which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Food and Nutrition Act of 2008 to expand online benefit redemption options under the supplemental nutrition assistance program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding SNAP Options Act of 2021</short-title></quote>.</text></section><section id="id61d64b3b34d74e1d89f98c705fd307ba"><enum>2.</enum><header>Online portal for SNAP benefit redemption</header><text display-inline="no-display-inline">Section 7(h)(14) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2016">7 U.S.C. 2016(h)(14)</external-xref>) is amended—</text><paragraph id="id73EA1591774F4654A61AD3A6A6FF5CEB"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>Subject to subparagraph (B), the</quote> and inserting <quote>The</quote>; and</text></paragraph><paragraph id="id4AE8742AB8ED48088C5F607EBA6F670F"><enum>(2)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id113E1ED6453D4689827C525C21F6EEE1"><subparagraph id="id5A538670D6CA40B880E180E3370F36E4"><enum>(B)</enum><header>EBT online redemption portal</header><clause id="id6234392AA5BE46A2809CC3955CB405E0"><enum>(i)</enum><header>Purpose</header><text>The purpose of this subparagraph is to expand options for and access to food for eligible households by making the online redemption of program benefits, including the acceptance of EBT cards, more widely available to grocery stores, small retailers, and farmers who face barriers in implementing their own online payment portals. </text></clause><clause id="id360b4b9a2fbe4281ac4312fb0d162f36"><enum>(ii)</enum><header>Contracts</header><text>Not later than 180 days after the date of enactment of the <short-title>Expanding SNAP Options Act of 2021</short-title>, the Secretary shall award on a competitive basis 1 or more contracts to 1 or more eligible entities described in clause (iii) to develop an online portal, to be known as the <quote>EBT Online Redemption Portal</quote>—</text><subclause id="id2AD091CB8847467EB72E04684CDB5504"><enum>(I)</enum><text>to allow program participants to use online or mobile electronic benefits transactions, including through the acceptance of EBT cards, to purchase program foods from, and make online payments to, authorized program retailers under the supplemental nutrition assistance program; and</text></subclause><subclause id="idC15F112A03C74F96B4EA2B2285176377"><enum>(II)</enum><text>to facilitate food purchase delivery for program participants using the transactions described in subclause (I).</text></subclause></clause><clause id="id8e78614f2d6b4e3884048cb19644a60a"><enum>(iii)</enum><header>Eligible entity</header><text>An eligible entity referred to in clause (ii) is any for-profit or nonprofit entity with demonstrable expertise in the development, operation, or maintenance of electronic payment systems (including systems with advanced security protocols), which may include expertise in benefits management or administration of State systems, as determined by the Secretary.</text></clause><clause id="id94D8C008B2324D46B9F82D625EE3BF05"><enum>(iv)</enum><header>Application; portal features</header><subclause id="id3461c72895714f7287474057eee0553a"><enum>(I)</enum><header>Application</header><text>An eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including—</text><item id="idA5323325073F49A3A78C5394B01B234D"><enum>(aa)</enum><text>a description of how the eligible entity plans to implement the requirements described in clause (v); and</text></item><item id="id7E0A53DFDF3641A58A5831E3D63BC070"><enum>(bb)</enum><text>a beta plan that has been user-tested.</text></item></subclause><subclause id="id9c206e0b47aa4e6ea4140a48ba30f546"><enum>(II)</enum><header>Portal features</header><text>In awarding a contract to an eligible entity under clause (ii), the Secretary shall give preference to an eligible entity that demonstrates an ability to implement the following features of an EBT Online Redemption Portal: </text><item id="id9e5362d2fb3645018952881e00ec0949"><enum>(aa)</enum><text>Client-facing technology with a primary preference for mobile device or smartphone application.</text></item><item id="id3e158ac95a90494b8d57f7e87d3cb7f7"><enum>(bb)</enum><text>Fail-safe systems to maintain privacy and online security of data.</text></item><item id="id1f7eb624ab284cc6976a5be56b0ce863"><enum>(cc)</enum><text>Ability to redirect a consumer to an existing online platform of a vendor, if applicable. </text></item><item id="ida44962c455b94564b80c054f34836b71"><enum>(dd)</enum><text>Ability to update as technologies evolve.</text></item><item id="id604de515f1d044ee9790fbf27399fb35"><enum>(ee)</enum><text>Ease of operation for program participants, including multilingual functionality.</text></item><item id="id1cc93c2e66a34978b8cb55c2357c4803"><enum>(ff)</enum><text>Interoperability with delivery technologies and interfaces.</text></item><item id="idd6cd169e601d41769a7adae913c53154"><enum>(gg)</enum><text>Identification of participating retailers within geographic proximity to the user.