Dutch Salmon Greater Gila Wild and Scenic River Act</short-title></quote>.</text></section><section id="id4AD135CE33394EBD88763E955837D36E"><enum>2.</enum><header>Designation of wild and scenic rivers</header><subsection id="id027b0b514eed497bb2b2092f121e9258"><enum>(a)</enum><header>Findings</header><text>Congress finds that— </text><paragraph id="idc14ee95c5b3848a98d93cb12bb5cf07a"><enum>(1)</enum><text>the Greater Gila River watershed and other rivers in the Gila National Forest are cherished by the people of the State of New Mexico and visitors from across the United States for their clean water, outstanding fish and wildlife habitat, low-cost recreational opportunities for local communities, and cultural sites;</text></paragraph><paragraph id="idf5bfbea64f5c468fbc0d7f895b9124b1"><enum>(2)</enum><text>the Greater Gila River watershed supports many important economic activities in the region, including farming, ranching, hunting, fishing, camping, backpacking, hiking, wildlife viewing, horseback riding, and floating; </text></paragraph><paragraph id="id98c7566c7915467382d93eba4303442c"><enum>(3)</enum><text>portions of the Greater Gila River watershed and other rivers in the Gila National Forest—</text><subparagraph id="id798f95431304412f92e6241a5dbd679f"><enum>(A)</enum><text>are a national treasure deserving of inclusion in the National Wild and Scenic Rivers System;</text></subparagraph><subparagraph id="id55a926e514d94388b3531a97a4bec119"><enum>(B)</enum><text>possess numerous outstandingly remarkable values; and</text></subparagraph><subparagraph id="idf63c4b8d9d414f88961b4aadaa599b66"><enum>(C)</enum><text>contain segments that merit the high level of protection provided by the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1271">16 U.S.C. 1271 et seq.</external-xref>) to maintain the benefits provided by the Greater Gila River watershed and other rivers in the Gila National Forest for future generations of people in the State of New Mexico to enjoy; and</text></subparagraph></paragraph><paragraph id="id76b44f101312459596ecf098fce77df4"><enum>(4)</enum><text>wild and scenic river designations—</text><subparagraph id="id66EC37C5AFE4406BA7626FA599538AAF"><enum>(A)</enum><text>recognize the importance of maintaining the values of the segments; </text></subparagraph><subparagraph id="id8fe515803535453f976ff2f27897f0ce"><enum>(B)</enum><text>are compatible with traditional values and cultural uses important to rural communities; </text></subparagraph><subparagraph id="idC3FC1017D3514AA08094B01AA6E6D3C6"><enum>(C)</enum><text>provide multiple benefits to the local community and beyond, including by—</text><clause id="id7be2af864e274e63adea60281b9c9a9f"><enum>(i)</enum><text>focusing management on river and river-related resources and values, including supporting voluntary management on adjacent non-Federal land;</text></clause><clause id="iddda6785408d345fe860273385bad9da7"><enum>(ii)</enum><text>protecting rivers in a manner complementary to the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), as contemplated under section 10(b) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1281">16 U.S.C. 1281(b)</external-xref>);</text></clause><clause id="id9f9b8ce394de477e8d67dd7bf7cbbe12"><enum>(iii)</enum><text>preserving and enhancing public access, including for the legal use of off-highway vehicles, while not opening private land to public access;</text></clause><clause id="id0837cc92f53641fe9503ab27b3a46825"><enum>(iv)</enum><text>preserving and enhancing the protection of cultural artifacts and Tribal sacred and ceremonial sites;</text></clause><clause id="id068799213fbf4160aa3b49d7a7c0b21f"><enum>(v)</enum><text>preserving and enhancing recreational opportunities;</text></clause><clause id="id61157c937c8a426faac11f755b9ee797"><enum>(vi)</enum><text>encouraging and enhancing traditional uses, such as hunting and fishing;</text></clause><clause id="id2176007381e040c7842bb95e9d02470e"><enum>(vii)</enum><text>better informing the public about areas in the region with exceptional