<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3162</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211103">November 3, 2021</action-date><action-desc><sponsor name-id="S221">Mrs. Feinstein</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To clarify the authority of States to use National Guard members performing Active Guard and Reserve duty during State-directed responses to domestic incidents.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Guard Emergency Response Act of 2021</short-title></quote>.</text></section><section id="id6F0764B9E4984484857EB94032BD7BEC"><enum>2.</enum><header>Authority of States to use National Guard members performing Active Guard and Reserve duty during State-directed responses to domestic incidents</header><text display-inline="no-display-inline">Section 328(b) of title 32, United States Code, is amended—</text><paragraph id="idD7B1FE5DA12D4D57A6B0732B7317561F"><enum>(1)</enum><text>by inserting <quote>(1)</quote> before <quote>A member</quote>; and</text></paragraph><paragraph id="id8C9A34D172E94BC5A56D510011D2AB09"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block id="id01584142D92D4B8BB882861A67F5E98A" style="OLC" act-name=""><paragraph indent="up1" id="idF135076FE4B247C8A5CCD7A0096FF953"><enum>(2)</enum><text>Under regulations prescribed by the Chief of the National Guard Bureau, the adjutant general of the jurisdiction concerned may authorize a member of the National Guard performing duty under subsection (a) to perform additional duties in response to a State-declared emergency or disaster provided that the adjutant general determines that members performing such additional duties will derive a benefit that satisfies or complements training requirements for the wartime mission or other training objectives of the members’ unit.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