</text></item><item id="id116a4965c285467ea76827706c7fa37d"><enum>(hh)</enum><text>Ability to perform single transactions using mixed tender, including a single transaction for eligible food items using an EBT card and noneligible items using another form of payment. </text></item><item id="id8a9589dacd4040429338b99d23ddf3e2"><enum>(ii)</enum><text>Adherence to a comprehensive business continuity and disaster recovery plan—</text><subitem id="idCC86D07CF73949AFA5245778CD69DDD6"><enum>(AA)</enum><text>to allow the portal to recover from any interruption of service; and </text></subitem><subitem id="id0780248D685E4683B0F3E691BB94BC48"><enum>(BB)</enum><text>that includes sufficient back-up systems, equipment, facilities, and trained personnel to implement the plan. </text></subitem></item></subclause></clause><clause id="id3a281c632800409d82bb0979aca987db"><enum>(v)</enum><header>Requirements</header><subclause id="id5127FF9163F3418081CBB746C9A7482A"><enum>(I)</enum><header>In general</header><text>The Online EBT Redemption Portal developed by the eligible entity awarded the contract under clause (ii) shall—</text><item id="ide2ec5fa5433641cf84d69316c487fbaf"><enum>(aa)</enum><text>enable the integrated processing of an online EBT transaction by providing a platform and facilitating the purchasing interaction between the consumer, retailer, third-party processors (for EBT card processing and the secure online entry of a personal identification number), and delivery vendor, as applicable;</text></item><item id="id21aea95c2a3a41e992a9d2be085dd6e0"><enum>(bb)</enum><text>to deter fraud, have in place for program participants privacy and security protections, similar to protections provided under existing electronic benefit transfer methods, including entry of a personal identification number in a manner that complies with the guidelines of leading national consensus standards organizations, as determined by the Secretary, for encrypting personal identification number entry; </text></item><item id="ide116295a5835469eb50002e8d20271e0"><enum>(cc)</enum><text>be secure and operate in a manner that maintains program integrity, including food item eligibility; </text></item><item id="idfc6929ca367041299099663162f9db05"><enum>(dd)</enum><text>be available in an initial or beta version not later than 120 days after the date on which the eligible entity is awarded the contract;</text></item><item id="id9aeab93b3f9041cbb5faa242dae936d7"><enum>(ee)</enum><text>be ready to be fully deployed in all States not later than 180 days after the date described in item (dd); </text></item><item id="idc0df908a9bff47ad94b2daad8ebf5332"><enum>(ff)</enum><text>be available for use by any retail food store or wholesale food concern authorized under section 9 to accept and redeem benefits under the supplemental nutrition assistance program— </text><subitem id="idE3ED0FD3866F483A94E9E4D8F28EDC7D"><enum>(AA)</enum><text>at no charge beyond a nominal fee that is not more than reasonably necessary to support maintenance of the portal and subject to the approval of the Secretary; and</text></subitem><subitem id="id2d4cad54428d4048861ee80685527bc2"><enum>(BB)</enum><text>on an application-based and browser-based platform for smartphones and a browser-based online platform for tablets and computers;</text></subitem></item><item id="id82b56d8273804ff2bfd7fee9d3b2ad4e"><enum>(gg)</enum><text>adhere to commercial standards for service level availability to ensure the viability of the portal and the use of the portal by retail food stores and wholesale food concerns authorized under section 9 to accept and redeem benefits under the supplemental nutrition assistance program; and</text></item><item id="idb9ff433caa0e4b8d8b1ab715810b511e"><enum>(hh)</enum><text>perform ongoing maintenance services and retailer enrollment and termination of enrollment activities to ensure continuous operability of the portal.</text></item></subclause><subclause commented="no" id="id82169C03AAA745549D6F9E62C22DFE09"><enum>(II)</enum><header>Evaluation of beta version</header><text>The Secretary shall conduct a review of the initial or beta version of the Online EBT Redemption Portal under subclause (I)(dd), including by soliciting feedback from program participants.</text></subclause></clause><clause id="id3ce65820a0a24fbb800ee30d904ea0dc"><enum>(vi)</enum><header>Report to Congress</header><text>Not later than 240 days after the date of enactment of the <short-title>Expanding SNAP Options Act of 2021</short-title>, the Secretary shall submit to Congress a report on the status of activities carried out under this subparagraph.</text></clause><clause commented="no" display-inline="no-display-inline" id="id46d559a34d464f51b412c6c53da6c1f6"><enum>(vii)</enum><header>Authorization of appropriations</header><text>There is appropriated to the Secretary, out of funds of the Treasury not otherwise appropriated, $25,000,000 to provide under the contract described in clause (ii).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id5ae8398807434490b9ba0fba98d211f1"><enum>3.