which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend titles XVIII and XIX of the Social Security Act to ensure quality care for residents of skilled nursing facilities and nursing facilities, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Quality Care for Nursing Home Residents Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="HE2A433DE7CC0475CB614FD084BE10BEE"><enum>2.</enum><header>Minimum nurse staffing requirements for skilled nursing facilities under Medicare program and nursing facilities under Medicaid program</header><subsection id="HB0E40B46FD804E7CA76D0971E85935B5"><enum>(a)</enum><header>Medicare</header><paragraph id="HE9BF60E710F24549A2AEC3F324EDAB0E"><enum>(1)</enum><header>In general</header><text>Subparagraph (C) of section 1819(b)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(b)(4)</external-xref>) is amended—</text><subparagraph id="H8C2246A351B9458FB7BC34423ED42FA4"><enum>(A)</enum><text>in clause (i)—</text><clause id="HA4AE4EAEED3B4F76B080A56F8E549164"><enum>(i)</enum><text display-inline="yes-display-inline">by amending the clause heading to read as follows: <quote><header-in-text level="clause" style="OLC">General requirements before 2022</header-in-text></quote>; and</text></clause><clause id="HFA54410991824DCE9712707989DB1BDE"><enum>(ii)</enum><text>by striking <quote>Except as provided in clause (ii),</quote> and inserting <quote>Except as provided in clause (iii), with respect to skilled nursing facility services provided before January 1, 2022,</quote>;</text></clause></subparagraph><subparagraph id="H6D98C4895DBE40C3AE9E7226228B9F9A"><enum>(B)</enum><text>by redesignating clause (ii) as clause (iii); and</text></subparagraph><subparagraph id="H3F1DC59EBE854502A47B4D3BEBED902F"><enum>(C)</enum><text>by inserting after clause (i) the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3A358359BD7D42E69F4C4280F31479A0"><clause id="HB8B27E5C54EC43239642DBD4F0735866"><enum>(ii)</enum><header>General requirements after 2021</header><subclause id="H4053F11442874FA98D9F4030B008C808"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to skilled nursing facility services provided on or after January 1, 2022, a skilled nursing facility must—</text><item id="H81325E46AE284DBEB171BAFA0FF877FB"><enum>(aa)</enum><text>provide nursing services that are sufficient to meet the nursing needs of its residents on a 24-hour basis, to be divided into day shifts, evening shifts, and night shifts;</text></item><item id="HFADC69A5CEF54210BBADBB1313E68B03"><enum>(bb)</enum><text>provide for minimum nurse staffing levels with respect to each such shift, in accordance with this clause; and</text></item><item id="H1E7E9BC2B00545698C7E9236BD51C673"><enum>(cc)</enum><text display-inline="yes-display-inline">ensure that, in carrying out items (aa) and (bb), a total minimum of 4.1 hours of care is provided per resident per day, with 0.75 hours of care of such total minimum provided by a registered professional nurse, 0.54 hours of care of such total minimum provided by a licensed practical nurse, and 2.81 hours of care of such total minimum provided by a nurse aide (as defined in paragraph (5)(F)).</text></item></subclause><subclause id="HC42D64FF356B40C5B66E0290C2FEA63B"><enum>(II)</enum><header>Day shifts</header><text>With respect to a day shift, the skilled nursing facility must have—</text><item id="HA958DC7D1C00443B88FB7CF4AC753698"><enum>(aa)</enum><text>at least 1 registered professional nurse for every 28 residents, with a minimum of 0.29 hours of care provided per resident during each such shift;</text></item><item id="HD5E5377C9A8B4FACBEB4B7E26B4EEF0D"><enum>(bb)</enum><text>at least 1 licensed practical nurse for every 40 residents, with a minimum of 0.20 hours of care provided per resident during each such shift; and</text></item><item id="H6B3C9B43C4124A968257C7F02DB7CD1F"><enum>(cc)</enum><text>at least 1 nurse aide (as defined in paragraph (5)(F)) for every 7 residents, with a minimum of 1.14 hours of care provided per resident during each such shift.</text></item></subclause><subclause id="H716DADDD6F5A4BD2A84EB90E9F1BA577"><enum>(III)</enum><header>Evening shifts</header><text>With respect to an evening shift, the skilled nursing facility must have—</text><item id="HFB4B1186515B4ACF8A54AF8234233584"><enum>(aa)</enum><text display-inline="yes-display-inline">at least 1 registered professional nurse for every 30 residents, with a minimum of 0.26 hours of care provided per resident during each such shift;</text></item><item id="HB2087730F68E4A31B78A9C956BE5245C"><enum>(bb)</enum><text>at least 1 licensed practical nurse for every 40 residents, with a minimum of 0.20 hours of care provided per resident during each such shift; and</text></item><item id="H7EFB655A4D514D80A7CBAB9EED873CC7"><enum>(cc)</enum><text>at least 1 nurse aide (as defined in paragraph (5)(F)) for every 7 residents, with a minimum of 1.14 hours of care provided per resident during each such shift.</text></item></subclause><subclause id="HA6FB035F92AE49849B7183BF7FF6595D"><enum>(IV)</enum><header>Night shifts</header><text>With respect to a night shift, the skilled nursing facility must have—</text><item id="H27CDA1AA17EE4D07A31B3BB750700FDC"><enum>(aa)</enum><text>at least 1 registered professional nurse for every 40 residents, with a minimum of 0.20 hours of care provided per resident during such shift;</text></item><item id="HAB936F9567CE4221ACB66EE4CA8ACD9C"><enum>(bb)</enum><text>at least 1 licensed practical nurse for every 56 residents, with a minimum of 0.14 hours of care provided per resident during such shift; and</text></item><item id="HC2F99CF306B842F583DC63FC3C819B7E"><enum>(cc)</enum><text>at least 1 nurse aide (as defined in paragraph (5)(F)) for every 15 residents, with a minimum of 0.53 hours of care provided per resident during such shift.</text></item></subclause><subclause id="HB4BA9A759AAD47E0BAB03150A1FD524A"><enum>(V)</enum><header>Secretarial authority to establish higher minimum nurse staffing levels</header><text>The Secretary may establish and require skilled nursing facilities (or, at the Secretary’s discretion, only skilled nursing facilities that have a higher percentage of residents with extensive care needs, as determined by the Secretary) to provide for minimum nurse staffing levels that are higher than the levels required under this clause.</text></subclause><subclause id="H3502C7A7B57846B6B4BEBCB8618C8D3C"><enum>(VI)</enum><header>Rule of construction regarding State authority to establish higher minimum nurse staffing levels</header><text>Nothing in this clause may be construed as preventing a State from establishing or requiring skilled nursing facilities in the State to provide for minimum nurse staffing levels that are higher than the levels required under this clause.</text></subclause><subclause id="H67F903FC0C1D47B691AB11525AA89C65"><enum>(VII)</enum><header>Clarification with respect to minimum hours of care provided per resident requirements</header><text display-inline="yes-display-inline">In complying with the minimum hours of care provided per resident requirements under this clause, a skilled nursing facility may not count any time spent by a registered professional nurse, licensed practical nurse, or nurse aide on administrative services towards compliance with such requirements.</text></subclause><subclause id="H974776D41FA84181B6BCA8DFA09011C3"><enum>(VIII)</enum><header>Definitions</header><text>In this clause:</text><item id="HA9E4E0C4A446430596E5917F624B8162"><enum>(aa)</enum><header>Administrative services</header><text>The term <term>administrative services</term> means food preparation, housekeeping, laundry services, maintenance services, and other noncaregiving-related services, as determined by the Secretary.</text></item><item id="H9B2E9D653B7046C4AA91DE8DDB63D6EE"><enum>(bb)</enum><header>Day shift</header><text>The term <term>day shift</term> means, with respect to a day and a skilled nursing facility, an assigned work shift that is a period of 8 consecutive hours, beginning not sooner than 6 a.m. in the time zone in which such facility is located and not later than 8 a.m. in such time zone.</text></item><item id="HDDCF7B4E9FB94C9C929C6AC1A3B25CDB"><enum>(cc)</enum><header>Evening shift</header><text>The term <term>evening shift</term> means, with respect to a day and a skilled nursing facility, an assigned work shift that is a period of 8 consecutive hours, beginning not sooner than 2 p.m. in the time zone in which such facility is located and not later than 4 p.m. in such time zone.</text></item><item id="H548C166D4F5F4C0395D2BF2EE165E7C7"><enum>(dd)</enum><header>Night shift</header><text>The term <term>night shift</term> means, with respect to a day and a skilled nursing facility, an assigned work shift that is a period of 8 consecutive hours, beginning not sooner than 10 p.m. in the time zone in which such facility is located and not later than midnight in such time zone.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="HF1270D3BE20B43A7B2D0147BB0694FD4"><enum>(2)</enum><header>Enforcement</header><text display-inline="yes-display-inline">Section 1819(h) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(h)</external-xref>) is amended—</text><subparagraph commented="no" id="H52AD84FB3FC841059C1979A57AC0FF0B"><enum>(A)</enum><text>in paragraph (1), by striking <quote>If a State finds, on the basis of a standard</quote> and inserting <quote>Subject to paragraph (7), if a State finds, on the basis of a standard</quote>;</text></subparagraph><subparagraph commented="no" id="H964A1660526D4E968E40F793F02C371F"><enum>(B)</enum><text>in paragraph (2), by striking <quote>With respect to</quote> and inserting <quote>Subject to paragraph (7), with respect to</quote>; and</text></subparagraph><subparagraph commented="no" id="H76A54B2501FF444A99ED39FC1C154B9F"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE76D8644F55646E8A4BEB46056594325"><paragraph id="HF2854647BFF44699A9640D2D4DFFCFF2"><enum>(7)</enum><header>Special enforcement process with respect to minimum nurse staffing requirements</header><subparagraph commented="no" id="HD55131C7CCC747528A4CFF91BFB3DA0F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If a State finds, on the basis of a standard, extended, or partial extended survey under subsection (g)(2) or otherwise, that a skilled nursing facility does not meet the minimum staffing requirements of clause (ii) of subsection (b)(4)(C) with respect to skilled nursing facility services provided on or after January 1, 2022, the State shall recommend to the Secretary that the Secretary take such actions as described in subclauses (I) and (II) of subparagraph (B)(i).</text></subparagraph><subparagraph id="HC7E90FA89B5B47D6975CF80C26450E20"><enum>(B)</enum><header>Secretarial authority</header><clause id="HB8D1DE393B8348C3AA91433FAD8485F3"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to any skilled nursing facility in a State, if the Secretary finds, or pursuant to a recommendation of the State under subparagraph (A) finds, that a skilled nursing facility does not meet the minimum staffing requirements of clause (ii) of subsection (b)(4)(C) with respect to skilled nursing facility services provided on or after January 1, 2022, the Secretary shall—</text><subclause id="H14E4B4BBFCF2420CA217AB87F2E69AD6"><enum>(I)</enum><text>deny any further payments under this title with respect to all individuals entitled to benefits under this title who are admitted to the facility after the effective date of the finding; and</text></subclause><subclause id="HE52DE1CB48B2413E96D0E19035580200"><enum>(II)</enum><text>impose a civil money penalty in an amount not to exceed $10,000 for each day of noncompliance. The provisions of section 1128A (other than subsections (a) and (b)) shall apply to a civil money penalty under the previous sentence in the same manner as such provisions apply to a penalty or proceeding under section 1128A(a).</text></subclause></clause><clause id="HE17C95ACA7314FC29680FA9D56A1498F"><enum>(ii)</enum><header>Reduction of civil money penalties in certain circumstances</header><text display-inline="yes-display-inline">Subject to clause (iii), in the case where a skilled nursing facility self-reports and promptly corrects a deficiency for which a penalty was imposed under clause (i)(II) not later than 10 calendar days after the date of such imposition, the Secretary may reduce the amount of the penalty imposed by—</text><subclause id="HE0E157B8648B440A9B9AA04F516BECA3"><enum>(I)</enum><text>not more than 50 percent; or</text></subclause><subclause id="H7310853451E5404AABE0A6C119DFAAA9"><enum>(II)</enum><text>in the case that the facility was penalized under this subsection within the three-year period preceding the date of such imposition, not more than 25 percent.</text></subclause></clause><clause id="HBC62569288304190B9601B116F683D2A"><enum>(iii)</enum><header>Prohibitions on reduction for certain deficiencies</header><subclause id="H6C806C068281403681552B51432F52F3"><enum>(I)</enum><header>Repeat deficiencies</header><text display-inline="yes-display-inline">The Secretary may not reduce the amount of a penalty under clause (ii) if the Secretary had reduced a penalty imposed on the skilled nursing facility in the preceding year under such clause with respect to a repeat deficiency.</text></subclause><subclause id="HBD079199971F4037A2AD473CC32D5584"><enum>(II)</enum><header>Certain other deficiencies</header><text display-inline="yes-display-inline">The Secretary may not reduce the amount of a penalty under clause (ii) if the penalty is imposed on the skilled nursing facility for a deficiency that is found to result in a pattern of harm or widespread harm, immediately jeopardizes the health or safety of a resident or residents of the facility, or results in the death of a resident of the facility.