<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3190</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211104">November 4, 2021</action-date><action-desc><sponsor name-id="S357">Mrs. Fischer</sponsor> (for herself, <cosponsor name-id="S153">Mr. Grassley</cosponsor>, <cosponsor name-id="S372">Mrs. Capito</cosponsor>, <cosponsor name-id="S266">Mr. Crapo</cosponsor>, <cosponsor name-id="S398">Mr. Cramer</cosponsor>, <cosponsor name-id="S395">Mrs. Hyde-Smith</cosponsor>, <cosponsor name-id="S373">Mr. Cassidy</cosponsor>, and <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 31, United States Code, to provide for transparency of payments made from the Judgment Fund.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H97501AD0ED6D41C1B15D75F6E8E9E890"><section section-type="section-one" id="H17661FBC463447B59B328D7DB86601DA"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Judgment Fund Accountability Act of 2021</short-title></quote>.</text></section><section id="H70C3239986D649938786DE5600CBB967"><enum>2.</enum><header>Judgment Fund transparency</header><subsection id="HCD976383CA674DF881F8C729C1E9B2E0"><enum>(a)</enum><header>Transparency requirement</header><text display-inline="yes-display-inline">Section 1304 of title 31, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H457E4E5CE9ED45289D88E63F19027D79"><subsection id="H20CD2BC4BF0B4F688B5F8CBB351B478C"><enum>(d)</enum><text display-inline="yes-display-inline">Unless the disclosure of such information is otherwise prohibited by law or court order, the Secretary of the Treasury shall make available to the public on a website, as soon as practicable, but not later than 30 days after the date on which a payment under this section is tendered, the following information with regard to that payment:</text><paragraph id="H5361375BF6B34397856CA7190FA768CE"><enum>(1)</enum><text>The name of the specific agency or entity whose actions gave rise to the claim or judgment.</text></paragraph><paragraph id="H054CDA3DCF3F4D7B8F4289460532091A"><enum>(2)</enum><text display-inline="yes-display-inline">The name of the plaintiff or claimant.</text></paragraph><paragraph id="H91CC9103325540B4A8AC0555B982F4FD"><enum>(3)</enum><text>The name of counsel for the plaintiff or claimant.</text></paragraph><paragraph commented="no" id="H4E2DCF58806444E192154A4F76703FAF"><enum>(4)</enum><text>The amount paid representing principal liability and any amounts paid representing any ancillary liability, including attorney fees, costs, and interest.</text></paragraph><paragraph commented="no" id="H730A89BEA78A4C788D2522F2571801C2"><enum>(5)</enum><text>A brief description of the facts that gave rise to the claim.</text></paragraph><paragraph id="HBEE16401D6014D7197E1DDCADB8CFF56"><enum>(6)</enum><text>The name of the agency that submitted the claim.</text></paragraph></subsection><subsection id="id3140ff394e4d4f91b73335058ef25751" commented="no"><enum>(e)</enum><text>No payment may be made under this section to an individual who has entered, or attempted to enter, the United States unlawfully.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC1DD821AD67547FEA93989BF88E9E16A"><enum>(b)</enum><header>Implementation</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall implement the amendment made by this section beginning not later than 60 days after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
