<official-title>To promote domestic energy production, to require onshore oil and natural gas lease sales, development of renewable energy on public lands, and offshore oil and natural gas and wind lease sales, and for other purposes.</official-title>

<section id="idc881d273c889415f8e95ac11533975b7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Made in America Renewable and Traditional Energy Act</short-title></quote> or the <quote><short-title>SMART Energy Act</short-title></quote>.</text></section> <section section-type="subsequent-section" id="id3BA3E217100B40B4AE62F411D142614D"><enum>2.</enum><header>Oil and natural gas and wind leasing; priority areas for renewable energy projects</header> <subsection id="id15037bb4b0574976950d660f55a096c1"><enum>(a)</enum><header>Onshore lease sales and renewable energy projects</header> <paragraph id="id891A17DF6CFE407D8C5AF2130F635D6A"><enum>(1)</enum><header>Requirement to immediately resume onshore and offshore oil and gas lease sales</header> <subparagraph id="id3D6686E16D964DF082DDA5C55CF32BDA"><enum>(A)</enum><header>In general</header><text>The Secretary of the Interior (referred to in this Act as the <quote>Secretary</quote>) shall immediately resume oil and gas lease sales in compliance with the <act-name parsable-cite="MLA">Mineral Leasing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>).</text></subparagraph>
<subparagraph id="id2ebcba5818734e0a94ed1c42bd0b73b8"><enum>(B)</enum><header>Requirement</header><text>The Secretary shall ensure that any oil and gas lease sale under subparagraph (A) is conducted immediately on completion of all applicable scoping, public comment, and environmental analysis requirements under the<act-name parsable-cite="MLA"> Mineral Leasing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>) and the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></subparagraph></paragraph> <paragraph id="id89ea192809e34f4a890d0af28db40146"><enum>(2)</enum><header>Annual lease sales</header> <subparagraph id="id80EEF135CC0A43AFAA50FEAE07CC59EA"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, in accordance with the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>), beginning in fiscal year 2022, the Secretary shall conduct a minimum of 4 oil and natural gas lease sales annually in each of the following States:</text>
<clause id="id6062f9199e3d49a3a3eff55bb871346e"><enum>(i)</enum><text>Wyoming.</text></clause> <clause id="id2c8a25f078464220a6b1234b78d6102e"><enum>(ii)</enum><text>New Mexico.</text></clause>
<clause id="idb065d498113b4cdfb8a4814fbf229e7c"><enum>(iii)</enum><text>Colorado.</text></clause> <clause id="id891ce0a5c4624f3385c95c055b84f5c2"><enum>(iv)</enum><text>Utah.</text></clause>
<clause id="id1501f08b666f45b79fd6bca7a88f020b"><enum>(v)</enum><text>Montana.</text></clause> <clause id="id8b23587d21894788be56b23325731689"><enum>(vi)</enum><text>North Dakota.</text></clause>
<clause id="id7bcb20d3985846d09673988f9ea0c4c3"><enum>(vii)</enum><text>Oklahoma.</text></clause> <clause id="id2d453cf2b3ff44f6a041d85d6da12513"><enum>(viii)</enum><text>Nevada.</text></clause>
<clause id="id5cfd36193e0e48dda2e514adfd707fac"><enum>(ix)</enum><text>Any other State in which there is land available for oil and natural gas leasing under that Act.</text></clause></subparagraph> <subparagraph id="id71e5f59caff2498db78e92890fae74b2" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Requirement</header><text>In conducting a lease sale under subparagraph (A) in a State described in that subparagraph, the Secretary shall offer all parcels eligible for oil and gas development under the resource management plan in effect for the State. </text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idD42A7D983C0A4B29975045AAD9CD3A9B"><enum>(C)</enum><header>Replacement sales</header><text>If, for any reason, a lease sale under subparagraph (A) for a calendar year is canceled, delayed, or deferred, including for a lack of eligible parcels, the Secretary shall conduct a replacement sale during the same calendar year. </text></subparagraph></paragraph> <paragraph id="id15d5593f30d3486e9def2179a6c34d13"><enum>(3)</enum><header>Priority areas for geothermal, solar, and wind energy projects</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary, in consultation with the Secretary of Energy, shall establish priority areas on public lands (as defined in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>)) for geothermal, solar, and wind energy projects, consistent with—</text>