</text></subclause></clause><clause id="H2AE36E1FD3C64A57AE3613E11E86659A"><enum>(iv)</enum><header>Repeated noncompliance</header><text>In the case of a skilled nursing facility which, on three consecutive standard surveys conducted under subsection (g)(2), has been found as not meeting the minimum staffing requirements of clause (ii) of subsection (b)(4)(C) with respect to skilled nursing facility services provided on or after January 1, 2022, the Secretary may (regardless of the remedies provided for under clause (i))—</text><subclause id="H454ED6B50D5749B68DEB65251D248322"><enum>(I)</enum><text>appoint temporary management to oversee the operation of the facility and to assure the health and safety of the facility’s residents in accordance with clause (iii) of paragraph (2)(B), except that <quote>the minimum staffing requirements of clause (ii) of subsection (b)(4)(C)</quote> shall be substituted for <quote>all the requirements of subsections (b), (c), and (d)</quote> under such clause;</text></subclause><subclause id="HE53380405C314CA293149D6C77FB42F9"><enum>(II)</enum><text display-inline="yes-display-inline">monitor the facility under subsection (g)(4)(B) with respect to such minimum staffing requirements until the facility has demonstrated to the satisfaction of the Secretary that the facility is in compliance, and will remain in compliance, with such minimum staffing requirements; or</text></subclause><subclause id="H96017AAC3F054AD4941E703BE63B2CFB"><enum>(III)</enum><text>subject to section 1128I(h), terminate the facility’s participation under this title.</text></subclause><continuation-text continuation-text-level="clause">If the facility’s participation under this title is terminated under this clause, the State shall provide for the safe and orderly transfer of the residents eligible under this title, consistent with the requirements of subsection (c)(2) and section 1128I(h).</continuation-text></clause><clause commented="no" id="HBB767E2EB4CA4622A382F0296553D34F"><enum>(v)</enum><header>Public notice of violations</header><subclause commented="no" id="H1B619C54C21E46A6BFA226F8A772835A"><enum>(I)</enum><header>Internet website</header><text display-inline="yes-display-inline">The Secretary shall publish on the internet website of the Department of Health and Human Services the names of skilled nursing facilities that have violated the minimum staffing requirements of clause (ii) of subsection (b)(4)(C) with respect to skilled nursing facility services provided on or after January 1, 2022.</text></subclause><subclause commented="no" id="H321F581175994988B23DC2AE03E3B87B"><enum>(II)</enum><header>Change of ownership</header><text display-inline="yes-display-inline">With respect to a skilled nursing facility whose name is published under subclause (I) and has a change of ownership, as determined by the Secretary, after the date of such publication, the Secretary shall remove the name of such facility from the website described under such subclause after the 1-year period beginning on the date of such change of ownership.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HE50B28B3A16349FE8C06C45B7AD53AAE"><enum>(3)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Item (a) of section 1819(f)(2)(B)(iii)(I) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(f)(2)(B)(iii)(I)</external-xref>) is amended by striking <quote>subsection (b)(4)(C)(ii)(II)</quote> and inserting <quote>subsection (b)(4)(C)(iii)(II)</quote>.</text></paragraph></subsection><subsection id="H01EF330427BC4C67AB2AC5525392D0EC"><enum>(b)</enum><header>Medicaid</header><paragraph id="H17A618D2D472461A9E12858735E203FF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subparagraph (C) of section 1919(b)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(b)(4)</external-xref>) is amended—</text><subparagraph id="HD104CEC3785F4E3B8DDB1173DCD91942"><enum>(A)</enum><text>in clause (i)—</text><clause id="HC6C4F828351244849416F88F790A5EA2"><enum>(i)</enum><text>in the clause heading, by inserting after <quote><header-in-text level="clause" style="OLC">General requirements</header-in-text></quote> the following <quote><header-in-text level="clause" style="OLC">before 2022</header-in-text></quote>;</text></clause><clause id="HEFCFF47002484CAE924AE83779A14267"><enum>(ii)</enum><text>in the matter preceding subclause (I), by inserting after <quote>October 1, 1990,</quote> the following: <quote>and before January 1, 2022,</quote>;</text></clause><clause id="H9A3C5F5796E94F478CB7EFAAB9C90EB9"><enum>(iii)</enum><text>in subclause (I), by striking <quote>clause (ii)</quote> and inserting <quote>clause (iii)</quote>; and</text></clause><clause id="H5E5612883B7E4D8EA14C2D52D84B9CB2"><enum>(iv)</enum><text>in subclause (II), by striking <quote>clause (ii)</quote> and inserting <quote>clause (iii)</quote>;</text></clause></subparagraph><subparagraph id="HA95C4C6F3DE34F209A4384FF72A9EB53"><enum>(B)</enum><text>by redesignating clauses (ii) and (iii) as clauses (iii) and (iv), respectively; and</text></subparagraph><subparagraph id="HFFABA7053A464A899CB184EEF59F9DA4"><enum>(C)</enum><text>by inserting after clause (i) the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3231A58E4FA1409D95B456097BC9C92D"><clause id="H982871ACB9C84164B2E4907ADC0EF0BA"><enum>(ii)</enum><header>General requirements after 2021</header><subclause id="HCF6BDD326AE54647AE81653DAB507003"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to nursing facility services provided on or after January 1, 2022, a nursing facility must—</text><item id="HB1C20A66A59240938D13B829B9BBB84E"><enum>(aa)</enum><text>provide nursing services that are sufficient to meet the nursing needs of its residents on a 24-hour basis, to be divided into day shifts, evening shifts, and night shifts;</text></item><item id="H5A1A7808D32C4DF2B5501CA5FF667056"><enum>(bb)</enum><text>provide for minimum nurse staffing levels with respect to each such shift, in accordance with this clause; and</text></item><item id="HD200BE524E4240D38D24043BEAC85801"><enum>(cc)</enum><text display-inline="yes-display-inline">ensure that, in carrying out items (aa) and (bb), a total minimum of 4.1 hours of care is provided per resident per day, with 0.75 hours of care of such total minimum provided by a registered professional nurse, 0.54 hours of care of such total minimum provided by a licensed practical nurse, and 2.81 hours of care of such total minimum provided by a nurse aide (as defined in paragraph (5)(F)).</text></item></subclause><subclause id="HE712E368D23C4A30968A7FF927731063"><enum>(II)</enum><header>Day shifts</header><text>With respect to a day shift, the nursing facility must have—</text><item id="H100F0612AC664371AA66798F0D5DF5BA"><enum>(aa)</enum><text>at least 1 registered professional nurse for every 28 residents, with a minimum of 0.29 hours of care provided per resident during each such shift;</text></item><item id="H974E0C44C2AA4B85BB1E22674B3F093D"><enum>(bb)</enum><text>at least 1 licensed practical nurse for every 40 residents, with a minimum of 0.20 hours of care provided per resident during each such shift; and</text></item><item id="HEB9C078A758D4E2F8DF0C99C04BBE230"><enum>(cc)</enum><text>at least 1 nurse aide (as defined in paragraph (5)(F)) for every 7 residents, with a minimum of 1.14 hours of care provided per resident during each such shift.</text></item></subclause><subclause id="H1D3817BE3AA94B7285E204D2F7B52C8F"><enum>(III)</enum><header>Evening shifts</header><text>With respect to an evening shift, the nursing facility must have—</text><item id="H819148CC87B24BC3AD57D13649777DA9"><enum>(aa)</enum><text display-inline="yes-display-inline">at least 1 registered professional nurse for every 30 residents, with a minimum of 0.26 hours of care provided per resident during each such shift;</text></item><item id="H7D3A93E28BCF404F8DBC46BD6B10E24C"><enum>(bb)</enum><text>at least 1 licensed practical nurse for every 40 residents, with a minimum of 0.20 hours of care provided per resident during each such shift; and</text></item><item id="HA70542B06BBE419F8351583FDE554E68"><enum>(cc)</enum><text>at least 1 nurse aide (as defined in paragraph (5)(F)) for every 7 residents, with a minimum of 1.14 hours of care provided per resident during each such shift.</text></item></subclause><subclause id="H5B53DE25ABCA4EC187940B285F2D28A5"><enum>(IV)</enum><header>Night shifts</header><text>With respect to a night shift, the nursing facility must have—</text><item id="H1AB465EC396B45CD8AF93DA1F6B300D3"><enum>(aa)</enum><text>at least 1 registered professional nurse for every 40 residents, with a minimum of 0.20 hours of care provided per resident during such shift;</text></item><item id="H9DA298032EB442D2B26532D24694F7D6"><enum>(bb)</enum><text>at least 1 licensed practical nurse for every 56 residents, with a minimum of 0.14 hours of care provided per resident during such shift; and</text></item><item id="HE2F272AA75D6496BA3E1B450000D2757"><enum>(cc)</enum><text>at least 1 nurse aide (as defined in paragraph (5)(F)) for every 15 residents, with a minimum of 0.53 hours of care provided per resident during such shift.</text></item></subclause><subclause id="HDC5EC68C0BF64BCBAC7AAD9320A557B3"><enum>(V)</enum><header>Secretarial authority to establish higher minimum nurse staffing levels</header><text>The Secretary may establish and require nursing facilities (or, at the Secretary’s discretion, only nursing facilities that have a higher percentage of residents with extensive care needs, as determined by the Secretary) to provide for minimum nurse staffing levels that are higher than the levels required under this clause.</text></subclause><subclause id="H4785BE4472D4439A9757A7CF141A2E60"><enum>(VI)</enum><header>Rule of construction regarding State authority to establish higher minimum nurse staffing levels</header><text>Nothing in this clause may be construed as preventing a State from establishing or requiring nursing facilities in the State to provide for minimum nurse staffing levels that are higher than the levels required under this clause.</text></subclause><subclause id="H7BFA2EC329144E65BCEF55E695A14E4E"><enum>(VII)</enum><header>Clarification with respect to minimum hours of care provided per resident requirements</header><text display-inline="yes-display-inline">In complying with the minimum hours of care provided per resident requirements under this clause, a nursing facility may not count any time spent by a registered professional nurse, licensed practical nurse, or nurse aide on administrative services towards compliance with such requirements.</text></subclause><subclause id="HC16AC7F8B8AE4702B5224B802CC59CC8"><enum>(VIII)</enum><header>Definitions</header><text>In this clause:</text><item id="HAED1F67CCACB4D55AFD82C75DA7596E6"><enum>(aa)</enum><header>Administrative services</header><text>The term <term>administrative services</term> means food preparation, housekeeping, laundry services, maintenance services, and other noncaregiving-related services, as determined by the Secretary.</text></item><item id="HDA4C91A583BD4A7BBC3C482D0131E69E"><enum>(bb)</enum><header>Day shift</header><text>The term <term>day shift</term> means, with respect to a day and a nursing facility, an assigned work shift that is a period of 8 consecutive hours, beginning not sooner than 6 a.m. in the time zone in which such facility is located and not later than 8 a.m. in such time zone.</text></item><item id="H00B31CEFBAC84F5292005B7E6FCA1F77"><enum>(cc)</enum><header>Evening shift</header><text>The term <term>evening shift</term> means, with respect to a day and a nursing facility, an assigned work shift that is a period of 8 consecutive hours, beginning not sooner than 2 p.m. in the time zone in which such facility is located and not later than 4 p.m. in such time zone.</text></item><item id="HC4BBF2C7A38746ACB9F9FD1B7A0F6E4A"><enum>(dd)</enum><header>Night shift</header><text>The term <term>night shift</term> means, with respect to a day and a nursing facility, an assigned work shift that is a period of 8 consecutive hours, beginning not sooner than 10 p.m. in the time zone in which such facility is located and not later than midnight in such time zone.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="H060383210103458C9E9AB80D012255DA"><enum>(2)</enum><header>Enforcement</header><text>Section 1919(h) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(h)</external-xref>) is amended—</text><subparagraph id="H1E630D3A06904C5982BC7AD7035CE413"><enum>(A)</enum><text>in paragraph (1), by striking <quote>If a State finds, on the basis of a standard</quote> and inserting <quote>Subject to paragraph (10), if a State finds, on the basis of a standard</quote>;</text></subparagraph><subparagraph id="H3FCE4178208D42EA868232B814E28686"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="HFD2E48B933FE4E61B0EDDDC1121B59DC"><enum>(i)</enum><text>in subparagraph (C), by striking <quote>If a nursing facility</quote> and inserting <quote>Subject to paragraph (10), if a nursing facility</quote>; and</text></clause><clause id="H35EDDCABF6D9483FAC0AC54635AF1A63"><enum>(ii)</enum><text>in subparagraph (D), by striking <quote>In the case of</quote> and inserting <quote>Subject to paragraph (10), in the case of</quote>;</text></clause></subparagraph><subparagraph id="HD5C88B5DF12441D9A3056431C80B6F1B"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (3)—</text><clause id="H235FA7E2E94B4DECB2B6972860BF42E8"><enum>(i)</enum><text>in subparagraph (A), by inserting before the period the following: <quote>and the remedies described in paragraph (10)(B)</quote>; and</text></clause><clause id="H16AB866BF96D428BB307B76DBB8AB883"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>With respect to</quote> and inserting <quote>Subject to paragraph (10), with respect to</quote>; and</text></clause></subparagraph><subparagraph id="H47B0CC885E704124906DAEFB9C2DABF4"><enum>(D)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H55DFE292929E41D596B0CB3C40F9D7BF"><paragraph id="HA78BC774DAFA4799AC88316B48546A5A"><enum>(10)</enum><header>Special enforcement process with respect to minimum nurse staffing requirements</header><subparagraph commented="no" id="HDE7E6F69903A4F07B1A45B5257305CD8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If a State finds, on the basis of a standard, extended, or partial extended survey under subsection (g)(2) or otherwise, that a nursing facility does not meet the minimum staffing requirements of clause (ii) of subsection (b)(4)(C) with respect to nursing facility services provided on or after January 1, 2022, the State shall—</text><clause id="H041D0FFBF07A4C4990BF0E7DC028C487"><enum>(i)</enum><text>deny any further payments under the State plan with respect to all individuals enrolled under such plan who are admitted to the facility after the effective date of the finding; and</text></clause><clause id="H138A79FDD50A4D20BB33CA225CC93E0E"><enum>(ii)</enum><text display-inline="yes-display-inline">recommend to the Secretary that the Secretary impose the civil money penalty described in subparagraph (B).