which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 10, United States Code, to establish a program of the Department of Defense to carry out stormwater management projects on or related to military installations to improve the resilience of military installations and defense access roads and protect waterways and stormwater-stressed ecosystems.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H1EC2F0090D8A4904B87C2CDC42D1C8C2"><section section-type="section-one" id="H0DDFEC1B5BBF4C1898EC249C177C2F8C"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>EMBRACE Stormwater Management Act</short-title></quote> or the <quote><short-title>Enhancing Military Base Resilience and Conserving Ecosystems through Stormwater Management Act</short-title></quote>.</text></section><section id="HE1BBD39E419047D9A8B60A9982B41312"><enum>2.</enum><header>Department of Defense stormwater management projects for military installations and defense access roads</header><subsection id="idA0AE40F046A04677AE45EE520CCE7307"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/169">chapter 169</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/2815">section 2815</external-xref> the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="H8FEA66C7A0D8491ABC3517750C6B1047"><section id="HBCC8FE1674044956990120A7B2FB532C"><enum>2815a.</enum><header>Stormwater management projects for installation and defense access road resilience and waterway and ecosystems conservation</header><subsection id="H28B223FAEC094AA5B53E0333B8A4A552"><enum>(a)</enum><header>Projects Authorized</header><text display-inline="yes-display-inline">The Secretary concerned may carry out a stormwater management project on or related to a military installation for the purpose of—</text><paragraph id="HBC8EA3EA3BA14E1391EC6EF7C0E210A0"><enum>(1)</enum><text display-inline="yes-display-inline">improving military installation resilience or the resilience of a defense access road or other essential civilian infrastructure supporting the military installation; and</text></paragraph><paragraph id="HD29ED819A3F74E388DA57AE00D9FC882"><enum>(2)</enum><text>protecting nearby waterways and stormwater-stressed ecosystems.</text></paragraph></subsection><subsection id="HFA5FE208B36D4D9EA3E2972211E83BD6"><enum>(b)</enum><header>Project methods and Funding sources</header><text display-inline="yes-display-inline">A stormwater management project may be carried out under this section as, or as part of, any of the following:</text><paragraph id="HAF68EBBB31834002A3C98628F475DC0B"><enum>(1)</enum><text>An authorized military construction project.</text></paragraph><paragraph id="H62944F81A5394D4DA0CC875CA8D64DD3"><enum>(2)</enum><text>An unspecified minor military construction project under section 2805 of this title, including using appropriations available for operation and maintenance subject to the limitation in subsection (c) of such section.</text></paragraph><paragraph id="H556863D2A72743A3818B1704A2E1E58B"><enum>(3)</enum><text display-inline="yes-display-inline">A military installation resilience project under section 2815 of this title, including using appropriations available for operations and maintenance subject to the limitation of subsection (e)(3) of such section.</text></paragraph><paragraph id="H69A4AFA088474FC39C11A02B7AC87A3E"><enum>(4)</enum><text display-inline="yes-display-inline">A defense community infrastructure resilience project under section 2391(d) of this title.</text></paragraph><paragraph id="H03C91139F3B744CC9C1F4889FF6E05AF"><enum>(5)</enum><text>A military construction project under section 2914 of this title.</text></paragraph><paragraph id="HF5785101460148238A773C91FE91AA0C"><enum>(6)</enum><text display-inline="yes-display-inline">A reserve component facility project under section 18233 of this title.</text></paragraph><paragraph id="HAABF36D679774BF499EE975AFA40F355"><enum>(7)</enum><text display-inline="yes-display-inline">A defense access road project under section 210 of title 23.</text></paragraph></subsection><subsection id="H791491E4E1E7473EA3BEE92101858783"><enum>(c)</enum><header>Project priorities</header><text display-inline="yes-display-inline">In selecting stormwater management projects to be carried out under this section, the Secretary concerned shall give a priority to project proposals involving the retrofitting of buildings and grounds on a military installation or retrofitting a defense access road to reduce stormwater runoff.</text></subsection><subsection id="HC8B73B4A4ED94F058BD475518C99092D"><enum>(d)</enum><header>Project activities</header><text display-inline="yes-display-inline">Activities carried out as part of a stormwater management project under this section may include the following:</text><paragraph id="H2D0BDD2647BB41F59D7E3269F8E007F9"><enum>(1)</enum><text>The installation, expansion, or refurbishment of stormwater ponds and other water-slowing and retention measures.