which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve access to medical examinations required by veterans to obtain disability compensation or pension under laws administered by the Secretary of Veterans Affairs, and for other purposes.</official-title></form><legis-body style="OLC"><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reform and Update Rural Access to Local Exams Act of 2021</short-title></quote> or the <quote><short-title>RURAL Exams Act of 2021</short-title></quote>.</text></section><section id="id6e7e3a8c7ae04399ac62dff771fc08e1"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id50352d5a34aa42558460a89cb286541b"><enum>(1)</enum><header>Covered medical disability examination</header><text>The term <term>covered medical disability examination</term> means a medical examination that the Secretary of Veterans Affairs determines necessary for the purposes of adjudicating a benefit under chapter 11 or 15 of title 38, United States Code, regardless of whether conducted by an employee or a contractor of the Department of Veterans Affairs. </text></paragraph><paragraph id="idc7fa643c46444af7a49d340116e1dbbd"><enum>(2)</enum><header>Housebound</header><text>The term <term>housebound</term>, with respect to a veteran, means—</text><subparagraph id="id9CA4C36570B7446E93B29D37FBF84B77"><enum>(A)</enum><text>the veteran meets the requirement of <quote>permanently housebound</quote> as described in section 1114(s) of title 38, United States Code;</text></subparagraph><subparagraph id="idF6CDF65B8D7948479DD300E17DB310F3"><enum>(B)</enum><text>the veteran meets the requirement of <quote>permanently housebound</quote> as described in section 1502(c) of such title; or</text></subparagraph><subparagraph id="id5EB0043039524587ACFE5764A31C5FF1"><enum>(C)</enum><text>the Secretary has determined that the veteran faces significant difficulty in traveling to obtain a covered medical disability examination.</text></subparagraph></paragraph><paragraph id="iddaecfa5a2e26493eba80a932d338f5bf"><enum>(3)</enum><header>Rural area</header><text>The term <term>rural area</term> means any non-urban area, within the meaning of the Rural-Urban Commuting Area Codes system of the Department of Agriculture and the Department of Health and Human Services, or successor system. </text></paragraph><paragraph id="id7A373D4FCC4D44A6879B72545B64762A"><enum>(4)</enum><header>Rural veteran</header><text>The term <term>rural veteran</term> means a veteran who resides in a rural area.</text></paragraph></section><section id="ide26f6dd58f1e443fab982066c58445cd"><enum>3.</enum><header>Improving data collection by Department of Veterans Affairs on covered medical disability examinations</header><subsection id="idad1957c39f544e05aebc7b06d0e72eb7"><enum>(a)</enum><header>Data collection required</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall begin collecting data to improve access of veterans to covered medical disability examinations.</text></subsection><subsection id="id544A6F6E6A6F4A259185DF3439161A5B"><enum>(b)</enum><header>Elements</header><text>Data collected under subsection (a) shall include data regarding the following:</text><paragraph id="id54A2627C8DCA4C7183DAC2C4EBD0F8A7"><enum>(1)</enum><text>Timeliness, quality, and veteran satisfaction measurements of covered medical disability examinations.</text></paragraph><paragraph id="id84882780A5A44E339B501DE57F821348"><enum>(2)</enum><text>Proportion of completed covered medical disability examinations determined to be inadequate for the adjudication of a claim for compensation or pension under chapter 11 or 15 of title 38, United States Code.</text></paragraph><paragraph id="id2221C62E73704FA9B366CBD73AE6D31D"><enum>(3)</enum><text>Every performance standard required for eligibility for financial incentives or disincentives in a contract between the Department of Veterans Affairs and any contractor for the provision of a covered medical disability examination.</text></paragraph></subsection><subsection id="id62BFD7EE076749039F87F023F9780CB2"><enum>(c)</enum><header>Disaggregation of data</header><text>The Secretary shall disaggregate data collected under subsection (a) by—</text><paragraph id="id3E3C279E9C2949AF9C46A1B3499A0F08"><enum>(1)</enum><text>State;</text></paragraph><paragraph id="id62E6E811AEC14202BDD73EFC682FE752"><enum>(2)</enum><text>county; and</text></paragraph><paragraph id="id0DE6124A3F2C4FAF83E0FFFD6E0B13BF"><enum>(3)</enum><text>as the case may be—</text><subparagraph id="id144C86131D1E4E3EAB657BE10A5F8501"><enum>(A)</enum><text>individual contractor with a Department of Veterans Affairs contract for the provision of a covered medical disability examination; or</text></subparagraph><subparagraph id="idC409EECFCE0A4CEE85C27A613EC71CEA"><enum>(B)</enum><text>individual Veterans Health Administration facility conducting a covered medical disability examination. </text></subparagraph></paragraph></subsection><subsection id="idb34a4f1219ea42f2b9f421dc3061cc97"><enum>(d)</enum><header>Publication</header><text>Not later than one year after the date of the enactment of this Act, the Secretary shall make publicly available on an internet website, and updated not less frequently than quarterly, all data collected under subsection (a).