</text></clause></subparagraph><subparagraph id="H99CA0C25054147E2813110DD3BBC6F59"><enum>(B)</enum><header>Secretarial authority</header><clause id="HCCAD704F73AD4DE588F216EC80CFA1A1"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to any nursing facility in a State other than a State nursing facility, if the Secretary finds that such a nursing facility does not meet the minimum staffing requirements of clause (ii) of subsection (b)(4)(C) with respect to nursing facility services provided on or after January 1, 2022, the Secretary shall—</text><subclause id="HA4CA340500F74AA98C5AC5D81403A387"><enum>(I)</enum><text>deny any further payments to the State for medical assistance furnished by the facility to all individuals enrolled under the State plan who are admitted to the facility after the effective date of the finding; and</text></subclause><subclause id="HD82E57AA752947338F6170A30EBE57AD"><enum>(II)</enum><text>impose a civil money penalty in an amount not to exceed $10,000 for each day of noncompliance. The provisions of section 1128A (other than subsections (a) and (b)) shall apply to a civil money penalty under the previous sentence in the same manner as such provisions apply to a penalty or proceeding under section 1128A(a).</text></subclause></clause><clause id="H996858793470439294C6AEA8BF3A24C4"><enum>(ii)</enum><header>Reduction of civil money penalties in certain circumstances</header><text display-inline="yes-display-inline">Subject to clause (iii), in the case where a nursing facility self-reports and promptly corrects a deficiency for which a penalty was imposed under clause (i)(II) not later than 10 calendar days after the date of such imposition, the Secretary may reduce the amount of the penalty imposed by—</text><subclause id="H4E30930D52BD4E5B9D12091CCBEFB0CC"><enum>(I)</enum><text>not more than 50 percent; or</text></subclause><subclause id="H8FD433ADB11E4508833B813D3835FDE9"><enum>(II)</enum><text>in the case that the facility was penalized under this subsection within the three-year period preceding the date of such imposition, not more than 25 percent.</text></subclause></clause><clause id="HE6FA6B206D0D460F865040C3CD4A4855"><enum>(iii)</enum><header>Prohibitions on reduction for certain deficiencies</header><subclause id="H0EF8D2D98C9B48FC8D221B0497BAE1F9"><enum>(I)</enum><header>Repeat deficiencies</header><text display-inline="yes-display-inline">The Secretary may not reduce the amount of a penalty under clause (ii) if the Secretary had reduced a penalty imposed on the nursing facility in the preceding year under such clause with respect to a repeat deficiency.</text></subclause><subclause id="HD7404800C299499297F82E1FF348F743"><enum>(II)</enum><header>Certain other deficiencies</header><text display-inline="yes-display-inline">The Secretary may not reduce the amount of a penalty under clause (ii) if the penalty is imposed on the nursing facility for a deficiency that is found to result in a pattern of harm or widespread harm, immediately jeopardizes the health or safety of a resident or residents of the facility, or results in the death of a resident of the facility.</text></subclause></clause><clause id="H9FA7AD7694CD47D0AB00045FF3407B11"><enum>(iv)</enum><header>Repeated noncompliance</header><text>In the case of a nursing facility which, on three consecutive standard surveys conducted under subsection (g)(2), has been found as not meeting the minimum staffing requirements of clause (ii) of subsection (b)(4)(C) with respect to nursing facility services provided on or after January 1, 2022, the Secretary may (regardless of the remedies provided for under clause (i))—</text><subclause id="HD61A5300E75B42CEB343538109B15D43"><enum>(I)</enum><text>appoint temporary management to oversee the operation of the facility and to assure the health and safety of the facility’s residents in accordance with clause (iii) of paragraph (3)(C), except that <quote>the minimum staffing requirements of clause (ii) of subsection (b)(4)(C)</quote> shall be substituted for <quote>all the requirements of subsections (b), (c), and (d)</quote> under such clause;</text></subclause><subclause id="H8FD57A33C52946BF9287E423FC9C696D"><enum>(II)</enum><text display-inline="yes-display-inline">monitor the facility under subsection (g)(4)(B) with respect to such minimum staffing requirements until the facility has demonstrated to the satisfaction of the Secretary that the facility is in compliance, and will remain in compliance, with such minimum staffing requirements; or</text></subclause><subclause id="H2001D2E42DC24F66994BE90F6A9DF35D"><enum>(III)</enum><text>subject to section 1128I(h), terminate the facility’s participation under this title.</text></subclause><continuation-text continuation-text-level="clause">If the facility’s participation under this title is terminated under this clause, the State shall provide for the safe and orderly transfer of the residents eligible under this title, consistent with the requirements of subsection (c)(2) and section 1128I(h).</continuation-text></clause><clause commented="no" id="H99D1454AD4FA49149B681FB8AFD5E29E"><enum>(v)</enum><header>Public notice of violations</header><subclause commented="no" id="H4EE1DDA5FB42461CA98BF68149FCDD37"><enum>(I)</enum><header>Internet website</header><text display-inline="yes-display-inline">The Secretary shall publish on the internet website of the Department of Health and Human Services the names of nursing facilities that have violated the minimum staffing requirements of clause (ii) of subsection (b)(4)(C) with respect to skilled nursing facility services provided on or after January 1, 2022.</text></subclause><subclause commented="no" id="HDB525EAE55944ACF812182CA4CF9C3C6"><enum>(II)</enum><header>Change of ownership</header><text display-inline="yes-display-inline">With respect to a nursing facility whose name is published under subclause (I) and has a change of ownership, as determined by the Secretary, after the date of such publication, the Secretary shall remove the name of such facility from the website described under such subclause after the 1-year period beginning on the date of such change of ownership.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HE084BA483DAA4493859C69332C6E8A2A"><enum>(3)</enum><header>Conforming amendments</header><subparagraph id="HA0D4926C2FA2430E80F8457DC0728B47"><enum>(A)</enum><text display-inline="yes-display-inline">Clause (iii) of section 1919(b)(4)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(b)(4)(C)</external-xref>), as redesignated by paragraph (1)(B), is amended by striking <quote>subject to clause (iii)</quote> and inserting <quote>subject to clause (iv)</quote>.</text></subparagraph><subparagraph id="H8396760266C44BEAB5CE69D4581A3B9A"><enum>(B)</enum><text>Item (a) of section 1919(f)(2)(B)(iii)(I) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(f)(2)(B)(iii)(I)</external-xref>) is amended by striking <quote>subsection (b)(4)(C)(ii)</quote> and inserting <quote>subsection (b)(4)(C)(iii)</quote>.</text></subparagraph><subparagraph id="H9E0098EEE1CD42FD97B39376EA4AC568"><enum>(C)</enum><text>Paragraph (9) of section 1919(f) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(f)</external-xref>) is amended by striking <quote>subsection (b)(4)(C)(ii)</quote> and inserting <quote>subsection (b)(4)(C)(iii)</quote>.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H0D4C9488B19D4C8E80D67F64C5F9CEEC"><enum>(c)</enum><header>Studies and reports regarding impact of minimum nurse staffing requirements</header><paragraph commented="no" id="H08B95C708AE84837BEAF1994CD33EE5D"><enum>(1)</enum><header>Initial study and report</header><subparagraph id="HCC8F747A7CFB45ABBA047D76F70C6D66"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than June 1, 2023, the Secretary of Health and Human Services shall study and submit to the Committee on Energy and Commerce and the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate a publicly available report—</text><clause id="H608859A9F5344121A8110F26F672ED63"><enum>(i)</enum><text>on the impact of the minimum nurse staffing requirements added by subsection (a) on the reimbursement levels of skilled nursing facilities under the Medicare program under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.) and the adequacy of personnel numbers in such skilled nursing facilities to meet such minimum nurse staffing requirements;</text></clause><clause id="HE6D1BD3A4D604E03AE2D0E222969775C"><enum>(ii)</enum><text display-inline="yes-display-inline">on the impact of the minimum nurse staffing requirements added by subsection (b) on the reimbursement levels of nursing facilities under the Medicaid program under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.) and the adequacy of personnel numbers in such nursing facilities to meet such minimum nurse staffing requirements; and</text></clause><clause commented="no" id="HD981F5DD5D964169974F3F94BB638AB8"><enum>(iii)</enum><text>including recommendations on the steps that such skilled nursing facilities and nursing facilities can take to ensure that adequate personnel are available in such skilled nursing facilities and nursing facilities to meet the minimum nurse staffing requirements added by subsections (a) and (b) for such skilled nursing facilities and nursing facilities, respectively, including methods for attracting and retaining such personnel.</text></clause></subparagraph><subparagraph id="HA7168C8E86B74E30BB5B6BD334B98D1A"><enum>(B)</enum><header>Considerations</header><text>In conducting the study required under subparagraph (A), the Secretary of Health and Human Services shall take into consideration—</text><clause id="HC162245F705A49FFA9057312E2D54B2F"><enum>(i)</enum><text>the benefits of any increase in nurse staffing levels, including with respect to workforce training and retention;</text></clause><clause id="HD527131B9DA945BA8DBB1A2DB2ABB7A2"><enum>(ii)</enum><text>any decrease in the rate of workplace injuries;</text></clause><clause id="HBBD1F76168CC4205A5798C022956B1A5"><enum>(iii)</enum><text>any changes in medical care costs for residents of skilled nursing facilities and nursing facilities;</text></clause><clause id="H446EC7EC9A5147CEBEDF33255849E132"><enum>(iv)</enum><text>any decrease in hospitalization rates for such residents;</text></clause><clause id="HA477B358562546509256BB0A90030E5D"><enum>(v)</enum><text>any changes in personnel and administrative costs for skilled nursing facilities and nursing facilities; and</text></clause><clause id="H2D7D888BB5AB49C1AA34015DE58E74F5"><enum>(vi)</enum><text>any changes in recruiting and training costs.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H2F8CA8B9935D46B6A641E233D7EF3800"><enum>(2)</enum><header>Subsequent study and report</header><text display-inline="yes-display-inline">Not later than January 1, 2025, the Secretary of Health and Human Services shall conduct a follow-up study to the study conducted under paragraph (1)(A) and submit to the Committee on Energy and Commerce and the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate a publicly available report on such follow-up study.</text></paragraph></subsection></section><section commented="no" id="HB8BCEFF1565A41CB9799EEE541A0F4A1"><enum>3.</enum><header>Disclosure of nurse staffing levels at skilled nursing facilities under Medicare program and nursing facilities under Medicaid program</header><subsection commented="no" id="H7E143F4EA664438CA3EDE44C6C696D8B"><enum>(a)</enum><header>Medicare</header><text display-inline="yes-display-inline">Paragraph (8) of section 1819(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(b)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5CB2E58FCA8949B79AABEDD283C3DCE2"><paragraph id="H7171420ED7504CB1BBCE5B734982ABE6"><enum>(8)</enum><header>Information on nurse staffing</header><subparagraph id="HB0B69E7A5D614D0C83E8EA3521658CA7"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Each day, a skilled nursing facility shall post for each shift notices with—</text><clause id="HB8E182DE8AC84098AE19AC73D99904BA"><enum>(i)</enum><text>a description of the nurse staffing requirements applicable with respect to the facility and day under paragraph (4)(C);</text></clause><clause id="HA6820647E3324B5399CD438AD3117FD8"><enum>(ii)</enum><text>information on the number of registered professional nurses, licensed practical nurses, and nurse aides (as defined in paragraph (5)(F)) assigned to provide direct care services to residents in the facility during the shift, disaggregated by units in the facility; and</text></clause><clause id="H392F354BCCC44E429FEF4CA7898E34DF"><enum>(iii)</enum><text>a statement that the facility is required, upon request, to provide any nurse staffing information (as described in this subparagraph) of the facility from the preceding 12-month period.