which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To make transitional compensation available to dependents of members of the Armed Forces convicted of dependent abuse in Federal or State court and dependents of members accused of dependent abuse who have forfeited all pay and allowances for an unrelated offense.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rachel Booth Act</short-title></quote>.</text></section><section id="idCF9748F7ED314EE3A6C4A1941FBD3609"><enum>2.</enum><header>Modifications to transitional compensation for dependents of members separated for dependent abuse</header><subsection id="id76107F917C1E422EA3A470D62BE251C0"><enum>(a)</enum><header>Covered punitive actions</header><text>Subsection (b) of section 1059 of title 10, United States Code, is amended—</text><paragraph id="idD6FCED8C769842958FF0D2B78882D1E6"><enum>(1)</enum><text>in paragraph (1)(B), by striking <quote>; or</quote> and inserting a semicolon;</text></paragraph><paragraph id="idCB1D65B16E0C42998D35AE2D73BE5895"><enum>(2)</enum><text>in paragraph (2), by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph id="id0CEC9800326E4F30A0CAB25D08510BDC"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2F147C95FC8D4997B06E8C22FD244061"><paragraph id="id0cb1101771844518b470933c245ed9cd"><enum>(3)</enum><text>who is—</text><subparagraph id="idE39BA31E2F0C40C7AC7A40605AE67713"><enum>(A)</enum><text>convicted of a dependent-abuse offense in a district court of the United States or a State court; and </text></subparagraph><subparagraph id="idAE7866399899408D87DFABABD7385DB3"><enum>(B)</enum><text>separated from active duty pursuant to a sentence of a court-martial, or administratively separated, voluntarily or involuntarily, from active duty, for an offense other than the dependent-abuse offense; or</text></subparagraph></paragraph><paragraph id="id6DAEFBCEFA5941E2969FAEE8390F4E01"><enum>(4)</enum><text>who is—</text><subparagraph id="idBD3B85F95207498C8AC6E891110392A1"><enum>(A)</enum><text>accused but not convicted of a dependent-abuse offense; </text></subparagraph><subparagraph id="id383E640130F74BA38EDB8E8EF79C814E"><enum>(B)</enum><text>determined, as a result of a review by the commander of the member and based on a preponderance of evidence, to have committed the dependent-abuse offense; and</text></subparagraph><subparagraph id="idD65D02FFE8A04C41863A5AD6FDC61A29"><enum>(C)</enum><text>required to forfeit all pay and allowances pursuant to a sentence of a court-martial for an offense other than the dependent-abuse offense.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id402692DB75C442278C89D4B88D95AA45"><enum>(b)</enum><header>Recipients of payments</header><text>Subsection (d) of such section is amended—</text><paragraph id="idDD4BBADDBEF94A11ABE34A2DE3F1AC2B"><enum>(1)</enum><text>in paragraph (1), by striking <quote>resulting in the separation</quote> and inserting <quote>referred to in subsection (b)</quote>; and</text></paragraph><paragraph id="idA8B5D540A05A476D8772452C8FCFB556"><enum>(2)</enum><text>in paragraph (4)—</text><subparagraph id="id6E3BD60F087344728DAD0482976323C4"><enum>(A)</enum><text>by striking <quote>determined as of the date</quote> and inserting the following: “determined—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9B1C9DDA46E24F9092E5C94B22B003D2"><subparagraph id="idE2EDB80C198340789D1D7DD8E68C5349"><enum>(A)</enum><text>as of the date</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id3863C19303614829B1A4E559EDF1CDC2"><enum>(B)</enum><text>by striking <quote>offense or, in a case</quote> and inserting the following: “offense;</text><quoted-block style="OLC" display-inline="no-display-inline" id="id540D3F413D444F6DB11D6B9E87CD4ED6"><subparagraph id="idA186368BC6EB4FC1B3F651B33C7324E2"><enum>(B)</enum><text>in a case</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id7044BF4B166E40699B0773CA883B69D9"><enum>(C)</enum><text>by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="idF1CB48F5A83742CD90C919D3A66795FC"><enum>(D)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block id="idF51BED21C98C4F34A2E65ABF0A2A4F5F" display-inline="no-display-inline" style="OLC"><subparagraph