<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3169</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211104">November 4, 2021</action-date><action-desc><sponsor name-id="S388">Ms. Hassan</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Food, Drug, and Cosmetic Act to prohibit the introduction or delivery for introduction into interstate commerce of food packaging containing intentionally added PFAS, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H650700FD7FEE41488D4B67B723327926"><section section-type="section-one" id="HC44DFFDE22C145F6870DED3B85D878A0"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Keep Food Containers Safe from PFAS Act of 2021</short-title></quote>.</text></section><section id="H1EDFC0BDD25B410695268A97B3E9682B"><enum>2.</enum><header>Prohibition against food packaging containing intentionally added PFAS</header><subsection id="HB71CBF552C5F45B0AC8AEC7108DE3A51"><enum>(a)</enum><header>In general</header><text>Section 301 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H5D8F828AB1F94343A1474570071F8C7C"><subsection id="HE3678781400B46A9B6618F03D75AD4B3"><enum>(fff)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H14C12359B3354E15AA59D57341F698E1"><enum>(1)</enum><text>The introduction or delivery for introduction into interstate commerce of food packaging containing intentionally added PFAS.</text></paragraph><paragraph id="H9687ECCB535D48F6BC59C29B80943F92" indent="up1"><enum>(2)</enum><text>The term <term>PFAS</term> means a perfluoroalkyl substance or a polyfluoroalkyl substance that is man-made with at least 1 fully fluorinated carbon atom.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3E5F0B78803244FDA754D239F10B7F30"><enum>(b)</enum><header>Applicability</header><text>The amendment made by subsection (a) applies beginning on January 1, 2024.</text></subsection></section></legis-body></bill>
