which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/13/7">chapter 7</external-xref> of title 13, United States Code, to prohibit certain deceptive practices in relation to a census, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H555AE48170D849F994FD97EB8B5E5910"><section commented="no" section-type="section-one" id="H182BF05DF7D14C42A1B9133EE92DA655"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Honest Census Communications Act</short-title></quote>.</text></section><section id="H038275B93272458F9EC1D498EED5C514"><enum>2.</enum><header>Prohibition on deceptive practices relating to census</header><subsection id="HD861F0E58D9B4B46BA0A13953A101492"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/13/7">Chapter 7</external-xref> of title 13, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H1B6E289C379342A498034D788132938F"><subchapter id="H9B42BFCAE86D4067B7FCBB8790F2B811"><enum>IV</enum><header>Deceptive Practices</header><section id="HAE406D619D0643C5975E2D58ADB9B923"><enum>251.</enum><header>Prohibition on deceptive practices</header><subsection id="idA8B8B7138F444BBAA81F644D52690A04"><enum>(a)</enum><header>Definitions</header><text>In this section— </text><paragraph id="idAB0326779EA34FF88D643EBDA52D5C70"><enum>(1)</enum><text>the term <term>census</term> means any census under this title, including the decennial census of population; </text></paragraph><paragraph id="id452F9136DE044023963EC29462DFF92A"><enum>(2)</enum><text>the term <term>census-related information</term> means any information regarding—</text><subparagraph id="H79B85A9D28114D8D8D5BCC8DF7C4014D"><enum>(A)</enum><text display-inline="yes-display-inline">the time, place, or manner of holding any census; or</text></subparagraph><subparagraph id="H55BA8DC1ACCF4029A2931858835369D9"><enum>(B)</enum><text display-inline="yes-display-inline">the qualifications for, or restrictions on, participation in any census; and</text></subparagraph></paragraph><paragraph id="id31FCBCFECD7548519769C06DF9E5ABEA"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>covered communication</term> means any—</text><subparagraph id="idF5589D6C617A45F2816435915438CE3E"><enum>(A)</enum><text display-inline="yes-display-inline">written communication; </text></subparagraph><subparagraph id="id41EEF7D92DB849E7BDDA50EAC3E7DFFF"><enum>(B)</enum><text display-inline="yes-display-inline">electronic or digital communication, including a communication through a website, application, online forum, social media platform, streaming service, or other means of communications using the internet or a similar communications network; or </text></subparagraph><subparagraph id="id628229219F2D464C9CB4C57335B27BDC"><enum>(C)</enum><text display-inline="yes-display-inline">telephonic communication, including any phone call, text message, or other communication sent, received, or transmitted using a wireless or wireline phone or a cellular or other phone network.</text></subparagraph></paragraph></subsection><subsection id="HDD381BFAA35B48B4ADA9FEFFC981B626"><enum>(b)</enum><header>Prohibition</header><text display-inline="yes-display-inline">It shall be unlawful for any person, whether acting under color of law or otherwise, to communicate or cause to be communicated any census-related information by any means, including by means of any covered communication, or to produce any census-related information with the intent that the census-related information be communicated—</text><paragraph id="H2C9ED3BAD3C749CBA8EF6E99DD24BDEC"><enum>(1)</enum><text display-inline="yes-display-inline">knowing the census-related information to be materially false; and</text></paragraph><paragraph id="H8839A6C5E26148988F83D986BB254E66"><enum>(2)</enum><text display-inline="yes-display-inline">with the intent to impede or prevent another person from participating in any census.</text></paragraph></subsection><subsection id="H6B50A5CB8B374AC89A65B38E6A037578"><enum>(c)</enum><header>Criminal penalties</header><text display-inline="yes-display-inline">Any individual who violates subsection (b) shall be fined in the amount equal to the maximum penalty provided under subsection (d), imprisoned for not more than 5 years, or both.</text></subsection><subsection id="H342D4D93C3C948FF9234FBDC87F8BAEE"><enum>(d)</enum><header>Civil penalties</header><text display-inline="yes-display-inline">A civil penalty of not more than $11,181 may be assessed against any individual who violates subsection (b).</text></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H4C16CC69F4B64315AF8B260DB11D84F4"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/13/7">chapter 7</external-xref> of title 13, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HCED8085C99714B6482B0A9909BB2A823"><toc regeneration="no-regeneration"><toc-entry level="subchapter">Subchapter IV—Deceptive Practices </toc-entry><toc-entry level="section">251.