</text></clause><continuation-text continuation-text-level="subparagraph">The information in such notices shall be written in a uniform manner, printed in an easily readable 14-point type font, and made available in appropriate languages, as determined by the Secretary. The skilled nursing facility shall make such notices available at each nurses’ station in the facility and other areas in each unit of the facility, as determined appropriate by the facility, and shall keep and maintain each such notice for at least three years after the date on which each such notice is posted in the facility.</continuation-text></subparagraph><subparagraph id="HC9B8DC1EA7234D91BE9CEB51BB6B5101"><enum>(B)</enum><header>Public availability of information</header><text>A skilled nursing facility shall, upon request, make available to the public any nurse staffing information (as described in subparagraph (A)) of the facility from the preceding 12-month period. In the case that the facility makes such information available as a paper copy, such facility may not charge for such copy an amount greater than the cost of making such copy.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="H7268406C1D4947E6811FC732F8719D2F"><enum>(b)</enum><header>Medicaid</header><text>Paragraph (8) of section 1919(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(b)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H2715B1E85C7F434481E9F157A0A0A24E"><paragraph id="H0CA799422CA94D7993A1E32DF592ED66"><enum>(8)</enum><header>Information on nurse staffing</header><subparagraph id="H988CD4B0B325442595CD8B054EC1EB7C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Each day, a skilled nursing facility shall post for each shift notices with—</text><clause id="HFAA3F9B13E91416582595DBF83A8F9B7"><enum>(i)</enum><text>a description of the nurse staffing requirements applicable with respect to the facility and day under paragraph (4)(C);</text></clause><clause id="H66BA4DD8B50445C9A64AF3C32F611C49"><enum>(ii)</enum><text>information on the number of registered professional nurses, licensed practical nurses, and nurse aides (as defined in paragraph (5)(F)) assigned to provide direct care services to residents in the facility during the shift, disaggregated by units in the facility; and</text></clause><clause id="H56E56FAF7FCE4C18840521BFE09830D3"><enum>(iii)</enum><text>a statement that the facility is required, upon request, to provide any nurse staffing information (as described in this subparagraph) of the facility from the preceding 12-month period.</text></clause><continuation-text continuation-text-level="subparagraph">The information in such notices shall be written in a uniform manner, printed in an easily readable 14-point type font, and made available in appropriate languages, as determined by the Secretary. The skilled nursing facility shall make such notices available at each nurses’ station in the facility and other areas in each unit of the facility, as determined appropriate by the facility, and shall keep and maintain each such notice for at least three years after the date on which each such notice is posted in the facility.</continuation-text></subparagraph><subparagraph id="H810D406DD580427A912A5B2867A4A8AC"><enum>(B)</enum><header>Public availability of information</header><text>A skilled nursing facility shall, upon request, make available to the public any nurse staffing information (as described in subparagraph (A)) of the facility from the preceding 12-month period.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC5199E9522C54FCAB99C599D85B253DE"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section take effect on the date of enactment of this Act and apply with respect to nurse staffing information posted or requested on or after the date that is one year after such date of enactment.</text></subsection></section><section commented="no" id="HEBB1C137D35849D7A847F28CD6C7D58D"><enum>4.</enum><header>Administrative staffing requirements for skilled nursing facilities under Medicare program and nursing facilities under Medicaid program</header><subsection commented="no" id="H2FD2FFE110B04F11B6E4BD58F00031A0"><enum>(a)</enum><header>Medicare</header><text display-inline="yes-display-inline">Paragraph (1) of section 1819(d) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(d)</external-xref>) is amended—</text><paragraph id="HEF3ACCDC336C4E469408A8C38D507601"><enum>(1)</enum><text>by redesignating the second subparagraph (C) as subparagraph (E); and</text></paragraph><paragraph id="HBF3D9C6655F140E8853696678B1B33FD"><enum>(2)</enum><text>by inserting after the first subparagraph (C) the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HEA9102F8909240329283CA570760EB98"><subparagraph id="H08F405D6399A481D9A08F96F563C3964"><enum>(D)</enum><header>Nursing management personnel</header><clause id="H29B85247560C4D49A357AEEB044F3F21"><enum>(i)</enum><header>In general</header><text>A skilled nursing facility must employ nursing management personnel in accordance with this subparagraph.</text></clause><clause id="H4C75975ED4E044FB96E25EB327674A90"><enum>(ii)</enum><header>Director of nursing services</header><text display-inline="yes-display-inline">A skilled nursing facility must employ a registered professional nurse to serve full-time as the director of nursing services of the facility. Such director of nursing services shall be responsible for determining the number and types of nursing personnel needed to sufficiently meet the nursing needs of the residents of the facility (as required under subsection (b)(4)(C)).</text></clause><clause id="H6F29BAD0E02741C390676A45F8438D8C"><enum>(iii)</enum><header>Assistant director of nursing services</header><text>A skilled nursing facility must employ a registered professional nurse to serve full-time as the assistant director of nursing services of the facility, except that in the case of a skilled nursing facility that has fewer than 100 beds, such facility may employ a registered professional nurse to serve part-time as the assistant director of nursing services of the facility. A registered professional nurse who serves as the assistant director of nursing services of a skilled nursing facility may also serve as a supervisor for direct clinical nursing care for such facility.</text></clause><clause id="H9111360241C742E586FD8053610F568A"><enum>(iv)</enum><header>Director of in-Service education</header><text display-inline="yes-display-inline">A skilled nursing facility must employ a registered professional nurse to serve full-time as the director of in-service education of the facility, except that in the case of a skilled nursing facility that has fewer than 100 beds, such facility may employ a registered professional nurse to serve part-time as the director of in-service education of the facility. In carrying out the previous sentence, a skilled nursing facility must, to the extent practicable and appropriate, employ a registered professional nurse who has received training in adult education and gerontology.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="HA7B072048A904DE28A54D7699B57696D"><enum>(b)</enum><header>Medicaid</header><paragraph id="HD767BE0F8718450C9C014BCA80964DEE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (1) of section 1919(d) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(d)</external-xref>) is amended by inserting after subparagraph (C) the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H051CC2D65B03493CB22087F334807521"><subparagraph id="H2340194401F34DA083C775CA7208FFB4"><enum>(D)</enum><header>Nursing management personnel</header><clause id="HABDF221245684C2CB5AE210DD2EE31FC"><enum>(i)</enum><header>In general</header><text>A nursing facility must employ nursing management personnel in accordance with this subparagraph.</text></clause><clause id="HE2F587790B9449638230E885204A791F"><enum>(ii)</enum><header>Director of nursing services</header><text display-inline="yes-display-inline">A nursing facility must employ a registered professional nurse to serve full-time as the director of nursing services of the facility. A registered professional nurse who serves as the assistant director of nursing services of a nursing facility may also serve as a supervisor for direct clinical nursing care for such facility.</text></clause><clause id="H113DE3385DB7499BABB669FB12354F43"><enum>(iv)</enum><header>Director of in-Service education</header><text display-inline="yes-display-inline">A nursing facility must employ a registered professional nurse to serve full-time as the director of in-service education of the facility, except that in the case of a nursing facility that has fewer than 100 beds, such facility may employ a registered professional nurse to serve part-time as the director of in-service education of the facility. In carrying out the previous sentence, a nursing facility must, to the extent practicable and appropriate, employ a registered professional nurse who has received training in adult education and gerontology.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H2605AB9DBCC44D448F964F48416F37E1"><enum>(2)</enum><header>Technical amendment</header><text display-inline="yes-display-inline">Paragraph (1) of section 1919(d) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(d)</external-xref>) is amended by redesignating subparagraph (V) as subparagraph (E).</text></paragraph></subsection><subsection id="HA890B28AA56840FB85F746B2314A48F3"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section take effect on the date of enactment of this Act and apply with respect to the administration of skilled nursing facilities and nursing facilities on or after the date that is one year after such date of enactment.</text></subsection></section><section commented="no" id="HE05AC664D7604482BEA36113263DE497"><enum>5.</enum><header>Nurse training requirements with respect to skilled nursing facilities under Medicare program and nursing facilities under Medicaid program</header><subsection commented="no" id="H9A5EA1C2BFFD4A0F904B16A99704981E"><enum>(a)</enum><header>Medicare</header><paragraph id="H2AD3B18260ED41E2AA3F2D842691BBA8"><enum>(1)</enum><header>Orientation for registered professional nurses, licensed practical nurses, and nurse aides</header><text display-inline="yes-display-inline">Section 1819(d) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(d)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5190D9A945A0426BAA40FA7AF77CE8BA"><paragraph id="HD1EF1138BD774910B3F61764BA27FB65"><enum>(5)</enum><header>Orientations</header><text display-inline="yes-display-inline">A skilled nursing facility must provide to registered professional nurses, licensed practical nurses, and nurse aides, before such registered professional nurses, licensed practical nurses, and nurse aides are assigned to provide direct care services to residents in the facility, orientations providing education on the policies and emergency procedures of the facility and on residents’ rights under this section.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H73412C3635B2495788D3DE40EAD50118"><enum>(2)</enum><header>Requirements for nurse aide training and competency evaluation programs and for nurse aide competency evaluation programs</header><text display-inline="yes-display-inline">Subparagraph (A) of section 1819(f)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(f)(2)</external-xref>) is amended—</text><subparagraph id="HA222D29F824643AC8E519E3A9C0AC76B"><enum>(A)</enum><text>in the matter preceding clause (i), by inserting after <quote>1988</quote> the following: <quote>, and update, as determined necessary by the Secretary</quote>;</text></subparagraph><subparagraph id="H971ED24667AB4B24BAC82E32CBE8A22E"><enum>(B)</enum><text>in clause (i)—</text><clause id="HC1A91EE6C5944A28B742D94C647E25FB"><enum>(i)</enum><text>by inserting after <quote>care of cognitively impaired residents,</quote> the following: <quote>care of older adults,</quote>;</text></clause><clause id="H684E08907BA446B69AA728F78F13FEFB"><enum>(ii)</enum><text>by striking <quote>patient abuse prevention training,</quote> and inserting <quote>patient abuse prevention training),</quote>; and</text></clause><clause id="H12A49AD5D6D641D69C473693D2674052"><enum>(iii)</enum><text>by striking <quote>and procedures</quote> and inserting <quote>(II) minimum hours of initial and ongoing training and retraining (including not less than 120 hours in the case of initial training), and (III) procedures</quote>.</text></clause></subparagraph></paragraph></subsection><subsection id="HED62922AE2144E3A83F2F24E45B4A982"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section take effect on the date of enactment of this Act and shall apply with respect to nurse aide training and competency evaluation programs, nurse aide competency evaluation programs, and nurse orientations conducted on or after the date that is one year after such date of enactment.</text></subsection></section><section commented="no" id="HF5D21A08326A490AAF2BDFB5FCFD7125"><enum>6.