id="id6CCD578031884CB19C4B685F4E710E76"><enum>(C)</enum><text>in a case described in subsection (b)(4), as of, as applicable—</text><clause id="idAD7F5CB06A2D4B379304880643CB4449"><enum>(i)</enum><text>the first date on which the individual is held in pretrial confinement relating to the dependent-abuse offense of which the individual is accused after the 7-day review of pretrial confinement required by Rule 305(i)(2) of the Rules for Courts-Martial; or </text></clause><clause id="idA2BF965A453244499A2F1F719E2AA50C" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>the date on which a review by a commander of the individual determines there is probable cause that the individual has committed that offense.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="idBC0D51C4AA7A4B478C126594CA1277C8"><enum>(c)</enum><header>Commencement of payment</header><text>Subsection (e)(1) of such section is amended—</text><paragraph id="idDCC217F1852E4F0CAD7579238C489194"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph id="id45F2BAEC8BC140F293294C46A76B8989"><enum>(A)</enum><text>in the matter preceding clause (i), by inserting after <quote>offense</quote> the following: <quote>or an offense described in subsection (b)(3)(B)</quote>; and</text></subparagraph><subparagraph id="idF0E9A19FE2C84A36BBCC02A92E54E054"><enum>(B)</enum><text>in clause (ii), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph></paragraph><paragraph id="idB0CA3A51E8104DC98E893F7A7D16075B"><enum>(2)</enum><text>in subparagraph (B)—</text><subparagraph id="id48871CD09E9C4F8499F49C7032BD5756"><enum>(A)</enum><text>by striking <quote>(if the basis</quote> and all that follows through <quote>offense)</quote>; and</text></subparagraph><subparagraph id="id155D90EB915C419D8E095D4CD2A71313"><enum>(B)</enum><text>by striking the period at the end and inserting a semicolon; and</text></subparagraph></paragraph><paragraph id="id925B1262CE3B414FABBDA753849244E1"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA85BDD66625444079FBD828F8046E971"><subparagraph id="id0579FBEAC2E64768ABC1BED25169EFCF" indent="up1"><enum>(C)</enum><text>in the case of a member described in subsection (b)(4), shall commence as of, as applicable—</text><clause id="idEB7ED33BB02D4B14AAF4C362E6361841"><enum>(i)</enum><text>the first date on which the member is held in pretrial confinement relating to the dependent-abuse offense of which the member is accused after the 7-day review of pretrial confinement required by Rule 305(i)(2) of the Rules for Courts-Martial; or </text></clause><clause id="id373CCE672B974F5DBBC18C2790443B84"><enum>(ii)</enum><text>the date on which a review by a commander of the member determines there is probable cause that the member has committed that offense.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id547400049C054C10BC285F5A72AA0371"><enum>(d)</enum><header>Definition of dependent child</header><text>Subsection (l) of such section is amended, in the matter preceding paragraph (1)—</text><paragraph id="id3CC65FDFCB2C4CB380A707D5A553832D"><enum>(1)</enum><text>by striking <quote>resulting in the separation of the former member or</quote> and inserting <quote>referred to in subsection (b) or</quote>; and</text></paragraph><paragraph id="idC6AF3B5C06244D4E9AF9E0AEAECA9E4B" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>by striking <quote>resulting in the separation of the former member and</quote> and inserting <quote>and</quote>.</text></paragraph></subsection><subsection id="idA97719CBF616445D8BEB800FA0F9D830"><enum>(e)</enum><header>Delegation of determinations relating to exceptional eligibility</header><text>Subsection (m)(4) of such section is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0D3F76CFE93E43B585C07CA3815A3E3A"><paragraph id="id5a390c44b593428f93f39ae078f857a6" indent="up1"><enum>(4)</enum><text>The Secretary concerned may delegate the authority under paragraph (1) to authorize eligibility for benefits under this section for dependents and former dependents of a member or former member to the first general or flag officer (or civilian equivalent) in the chain of command of the member.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