<subparagraph id="id75800479D5C94645A9811297ACB6C7F2"><enum>(A)</enum><text>the principles of multiple use (as defined in that section); and</text></subparagraph> <subparagraph id="id0E4BAA5907BF47E2A4BBAEA5984889F8" commented="no"><enum>(B)</enum><text>the national goals for renewable energy production established pursuant to section 3104 of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/43/3004">43 U.S.C. 3004</external-xref>), including the minimum production goal described in subsection (b) of that section.</text></subparagraph></paragraph></subsection>
<subsection id="id5afab984440c4ef49130f57d5106eec4"><enum>(b)</enum><header>Offshore lease sales</header>
<paragraph id="id45888813B18A4F3FAB5EB84E703F784D"><enum>(1)</enum><header>In general</header><text>The Secretary shall conduct all lease sales described in the 2017–2022 Outer Continental Shelf Oil and Gas Leasing Proposed Final Program (November 2016) that have not been conducted as of the date of enactment of this Act by not later than December 31, 2022.</text></paragraph> <paragraph id="id71bc4f02cfaa45dcad05a5c1ace4f6d2"><enum>(2)</enum><header>Gulf of Mexico region annual lease sales</header><text>Notwithstanding any other provision of law, beginning in fiscal year 2022, the Secretary shall conduct a minimum of 2 region-wide oil and natural gas lease sales annually in the Gulf of Mexico Region of the outer Continental Shelf, which shall include the following areas described in the 2017–2022 Outer Continental Shelf Oil and Gas Leasing Proposed Final Program (November 2016):</text>
<subparagraph id="id7c6eef93023c48478035ff94ef63ee13"><enum>(A)</enum><text>The Central Gulf of Mexico Planning Area.</text></subparagraph> <subparagraph id="id4b8c7b29823a4873b16d1ddb91b7f538"><enum>(B)</enum><text>The Western Gulf of Mexico Planning Area.</text></subparagraph></paragraph>
<paragraph id="id1671f6d1882443deb9e933cf3b60a3b0"><enum>(3)</enum><header>Alaska region annual lease sales</header><text>Notwithstanding any other provision of law, beginning in fiscal year 2022, the Secretary shall conduct a minimum of 2 region-wide oil and natural gas lease sales annually in the Alaska Region of the outer Continental Shelf, as described in the 2017–2022 Outer Continental Shelf Oil and Gas Leasing Proposed Final Program (November 2016).</text></paragraph> <paragraph id="id9de1f2a5ec0a41edaff29340c1f36e8d"><enum>(4)</enum><header>Atlantic region and Pacific region annual lease sales</header> <subparagraph id="idFFB5F55200AB4CB5A31C4937CC561727"><enum>(A)</enum><header>In general</header><text>The Secretary shall immediately review and make proposals for the offshore wind leasing program for the Atlantic and Pacific Regions of the outer Continental Shelf in order to reach the goal of conducting a minimum of 2 region-wide wind lease sales annually in each of the Atlantic and Pacific Regions of the outer Continental Shelf.</text></subparagraph>
<subparagraph id="id8211c95fca81438392ca7e8d95788c2f"><enum>(B)</enum><header>Requirement</header><text>The Secretary shall ensure that the proposals for offshore wind leasing under subparagraph (A) take into consideration the locally affected coastal communities.</text></subparagraph></paragraph> <paragraph id="id6c31ab7463804115ad753400e08ac4fa" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header>Requirements</header><text>In conducting lease sales under paragraphs (2), (3), and (4), the Secretary shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="idFC30120E7A5A4BFC84F27E431E2835AE"><enum>(A)</enum><text>issue leases to the highest responsible qualified bidder or bidders; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idD95C2B55A64C4577BF76902623D37927"><enum>(B)</enum><text>include in each lease sale all unleased areas that are not subject to restrictions as of the date of the lease sale. </text></subparagraph></paragraph>
