which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a joint United States-Taiwan Infectious Disease Monitoring Center to serve as an early warning center in the case of an infectious disease outbreak in the Indo-Pacific region.</official-title></form><legis-body><section id="id209B9941271F43B49C139FA7B78569D5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>United States-Taiwan Public Health Protection Act</short-title></quote>.</text></section><section id="id9762C3C692104C89ACBD4A09D7917D41"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="ida5b3354d8b5c463a948761947f42abe8"><enum>(1)</enum><header>Center</header><text>The term <term>Center</term> means the Infectious Disease Monitoring Center established pursuant to section 3.</text></paragraph><paragraph id="idf06b64862739404ca758d61023a0dc63"><enum>(2)</enum><header>Relevant congressional committees</header><text>The term <term>relevant congressional committees</term> means—</text><subparagraph id="idA7FD231C66FE424C829ED88A8BC7ECA6"><enum>(A)</enum><text>the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>;</text></subparagraph><subparagraph id="id4977245E303F4B23A2B61E4A1047B9D2"><enum>(B)</enum><text>the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions of the Senate</committee-name>;</text></subparagraph><subparagraph id="id387721B2C23046F99016144A2F9EDC6C"><enum>(C)</enum><text>the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>; and</text></subparagraph><subparagraph id="id5FF9FCB1A248457193141D72AF94F165"><enum>(D)</enum><text>the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name>.</text></subparagraph></paragraph><paragraph id="id51c1bb46792c49b6a1239a8afeb1ac69"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of State. </text></paragraph></section><section id="idAAD8D4F08FCA4843BD01FAFE7E52DC46" section-type="subsequent-section"><enum>3.</enum><header>Infectious Disease Monitoring Center</header><subsection id="idC2741E241B3F479A809577A854E7674C"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of Health and Human Services and the heads of other relevant Federal departments and agencies, shall—</text><paragraph id="idC04C9E3E6A0542E68221F99B197534B1"><enum>(1)</enum><text display-inline="yes-display-inline">establish an Infectious Disease Monitoring Center within the American Institute in Taiwan in Taipei, Taiwan; and</text></paragraph><paragraph id="id7ad50f03a6fe4784a2430cb8f266ebec"><enum>(2)</enum><text>not later than 1 year after the date of the enactment of this Act, complete a study of how best to establish the Center that includes—</text><subparagraph id="id1b51da2a4066495b8f71802a74cb7391"><enum>(A)</enum><text>consultation with the Taiwan Economic and Cultural Representative Office in the United States, the Taiwan Centers for Disease Control, and any other relevant instrumentalities of the Taiwanese government; and</text></subparagraph><subparagraph id="id117ed996baa64d8195e71f90e5a9dfb0"><enum>(B)</enum><text>a consideration of the personnel, material, and funding requirements necessary to establish and operate the Center. </text></subparagraph></paragraph></subsection><subsection id="idC5FFF8AC636F4166B17D9E0F1DA74FF3" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Partnership</header><text display-inline="yes-display-inline">The Center shall seek to partner with the Taiwan Centers for Disease Control to conduct health monitoring of infectious diseases in the region by—</text><paragraph commented="no" display-inline="no-display-inline" id="id738C37A2C0974348914BFA3FF891E9D8"><enum>(1)</enum><text display-inline="yes-display-inline">regularly monitoring, analyzing, and disseminating open-source material from countries in the region, including viral strains, bacterial sub­types, and other pathogens;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9ECEE3C14336465BAC75F05311A22C85"><enum>(2)</enum><text>engaging in people-to-people contacts with medical specialists and public health officials in the region;</text></paragraph><paragraph id="id1fe0e4811a1c4b50ac980953986633c2"><enum>(3)</enum><text>providing expertise and information on infectious diseases to the Government of the United States and the Taiwanese government; and</text></paragraph><paragraph id="id6DD15320401E41CCAF0B16E31C41A6A8"><enum>(4)</enum><text>carrying out other appropriate activities, as determined by the Director of the Center. </text></paragraph></subsection><subsection id="id3970e09cc6644693bf13eb8c240ff1b4"><enum>(c)</enum><header>Staffing</header><paragraph id="id6987c842b0b14a53aee59762d793b2e0"><enum>(1)</enum><header>Infectious disease experts</header><text>The Secretary of Health and Human Services shall annually submit a list to the Secretary that identifies not fewer than 3 infectious disease experts, from among the National Institutes of Health, the Centers for Disease Control and Prevention, and the Food and Drug Administration, who are recommended to serve as detailees to the Center.</text></paragraph><paragraph id="idd909f79764424ec6a22d1d940fa338d0"><enum>(2)</enum><header>Other public health professionals</header><text>The heads of other relevant Federal departments and agencies may submit recommendations to the Secretary of qualified persons within their respective departments and agencies to serve as detailees to the Center.