</text></subsection></section><section id="id2bdf29c2ce6b442a9d94a0ca70298f47"><enum>4.</enum><header>Study on improvements to Department of Veterans Affairs covered medical disability examinations in rural areas</header><subsection id="id4A973AFF88E24978A7434B90F68F2920"><enum>(a)</enum><header>Study required</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall complete a study on access by rural veterans to covered medical disability examinations.</text></subsection><subsection id="idCA6F9E6DE80342ADA611FCD386F96980"><enum>(b)</enum><header>Elements</header><paragraph id="id0FB7B4A8D41D4883BA8BF1BA155EACB5"><enum>(1)</enum><header>In general</header><text>The study conducted under subsection (a) shall include the following:</text><subparagraph id="idbcbbe0bad24944da9e9270b707983d4c"><enum>(A)</enum><text>A comparison of the average number of days to complete covered medical disability examinations for rural veterans compared to the national non-rural average time to complete covered medical disability examinations, by either contractors or employees of the Department.</text></subparagraph><subparagraph id="id24E6A38B105B49FA9D39B9934EA35759"><enum>(B)</enum><text>A root cause analysis of differences identified pursuant to subparagraph (A).</text></subparagraph><subparagraph id="idEA3957810DE948C089D40306F2D07F28"><enum>(C)</enum><text>The plan of the Secretary for the following year to improve access described in subsection (a), which shall include a plan for the pursuit of a commercial or industry-standard solution or technology that could enable rural or housebound veterans to receive examinations without traveling long distances.</text></subparagraph></paragraph><paragraph id="id5b5afe0992f94632ae91dce1a7395c97"><enum>(2)</enum><header>National non-rural average defined</header><text>For purposes of paragraph (1)(A), the term <term>national non-rural average</term> means the national average of all periods in the previous calendar year—</text><subparagraph id="id73938e2ed57046da91637735247acfde"><enum>(A)</enum><text>beginning on the date on which a contractor received a request from the Secretary to conduct a covered medical disability examination for a veteran who is not a rural veteran; and</text></subparagraph><subparagraph id="id98cceb0d70b04ab0aecb81edd8c5ce35" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>ending on the date on which the examination was completed. </text></subparagraph></paragraph></subsection><subsection id="idd59aee0f2b18409da74e653086d1c822"><enum>(c)</enum><header>Report on study</header><text>Not later than one year after the date of the enactment of this Act, the Secretary shall submit to the Committee on Veterans' Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a report on the findings of the Secretary with respect to the study completed under subsection (a).</text></subsection><subsection id="id365F801103B649B18DCC99A5B53E5C0B"><enum>(d)</enum><header>Annual report on plans</header><text>Not later than two years after the date of the enactment of this Act and not less frequently than once each year thereafter, the Secretary shall submit to the Committee on Veterans' Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a report evaluating the conduct of the plans of the Secretary to improve access described in subsection (a) and a new or revised plan for such improvement in the following year.</text></subsection></section><section id="iddab97d1d45fe42e883cefbed8c5a2873"><enum>5.</enum><header>Department of Veterans Affairs timeliness requirements for provision of covered medical disability examinations by contractors to rural and housebound veterans</header><text display-inline="no-display-inline">In each contract entered into by the Secretary of Veterans Affairs after the date of the enactment of this Act for the provision by a contractor of a covered medical disability examination, the Secretary shall include the following:</text><paragraph id="idC6630C827BCE40A9A6AA3C12746C8D52"><enum>(1)</enum><text>Such financial incentives as the Secretary considers appropriate to encourage a contractor to provide a covered medical disability examination to a rural veteran or a housebound veteran in a timely manner.