</enum><header>Whistleblower and resident protections</header><subsection commented="no" id="HF1B3E8661F8E43A38C80F45A8E37EBDC"><enum>(a)</enum><header>Medicare</header><text display-inline="yes-display-inline">Section 1819 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3FA456A886B14036A22355AD8485C529"><subsection id="HFF68848BF77D4C3A9A1C5F46017DED3A"><enum>(k)</enum><header>Whistleblower and resident protections</header><paragraph commented="no" id="HB13D19C8CFFF4CECB7E5E45E82599DE3"><enum>(1)</enum><header>Statement regarding professional obligation and rights</header><text display-inline="yes-display-inline">All nurses employed by a skilled nursing facility have a duty and right to act based on their professional judgment in accordance with the nursing laws and regulations of the State in which such facility is located, to provide nursing care in the exclusive interests of the residents of the facility, and to act as the residents’ advocate.</text></paragraph><paragraph id="H6963057741624512B7893B3B70F30CF1"><enum>(2)</enum><header>Objection to or refusal of work assignment</header><text>A nurse may object to, or refuse to participate in, any activity, policy, practice, assignment, or task (referred to in this subsection as a <quote>work assignment</quote>) if—</text><subparagraph id="HB41E53EC80CB43909909B11F05A70B86"><enum>(A)</enum><text display-inline="yes-display-inline">the nurse reasonably believes such work assignment to be in violation of the minimum nurse staffing requirements of clause (ii) of subsection (b)(4)(C); or</text></subparagraph><subparagraph id="HD7C4737675C84344B8CE5A6E72C24DC8"><enum>(B)</enum><text>the nurse reasonably believes that the nurse is not prepared by education, training, or experience to perform or comply with such work assignment without compromising the safety of a resident or jeopardizing the license of the nurse.</text></subparagraph></paragraph><paragraph id="H065FEBC7D29E4A56A008B81244AF9C97"><enum>(3)</enum><header>Retaliation for objection to or refusal of work assignment barred</header><subparagraph id="HEA60EAF76B854616967C345F9489D21D"><enum>(A)</enum><header>No discharge, discrimination, or retaliation</header><text display-inline="yes-display-inline">No skilled nursing facility may discharge, retaliate, discriminate, or otherwise take adverse action in any manner with respect to any aspect of a nurse’s employment with the facility, including discharge, promotion, compensation, or terms, conditions, or privileges of employment, based on the nurse’s objection to, or refusal of, a work assignment under paragraph (2).</text></subparagraph><subparagraph id="HF9BB021086AC438E84139E3559488DCA"><enum>(B)</enum><header>No filing of complaint</header><text>No skilled nursing facility may file a complaint or a report against a nurse with a State professional disciplinary agency because of the nurse’s objection to, or refusal of, a work assignment under paragraph (2).</text></subparagraph></paragraph><paragraph id="H9B0C60DB814C4B13A080BE1E5911C728"><enum>(4)</enum><header>Cause of action</header><text>Any nurse (or a collective bargaining representative or legal representative of such nurse) against whom a skilled nursing facility has taken an adverse action in violation of paragraph (3)(A), or against whom such facility has filed a complaint or report in violation of paragraph (3)(B), may (without regard to whether a complaint has been filed under paragraph (5) or (10)(B)) bring a cause of action in an appropriate district court of the United States. The legal burdens of proof specified in section 1221(e) of title 5, United States Code, shall be controlling for the purposes of any cause of action brought under this paragraph. A nurse who prevails on the cause of action may be entitled to one or more of the following:</text><subparagraph display-inline="no-display-inline" id="H9152DC32FFBA4D08A68359409BC2D2A4"><enum>(A)</enum><text>Reinstatement.</text></subparagraph><subparagraph display-inline="no-display-inline" id="HDE20C6FA99EE4C6880D33B26697E1118"><enum>(B)</enum><text>Reimbursement of lost wages, compensation, and benefits.</text></subparagraph><subparagraph display-inline="no-display-inline" id="HD459003BA0B64A0DBD9467FC53208B84"><enum>(C)</enum><text>Attorneys’ fees.</text></subparagraph><subparagraph display-inline="no-display-inline" id="H8BB24A9B4F6A4D2B8663AF4D83107FF4"><enum>(D)</enum><text>Court costs.</text></subparagraph><subparagraph display-inline="no-display-inline" id="HB9A9E4357F694278916338103C36ECC8"><enum>(E)</enum><text>Other damages.</text></subparagraph></paragraph><paragraph id="H30002D8F7F994CBDB7750FD7B00B9710"><enum>(5)</enum><header>Complaint to Secretary</header><text>Any individual may file a complaint with the Secretary against a skilled nursing facility that violates a requirement described in paragraph (3). For any complaint filed, the Secretary shall—</text><subparagraph display-inline="no-display-inline" id="H43ABB858F4D742BEA1CF3DABA4364B4E"><enum>(A)</enum><text>receive and investigate the complaint;</text></subparagraph><subparagraph display-inline="no-display-inline" id="HF0950BCFF90B44AF819EC48CFE75EC9E"><enum>(B)</enum><text>determine whether a violation of such paragraph, as alleged in the complaint, has occurred; and</text></subparagraph><subparagraph display-inline="no-display-inline" id="HE7699421C7EA41B5AD58D90CB224B16C"><enum>(C)</enum><text>in the case that the Secretary determines that such a violation has occurred, issue an order that the complaining individual may not suffer any adverse action prohibited by paragraph (3) or (7).</text></subparagraph></paragraph><paragraph id="H466437BC01BD457FBFE28ACD361B270F"><enum>(6)</enum><header>Toll-Free telephone number</header><subparagraph id="H2943DE14D65C4FB1BB009677247E3BA6"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall provide for the establishment of a toll-free telephone hotline to provide information regarding the minimum nurse staffing requirements of clause (ii) of subsection (b)(4)(C) and to receive reports of violations of such requirements.</text></subparagraph><subparagraph id="HC0FB49D349AB432AB23C4D805B13179D"><enum>(B)</enum><header>Notice to residents</header><text>A skilled nursing facility shall provide each resident admitted to the facility with the telephone number of the hotline described in subparagraph (A) and give notice to each such resident that such hotline may be used to report inadequate staffing.</text></subparagraph></paragraph><paragraph id="HE686654474E24CF08C75D8BA92E6956E"><enum>(7)</enum><header>Protection for reporting</header><subparagraph id="HB5CDB9B4DC9949758F91BB299E7C5CE1"><enum>(A)</enum><header>Prohibition on retaliation or discrimination</header><text display-inline="yes-display-inline">A skilled nursing facility may not retaliate or discriminate in any manner against any resident, employee, or contract employee of the facility, or any other individual, on the basis that such resident, employee, contract employee, or individual (individually or in conjunction with another individual) has, in good faith—</text><clause id="H281BA5BD4D96478FA61E1E994F14CC0A"><enum>(i)</enum><text>presented a grievance or complaint;</text></clause><clause id="H1DC9625B727644B7A1CC3F81C1AE9D96"><enum>(ii)</enum><text>initiated or cooperated in any investigation or proceeding of any governmental entity, regulatory agency, or private accreditation body;</text></clause><clause id="H27D9929D75924B4AB15692A33A89A827"><enum>(iii)</enum><text>made a civil claim or demand; or</text></clause><clause id="H49E507599C1443BDB387A551CA889EC5"><enum>(iv)</enum><text>filed an action relating to the care, services, or conditions of the facility.</text></clause></subparagraph><subparagraph id="H1AE8B2F9A470404890FBA45E3DE3B3F9"><enum>(B)</enum><header>Good faith defined</header><text>For purposes of this paragraph, an individual shall be deemed to be acting in good faith if the individual reasonably believes—</text><clause id="H8AAEDD2FFD47409DA0E75C64EFD657F6"><enum>(i)</enum><text>the information reported or disclosed is true; and</text></clause><clause commented="no" id="H5603AC300858477990479C0DEE084B55"><enum>(ii)</enum><text display-inline="yes-display-inline">a violation of the minimum nurse staffing requirements of clause (ii) of subsection (b)(4)(C) has occurred or may occur.</text></clause></subparagraph></paragraph><paragraph id="H6028E4D25CBE4092A1FC4587E9AC0EFA"><enum>(8)</enum><header>Prohibition on interference with rights</header><subparagraph display-inline="no-display-inline" id="H43428141254F4349A4E755A8E7F36C96"><enum>(A)</enum><header>Exercise of rights</header><text>A skilled nursing facility may not—</text><clause id="H3632254527DA4D2F93BC5D6FDA3AB743"><enum>(i)</enum><text>interfere with, restrain, or deny the exercise, or attempt to exercise, by any individual of any right, procedure, or remedy provided or protected under this subsection; or</text></clause><clause id="H20E95C4372284DA8A47C58C8D0D06B72"><enum>(ii)</enum><text>coerce or intimidate any individual regarding the exercise, or attempt to exercise, such right.</text></clause></subparagraph><subparagraph id="H6FCEFC819554454D8BC715B267D9D442"><enum>(B)</enum><header>Opposition to unlawful policies or practices</header><text display-inline="yes-display-inline">A skilled nursing facility may not retaliate or discriminate against any individual for opposing any policy, practice, or action of the facility which is alleged to violate, breach, or fail to comply with any provision of the minimum nurse staffing requirements of clause (ii) of subsection (b)(4)(C).</text></subparagraph><subparagraph id="H90DB6F3082E241A19F8731AF4BB640A9"><enum>(C)</enum><header>Prohibition on interference with protected communications</header><text>A skilled nursing facility may not make, adopt, or enforce any rule, regulation, policy, or practice which in any manner directly or indirectly prohibits, impedes, or discourages a nurse from, or intimidates, coerces, or induces a nurse regarding, engaging in free speech activities or disclosing information as provided under this subsection.</text></subparagraph><subparagraph id="HE993DFC7524343AFA95FC775A16D4B24"><enum>(D)</enum><header>Prohibition on interference with collective action</header><text>A skilled nursing facility may not in any way interfere with the rights of nurses to organize, bargain collectively, and engage in concerted activity under section 7 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/157">29 U.S.C. 157</external-xref>).</text></subparagraph></paragraph><paragraph id="HDF038E90B9DB496796ABDF33B4ABEDF5"><enum>(9)</enum><header>Notice</header><text>A skilled nursing facility shall post in an appropriate location in each unit a conspicuous notice, in a form specified by the Secretary, that—</text><subparagraph display-inline="no-display-inline" id="HEFE93748878946169B73420A43C1EF3C"><enum>(A)</enum><text>explains the rights of nurses, residents, and other individuals under this subsection;</text></subparagraph><subparagraph display-inline="no-display-inline" id="H4A2D13073FC0498B9C47A569285C7544"><enum>(B)</enum><text>includes a statement that a nurse, resident, or other individual may file a complaint with the Secretary against the facility for a violation of a requirement or a prohibition of this subsection; and</text></subparagraph><subparagraph display-inline="no-display-inline" id="H06DB848BE89A40FC810FA1105D80F5E5"><enum>(C)</enum><text>provides instructions on how to file such a complaint.</text></subparagraph></paragraph><paragraph id="H56130511A9024B9092D8CD0CAAA93398"><enum>(10)</enum><header>Enforcement</header><subparagraph id="H274F9DD259034F72B0A334E1D8C776F2"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall enforce the requirements and prohibitions of this subsection in accordance with this paragraph.</text></subparagraph><subparagraph id="H6B0E7D96EB724BF0966CBC9AACCD6E52"><enum>(B)</enum><header>Procedures for receiving and investigating complaints</header><text>The Secretary shall establish procedures under which—</text><clause display-inline="no-display-inline" id="H452670E00CBE4869B8B2C21B5933E0A0"><enum>(i)</enum><text>any individual may file a complaint alleging that a skilled nursing facility has violated a requirement or a prohibition of this subsection; and</text></clause><clause display-inline="no-display-inline" id="HFFF0C390975F408F97C61D5383F292A0"><enum>(ii)</enum><text>any such complaint shall be investigated by the Secretary.</text></clause></subparagraph><subparagraph id="H11D5C08393F14A5586C7DCF8847A528A"><enum>(C)</enum><header>Remedies</header><text>If the Secretary determines that a skilled nursing facility has violated a requirement or prohibition of this subsection, the Secretary—</text><clause display-inline="no-display-inline" id="HF8CD06E00FCB42B1B91024719E09D333"><enum>(i)</enum><text>shall require the facility to establish a corrective action plan to prevent the recurrence of such violation; and</text></clause><clause display-inline="no-display-inline" id="H8CB8716C56A54EAFA77AE81E4AB24FAC"><enum>(ii)</enum><text>may impose civil money penalties as described in subparagraph (D).</text></clause></subparagraph><subparagraph id="H0807020D2A144A7A957B85091C22892D"><enum>(D)</enum><header>Civil penalties</header><clause id="H685B541B807948DAAAF639885303F260"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to any other penalties prescribed by law, the Secretary may impose civil penalties as follows:</text><subclause id="HA8F11AEBC41840338E60D02F8B901741"><enum>(I)</enum><header>Skilled nursing facility liability</header><text>The Secretary may impose on a skilled nursing facility found to be in violation of this subsection a civil money penalty of—</text><item display-inline="no-display-inline" id="H075ACDDE45404E318ACAEF4BC4D8C330"><enum>(aa)</enum><text>not more than $25,000 for the first knowing violation of this subsection by such facility; and</text></item><item id="H79670F8F3FB54515A7CA7CAEAD8A8230"><enum>(bb)</enum><text>not more than $50,000 for any subsequent knowing violation of this subsection by such facility.