</text></paragraph><paragraph id="id790daa9dda694b9494708eacf7593526" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Selection</header><text>The Secretary, after considering the detailees recommended pursuant to paragraphs (1) and (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idACA582D0ECF24E0CBDDF6F75DEB8FC13"><enum>(A)</enum><text>shall appoint, for a period to be determined by the Secretary—</text><clause commented="no" display-inline="no-display-inline" id="id7C6768638A1244BDBA8693990D4A7183"><enum>(i)</enum><text>not fewer than 3 infectious disease experts detailed from among the National Institutes of Health, the Centers for Disease Control and Prevention, and the Food and Drug Administration to work at the Center, including 1 expert to serve as the Director of the Center; and</text></clause><clause id="id569EEE91290E48DC9E4A71F31A791472"><enum>(ii)</enum><text>not fewer than 1 qualified person from any other relevant Federal department or agency, including the Department of State and the United States Agency for International Development, to work at the Center;</text></clause></subparagraph><subparagraph id="id81277E214028444FABD32964A9A5A3FA"><enum>(B)</enum><text>may employ qualified foreign service nationals or locally engaged staff who are considered citizens of Taiwan to work at the Center; and</text></subparagraph><subparagraph id="id2B3D43168C78414481EBE4E1A1B86C0D"><enum>(C)</enum><text>may enter into agreements with the Taiwanese government regarding employees of the Taiwan Centers for Disease Control who may be tasked with supporting or coordinating with the Center.</text></subparagraph></paragraph><paragraph id="id260a908686c743dc8c42977a23318181"><enum>(4)</enum><header>Compensation</header><text>Individuals appointed by the Secretary pursuant to clause (i) or (ii) of paragraph (3)(A)—</text><subparagraph id="id7750BB7858EC4749907BC6B3E2C86F92"><enum>(A)</enum><text>shall be placed on leave without pay from their respective Federal departments and agencies for the duration of such appointment; and </text></subparagraph><subparagraph id="id92AB903D713647ABA930C2F41E760A86"><enum>(B)</enum><text>shall be compensated by the Department of State. </text></subparagraph></paragraph></subsection></section><section id="id64eee4059f1149088052d78328819f65"><enum>4.</enum><header>Report</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary shall submit a report to the relevant congressional committees that contains the results of the study described in section 3(a)(2), including—</text><paragraph id="id7ae7c70d2a484154b341844e343078d9"><enum>(1)</enum><text>a plan on how to establish and operate the Center, including—</text><subparagraph id="idb45e8cb62dca400ba3c199565310531f"><enum>(A)</enum><text>the personnel, material, and funding requirements necessary to establish and operate the Center; and</text></subparagraph><subparagraph id="id37aad263066542f8a20b065fdd5122e1"><enum>(B)</enum><text>the proposed structure and composition of Center personnel;</text></subparagraph></paragraph><paragraph id="id131a20d4e16947fa80461e118528d26a"><enum>(2)</enum><text>a description of the efforts that have been undertaken to establish the Center; and</text></paragraph><paragraph id="ide1f67bc7efae4334abd2cbfb01f95913"><enum>(3)</enum><text>a description of any consultations or agreements between the Department of State and the Taiwanese government regarding the establishment and operation of the Center, including—</text><subparagraph id="id332c1a84744f4b158de1ad16c86b7f70"><enum>(A)</enum><text>the role that employees of the Taiwan Centers for Disease Control would play in supporting or coordinating with the Center; and</text></subparagraph><subparagraph id="id3d2fa6ac3e274e0db7223918ae2d40fb"><enum>(B)</enum><text>whether any employees of the Taiwan Centers for Disease Control would be detailed to, or co-located with, the Center.</text></subparagraph></paragraph></section><section id="id6aed6b5cc8d3485fb2bbd10d4aaea7b0"><enum>5.</enum><header>Authorization of appropriations</header><subsection id="id49bd0a37850e40e98e8280bf9fe048c5"><enum>(a)</enum><header>Department of State</header><text>There are authorized to be appropriated to the Department of State—</text><paragraph id="idbe782eb7133d457993b7bed6dd40743f"><enum>(1)</enum><text>for fiscal year 2022, $300,000, of which—</text><subparagraph id="idd04a54c3a363486fbea8276d9fb8af4e"><enum>(A)</enum><text>$250,000 shall be used to conduct the study described in section 3(a)(2); and</text></subparagraph><subparagraph id="idd2e07c066e9c4c0da4221a4b50f1f3b3"><enum>(B)</enum><text>$50,000 shall be used to determine the selection of detailees to the Center from among the National Institutes of Health, the Centers for Disease Control and Prevention, the Food and Drug Administration, and other relevant Federal departments or agencies; and</text></subparagraph></paragraph><paragraph id="id132217da605547b289c0a056f60d1c46"><enum>(2)</enum><text>for fiscal year 2023, and each succeeding fiscal year, $50,000, which shall be used to determine the selection of detailees to the Center from among the National Institutes of Health, the Centers for Disease Control and Prevention, the Food and Drug Administration, and other relevant Federal departments or agencies.</text></paragraph></subsection><subsection id="id3ec565508844410797c31ffecb15d145"><enum>(b)</enum><header>American Institute in Taiwan</header><text>There are authorized to be appropriated to the American Institute in Taiwan for fiscal year 2022, and each succeeding fiscal year, $1,300,000, of which—</text><paragraph id="id66ded36620fc461eaf0062d7f845edba"><enum>(1)</enum><text>$1,200,000 shall be used to employ the personnel described in section 3(c)(3); and</text></paragraph><paragraph id="idebd0e1ec46434da383c788e1e87fa630"><enum>(2)</enum><text>$100,000 shall be used for management expenses related to operating the Center. </text></paragraph></subsection></section></legis-body></bill>