characteristics and opportunities for unique experiences; </text></clause><clause id="id8d9c1c842bea457ba3993b9c95566fb5"><enum>(viii)</enum><text>promoting the outdoor recreation economy; and</text></clause><clause id="id6a3bd01f36fd4d85911b56745f08fa04"><enum>(ix)</enum><text>protecting and enhancing economic activity through protecting natural flows through designated segments; </text></clause></subparagraph><subparagraph id="id3b4b5c44648a4f138031d68ca5d72c24"><enum>(D)</enum><text>do not abrogate existing rights, privileges, or contracts, including—</text><clause id="idc28a1f21d5ad4b948893420bdd0c83d7"><enum>(i)</enum><text>private property rights or restrict development or use on private land;</text></clause><clause id="ida4e3c37a3f4f458f8d37940084e800d3"><enum>(ii)</enum><text>existing water rights, interstate water compacts, or existing irrigation systems and other water development or distribution facilities, including the ability to maintain the systems and facilities;</text></clause><clause id="id6267c603cd394b43866b2c346dceba9a"><enum>(iii)</enum><text>grazing operations; or</text></clause><clause id="idaeb7c341511a4d5facbdf181a9821d8a"><enum>(iv)</enum><text>access for the public to public land within a designated river corridor; and</text></clause></subparagraph><subparagraph id="idee1d2c2289964f71830b41e0f9bf22d4"><enum>(E)</enum><text>do not open private land to public access.</text></subparagraph></paragraph></subsection><subsection id="id9660a728fe1345e783596393b44eccec"><enum>(b)</enum><header>Purpose</header><text>The purpose of this section is to protect for current and future generations of people in the United States the outstandingly remarkable scenic, natural, cultural, wildlife, fish, recreational, scientific, historic, cultural, ecological, and other values of certain segments of the Greater Gila River watershed and other rivers in the Gila National Forest.</text></subsection><subsection id="id579ec43b4e1e430b90f2daad4c5ba53e"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id90233dcabccb4c03be48d0c2d034bf5d"><enum>(1)</enum><header>Covered segment</header><text>The term <term>covered segment</term> means a river segment designated by paragraph (231) of section 3(a) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)</external-xref>) (as added by subsection (d)).</text></paragraph><paragraph id="idf2fc07f1d54644f984678790c3c49dbd"><enum>(2)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><subparagraph id="id235f4023af9f40f39b3a4ef1e3b3a3b0"><enum>(A)</enum><text>the Secretary of the Interior, with respect to a covered segment under the jurisdiction of the Secretary of the Interior; and</text></subparagraph><subparagraph id="id4f1edf2a14484891ad98d391bd6cf484"><enum>(B)</enum><text>the Secretary of Agriculture, with respect to a covered segment under the jurisdiction of the Secretary of Agriculture.</text></subparagraph></paragraph><paragraph id="idd7ed7949fb1e46469bce66bb5459ae7f"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means the State of New Mexico.</text></paragraph></subsection><subsection id="id8bc4d6a4250e427ab5a41c3e81003134"><enum>(d)</enum><header>Designation of segments</header><text>Section 3(a) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id21E1BA533A6D4FC7AE300ED0392AAFA4"><paragraph id="idDB1FBDC8978840C384C10B7CBAD9722B"><enum>(231)</enum><header>Gila River System, New Mexico</header><text>The following segments of the Gila River system in Las Animas Creek, Holden Prong, and McKnight Canyon in the State of New Mexico, to be administered by the Secretary concerned (as defined in section 2(c) of the <short-title>M.H. Dutch Salmon Greater Gila Wild and Scenic River Act</short-title>) in the following classifications: </text><subparagraph id="id7C34652AA6884F20975DE7401F5D8C07"><enum>(A)</enum><header>Apache creek</header><text display-inline="yes-display-inline">The approximately 10.5-mile segment, as generally depicted on the map entitled <quote>Apache Creek</quote> and dated April 30, 2020, as a wild river.