<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3152</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211103">November 3, 2021</action-date><action-desc><sponsor name-id="S317">Mr. Barrasso</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Energy Policy Act of 2005 to disqualify certain borrowers from receiving a guarantee for a project, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HC28AF5B503B741D597BBFD35EA7EC0D8"><section section-type="section-one" id="H2A07358D0E574B73A05BF650ACB9A50A"><enum>1.</enum><header>Disqualification of borrowers who have previously defaulted</header><subsection id="id9A927895ECFA45429D1DF64A164A08E6"><enum>(a)</enum><header>Incentives for innovative technologies</header><text display-inline="yes-display-inline">Section 1702 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16512">42 U.S.C. 16512</external-xref>) is amended—</text><paragraph id="id929ECE9F34D54F61A5DCDC1887391F42"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (i) through (q) as subsections (j) through (r), respectively; and</text></paragraph><paragraph id="id175ADEA4674647AA9DEC44FFE4219889"><enum>(2)</enum><text>by inserting after subsection (h) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H58FBE87746A34431A7E13F79005D2980"><subsection id="HF12D85F5077144ABB95EADEA297FBB31"><enum>(i)</enum><header>Disqualification for previous defaults</header><text display-inline="yes-display-inline">The Secretary may not make a guarantee under this title for a project if the borrower has previously defaulted on an obligation guaranteed under this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idf488e856ccf94dafb82d4f57457a685e"><enum>(b)</enum><header>Advanced technology vehicles manufacturing incentive program</header><text>Section 136(d) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17013">42 U.S.C. 17013(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3e3f2e9832fa4252ae297a71a82ee964"><paragraph id="id30a152a955f643ddbc09a8380153caee"><enum>(5)</enum><header>Disqualification for previous defaults</header><text>The Secretary may not provide a loan under this subsection to an applicant for the loan if the applicant has previously defaulted on a loan provided under this subsection.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