</text></paragraph><paragraph id="HD470449A7B754015984AA7CCABD275F5"><enum>(2)</enum><text>The installation of permeable pavement in lieu of, or to replace existing, nonpermeable pavement.</text></paragraph><paragraph id="H65F343D773374ED891E03065DB56D3F7"><enum>(3)</enum><text>The use of planters, tree boxes, cisterns, and rain gardens to reduce stormwater runoff.</text></paragraph></subsection><subsection id="H3A725BDDD5A34A58A3A69571680A64EE"><enum>(e)</enum><header>Project coordination</header><text display-inline="yes-display-inline">In the case of a stormwater management project carried out under this section on or related to a military installation and any project related to the same installation carried out under section 2391(d), 2815, or 2914 of this title, the Secretary concerned shall ensure coordination between the projects regarding the water access, management, conservation, security, and resilience aspects of the projects.</text></subsection><subsection id="H6F46571011124B5DA3754BCB21523C90"><enum>(f)</enum><header>Annual Report</header><paragraph commented="no" display-inline="yes-display-inline" id="H3924C0B734724627B34F6D5163372FC4"><enum>(1)</enum><text display-inline="yes-display-inline">Not later than 90 days after the end of each fiscal year, each Secretary concerned shall submit to the congressional defense committees a report describing—</text><subparagraph id="HFEE64AE89F5743159942A46C3A2DC219" indent="up1"><enum>(A)</enum><text>the status of planned and active stormwater management projects carried out by that Secretary under this section; and</text></subparagraph><subparagraph id="HED2035F2C403483BADADF93EE643112B" indent="up1"><enum>(B)</enum><text>all projects completed by that Secretary during the previous fiscal year.</text></subparagraph></paragraph><paragraph id="H03DF82570B1D461EAEF4014DC8714D07" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Each report submitted under paragraph (1) shall include, with respect to each stormwater management project described in the report, the following information:</text><subparagraph id="HF04A10E6B4184E00ACC522049E00731F"><enum>(A)</enum><text>The title, location, a brief description of the scope of work, the original project cost estimate, and the current working cost estimate.</text></subparagraph><subparagraph id="H4DEF8D9C3759438FADDC6530FE3E77A6"><enum>(B)</enum><text display-inline="yes-display-inline">The rationale for how the project will—</text><clause id="H68EB1FA06D9F4AB89FA9425FEAD6E7B4"><enum>(i)</enum><text>improve military installation resilience or the resilience of a defense access road or other essential civilian infrastructure supporting a military installation; and</text></clause><clause id="H9C05C0F5A02D4AEB970E16F107EDF4A0"><enum>(ii)</enum><text>protect waterways and stormwater-stressed ecosystems.</text></clause></subparagraph><subparagraph id="H1EC09CC45C7449E59A78F8F6EB9101D7"><enum>(C)</enum><text>Such other information as the Secretary concerned considers appropriate.</text></subparagraph></paragraph></subsection><subsection id="H324F261B3E0646D9BEEDEB050CA99031"><enum>(g)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HD6B0F80EB34A421BBF4737DAE4420F8B"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>defense access road</term> means a road certified to the Secretary of Transportation as important to the national defense under section 210 of title 23.</text></paragraph><paragraph id="H5A0FE39EBBFA4D4FBE81E6970B903BE9"><enum>(2)</enum><text>The terms <term>facility</term> and <term>State</term> have the meanings given those terms in section 18232 of this title.</text></paragraph><paragraph id="HF6EF85EBAC8649DB971D651DB51B7BFA"><enum>(3)</enum><text>The term <term>military installation</term> includes a facility of a reserve component of an armed force owned by a State rather than the United States.</text></paragraph><paragraph id="H309A9F160AC04A539D320728C663FFF0"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>Secretary concerned</term> means—</text><subparagraph id="HCC99A31CF1ED44809A10200C11BA491B"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary of a military department with respect to military installations under the jurisdiction of that Secretary; and</text></subparagraph><subparagraph id="HD804D03DB95E48719072C7D06009B3C3"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of Defense with respect to matters concerning the Defense Agencies and facilities of a reserve component owned by a State rather than the United States.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idE476E6B505EC421EB74AD2E8965C47D9"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of subchapter I of such title is amended by inserting after the item relating to section 2815 the following new item:</text><quoted-block style="USC" id="id3aa97918-61a5-431b-8ab6-b66c84ea4c55"><toc><toc-entry level="section" idref="HBCC8FE1674044956990120A7B2FB532C">2815a. Stormwater management projects for installation and defense access road resilience and waterway and ecosystems conservation.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