</text></subparagraph><subparagraph id="idD2B4ED512E1C414CAC5DDB2E987CF366"><enum>(B)</enum><header>Black canyon creek</header><clause id="id437B2CF7910D44C5A46B5EEA819BDD07"><enum>(i)</enum><text display-inline="yes-display-inline">The 11.8-mile segment, as generally depicted on the map entitled <quote>Black Canyon Creek</quote> and dated April 30, 2020, as a wild river.</text></clause><clause id="idE3686AC801BB414ABC567F93E3707A96"><enum>(ii)</enum><text display-inline="yes-display-inline">The 0.6-mile segment, as generally id="id60F21FCFEE7042BD911B5BB137F87751"><enum>(e)</enum><header>Withdrawal</header><text>Subject to valid existing rights, all Federal land within the boundary of a covered segment is withdrawn from all forms of—</text><paragraph id="id64d72606693040cdaf2a2f29520dc81c"><enum>(1)</enum><text>entry, appropriation, or disposal under the public land laws;</text></paragraph><paragraph id="ida2c17474618e4ec19b72a1618bef6275"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text></paragraph><paragraph id="id3df5c7bf3bc443efb40487751a46bb75"><enum>(3)</enum><text>disposition under all laws pertaining to mineral and geothermal leasing or mineral materials.</text></paragraph></subsection><subsection id="idc2335069acd84f8b8f20744e0f11a414"><enum>(f)</enum><header>Maps; legal descriptions</header><paragraph id="ide51550fdc59c4af7b88bf94b81fba4ce"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary concerned shall prepare maps and legal descriptions of the covered segments.</text></paragraph><paragraph id="idc09ea498d8ce4b02bf7f20fcd09f8336"><enum>(2)</enum><header>Force of law</header><text>The maps and legal descriptions prepared under paragraph (1) shall have the same force and effect as if included in this section, except that the Secretary concerned may correct minor errors in the maps and legal descriptions.</text></paragraph><paragraph id="id240b3dc35d9643b3be16b7edbe3a5440"><enum>(3)</enum><header>Availability</header><text>The map and legal description prepared under paragraph (1) shall be on file and available for public inspection in the appropriate offices of the Forest Service, the Bureau of Land Management, and the National Park Service.</text></paragraph></subsection><subsection id="id9827B13FD888452F9322D257C32C3870"><enum>(g)</enum><header>Comprehensive river management plan</header><text>The Secretary concerned shall prepare the comprehensive management plan for the covered segments pursuant to section 3(d) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(d)</external-xref>) after consulting with Tribal governments, applicable political subdivisions of the State, and interested members of the public.</text></subsection><subsection id="id577ccbd77eb440648b108fb93d402f88"><enum>(h)</enum><header>Incorporation of acquired land and interests in land</header><text>If the United States acquires any non-Federal land within or adjacent to a covered segment, the acquired land shall be incorporated in, and be administered as part of, the applicable covered segment.</text></subsection><subsection id="id37116650e7f5470c85c293e1784d5466"><enum>(i)</enum><header>Effect of section</header><paragraph id="iddebae0b338d54bda99fcd8d54747319f"><enum>(1)</enum><header>Effect on rights</header><text>In accordance with section 12(b) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1283">16 U.S.C. 1283(b)</external-xref>), nothing in this section or an amendment made by this section abrogates any existing rights of, privilege of, or contract held by any person, including any right, privilege, or contract that affects Federal land or private land, without the consent of the person, including—</text><subparagraph id="idf6d83bd8e08440a3860e19468e56c729"><enum>(A)</enum><text>grazing permits or leases;</text></subparagraph><subparagraph id="id9f5be1e801a34ead973b06ac17ba5e57"><enum>(B)</enum><text>existing water rights, including the jurisdiction of the State in administering water rights;</text></subparagraph><subparagraph id="id2ff98e1f56164fd38c44356c47d90749" commented="no"><enum>(C)</enum><text>existing