<paragraph id="id0236dc8a60054bd8a0e958cacf805ff0" commented="no"><enum>(6)</enum><header>Outer Continental Shelf oil and gas leasing program</header><text>Section 18 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1344">43 U.S.C. 1344</external-xref>) is amended—</text> <subparagraph commented="no" id="idE5700CB54A2E4994AFFE333F42770272"><enum>(A)</enum><text>in subsection (a), in the first sentence of the matter preceding paragraph (1), by striking <quote>subsections (c) and (d) of this section</quote> and inserting <quote>subsections (c) through (f)</quote>;</text></subparagraph>
<subparagraph commented="no" id="id30A25E2BB64B403390D68D8EE897D076"><enum>(B)</enum><text>by redesignating subsections (f) through (h) as subsections (g) through (i), respectively; and</text></subparagraph> <subparagraph commented="no" id="id653A997C53C449E486DA837E2907D65E"><enum>(C)</enum><text>by inserting after subsection (e) the following:</text>

<subsection commented="no" id="id5E8513029A4C45DBBC075593CE72C750"><enum>(f)</enum><header>Subsequent leasing programs</header>
<paragraph commented="no" id="idA057661F2F404F06BA974DA5B03ACE9A"><enum>(1)</enum><header>In general</header><text>Not later than 36 months after conducting the first lease sale under an oil and gas leasing program prepared pursuant to this section, the Secretary shall begin preparing the subsequent oil and gas leasing program under this section.</text></paragraph> <paragraph id="idAF4B72558D5A4AACA70CB0DAE9314D13" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Requirement</header><text>Each subsequent oil and gas leasing program under this section shall be approved not later than 180 days before the expiration of the previous oil and gas leasing program.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection>
<subsection id="idd3a6a0e203744a7c918a849a138ee208"><enum>(c)</enum><header>Prohibition</header>
<paragraph id="idCAD78B2B27514454889BF9D8B81F24E8"><enum>(1)</enum><header>In general</header><text>The President shall not, through Executive order or any other administrative procedure, unreasonably pause, cancel, delay, defer, or otherwise impede or circumvent the Federal energy mineral leasing processes under the <act-name parsable-cite="MLA">Mineral Leasing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>) or the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331 et seq.</external-xref>) or a related rulemaking process required by subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>), without Congressional approval.</text></paragraph> <paragraph id="idb0542c9d9ddf4f65a31d5936185980f0" commented="no"><enum>(2)</enum><header>Rebuttable presumption</header><text>There shall be a rebuttable presumption that any attempt by the President to pause, cancel, delay, defer, or otherwise impede or circumvent any Federal energy mineral leasing process under the <act-name parsable-cite="MLA">Mineral Leasing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>) or the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331 et seq.</external-xref>) or a related rulemaking process required by subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>), without Congressional approval, is a violation of the applicable law.</text></paragraph></subsection></section>
<section id="idd853961c5c58444a87c1867d15d19757"><enum>3.</enum><header>Requirement to submit documents and communications</header>
<subsection id="id75179D0D34884FEB955ABB1D2B37581D"><enum>(a)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of this Act, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives all documents and communications relating to the comprehensive review of Federal oil and gas permitting and leasing practices required under section 208 of Executive Order 14008 (86 Fed. Reg. 7624 (February 1, 2021); relating to tackling the climate crisis at home and abroad). </text></subsection> <subsection id="id2D46F632706D4ABD9C9F8CC37C5339C3" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Inclusions</header><text>The submission under subsection (a) shall include all documents and communications submitted to the Secretary by members of the public in response to any public meeting or forum relating to the comprehensive review described in that subsection. </text></subsection></section>