</text></item></subclause><subclause id="H3B4A8B06D9214A5E95BC658D4FFBAE7F"><enum>(II)</enum><header>Individual liability</header><text>The Secretary may impose on an individual who—</text><item display-inline="no-display-inline" id="HFA4FD6B52D2840E0A302B5D796C86FD8"><enum>(aa)</enum><text>is employed by a skilled nursing facility; and</text></item><item id="H4A01131E442343E39D20FC1380660283"><enum>(bb)</enum><text>is found by the Secretary to have knowingly violated this subsection on behalf of the facility,</text></item><continuation-text continuation-text-level="subclause">a civil money penalty of not more than $20,000 for each such violation by the individual.</continuation-text></subclause></clause><clause id="H270D161F929047738696AEBD73D5EC6B"><enum>(ii)</enum><header>Procedures</header><text display-inline="yes-display-inline">The provisions of section 1128A of the Social Security Act (other than subsections (a) and (b)) shall apply with respect to a civil money penalty or proceeding under this subparagraph in the same manner as such provisions apply with respect to a civil money penalty or proceeding under such section 1128A.</text></clause></subparagraph><subparagraph commented="no" id="H0896138086A64A5BB983A5EFFDB7B28C"><enum>(E)</enum><header>Public notice of violations</header><clause commented="no" id="HB2DC857658FC493ABBD6EAAF494A43D9"><enum>(i)</enum><header>Internet website</header><text display-inline="yes-display-inline">The Secretary shall publish on the internet website of the Department of Health and Human Services the names of skilled nursing facilities on which a civil money penalty has been imposed under this subsection, the violation for which such penalty was imposed, and such additional information as the Secretary determines appropriate.</text></clause><clause commented="no" id="H4728CA082CC4470D9AF8265B30492087"><enum>(ii)</enum><header>Change of ownership</header><text display-inline="yes-display-inline">With respect to a skilled nursing facility that had a change of ownership, as determined by the Secretary, penalties imposed on the facility while under previous ownership shall no longer be published by the Secretary pursuant to clause (i) after the 1-year period beginning on the date of such change of ownership.</text></clause></subparagraph><subparagraph id="HE87DD248D8D34898BC6457EFFCDB0D46"><enum>(F)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Funds collected by the Secretary pursuant to this subsection are authorized to be appropriated to implement the minimum nurse staffing requirements of clause (ii) of subsection (b)(4)(C).</text></subparagraph></paragraph><paragraph id="HAE0D059F84814CCE875B58398DF40D4D"><enum>(11)</enum><header>Nurse defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>nurse</term> means a registered professional nurse, a licensed practical nurse, and a nurse aide.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="HE40E48360AF544AA86016E0C1EFB24C7"><enum>(b)</enum><header>Medicaid</header><text display-inline="yes-display-inline">Section 1919 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3673A53DBCC744F89BA12CDF335BD8CD"><subsection id="H8B91FE8121D74C859EA39F12F953A2AE"><enum>(k)</enum><header>Whistleblower and resident protections</header><paragraph commented="no" id="H4D3CAF2BDB7F42F2B1E298E43AE7BA34"><enum>(1)</enum><header>Statement regarding professional obligation and rights</header><text display-inline="yes-display-inline">All nurses employed by a nursing facility have a duty and right to act based on their professional judgment in accordance with the nursing laws and regulations of the State in which such facility is located, to provide nursing care in the exclusive interests of the residents of the facility, and to act as the residents’ advocate.</text></paragraph><paragraph id="H6D5401EA2B3744D7A23B253042934524"><enum>(2)</enum><header>Objection to or refusal of work assignment</header><text>A nurse may object to, or refuse to participate in, any activity, policy, practice, assignment, or task (referred to in this subsection as a <quote>work assignment</quote>) if—</text><subparagraph id="H92CE63DAFE154D36B895C655B3B4FCA5"><enum>(A)</enum><text display-inline="yes-display-inline">the nurse reasonably believes such work assignment to be in violation of the minimum nurse staffing requirements of clause (ii) of subsection (b)(4)(C); or</text></subparagraph><subparagraph id="H821BFCE7E02742B0929AA163A81CBA75"><enum>(B)</enum><text>the nurse reasonably believes that the nurse is not prepared by education, training, or experience to perform or comply with such work assignment without compromising the safety of a resident or jeopardizing the license of the nurse.</text></subparagraph></paragraph><paragraph id="HEE74AC9006C7426E8DC8235545776024"><enum>(3)</enum><header>Retaliation for objection to or refusal of work assignment barred</header><subparagraph id="H45C5C64A07A5486CADF20F1405C4B088"><enum>(A)</enum><header>No discharge, discrimination, or retaliation</header><text display-inline="yes-display-inline">No nursing facility may discharge, retaliate, discriminate, or otherwise take adverse action in any manner with respect to any aspect of a nurse’s employment with the facility, including discharge, promotion, compensation, or terms, conditions, or privileges of employment, based on the nurse’s objection to, or refusal of, a work assignment under paragraph (2).</text></subparagraph><subparagraph id="H6B6A3C2963704B948C8D3291A1BD95C7"><enum>(B)</enum><header>No filing of complaint</header><text>No nursing facility may file a complaint or a report against a nurse with a State professional disciplinary agency because of the nurse’s objection to, or refusal of, a work assignment under paragraph (2).</text></subparagraph></paragraph><paragraph id="H91B0CA3C622D402C831BA25DAD59393E"><enum>(4)</enum><header>Cause of action</header><text>Any nurse (or a collective bargaining representative or legal representative of such nurse) against whom a nursing facility has taken an adverse action in violation of paragraph (3)(A), or against whom such facility has filed a complaint or report in violation of paragraph (3)(B), may (without regard to whether a complaint has been filed under paragraph (5) or (10)(B)) bring a cause of action in an appropriate district court of the United States. The legal burdens of proof specified in section 1221(e) of title 5, United States Code, shall be controlling for the purposes of any cause of action brought under this paragraph. A nurse who prevails on the cause of action may be entitled to one or more of the following:</text><subparagraph display-inline="no-display-inline" id="H32FD14D096E2417DBCBE9C3A2194211D"><enum>(A)</enum><text>Reinstatement.</text></subparagraph><subparagraph display-inline="no-display-inline" id="HD2CD81B26EBC43FDA0EC7F46A2E06745"><enum>(B)</enum><text>Reimbursement of lost wages, compensation, and benefits.</text></subparagraph><subparagraph display-inline="no-display-inline" id="HB0440B5D505C4127BC59382EEABC6DE8"><enum>(C)</enum><text>Attorneys’ fees.</text></subparagraph><subparagraph display-inline="no-display-inline" id="H5C11A33B46174E3AB2CD2B957DF880AA"><enum>(D)</enum><text>Court costs.</text></subparagraph><subparagraph display-inline="no-display-inline" id="H651480BD290D4A9CB6943805119C665D"><enum>(E)</enum><text>Other damages.</text></subparagraph></paragraph><paragraph id="HF9420C256ED648A7A791DDDF1CDCA132"><enum>(5)</enum><header>Complaint to Secretary</header><text>Any individual may file a complaint with the Secretary against a nursing facility that violates a requirement described in paragraph (3). For any complaint filed, the Secretary shall—</text><subparagraph display-inline="no-display-inline" id="H04BEFF6A6CDA4A46B0D8FC7CA14420C2"><enum>(A)</enum><text>receive and investigate the complaint;</text></subparagraph><subparagraph display-inline="no-display-inline" id="H979B4297DCBF44BA9686ADC7C30C933A"><enum>(B)</enum><text>determine whether a violation of such paragraph, as alleged in the complaint, has occurred; and</text></subparagraph><subparagraph display-inline="no-display-inline" id="H422E84EE3C4346ECBA7BC816C03258C5"><enum>(C)</enum><text>in the case that the Secretary determines that such a violation has occurred, issue an order that the complaining individual may not suffer any adverse action prohibited by paragraph (3) or (7).</text></subparagraph></paragraph><paragraph id="H5ADD19D16EA5452D90CD3B1AE02497FB"><enum>(6)</enum><header>Toll-Free telephone number</header><subparagraph id="HF6895BB40D6145C9871F69C955D79844"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall provide for the establishment of a toll-free telephone hotline to provide information regarding the minimum nurse staffing requirements of clause (ii) of subsection (b)(4)(C) and to receive reports of violations of such requirements.</text></subparagraph><subparagraph id="HD3ECD3DF595D4746B362AFE2AD21E2D7"><enum>(B)</enum><header>Notice to residents</header><text>A nursing facility shall provide each resident admitted to the facility with the telephone number of the hotline described in subparagraph (A) and give notice to each such resident that such hotline may be used to report inadequate staffing or care.</text></subparagraph></paragraph><paragraph id="H3A492B0E59A54F21B77377AA1D015DE0"><enum>(7)</enum><header>Protection for reporting</header><subparagraph id="H3A5057913BB24A19A3C4A56DD1D5F1B0"><enum>(A)</enum><header>Prohibition on retaliation or discrimination</header><text display-inline="yes-display-inline">A nursing facility may not retaliate or discriminate in any manner against any resident, employee, or contract employee of the facility, or any other individual, on the basis that such resident, employee, contract employee, or individual (individually or in conjunction with another individual) has, in good faith—</text><clause id="H2BA5CBC8AE3946C4A8C10B1FF32FC72E"><enum>(i)</enum><text>presented a grievance or complaint;</text></clause><clause id="HAAE9ABAE5A424E748921D9D9A2A90439"><enum>(ii)</enum><text>initiated or cooperated in any investigation or proceeding of any governmental entity, regulatory agency, or private accreditation body;</text></clause><clause id="HE4F554C788B04181BA31AA34BD2A4945"><enum>(iii)</enum><text>made a civil claim or demand; or</text></clause><clause id="H38C932401D5D4A6EBFEC8BEA1EB742FD"><enum>(iv)</enum><text>filed an action relating to the care, services, or conditions of the facility.</text></clause></subparagraph><subparagraph id="H3776A75178394CE489E8CD63E8988C3A"><enum>(B)</enum><header>Good faith defined</header><text>For purposes of this paragraph, an individual shall be deemed to be acting in good faith if the individual reasonably believes—</text><clause id="HAA07B59EC6AC4460A0AE467B49FD4E1E"><enum>(i)</enum><text>the information reported or disclosed is true; and</text></clause><clause commented="no" id="H2EB1AB462E42438AB958DC563CE11DB9"><enum>(ii)</enum><text display-inline="yes-display-inline">a violation of the minimum nurse staffing requirements of clause (ii) of subsection (b)(4)(C) has occurred or may occur.</text></clause></subparagraph></paragraph><paragraph id="HAEED537AE5B2474B9EA740587FD31CD9"><enum>(8)</enum><header>Prohibition on interference with rights</header><subparagraph display-inline="no-display-inline" id="H2FA7D640D10C40E8BA67E844231D124B"><enum>(A)</enum><header>Exercise of rights</header><text>A nursing facility may not—</text><clause id="H548BE3103FA14660A10CEC3356FBE584"><enum>(i)</enum><text>interfere with, restrain, or deny the exercise, or attempt to exercise, by any individual of any right, procedure, or remedy provided or protected under this subsection; or</text></clause><clause id="HBDC560546675481884DDE1B4E121CEC5"><enum>(ii)</enum><text>coerce or intimidate any individual regarding the exercise, or attempt to exercise, such right.</text></clause></subparagraph><subparagraph id="HD0EFAB33676B4A1EBBAA5337E69EBAFE"><enum>(B)</enum><header>Opposition to unlawful policies or practices</header><text display-inline="yes-display-inline">A nursing facility may not retaliate or discriminate against any individual for opposing any policy, practice, or action of the facility which is alleged to violate, breach, or fail to comply with any provision of the minimum nurse staffing requirements of clause (ii) of subsection (b)(4)(C).</text></subparagraph><subparagraph id="H6078942600D1448299188F0867C95152"><enum>(C)</enum><header>Prohibition on interference with protected communications</header><text>A nursing facility may not make, adopt, or enforce any rule, regulation, policy, or practice which in any manner directly or indirectly prohibits, impedes, or discourages a nurse from, or intimidates, coerces, or induces a nurse regarding, engaging in free speech activities or disclosing information as provided under this subsection.</text></subparagraph><subparagraph id="HE585F05F564F473393F5167AE71A9C3B"><enum>(D)</enum><header>Prohibition on interference with collective action</header><text>A nursing facility may not in any way interfere with the rights of nurses to organize, bargain collectively, and engage in concerted activity under section 7 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/157">29 U.S.C. 157</external-xref>).