points of diversion, including appropriate maintenance, repair, or replacement; </text></subparagraph><subparagraph id="idd4a8ca8ff00f434788612c92f17a5c0b" commented="no"><enum>(D)</enum><text>existing water distribution infrastructure, including appropriate maintenance, repair, or replacement; and</text></subparagraph><subparagraph id="id7391df0279ad46b19c692a1add12705f"><enum>(E)</enum><text>valid existing rights for mining and mineral leases. </text></subparagraph></paragraph><paragraph id="id88ef8772d49b4e7e905585f7c7200590"><enum>(2)</enum><header>Condemnation</header><text>No land or interest in land shall be acquired under this section or an amendment made by this section without the consent of the owner.</text></paragraph><paragraph id="id997c7abdae04487ba52672b37085457c"><enum>(3)</enum><header>Relationship to other law</header><text>Nothing in this section amends or otherwise affects the Arizona Water Settlements Act (<external-xref legal-doc="public-law" parsable-cite="pl/108/451">Public Law 108–451</external-xref>; 118 Stat. 3478). </text></paragraph><paragraph id="id610f3484e0df492fac894e54e10041c0"><enum>(4)</enum><header>Species recovery</header><subparagraph id="id53629c160e554b54a9ff7df2b2e3a5e5"><enum>(A)</enum><header>In general</header><text>Notwithstanding section 7 of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1278">16 U.S.C. 1278</external-xref>) and subject to subparagraphs (B) and (C), the Secretary concerned may authorize the construction, maintenance, or replacement of 1 or more fish barriers or other projects with respect to a covered segment if the Secretary concerned determines that the fish barrier or other project—</text><clause id="id47022D10069445A790D1F81A01AC49D1"><enum>(i)</enum><text>is necessary for the recovery of a species that is—</text><subclause id="id8D54091014774FF0A60621E36EF9C832"><enum>(I)</enum><text>listed as endangered or threatened under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); and</text></subclause><subclause id="idBAC2248FE533412EA03DBA3F6DEDCD3A"><enum>(II)</enum><text>identified as an outstandingly remarkable value of the covered segment in accordance with the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1271">16 U.S.C. 1271 et seq.</external-xref>); and</text></subclause></clause><clause id="id45F89FCFD62641BFBDF89A23B189F63E"><enum>(ii)</enum><text>is included in the applicable species recovery plan prepared under section 4 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533</external-xref>).</text></clause></subparagraph><subparagraph id="idDA5B7EC8AB5D4B4299ACA85ED07FEC75"><enum>(B)</enum><header>Review required</header><text>A project authorized under subparagraph (A) shall be reviewed in accordance with section 7 of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1278">16 U.S.C. 1278</external-xref>), but a finding that the project does not meet the applicable evaluation standard under that section shall not, of itself, preclude the project from being carried out. </text></subparagraph><subparagraph id="id140e42ed3992414f9985daf4193b6d85"><enum>(C)</enum><header>Impacts minimized</header><text>For any project authorized under subparagraph (A), the Secretary concerned shall ensure that any impacts to the free-flowing characteristics of the river and other outstandingly remarkable river and scenic values are minimized to the maximum extent the Secretary concerned determines to be practicable, consistent with the natural appearance and accessibility of the covered segment as in existence on the date of enactment of this Act.</text></subparagraph><subparagraph id="idc3464c3addeb4da5b47915aea1179edf"><enum>(D)</enum><header>Assistance</header><text>Nothing in this paragraph prohibits a Federal agency from assisting with a loan, grant, or permit, or providing any other form of assistance, for a project authorized under subparagraph (A).