<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3196</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211104">November 4, 2021</action-date><action-desc><sponsor name-id="S318">Mr. Wicker</sponsor> (for himself, <cosponsor name-id="S331">Mrs. Gillibrand</cosponsor>, and <cosponsor name-id="S252">Ms. Collins</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To enhance the policies, procedures, and training for midshipmen at the United States Merchant Marine Academy, and for other purposes. </official-title></form><legis-body style="OLC"><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Protections for Midshipmen Act</short-title></quote>.</text></section><section id="id3236f72604054ffdab857c0b2f8174ff"><enum>2.</enum><header>Suspension or revocation of merchant mariner credentials for perpetrators of sexual harassment or sexual assault</header><subsection id="idd9d8f69735a64312a92348a00bedf14d" commented="no"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/77">Chapter 77</external-xref> of title 46, United States Code, is amended—</text><paragraph id="id6331e7b8011b4663b731164cf9fc131c" commented="no"><enum>(1)</enum><text>in section 7701(b), by striking <quote>section 7703</quote> and inserting <quote>section 7703, 7704, or 7704a,</quote>; and</text></paragraph><paragraph id="id3dbf172d6f7e424f9901a5baaa052d15" commented="no"><enum>(2)</enum><text>by inserting after section 7704 the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id33443F320763442ABF53535E2606BBC3"><section id="idB02773606F064B1993691B3C4BFEB2DD" commented="no"><enum>7704a.<?LEXA-Enum 7704a.?></enum><header>Sexual harassment or sexual assault as grounds for suspension or revocation</header><text display-inline="no-display-inline">If it is shown at a hearing under this chapter that a holder of a license, certificate of registry, or merchant mariner’s document issued under this part, within 10 years before the beginning of the proceedings, is the subject of a claim, that is—</text><paragraph id="id6ABA952CCD3C4EEB9E254BEC6D02FC6E" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">a claim of—</text><subparagraph id="id0BC15721E400433BB76C6841240577F6" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">sexual harassment as defined in section 1561(e)(1) of title 10; or </text></subparagraph><subparagraph id="id324565D569E14C0DB2B4D728AA242642" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">sexual assault as described by section 920 of title 10 (article 120 of the Uniform Code of Military Justice); and </text></subparagraph></paragraph><paragraph id="id9a9122d1f4084ec1bf1cec9b9cc5ade7" commented="no"><enum>(2)</enum><text>substantiated, meaning that either—</text><subparagraph commented="no" id="id884E6516A5F8441EA95B2C1679DF05C2"><enum>(A)</enum><text>the employer of the accused determines that it is more likely than not that the harassment or assault has taken place; or</text></subparagraph><subparagraph commented="no" id="id276785AF4A334EBFADFD447111918D1E"><enum>(B)</enum><text>a finding by any Federal, State, local, or Tribal administrative or legal proceeding that the harassment or assault has taken place,</text></subparagraph><continuation-text continuation-text-level="paragraph" commented="no">the license, certificate, or document shall be suspended or revoked.</continuation-text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idB25F4DDB583C462C8A83C1D039319805" commented="no"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/77">chapter 77</external-xref> of title 46, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/46/7704">section 7704</external-xref> the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idA503F52310344341BB7A1487C36938B2"><toc><toc-entry bold="off" level="section">7704a. Sexual harassment or sexual assault as grounds for suspension or revocation.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="idfc00b1a1fccb43b6aac62326643bf959"><enum>3.</enum><header>Supporting the United States Merchant Marine Academy</header><subsection id="idA02C268A39F14C198F779D0EA5F3EEE2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/513">Chapter 513</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idC8447F962ED243E6922DA204701810EE"><section id="id716658FD0BB241BF9923C738A9602951"><enum>51323.</enum><header>Sexual assault and sexual harassment prevention information management system</header><subsection id="id9140081a40074cc981188e54618ea930"><enum>(a)</enum><header>Information management system</header><text>Not later than January 1, 2023, the Maritime Administrator shall establish an information management system—</text><paragraph id="id308f02872c304e1d9026c1e2c8896acf"><enum>(1)</enum><text>to track and maintain—</text><subparagraph id="idcd7a0f2dcb6841508ec99bf30f1a792f"><enum>(A)</enum><text>the overall number of sexual assault or sexual harassment incidents per fiscal year at the United States Merchant Marine Academy;</text></subparagraph><subparagraph id="id2e256e90c5dc4730be30585754386103"><enum>(B)</enum><text>the location of each such incident;</text></subparagraph><subparagraph id="id109aab728c7d43c3a699d9291ceae7ee"><enum>(C)</enum><text>the names and ranks of the individuals involved in each such incident;</text></subparagraph><subparagraph id="id8728db3436644aa183e7e9d498667af9"><enum>(D)</enum><text>the general nature of each such incident;</text></subparagraph><subparagraph id="id191c3feb1a5d40468b300d502f8d0381"><enum>(E)</enum><text>the type of inquiry made into each such incident;</text></subparagraph><subparagraph id="id1919944aa7fe404fa96c16cce19cf973"><enum>(F)</enum><text>a determination as to whether each such incident is substantiated; and</text></subparagraph><subparagraph id="idfc654c70ca8048e3ac402b25747501fa"><enum>(G)</enum><text>any accountability taken for misconduct related to the incident; and</text></subparagraph></paragraph><paragraph id="ide4d59da89e284810bdf749e6e71a09bd"><enum>(2)</enum><text>that is maintained in a secure fashion and ensures the protection of privacy for any individuals involved in such incidents.