</text></subparagraph></paragraph><paragraph id="H56739DED68614FD1856AC4A711AA9F45"><enum>(9)</enum><header>Notice</header><text>A nursing facility shall post in an appropriate location in each unit a conspicuous notice, in a form specified by the Secretary, that—</text><subparagraph display-inline="no-display-inline" id="H30BAD90242304884854A9EDAC8226B69"><enum>(A)</enum><text>explains the rights of nurses, residents, and other individuals under this subsection;</text></subparagraph><subparagraph display-inline="no-display-inline" id="H2761E0FD68E84047BF9C9EF45D2A0B66"><enum>(B)</enum><text display-inline="yes-display-inline">includes a statement that a nurse, resident, or other individual may file a complaint with the Secretary against the facility for a violation of a requirement or a prohibition of this subsection; and</text></subparagraph><subparagraph display-inline="no-display-inline" id="H0249EE008F784624BF792619BC3C3AD6"><enum>(C)</enum><text>provides instructions on how to file such a complaint.</text></subparagraph></paragraph><paragraph id="H9C6846D49F56487C92C4F3F9E659CC00"><enum>(10)</enum><header>Enforcement</header><subparagraph id="H72AFF6599A154910B933221B22AA7C23"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall enforce the requirements and prohibitions of this subsection in accordance with this paragraph.</text></subparagraph><subparagraph id="H9C69B2F18659450B81A1BDF04A3C7F62"><enum>(B)</enum><header>Procedures for receiving and investigating complaints</header><text>The Secretary shall establish procedures under which—</text><clause display-inline="no-display-inline" id="H960D5E53FAD845859D01FDC4BE43AD99"><enum>(i)</enum><text>any individual may file a complaint alleging that a nursing facility has violated a requirement or a prohibition of this subsection; and</text></clause><clause display-inline="no-display-inline" id="HBB4BB369D6924B478E38BA3110E0C526"><enum>(ii)</enum><text>any such complaint shall be investigated by the Secretary.</text></clause></subparagraph><subparagraph id="H7E6CC1F79D8D414C90C8AD2D525FFA56"><enum>(C)</enum><header>Remedies</header><text>If the Secretary determines that a nursing facility has violated a requirement or prohibition of this subsection, the Secretary—</text><clause display-inline="no-display-inline" id="H6BE4561B3A2F408B8EE2234839A52CED"><enum>(i)</enum><text>shall require the facility to establish a corrective action plan to prevent the recurrence of such violation; and</text></clause><clause display-inline="no-display-inline" id="HC29F53ED416A4172A1F30F6961582DEE"><enum>(ii)</enum><text>may impose civil money penalties as described in subparagraph (D).</text></clause></subparagraph><subparagraph id="H453131F214B74CC6B5801A8318ACCE2C"><enum>(D)</enum><header>Civil penalties</header><clause id="H1CAC1587A2314E65B5F4257C5C09614F"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to any other penalties prescribed by law, the Secretary may impose civil penalties as follows:</text><subclause id="HA0E797578DEC4C23A98F0DF3241F906C"><enum>(I)</enum><header>Nursing facility liability</header><text>The Secretary may impose on a nursing facility found to be in violation of this subsection a civil money penalty of—</text><item display-inline="no-display-inline" id="H5B711E218046452981AEF6EAD26DA0FA"><enum>(aa)</enum><text>not more than $25,000 for the first knowing violation of this subsection by such facility; and</text></item><item id="HAF4FD03651ED48759023CAD9463FD894"><enum>(bb)</enum><text>not more than $50,000 for any subsequent knowing violation of this subsection by such facility.</text></item></subclause><subclause id="HB76A50E4B3DD4A229DC059A26C03516D"><enum>(II)</enum><header>Individual liability</header><text>The Secretary may impose on an individual who—</text><item display-inline="no-display-inline" id="H332F86DDAD074ABF8C62549AD258CCD7"><enum>(aa)</enum><text>is employed by a nursing facility; and</text></item><item id="HD1F59CF97A7244FC944FEDAC7FF56F31"><enum>(bb)</enum><text>is found by the Secretary to have knowingly violated this subsection on behalf of the facility,</text></item><continuation-text continuation-text-level="subclause">a civil money penalty of not more than $20,000 for each such violation by the individual.</continuation-text></subclause></clause><clause id="HB34A06024E264B14BBE8BFD64C79FCA8"><enum>(ii)</enum><header>Procedures</header><text display-inline="yes-display-inline">The provisions of section 1128A of the Social Security Act (other than subsections (a) and (b)) shall apply with respect to a civil money penalty or proceeding under this subparagraph in the same manner as such provisions apply with respect to a civil money penalty or proceeding under such section 1128A.</text></clause></subparagraph><subparagraph commented="no" id="HACF37B2CAEC145D8B69946D743D29237"><enum>(E)</enum><header>Public notice of violations</header><clause commented="no" id="HC339D92882B1446A82485486924D22FA"><enum>(i)</enum><header>Internet website</header><text display-inline="yes-display-inline">The Secretary shall publish on the internet website of the Department of Health and Human Services the names of nursing facilities on which a civil money penalty has been imposed under this subsection, the violation for which such penalty was imposed, and such additional information as the Secretary determines appropriate.</text></clause><clause commented="no" id="HBF27FB3862B646839006BF52E0D326D4"><enum>(ii)</enum><header>Change of ownership</header><text display-inline="yes-display-inline">With respect to a nursing facility that had a change of ownership, as determined by the Secretary, penalties imposed on the facility while under previous ownership shall no longer be published by the Secretary id="H34AEF44CF1E94CD18138E3310C08FEC8"><enum>(11)</enum><header>Nurse defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>nurse</term> means a registered professional nurse, a licensed practical nurse, and a nurse aide.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HAB129EF159EF49BFACAAC0A726B3FFE8"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section take effect on the date of enactment of this Act and shall apply with respect to objections to or refusals of work assignments, complaints, retaliations and other adverse actions, and interferences with rights that occur on or after the date that is one year after such date of enactment and with respect to notices provided on or after the date that is one year after such date of enactment.</text></subsection></section><section id="HAF8420E4340249D3A97A3B63B808C10E"><enum>7.</enum><header>Prohibiting pre-dispute arbitration agreements</header><subsection id="H685F1B8012F7460290308AFB3759CAEA"><enum>(a)</enum><header>Medicare</header><text>Section 1819(c) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(c)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAA92D2D0736A4464A985621080FF04CB"><paragraph id="H9EBAE352EFC44976BFE6AC9534F243E1"><enum>(7)</enum><header>Prohibition on use of pre-dispute arbitration agreements</header><subparagraph id="H4E938CAF097643D887A741E25F9AEFE1"><enum>(A)</enum><header>In general</header><text>A skilled nursing facility may not require, solicit, accept, or move to enforce a pre-dispute arbitration agreement from or on behalf of any resident, whether the agreement is made before, during, or after the resident’s admission to the facility, or from or on behalf of any employee, or contract employee of the facility, or any other individual if such individual is alleged to be engaged in conduct protected under subsection (k).</text></subparagraph><subparagraph id="H2D273FC83A0E498CA36174649C47EA71"><enum>(B)</enum><header>Application</header><text>This paragraph shall apply to the skilled nursing facility and to any other business or person providing or responsible for providing skilled nursing services to the resident.</text></subparagraph><subparagraph id="H9795C7344AE2447CBE388C30353CE7AB"><enum>(C)</enum><header>No validity or enforcement</header><text>A pre-dispute arbitration agreement shall not be valid or specifically enforceable against a resident or former resident of a skilled nursing facility, without regard to whether the agreement was made prior to or after the effective date of this paragraph.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA763FC8D87244E86AA5191012D278042"><enum>(D)</enum><header>Definition of pre-dispute arbitration agreement</header><text>In this paragraph, the term <term>pre-dispute arbitration agreement</term> means any agreement to arbitrate a dispute when the dispute has arisen after such agreement has been made.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9ED219D83A3E4529B7EA5D257A424B15"><enum>(E)</enum><header>Judicial review</header><text>A determination as to whether and how this paragraph applies to an arbitration agreement shall be determined under Federal law by a court of competent jurisdiction, rather than an arbitrator, without regard to whether the party opposing arbitration challenges such agreement specifically or in conjunction with any other term of the contract containing such agreement.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H34C49B64FABA480C8ABC6A894B01A3F2"><enum>(b)</enum><header>Medicaid</header><paragraph id="H1BEF18D7FCDC4867994433592BC123B0"><enum>(1)</enum><header>Home and community-based services and home health care services</header><text>Section 1915 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396n">42 U.S.C. 1396n</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAA21746ED4F34F6ABF0C2094F7891CDB"><subsection id="HFAF7DCAAD3F34FAE8E8A53B73A80E89C"><enum>(m)</enum><header>Prohibiting pre-Dispute arbitration agreements</header><paragraph id="H3CF05A2E8A054760BFD91BA194006214"><enum>(1)</enum><header>In general</header><text>For home and community-based services or home health care services provided under a waiver under this section, section 1902(a)(10)(D), or any other provision authorizing the provision of home and community-based services or home health care services under this title, the provider of such services (and any employee, agent, related entity, or affiliate of such provider) shall not require, solicit, or accept a pre-dispute arbitration agreement from or on behalf of any individual receiving such services, whether the agreement is made before, during, or after the first date on which services are received, or from or on behalf of any employee, or contract employee of the provider, or any other individual if such individual is alleged to be engaged in conduct protected under section 1919(k). A pre-dispute arbitration agreement between such a provider (or entity or person) and an individual receiving services (or who formerly received services) shall not be valid or enforceable, without regard to whether such agreement was made prior to the effective date of this subsection.</text></paragraph><paragraph id="H9988687B142546ECB3FAFFE9E562B12D"><enum>(2)</enum><header>Definition of pre-dispute arbitration agreement</header><text>The term <term>pre-dispute arbitration agreement</term> means any agreement to arbitrate a dispute when the dispute has arisen after such agreement has been made.</text></paragraph><paragraph id="HA24851A82B724B12BA73B20F10E6518B"><enum>(3)</enum><header>Judicial review</header><text>A determination as to whether and how this subsection applies to an arbitration agreement shall be determined under Federal law by a court of competent jurisdiction, rather than an arbitrator, without regard to whether the party opposing arbitration challenges such agreement specifically or in conjunction with any other term of the contract containing such agreement.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HE4FCDC2BE5E14512B6D19D4087A44DCB"><enum>(2)</enum><header>Nursing facilities</header><text>Section 1919(c) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(c)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H87E94C2D23AF4BEB83342152950F0C14"><paragraph id="HE1C3A10D59BF49E6ABDB7123E83DA7CC"><enum>8.</enum><header>Standardized protocol for obtaining informed consent from residents prior to prescribing psychotropic drugs</header><subsection commented="no" id="HACDD3FFDA8734675A6B1C9680E7521EF"><enum>(a)</enum><header>Standardized protocol</header><paragraph commented="no" id="H1E19ED0F2E0B41AD9F7241E6FFA88BEA"><enum>(1)</enum><header>Skilled nursing facilities</header><text>Section 1819(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(b)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H613BDDE945EB463AB9CACAB94DB727D7"><paragraph commented="no" id="HE4C8E2EE567848DFA6BF8BDB69A79E8B"><enum>(9)</enum><header>Standardized protocol for obtaining informed consent from a resident prior to prescribing psychotropic drugs for a use not approved by the Food and Drug Administration</header><subparagraph commented="no" id="H5AFD817D371E4570BB3C52334556817C"><enum>(A)</enum><header>Protocol</header><text display-inline="yes-display-inline">Not later than the date that is one year after the date of the enactment of this paragraph, the Secretary, taking into account the results of the study conducted by the Comptroller General of the United States under section 8(a)(3) of the <short-title>Quality Care for Nursing Home Residents Act</short-title> and in consultation with stakeholder groups (including residents of skilled nursing facilities, family members of such residents, advocates for such residents, long-term care ombudsmen, and providers), shall develop a standardized protocol for skilled nursing facilities to obtain written informed consent, in accordance with this paragraph, from a resident (or, if applicable, the resident’s designated health care agent or other surrogate under State law or regulation) prior to prescribing a psychotropic drug to the resident for a use not approved by the Food and Drug Administration.