</text></subparagraph></paragraph><paragraph id="idf74add87213c499e9589b87d141b898e"><enum>(5)</enum><header>State land jurisdiction</header><text>Nothing in this section or an amendment made by this section affects the jurisdiction of land under the jurisdiction of the State, including land under the jurisdiction of the New Mexico State Land Office and the New Mexico Department of Game and Fish. </text></paragraph><paragraph id="ideeb6e720642f481e9167760b28b75680"><enum>(6)</enum><header>Fish and wildlife</header><text>Nothing in this section or an amendment made by this section affects the jurisdiction of the State with respect to fish and wildlife in the State.</text></paragraph><paragraph id="id90dc91a9b0574ae78d35b7e826a8aa5e"><enum>(7)</enum><header>Treaty rights</header><text>Nothing in this section or an amendment made by this section alters, modifies, diminishes, or extinguishes the reserved treaty rights of any Indian Tribe with respect to hunting, fishing, gathering, and cultural or religious rights in the vicinity of a covered segment as protected by a treaty. </text></paragraph></subsection></section><section id="idDD6DE34A7C834E3E91562ACB10F79ED6"><enum>3.</enum><header>Modification of boundaries of Gila Cliff Dwellings National Monument and Gila National Forest</header><subsection id="id2D9452CFC3BB47DE992C70C65BB4A3A1"><enum>(a)</enum><header>Transfer of administrative jurisdiction</header><paragraph id="id40f9e88b692d45bdb15637d13a980df5"><enum>(1)</enum><header>In general</header><text>Administrative jurisdiction over the land described in paragraph (2) is transferred from the Secretary of Agriculture to the Secretary of the Interior.</text></paragraph><paragraph id="id092b8c73347a4aa69ba5b71ce0be9e84"><enum>(2)</enum><header>Description of land</header><text>The land referred to in paragraph (1) is the approximately 440 acres of land identified as <quote>Transfer from USDA Forest Service to National Park Service</quote> on the map entitled <quote>Gila Cliff Dwellings National Monument Proposed Boundary Adjustment</quote> and dated March 2020. </text></paragraph></subsection><subsection id="idFF01097D2E1C405D8C307D26E4B56233"><enum>(b)</enum><header>Boundary modifications</header><paragraph id="id700aa40bb15846459a113645f260cb7d"><enum>(1)</enum><header>Gila Cliff Dwellings National Monument</header><subparagraph id="id4560fe1bb59b4a5b846bf9d2bc669010"><enum>(A)</enum><header>In general</header><text>The boundary of the Gila Cliff Dwellings National Monument is revised to incorporate the land transferred to the Secretary of the Interior under subsection (a)(1).</text></subparagraph><subparagraph id="id364d0b6cb868485592426aa254e59174"><enum>(B)</enum><header>Map</header><clause id="id8b17fc066d5e43e0bd2c3b83f150e988"><enum>(i)</enum><header>In general</header><text>The Secretary of the Interior shall prepare and keep on file for public inspection in the appropriate office of the National Park Service a map and a legal description of the revised boundary of the Gila Cliff Dwellings National Monument.</text></clause><clause id="idb1e439f1ee27483dbd72a796421d41e9"><enum>(ii)</enum><header>Effect</header><text>The map and legal description under clause (i) shall have the same force and effect as if included in this section, except that the Secretary of the Interior may correct minor errors in the map and legal description.</text></clause></subparagraph></paragraph><paragraph id="id83c36abe96bb4e538028c12fbd016963"><enum>(2)</enum><header>Gila National Forest</header><subparagraph id="id7732ba62bb794e2a92a5c7d186be35c6"><enum>(A)</enum><header>In general</header><text>The boundary of the Gila National Forest is modified to exclude the land transferred to the Secretary of the Interior under subsection (a)(1).</text></subparagraph><subparagraph id="id1ac5b63c6c8b4f6bba4fa6ea211b79fe"><enum>(B)</enum><header>Map</header><clause id="idE52D72DEE7AB413A84030930F3F00B31"><enum>(i)</enum><header>In general</header><text>The Secretary of Agriculture shall prepare and keep on file for public inspection in the appropriate office of the Forest Service a map and a legal description of the revised boundary of the Gila National