</text></paragraph></subsection><subsection id="id04635a7bb3474fd3a67cdf2981fcd588"><enum>(b)</enum><header>Sea Year program</header><text>The Maritime Administrator shall provide for the establishment of in-person and virtual confidential exit interviews for midshipmen from the Academy upon completion of Sea Year and following completion by the midshipmen of the survey under section 51322(d). </text></subsection></section><section commented="no" display-inline="no-display-inline" id="id4A44A7AD635B4E22978F61B92DECEA2F"><enum>51324.</enum><header>Sexual assault advisory council</header><subsection id="id0E62C7CEC8844DC1B4B734D84FFBBF35"><enum>(a)</enum><header>Establishment</header><text>The Secretary of Transportation shall establish a Sexual Assault Advisory Council (in this section referred to as the <quote>Council</quote>). </text></subsection><subsection id="id7661A7479C3F4B4EB75FF6BAFC668329"><enum>(b)</enum><header>Membership</header><text>The Council shall be composed of not fewer than eight and not more than 14 individuals selected by the President who are alumni or current midshipmen of the United States Merchant Marine Academy (including midshipmen or alumni who were victims of sexual assault and midshipmen or alumni who were not victims of sexual assault) and governmental and nongovernmental experts and professionals in the sexual assault field. At least one member shall be licensed in the field of mental health and have prior experience working as a counselor or therapist providing mental health care to survivors of sexual assault in a victim services agency or organization. No employee of the Department of Transportation shall be a member of the Council. The number of governmental experts appointed to the Council shall not exceed the number of nongovernmental experts. </text></subsection><subsection id="idB337AB9B34DD4957B5D625232E745EA3"><enum>(c)</enum><header>Functions; meetings</header><text>The Council shall meet not less often than annually to review the policy on sexual harassment, dating violence, domestic violence, sexual assault, and stalking under section 51318, and such other matters related to sexual assault and sexual harassment the Council views as appropriate, to ensure that such policy and such matters conform to the extent practicable to best practices in the sexual assault field. To carry out this subsection, the Council may conduct case reviews and have access, including through interviews, to current and former midshipmen of the United States Merchant Marine Academy (to the extent that such midshipmen provide the Department of Transportation express consent to be interviewed by the Council), to Sea Year surveys under section 51323(b), to all data collected from restricted reporting, and to any other information necessary to conduct such case reviews, except that the Council may not have access to any personally identifying information associated with such interviews, surveys, data, or information. </text></subsection><subsection id="id2CA405F30EB04991A0C8695B4306ABBD"><enum>(d)</enum><header>Reports</header><text>On an annual basis for each of the 5 years after the date of enactment of this section, and at the discretion of the Council thereafter, the Council shall submit, to the President and the Committee on Commerce, Science, and Transportation and the Committee on Appropriations of the Senate and the Committee on Transportation and Infrastructure and the Committee on Appropriations of the House of Representatives, a report on its findings based on the reviews conducted pursuant to subsection (c). </text></subsection><subsection id="id34C3D69EED1647EBAABC8021F1C8D3E8"><enum>(e)</enum><header>Employee status</header><text>Members of the Council shall not be considered employees of the United States Government for any purpose and shall not receive compensation other than reimbursement of travel expenses and per diem allowance in accordance with section 5703 of title 5.</text></subsection><subsection id="id10EA233A27CA43BBBE4A759B0F45DFD0"><enum>(f)</enum><header>Nonapplicability of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Council. </text></subsection><subsection id="id86BE40D56BE94A7A91C7DF03291B9D63" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header>Sunset</header><text>This section shall cease to be effective on the date that is 10 years after the date of enactment of this section.</text></subsection></section><section id="id68a707ea27af478199d2eeaae8bbb22e"><enum>51325.