</enum><header>Broad acceptance of SNAP benefits through online transactions</header><text display-inline="no-display-inline">Section 7(k) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2016">7 U.S.C. 2016(k)</external-xref>) is amended—</text><paragraph id="idF37987B2691A4D4487554C0AC6260EB2"><enum>(1)</enum><text>by striking <quote>on-line</quote> each place it appears and inserting <quote>online</quote>;</text></paragraph><paragraph id="id3F1F9DD49CEE43208144DB57877ABFC1"><enum>(2)</enum><text>in paragraph (1)—</text><subparagraph id="id11A6FA459D754FF4BBCA38DACB5C46CD"><enum>(A)</enum><text>by striking <quote>Subject to paragraph (4), the</quote> and inserting <quote>The</quote>; and</text></subparagraph><subparagraph id="id3A8C2A2C0BF94FE994103448A77E784B"><enum>(B)</enum><text>by inserting <quote>in any State</quote> after <quote>stores</quote>; and</text></subparagraph></paragraph><paragraph id="id3A6E7C21038F4C1ABF98DA75F015EF23"><enum>(3)</enum><text>by striking paragraph (4) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4CA60DE82AF543B68E37F03024EC22F8"><paragraph id="id0b853496945a4a33b206d5a76bf1ea27"><enum>(4)</enum><header>Technical assistance</header><subparagraph id="id87AD23710CAD41CCAF8A0D567FFAE981"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="idF3B3B905ABDA45F3823B0F8318C8E7F1"><enum>(i)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means a public or private nonprofit entity.</text></clause><clause id="id2D6B64FB39534D94849F7F3AFEA61E47"><enum>(ii)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a retail food store or wholesale food concern authorized under section 9 to accept and redeem benefits under the supplemental nutrition assistance program.</text></clause></subparagraph><subparagraph id="id585e1b92035e4189adaa60a55798780a"><enum>(B)</enum><header>Technical assistance center</header><text>The Secretary, acting through the Administrator of the Food and Nutrition Service, shall, on a competitive basis, award 1 or more grants to, or enter into 1 or more cooperative agreements with, 1 or more covered entities to establish a technical assistance center, to be known as the <quote>SNAP Online Purchasing Technical Assistance Center</quote>, to provide—</text><clause id="idEF56A0B384AA4AD997915E70B0AB187F"><enum>(i)</enum><text>to State agencies, eligible entities, and program participants information on and technical assistance with, as applicable—</text><subclause id="idF4F7D772E3AF4941953781A414BF67F6"><enum>(I)</enum><text>accepting program benefits through online transactions;</text></subclause><subclause commented="no" id="id3A71650689844C2A96EC85529ABA9C6D"><enum>(II)</enum><text>using the EBT Online Redemption Portal described in subsection (h)(14)(B);</text></subclause><subclause id="id141ebd34a39b44cab2224b516324333d"><enum>(III)</enum><text>in the case of State agencies, conducting outreach to eligible entities to ensure that those eligible entities are informed of the technical assistance provided by the center; </text></subclause><subclause id="id8B68BEA8DED14D4C913979A2C15E8D8C"><enum>(IV)</enum><text>research, training, and best practices relating to redeeming program benefits through online transactions; and</text></subclause><subclause id="id83fc4a32001d40b2bc42d8a73be35755"><enum>(V)</enum><text>facilitating communication between eligible entities, applicable State agencies, and the Department of Agriculture; and</text></subclause></clause><clause id="idc05914ae2c204a4bbdda292ef5ca0441"><enum>(ii)</enum><text>to eligible entities direct grants to defray the technological costs of carrying out the activities described in subclauses (I) and (II) of clause (i).</text></clause></subparagraph><subparagraph id="id5689162f10e948f5aca543d434bb378e"><enum>(C)</enum><header>Qualifications</header><text>At least 1 covered entity that receives a grant or enters into a cooperative agreement under subparagraph (B) shall have expertise in providing technical assistance to food retailers operating under a Federal nutrition program. </text></subparagraph><subparagraph id="id37C9B267AC604335A6486CB5C5FD45D0"><enum>(D)</enum><header>Technical assistance priority</header><text>In providing technical assistance to eligible entities, the SNAP Online Purchasing Technical Assistance Center shall give priority to eligible entities that are small and limited-resource retailers. </text></subparagraph><subparagraph id="id101b3bc6a25f48bb8968b3b1ca1b9ac4"><enum>(E)</enum><header>Funding</header><text>There is appropriated to the Secretary, out of funds of the Treasury not otherwise appropriated, $75,000,000 to carry out this paragraph, to remain available until expended, of which not more than 3 percent may be used by the Secretary for administrative expenses.</text></subparagraph></paragraph><paragraph commented="no" id="idff997601833d4004b99dfff0a56a5fbf"><enum>(5)</enum><header>Publication of online vendors</header><text>The Secretary shall maintain on the website of the Department of Agriculture a publicly available listing, organized and searchable by region, locality, and State, of all approved retail food stores accepting benefits from recipients of supplemental nutrition assistance, including through online transactions.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
