9AC8358D7C59AF7A"><enum>(I)</enum><text>used for more than 180 total days during a year; and</text></subclause><subclause id="id23FB2FFACA9F4E9E8D7FBF00E5A6BAF2"><enum>(II)</enum><text>kept in a mobile or traveling housing facility for more than 12 total hours during a day;</text></subclause></clause><clause id="H9988C4D5CA5D40BCB402265BA9CF4D20"><enum>(iii)</enum><text>by an institution of higher education, laboratory, or other research facility registered under section 6 for the purpose of conducting research;</text></clause><clause id="H46A9435F5B3745AAB501A26955922530"><enum>(iv)</enum><text>in film, television, or advertising, if the use does not involve a live animal exhibition conducted before a public studio audience; or</text></clause><clause id="HEF2FB857D599476F86BD6F31FA24CEE1"><enum>(v)</enum><text>in a rodeo;</text></clause></subparagraph><subparagraph id="H52BF370844CD4A26B6D59F2DCEFB1A7F"><enum>(B)</enum><text>the use of an indigenous wild animal by a wildlife rehabilitator in an environmental education program—</text><clause id="HA1CBAA83C6DE42DA81A380866A2F159F"><enum>(i)</enum><text>that is permitted by the relevant jurisdiction;</text></clause><clause id="H8F2666AB71A5460AA52729CBD4B6B7E7"><enum>(ii)</enum><text>that is accredited or certified by the National Wildlife Rehabilitators Association or the International Wildlife Rehabilitation Council; and</text></clause><clause id="id70F6C89869BE4878B76A52D8DF471CB8"><enum>(iii)</enum><text>if the exotic or wild animal is kept in a mobile or traveling housing facility for not more than 12 total hours during a day;</text></clause></subparagraph><subparagraph id="HF40BFC91A1E14809B7FF71303BC86C25"><enum>(C)</enum><text>a federally permitted falconer; or</text></subparagraph><subparagraph id="H6143D59F6F944C8E963774CF8460BF9B"><enum>(D)</enum><text>a wildlife sanctuary.</text></subparagraph></paragraph><paragraph commented="no" id="HB81499DB55A540B5AAE70D6C5F2FE789"><enum>(4)</enum><header>Penalty</header><text>Any person that fails to comply with this subsection shall be subject to the enforcement and penalties described in sections 16, 19, and 29.</text></paragraph><paragraph id="id84C22D36E6504B438EC7B4D1F1C3C639"><enum>(5)</enum><header>Relationship with other law</header><subparagraph id="H8D6055DBB96D4F6DAFFFDF6C8A344336"><enum>(A)</enum><header>In general</header><text>Nothing in this subsection—</text><clause id="H736D468AC1274B62835F2363FC54AA9E"><enum>(i)</enum><text>authorizes the interstate transport of any species listed as threatened or endangered under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); or</text></clause><clause id="H93FF55BC1AA34A98B6948EF96E6E5C43"><enum>(ii)</enum><text>waives any requirement to comply with any regulation issued under this Act.</text></clause></subparagraph><subparagraph id="H5B4D823238F4469D8055A9472804206A"><enum>(B)</enum><header>Supplement not supplant</header><text>The standards and requirements of this subsection—</text><clause id="id0CA685C81E574948945B87DF46E2E321"><enum>(i)</enum><text>are in addition to, and not in lieu of, any other laws protecting animal welfare; and</text></clause><clause id="id4D8D0ECEFAA34107A7687D8CFAF322C8" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>do not limit any other Federal, State, or local law or rule that more stringently protects the welfare of animals.</text></clause></subparagraph><subparagraph id="idF34D8C9EA4154C19ADF57B8C58371E7D"><enum>(C)</enum><header>Preemption</header><text>No State or political subdivision of a State may establish or continue to enforce any standards, requirements, or regulations with respect to causing a performance of, or allowing for the participation of, an exotic or wild animal in a traveling animal act that are inconsistent with or less stringent than the standards and requirements under this subsection.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H97DEB92735AB4DD7AA44A9052844A6C5"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect on the date that is 1 year after the date of enactment of this Act.</text></section></legis-body></bill>