</enum><header>Diversity and inclusion action plan</header><subsection id="idB3FD1479DDB54BB09A2B6A82BD3DEE41"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than January 1, 2023, the Maritime Administrator shall promulgate a Diversity and Inclusion Action Plan for the United States Merchant Marine Academy (referred to in this section as the <quote>Plan</quote>). The Plan shall—</text><paragraph id="id779f88de7a99488c9a31e7172a8ad21d"><enum>(1)</enum><text>increase recruiting efforts in historically underrepresented communities, including through partnerships with historically black colleges and universities and maritime centers of excellence designated under section 51706;</text></paragraph><paragraph id="id71022f1c3dab4704b69a45d463a2acea"><enum>(2)</enum><text>promulgate and make available a set of resources to—</text><subparagraph id="id9fb12d5b9a9c4c44b618c0ce8753e9d4"><enum>(A)</enum><text>establish responsibilities for midshipmen, faculty, and staff of the Academy with respect to diversity and inclusion;</text></subparagraph><subparagraph id="id7551d67e00314262b45d66b171fba253"><enum>(B)</enum><text>create standards of—</text><clause id="id8336dbf449354bf4b9962a5865890850"><enum>(i)</enum><text>training that require interpersonal dialogue on diversity and inclusion;</text></clause><clause id="idfa205ac31ef14900b7cdf4350cf481f2"><enum>(ii)</enum><text>setting behavioral boundaries with others; and</text></clause><clause id="id136623ed6e4e4f47a94ebb4529ddcc2c"><enum>(iii)</enum><text>specific processes for the reporting and documentation of misconduct related to hazing, bullying, hate, and harassment;</text></clause></subparagraph><subparagraph id="idc0ed9ec357d34a50a518b54f01dd6c2d"><enum>(C)</enum><text>hold leaders and other individuals at the Academy accountable for violations of such standards;</text></subparagraph><subparagraph id="id4895f0ed5cb142df9de18ae9286c9bd2"><enum>(D)</enum><text>equip midshipmen, faculty, and staff of the Academy with the resources and materials to promote a diverse and inclusive working environment; and</text></subparagraph><subparagraph id="id7cb6cccfdc3c4fd8a5b19bfab821ab7f"><enum>(E)</enum><text>address how concepts of diversity and inclusion can be integrated into the curriculum and training of the Academy; </text></subparagraph></paragraph><paragraph id="idb2e9f248a82144eca160eca085e71fc2"><enum>(3)</enum><text>require a biannual survey of midshipmen, faculty, and staff of the Academy assessing—</text><subparagraph id="id8d7a334264f84db8850d425bff2a5d10"><enum>(A)</enum><text>the inclusiveness of the environment of the Academy; and</text></subparagraph><subparagraph id="id4fd21a0f2807483d84f62ebe7d80aafc"><enum>(B)</enum><text>the effectiveness of the Plan; and</text></subparagraph></paragraph><paragraph id="id7c195dbfa8e244c1a805107fe0222439"><enum>(4)</enum><text>require an annual survey of faculty and staff of the Academy assessing the inclusiveness of the environment of the Sea Year program.</text></paragraph></subsection><subsection id="iddcdb2d97f0364a35aff05c0ba6770b4d" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Report to Congress</header><text>Not later than 30 days after the date of enactment of this section, the Maritime Administrator shall provide Congress with a report on the resources necessary to properly implement this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id5BE6257E00424DB2BB718F240E3E53CE"><enum>(b)</enum><header>Conforming amendments</header><text>The chapter analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/513">chapter 513</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB2FD64F6CF2F4435AD02DD7C3AA199BB"><toc><toc-entry level="section" bold="off">51323. Sexual assault and sexual harassment prevention information management system</toc-entry><toc-entry level="section" bold="off">51324. Sexual assault advisory council</toc-entry><toc-entry level="section" bold="off">51325. Diversity and inclusion action plan</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ida739f6dbc0794dfc844af4bf5ea275e3"><enum>(c)</enum><header>United States Merchant Marine Academy student support plan</header><paragraph id="idc07e9b5a46594b1189457d1bb5aa7369"><enum>(1)</enum><header>Student support plan</header><text>Not later than January 1, 2023, the Maritime Administrator shall promulgate a Student Support Plan for the United States Merchant Marine Academy. Such plan shall—</text><subparagraph id="id96839D4950624199A3D2DFDE4305D87F"><enum>(A)</enum><text>address the mental health resources available to midshipmen, both on-campus and during Sea Year;</text></subparagraph><subparagraph id="idD379FC48AFFA41948B62678BD8760BDF"><enum>(B)</enum><text>establish a tracking system for suicidal ideations and suicide attempts; </text></subparagraph><subparagraph id="idE8E99FF3A32A4FA9B4B0F9437704BFB8"><enum>(C)</enum><text>create an option for midshipmen to obtain assistance from a professional care provider virtually; and</text></subparagraph><subparagraph id="id2da1301b5f14445284328a8f64040420"><enum>(D)</enum><text>require an annual survey of faculty and staff assessing the adequacy of mental health resources for midshipmen of the Academy, both on campus and during Sea Year.</text></subparagraph></paragraph><paragraph id="id628078c5ee0443dc996fdc1d76bac333" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Report to Congress</header><text>Not later than 30 days after the date of enactment of this Act, the Maritime Administrator shall provide Congress with a report on the resources necessary to properly implement this subsection. </text></paragraph></subsection></section><section id="idef2d586fbe3b43298169182607f3f167" commented="no"><enum>4.