</text></paragraph><paragraph id="id151c9e9a6a10460ba8f9912a4ad8ed3b"><enum>(2)</enum><text>Such financial disincentives as the Secretary considers appropriate to discourage a contractor from failing to provide a covered medical disability examination to a rural veteran or a housebound veteran in a timely manner.</text></paragraph><paragraph id="id1D43B85F18D64CE0A653DF7D5813BBC3"><enum>(3)</enum><text>A requirement that the contractor cooperate with inspections conducted under the program required by section 6(a).</text></paragraph></section><section id="id28938ad4f92948d1ad6ce24c8c17a787"><enum>6.</enum><header>Annual inspections by Department of Veterans Affairs of facilities used by contractors for provision of covered medical disability examinations</header><subsection id="idD5C0883397BA451981CED64D53E7959C"><enum>(a)</enum><header>Program required</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall establish a program of periodic inspections of sites, locations, and facilities where covered medical disability examinations are provided by contractors of the Department of Veterans Affairs.</text></subsection><subsection id="idCD641D0CE9404E8486B413972FE53C78"><enum>(b)</enum><header>Number and periodicity</header><paragraph id="id4C223D7061094AF5924F8844C0ABBA02"><enum>(1)</enum><header>In general</header><text>Under the program required by subsection (a), the Secretary shall, each year, inspect not fewer than three percent of all sites, locations, and facilities used by a contractor of the Department to provide a covered medical disability examination during the previous one-year period.</text></paragraph><paragraph id="id9E66E6371E8C4409A2B96D28313EFA38"><enum>(2)</enum><header>Initial inspections</header><text>Paragraph (1) shall apply with respect to the first one-year period beginning after the date of the establishment of the program pursuant to subsection (a) and each year thereafter.</text></paragraph></subsection><subsection id="id170C5EC702934F818368B53D2838D98F"><enum>(c)</enum><header>Selection of sites, locations, and facilities for inspection</header><text>Under the program required by subsection (a), the Secretary shall—</text><paragraph id="idCACC8A7BA58842BF81151225002A71EA"><enum>(1)</enum><text>use both random and targeted methods of selecting sites, locations, and facilities for inspection; and</text></paragraph><paragraph id="id5BFF136732014DD8B7AE57B0DE2E592E"><enum>(2)</enum><text>ensure that the number of inspections of sites, locations, and facilities in rural areas bears the same ratio to the total number of inspections as the number of covered medical disability examinations provided by contractors of the Department to rural veterans bears to the total number of covered medical disability examinations provided by contractors of the Department to all veterans.</text></paragraph></subsection><subsection id="id6B2F879BD33E48D48945D000225A6B8D"><enum>(d)</enum><header>Notice and timing</header><text>Each inspection under the program required by subsection (a) shall be conducted during such business hours as the Secretary considers reasonable and the Secretary shall provide no more notice than the Secretary considers necessary to ensure the inspected facility is available for such inspection.</text></subsection><subsection id="id8DCD2F3A47C7448C9CA35F01A727FA9B"><enum>(e)</enum><header>Elements</header><text>Each inspection conducted under the program required by subsection (a) shall include inspection of a site, location, or facility for the following:</text><paragraph id="id7E98D8D214E84376B2D0254FA3691362"><enum>(1)</enum><text>Compliance with the terms of any applicable contract.</text></paragraph><paragraph id="id2A1365C5310F4808A9E67CEBB5D2CFCA"><enum>(2)</enum><text>Compliance with the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>).</text></paragraph><paragraph id="idF5F254DBC5A84CB4BFD8C5995FFF78AE"><enum>(3)</enum><text>Cleanliness.</text></paragraph><paragraph id="id0275199D34DD483F8D9E8DB740AFA088"><enum>(4)</enum><text>General fitness for a covered medical disability examination.</text></paragraph><paragraph id="id01B09EC4313D49418223568ADE745F14"><enum>(5)</enum><text>Such other elements as the Secretary considers necessary to ensure that covered medical disability examinations provided on behalf of the Department are safe, clean, accessible, and dignified.</text></paragraph></subsection><subsection id="id119A195350FD4C4A91C1DA6E3B6A346B"><enum>(f)</enum><header>Annual reports</header><text>Not later than one year after the date of the establishment of the program required by subsection (a), the Secretary shall submit to the Committee on Veterans' Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a report on the findings of the Secretary with respect to the inspections conducted under the program during the one-year period ending on the date of the submittal of the report. </text></subsection></section></legis-body></bill>