</text></subparagraph><subparagraph commented="no" id="H1110E22839764DF99F54CB43EDB073A5"><enum>(B)</enum><header>Requirements</header><text>The standardized protocol developed under subparagraph (A) shall include the following:</text><clause commented="no" id="H9066106E7B284C4BA8C15EFCFE39034A"><enum>(i)</enum><text>A requirement, with respect to a resident, that—</text><subclause commented="no" id="HFA8BCCF077E94CABB112489843E724EA"><enum>(I)</enum><text>the facility, with the involvement of the prescriber, inform the resident (or, if applicable, the resident’s designated health care agent or other surrogate under State law or regulation) of—</text><item commented="no" id="H48684CA7C005499E9148D3B20D663CB3"><enum>(aa)</enum><text display-inline="yes-display-inline">possible side effects and risks associated with the psychotropic drug, including the mention of any <quote>black box warning</quote>;</text></item><item commented="no" id="H4EBB227BC133488E883EC7043E6BFE8F"><enum>(bb)</enum><text display-inline="yes-display-inline">treatment modalities that were attempted prior to the use of the psychotropic drug; and</text></item><item commented="no" id="H68713AAB371D44F6B2B34BF49DBA234E"><enum>(cc)</enum><text>any other information the Secretary determines appropriate;</text></item></subclause><subclause commented="no" id="H26E3F3434B734766A30AB145624CC701"><enum>(II)</enum><text display-inline="yes-display-inline">the resident (or, if applicable, the resident’s designated health care agent or other surrogate under State law or regulation) provide written informed consent to the administration of the psychotropic drug; and</text></subclause><subclause commented="no" id="HFE356DA780FB404398CC1F6C0AACDDD6"><enum>(III)</enum><text display-inline="yes-display-inline">the administration of the psychotropic drug is in accordance with any plan of care that the resident has in place, including non-pharmacological interventions as appropriate that can effectively address underlying medical and environmental causes of behavioral disorders.</text></subclause></clause><clause commented="no" id="HC7C22A0D99A44728BB15D891076E8BF5"><enum>(ii)</enum><text>An alternative protocol for obtaining such written informed consent—</text><subclause commented="no" id="H389877BB87E2414DBD032BAADE6A7A4B"><enum>(I)</enum><text>in the case of emergencies; and</text></subclause><subclause commented="no" id="H10A1892FB0FA45148D4066322CD62803"><enum>(II)</enum><text>in the absence of a clearly identified designated health care agent or other surrogate under State law or regulation.</text></subclause></clause><clause commented="no" id="H0FCEC391197F406691BD7DFDB445926F"><enum>(iii)</enum><text>Other items determined appropriate by the Secretary.</text></clause></subparagraph><subparagraph commented="no" id="HA3D28DF82F1D4A90B96B71D406146724"><enum>(C)</enum><header>Timing of informed consent</header><text display-inline="yes-display-inline">Under the standardized protocol, a skilled nursing facility shall obtain the written informed consent described in subparagraph (A), with respect to a psychotropic drug and a resident of the facility—</text><clause commented="no" id="H3BB6D3E6094B41128537BE24BF7A9ADD"><enum>(i)</enum><text display-inline="yes-display-inline">prior to the initial prescribing of such psychotropic drug to such resident if such resident does not have a current prescription for such psychotropic drug at the time such resident is admitted to the facility; and</text></clause><clause commented="no" id="H7B7F99C57A2647E385E3ECE10F3FAEE0"><enum>(ii)</enum><text display-inline="yes-display-inline">at least once a month to the extent that the administration of such psychotropic drug to such resident is in accordance with the plan of care that the resident has in place.</text></clause></subparagraph><subparagraph commented="no" id="H1DC8027E8409413D850B841B7F4DAB38"><enum>(D)</enum><header>Compliance</header><text>Effective beginning on the date that is one year and 180 days after the date of the enactment of this paragraph, a skilled nursing facility shall comply with the standardized protocol developed under subparagraph (A).</text></subparagraph><subparagraph commented="no" id="H3BF4EBD1E4684C9296473832F4C7D7A0"><enum>(E)</enum><header>No preemption</header><text>Nothing in this paragraph shall preempt any provision of State or Federal law that provides broader rights with respect to written informed consent for residents of facilities.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="HC6B7976FE72E4E769FB309F4AFB400B8"><enum>(2)</enum><header>Nursing facilities</header><text>Section 1919(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(b)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H155154127F744D00BA6A88C7EA2FA2D8"><paragraph commented="no" id="H1F831278B8C94FF7A378984944B9EE43"><enum>(9)</enum><header>Standardized protocol for obtaining informed consent from a resident prior to prescribing psychotropic drugs for a use not approved by the Food and Drug Administration</header><subparagraph commented="no" id="HB0416315EE3549F3BEE6081B4A43A2DB"><enum>(A)</enum><header>Protocol</header><text display-inline="yes-display-inline">Not later than the date that is one year after the date of the enactment of this paragraph, the Secretary, taking into account the results of the study conducted by the Comptroller General of the United States under section 8(a)(3) of the <short-title>Quality Care for Nursing Home Residents Act</short-title> and in consultation with stakeholder groups (including residents of skilled nursing facilities, family members of such residents, advocates for such residents, and Drug Administration.</text></subparagraph><subparagraph commented="no" id="H438AA9693B524EE498343BFFACD044DC"><enum>(B)</enum><header>Requirements</header><text>The standardized protocol developed under subparagraph (A) shall include the following:</text><clause commented="no" id="H8813BB956FFF4BFD8CD2EBC6C747D081"><enum>(i)</enum><text>A requirement, with respect to a resident, that—</text><subclause commented="no" id="H0F9885778C8347069A190D58C9907FEA"><enum>(I)</enum><text>the facility, with the involvement of the prescriber, inform the resident (or, if applicable, the resident’s designated health care agent or other surrogate under State law or regulation) of—</text><item commented="no" id="H0E4F41361F444F92A66B8A4CAEFCEAC5"><enum>(aa)</enum><text display-inline="yes-display-inline">possible side effects and risks associated with the psychotropic drug, including the mention of any <quote>black box warning</quote>;</text></item><item commented="no" id="H26B4FDF5A73D40A19772436C2EAF1D19"><enum>(bb)</enum><text display-inline="yes-display-inline">treatment modalities that were attempted prior to the use of the psychotropic drug; and</text></item><item commented="no" id="H847E525A448E49B0BB7F398091413B7B"><enum>(cc)</enum><text>any other information the Secretary determines appropriate;</text></item></subclause><subclause commented="no" id="H83993F322B4F4B4B9DC0295EA04092AE"><enum>(II)</enum><text display-inline="yes-display-inline">the resident (or, if applicable, the resident’s designated health care agent or other surrogate under State law or regulation) provide written informed consent to the administration of the psychotropic drug; and</text></subclause><subclause commented="no" id="H81DA459190204E5B926908629A39F7D3"><enum>(III)</enum><text display-inline="yes-display-inline">the administration of the psychotropic drug is in accordance with any plan of care that the resident has in place, including non-pharmacological interventions as appropriate that can effectively address underlying medical and environmental causes of behavioral disorders.</text></subclause></clause><clause commented="no" id="H3CC8E74135AC4F488039A077873108CB"><enum>(ii)</enum><text>An alternative protocol for obtaining such written informed consent—</text><subclause commented="no" id="H6BF9600E9A2A468797C1C96A24384FAE"><enum>(I)</enum><text>in the case of emergencies; and</text></subclause><subclause commented="no" id="HCD86359BAF1D4FE8B7F73F3F4D50C297"><enum>(II)</enum><text>in the absence of a clearly identified designated health care agent or other surrogate under State law or regulation.</text></subclause></clause><clause commented="no" id="H377725458D8A4EE98413C7527F3233BD"><enum>(iii)</enum><text>Other items determined appropriate by the Secretary.</text></clause></subparagraph><subparagraph commented="no" id="H1B5DD317440349FF97427AC3C54D62AA"><enum>(C)</enum><header>Timing of informed consent</header><text display-inline="yes-display-inline">Under the standardized protocol, a nursing facility shall obtain the written informed consent described in subparagraph (A), with respect to a psychotropic drug and a resident of the facility—</text><clause commented="no" id="H4F56E0AC8BE04122BB4231A3E84942D6"><enum>(i)</enum><text display-inline="yes-display-inline">prior to the initial prescribing of such psychotropic drug to such resident if such resident does not have a current prescription for such psychotropic drug at the time such resident is admitted to the facility; and</text></clause><clause commented="no" id="H6E5AD5DC61D047B09158903687126CDD"><enum>(ii)</enum><text display-inline="yes-display-inline">at least once a month to the extent that the administration of such psychotropic drug to such resident is in accordance with the plan of care that the resident has in place.</text></clause></subparagraph><subparagraph commented="no" id="H3DD6A5C5754040FAA0E8ED69A7F64DC3"><enum>(D)</enum><header>Compliance</header><text>Effective beginning on the date that is one year and 180 days after the date of the enactment of this paragraph, a nursing facility shall comply with the standardized protocol developed under subparagraph (A).</text></subparagraph><subparagraph commented="no" id="HCEFA9AEDAF0B4F52B51727C5DB9E853B"><enum>(E)</enum><header>No preemption</header><text>Nothing in this paragraph shall preempt any provision of State or Federal law that provides broader rights with respect to written informed consent for residents of facilities.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="HDC6107D33E1940ED87D16A2236A312AE"><enum>(3)</enum><header>GAO study and report on informed consent laws with respect to prescribing of psychotropic drugs</header><subparagraph commented="no" id="H2EF9681216ED410E9F05CFF992E59E8C"><enum>(A)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General of the United States (in this paragraph referred to as the <quote>Comptroller General</quote>) shall conduct a study of State laws and regulations concerning informed consent with respect to the administration of a psychotropic drug with regard to the effectiveness of such laws and practices in changing the frequency of prescribing of psychotropic drugs to older adults. The study shall include an analysis as to whether in the case of States that have not enacted such informed consent laws, such States have developed other mechanisms to guide appropriate prescribing of psychotropic drugs in older adults with dementia.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4B0858DD707B4D72962B13C75A71576A"><enum>(B)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this Act, the Comptroller General shall submit to the Secretary of Health and Human Services, the Committees on Energy and Commerce and Ways and Means of the House of Representatives, and the Committee on Finance of the Senate a report containing the results of the study conducted under subparagraph (A), together with such recommendations as the Comptroller General determines appropriate.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H8F236B2C33CA4882A2096C62A7E4EA42"><enum>(b)</enum><header>Development of measure of utilization of psychotropic drugs for inclusion on Nursing Home Compare website</header><paragraph commented="no" id="H94C641E382494640A600C5C94421AB5B"><enum>(1)</enum><header>Medicare</header><text>Section 1819(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(i)</external-xref>) is amended—</text><subparagraph commented="no" id="HB969CE5721DF46DDB2A44FB735292D4F"><enum>(A)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text></subparagraph><subparagraph commented="no" id="HC2D6B3A3866E4C9E942CA48BA196710F"><enum>(B)</enum><text>by inserting after paragraph (2) the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6CB6EC5781294451A4187D6AC4AD57BA"><paragraph commented="no" id="H91C1F6AFF37846CE9DB0261820880AE0"><enum>(3)</enum><header>Development of measure of utilization of psychotropic drugs</header><subparagraph commented="no" id="H6793EF7DE622473081366E1277C98324"><enum>(A)</enum><header>In general</header><text>Not later than the date that is one year after the date of the enactment of this paragraph, the Secretary shall include a measure of the utilization of psychotropic drugs for each skilled nursing facility for inclusion on such website (or a successor website) as part of the quality measures or health inspections measures, or both such measures, under the Five-Star Quality Rating System established by the Administrator of the Centers for Medicare &amp; Medicaid Services.</text></subparagraph><subparagraph commented="no" id="H6716E8F9138C409490CA352EC4866E60"><enum>(B)</enum><header>Considerations</header><text>In developing the measure under subparagraph (A), the Secretary shall take into account special patient populations, special care units, appropriate diagnoses, and other factors, as determined appropriate by the Secretary.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="HD5B0C57F584E4EF5AAD3A634E2393DBC"><enum>(2)</enum><header>Medicaid</header><text>Section 1919(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(i)</external-xref>) is amended—</text><subparagraph commented="no" id="H6B21FEBEBDF348F99599B828FFD304F3"><enum>(A)</enum><text>by redesignating paragraph (3) as paragraph (4);