</enum><header>Special victims counsel</header><text display-inline="no-display-inline">Section 51319 of title 46, United States Code, is amended—</text><paragraph commented="no" id="idAA6B84E5D80B41FCA454A0EEF3E1A310"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d);</text></paragraph><paragraph commented="no" id="id1358B80A1F14432F9E2771B36BF30A9F"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id289C95C72CDE4395B29F2BEB25F25F0A"><subsection id="id17b21daf09214642bf4b311423c80b64" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Special victims counsel</header><text>The Secretary shall designate legal counsel (to be known as <quote>Special Victims’ Counsel</quote>) for the purpose of providing legal assistance to any cadet of the Academy who is the victim of an alleged sex-related offense, regardless of whether the report of that offense is restricted or unrestricted.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="idCCB9107A519F4325B57928E09FD6CD71"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id603C9C0E11DA4F5ABC74F6C70D2574DC"><subsection commented="no" display-inline="no-display-inline" id="id84B372BEA9D348109D82048CDD567BA2"><enum>(e)</enum><header>Unfilled vacancies</header><text>In the event of an unfilled vacancy for any position under this section, the Secretary may appoint, without regard to the provisions of subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, other than sections 3303 and 3328 of that title, a qualified candidate for the purposes of filling such position.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id6ef0b2252b4f470dbb583425f5313a07"><enum>5.</enum><header>Catch a Serial Offender assessment</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Commandant of the Coast Guard, in consultation with the Maritime Administrator, shall conduct an assessment of the feasibility and process necessary to implement a program for the United States Merchant Marine Academy and United States Merchant Marine modeled off of the Catch a Serial Offender program of the Department of Defense using the information management system required under subsection (a) of section 51323 of title 46, United States Code, and the exit interviews under subsection (b) of such section.</text></section><section id="idc93d4faf11b04c44b22f805d9fe4f8b7" commented="no"><enum>6.</enum><header>Shipboard training</header><text display-inline="no-display-inline">Section 51322(a) of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEF53C5432C3A4E6483F649E113B4E98E"><paragraph id="id1c25914bd85c46b6bc5195ff36c145b7" commented="no"><enum>(3)</enum><header>Training</header><subparagraph id="id5222A00FA5B542FCA05D348D01DC9297" commented="no"><enum>(A)</enum><header>In general</header><text>As part of training provided to all midshipmen of the Academy, the Maritime Administrator shall develop and implement comprehensive in-person sexual assault risk-reduction and response training that, to the extent practicable, conforms to best practices in the sexual assault field and includes appropriate scenario-based training.</text></subparagraph><subparagraph id="id6bbb6d921dac4135a51daa4f8f7394a7" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Development and consultation with experts</header><text>In developing the sexual assault risk-reduction and response training under subparagraph (A), the Maritime Administrator shall consult with and incorporate, as appropriate, the recommendations and views of experts in the sexual assault field.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idC4CA24469C484E96B94A4604CE5B65EA"><enum>7.</enum><header>United States maritime transportation system workforce diversity and inclusion task force</header><text display-inline="no-display-inline">Section 55501 of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE59F98F3C6CE44C9BA39E4C886244F76"><subsection id="id3f29d9ca4f714c3b8b7965e1908c9fdc"><enum>(g)</enum><header>Maritime transportation system diversity and inclusion task force</header><paragraph id="id43F954223A9C4235B3A42C5640685842"><enum>(1)</enum><header>In general</header><text>Not later than 120 days after the date of enactment of this subsection, the Secretary of Transportation shall establish within the Committee a task force to provide an interagency forum for the identification, discussion, and sharing of tools and practices that promote diversity and inclusiveness within the maritime transportation system workforce.</text></paragraph><paragraph id="id79f5707ea6734002993a07818df1e303"><enum>(2)</enum><header>Responsibilities</header><text>The task force established under this subsection shall share best practices with the Committee toward enhancing representation in the maritime transportation system workforce.</text></paragraph><paragraph id="id488211B5C2CA4417A5F68141F8159D24"><enum>(3)</enum><header>Diversity and inclusion action plan</header><text>Not later than January 1, 2023, the Secretary of Transportation shall promulgate a Diversity and Inclusion Action Plan for the maritime transportation system workforce. Such plan shall establish measurable parameters to assess recruiting, retention, training, and support for women and historically underrepresented racial and ethnic minorities within the United States maritime community.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
