which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a manufactured housing community improvement grant program, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Manufactured Housing Community Improvement Grant Program Act</short-title></quote>.</text></section><section id="id95C54F996C1543DBA7D669403B30134D"><enum>2.</enum><header>Manufactured housing community improvement grant program</header><subsection id="idcd066e9d4db743c3b28caafa502aadad"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idbc5e25d003e943aba00f0d60d60cf84f"><enum>(1)</enum><header>Eligible manufactured home community</header><text>The term <term>eligible manufactured home community</term> means a community that—</text><subparagraph id="id5f912491c7464e00a1fbfea2f5e8cc4d"><enum>(A)</enum><text>is affordable to low- and moderate-income persons (as such term is defined in section 102(a) of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5302">42 U.S.C. 5302(a)</external-xref>)); and </text></subparagraph><subparagraph id="id72A243F7299F4E31AD6D221A04CFAA36"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id328EB4D426614FD2B67BB0AE84CCFA63"><enum>(i)</enum><text>is owned by the residents of the manufactured housing community through a resident-controlled entity, as defined by the Secretary, in which at least two-thirds of residents are member-owners of the land-owning entity; or</text></clause><clause id="idc96184a3ad064877a513ec63ed2d7559" indent="up1"><enum>(ii)</enum><text>will be maintained as such a community, and remain affordable for low- and moderate-income families, to the maximum extent practicable and for the longest period feasible.</text></clause></subparagraph></paragraph><paragraph id="id09837994b42046d39c700e332e72eb3f"><enum>(2)</enum><header>Eligible recipient</header><text>The term <term>eligible recipient</term> means a partnership of—</text><subparagraph id="id12b4bb43a71446208d40e88d0f432e46"><enum>(A)</enum><text>a grantee under paragraph (2) or (4) of section 106(a) of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5306">42 U.S.C. 5306(a)</external-xref>); and</text></subparagraph><subparagraph id="id2604c21ffb7b40fbbb74ba8899e70ef9"><enum>(B)</enum><text>an eligible manufactured home community, a nonprofit entity, or a consortia of nonprofit entities working with an eligible manufactured home community.</text></subparagraph></paragraph><paragraph id="id50bfa361bf5b4e1198bc9ae03013d69c"><enum>(3)</enum><header>Manufactured home community</header><text>The term <term>manufactured home community</term> means any community, court, or park equipped to accommodate manufactured homes for which pad sites, with or without existing manufactured homes or other allowed homes, or other suitable sites, are used primarily for residential purposes, with any additional requirements as determined by the Secretary, including any manufactured housing community as such term is used for purposes of the program of the Federal National Mortgage Association for multifamily loans for manufactured housing communities and the program of the Federal Home Loan Mortgage Corporation for loans for manufactured housing communities.</text></paragraph><paragraph id="id7C71767AD2EC4A588989D22EC7D136C0" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph></subsection><subsection id="id60810AF99B3D4969A1D646C41B0F16DE"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall carry out a competitive grant program to award funds to eligible recipients to carry out eligible projects for improvements in eligible manufactured home communities.</text></subsection><subsection id="id3fa5c5218dab4877a54b5de49cf7eca3"><enum>(c)</enum><header>Eligible projects</header><text>Amounts from grants under this section shall be used to assist in carrying out a project for construction, reconstruction, repair, or clearance of housing, facilities and improvements in or serving a manufactured housing community that is necessary to protect the health and safety of the residents of the manufactured housing community and the long-term sustainability of the community.</text></subsection><subsection id="idcea4e523c05644a0a861a2c74f7fd6f1"><enum>(d)</enum><header>Waivers</header><text>The Secretary may waive or specify alternative requirements for any provision of law or regulation that the Secretary administers in connection with use of amounts made available under this section other than requirements related to fair housing, nondiscrimination, labor standards, and the environment, upon a finding that the waiver or alternative requirement is not inconsistent with the overall purposes of such Act and that the waiver or alternative requirement is necessary to facilitate the use of amounts made available under this section.</text></subsection><subsection id="idd74c011193ed4ae0a036000bdbd7d7c1"><enum>(e)</enum><header>Implementation</header><text>The Secretary shall have authority to issue such regulations, notices, or other guidance, forms, instructions, and publications to carry out the programs, projects, or activities authorized under this section to ensure that such programs, projects, or activities are completed in a timely and effective manner. </text></subsection><subsection id="id42723B66AD814F438236CB5F48F58807"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary such sums as may be necessary to carry out this section.</text></subsection></section></legis-body></bill>
