<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3127</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211101">November 1, 2021</action-date><action-desc><sponsor name-id="S390">Mr. Van Hollen</sponsor> (for himself and <cosponsor name-id="S308">Mr. Cardin</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 10 and title 46, United States Code, to allocate authority for nominations to the service academies in the event of the death, resignation, or expulsion from office of a Member of Congress, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id4183E24293324E0D8577348BEBAE8FE1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Service Education Reallocation for Vacant Elected offices Act of 2021</short-title></quote> or the <quote><short-title>SERVE Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="idC4A5320997E0417B8D9384D96A9D98C9"><enum>2.</enum><header>Allocation of authority for nominations to the service academies in the event of the death, resignation, or expulsion from office of a Member of Congress</header><subsection id="id75F42601F9B544A58BABA4C41B4F8001"><enum>(a)</enum><header>United States Military Academy</header><paragraph id="id68D9DB5B9334443EA110A1E3D040CF57"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/753">Chapter 753</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/7442">section 7442</external-xref> the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="id9F1D9A5A5B58494EBE537C7A2A764D36"><section id="id9DB5F697D1A9411CB4F4FF19E636E8BD"><enum>7442a.</enum><header>Cadets: nomination in event of death, resignation, or expulsion from office of Member of Congress otherwise authorized to nominate</header><subsection id="id26603E3AB26C44DB85CC2D35976703F5"><enum>(a)</enum><header>Senators</header><text>In the event a Senator does not submit nominations for cadets for an academic year in accordance with section 7442(a)(3) of this title due to death, resignation from office, or expulsion from office and the date of the swearing-in of the Senator's successor as Senator occurs after the date of the deadline for submittal of nominations for cadets for the academic year, the nominations for cadets otherwise authorized to be made by the Senator pursuant to such section shall be made instead by the other Senator from the State concerned.</text></subsection><subsection id="id463F5A2100E24B4F8FB2A1F0844CB184"><enum>(b)</enum><header>Representatives</header><text>In the event a Representative from a State does not submit nominations for cadets for an academic year in accordance with section 7442(a)(4) of this title due to death, resignation from office, or expulsion from office and the date of the swearing-in of the Representative's successor as Representative occurs after the date of the deadline for submittal of nominations for cadets for the academic year, the nominations for cadets otherwise authorized to be made by the Representative pursuant to such section shall be made instead by the Senators from the State of the congressional district concerned, with such nominations divided equally among such Senators and any remainder going to the senior Senator from the State.</text></subsection><subsection id="idf3af2eefbc164376b35a3c412e6cfa57"><enum>(c)</enum><header>Construction of authority</header><text>Any nomination for cadets made by a Member pursuant to this section is not a reallocation of a nomination. Such nominations are made in lieu of a Member that does not submit nominations for cadets for an academic year in accordance with section 7442 of this title due to death, resignation from office, or expulsion from office and the date of the swearing-in of the Member’s successor occurs after the date of the deadline for submittal of nominations for cadets for the academic year.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id4484BD0EE6FA4304A619C49BAE0410F7"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 753 of such title is amended by inserting after the item relating to section 7442 the following new item:</text><quoted-block style="USC" id="id3e026db2-7963-4168-b750-0cba7ee9ae89"><toc><toc-entry level="section" idref="id9DB5F697D1A9411CB4F4FF19E636E8BD">7442a. Cadets: nomination in event of death, resignation, or expulsion from office of Member of Congress otherwise authorized to nominate.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id1F7284E1CE534E968B03E7EFD2A3A040"><enum>(b)</enum><header>United States Naval Academy</header><paragraph id="idECEB5184623049F6990B42FDDF9B1480"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/853">Chapter 853</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/8454">section 8454</external-xref> the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="id5365100E645B4ED08153BFF56A8B36C6"><section id="idA3EA55A88CE34DF2A0DCE177594DA43C"><enum>8454a.</enum><header>Midshipmen: nomination in event of death, resignation, or expulsion from office of Member of Congress otherwise authorized to nominate</header><subsection id="id06D6B475651A4707B6AC2902AA6355CB"><enum>(a)</enum><header>Senators</header><text>In the event a Senator does not submit nominations for midshipmen for an academic year in accordance with section 8454(a)(3) of this title due to death, resignation from office, or expulsion from office and the date of the swearing-in of the Senator's successor as Senator occurs after the date of the deadline for submittal of nominations for midshipmen for the academic year, the nominations for midshipmen otherwise authorized to be made by the Senator pursuant to such section shall be made instead by the other Senator from the State concerned.</text></subsection><subsection id="id734C201FF48D440EAADDCBA68566FF79"><enum>(b)</enum><header>Representatives</header><text>In the event a Representative from a State does not submit nominations for midshipmen for an academic year in accordance with section 8454(a)(4) of this title due to death, resignation from office, or expulsion from office and the date of the swearing-in of the Representative's successor as Representative occurs after the date of the deadline for submittal of nominations for midshipmen for the academic year, the nominations for midshipmen otherwise authorized to be made by the Representative pursuant to such section shall be made instead by the Senators from the State of the congressional district concerned, with such nominations divided equally among such Senators and any remainder going to the senior Senator from the State.</text></subsection><subsection id="id88d7da3429504c45a7477993717aa791"><enum>(c)</enum><header>Construction of authority</header><text>Any nomination for midshipmen made by a Member pursuant to this section is not a reallocation of a nomination. Midshipmen: nomination in event of death, resignation, or expulsion from office of Member of Congress otherwise authorized to nominate.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0497EDEDB65E4810884EDED2536AD8C3"><enum>(c)</enum><header>Air Force Academy</header><paragraph id="idB45912FB67E748C49A1B8DE048F29667"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/953">Chapter 953</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/9442">section 9442</external-xref> the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="idACA35FD439B848AE9F4FE57D91B9162C"><section id="id8CDADF6D7F6649DDB555A19E95E22F69"><enum>9442a.</enum><header>Cadets: nomination in event of death, resignation, or expulsion from office of Member of Congress otherwise authorized to nominate</header><subsection id="idC852D530A36242EC9EE709A13BF179DE"><enum>(a)</enum><header>Senators</header><text>In the event a Senator does not submit nominations for cadets for an academic year in accordance with section 9442(a)(3) of this title due to death, resignation from office, or expulsion from office and the date of the swearing-in of the Senator's successor as Senator occurs after the date of the deadline for submittal of nominations for cadets for the academic year, the nominations for cadets otherwise authorized to be made by the Senator pursuant to such section shall be made instead by the other Senator from the State concerned.</text></subsection><subsection id="id758F9853D82048AF808DF9B670B8A8E6"><enum>(b)</enum><header>Representatives</header><text>In the event a Representative from a State does not submit nominations for cadets for an academic year in accordance with section 9442(a)(4) of this title due to death, resignation from office, or expulsion from office and the date of the swearing-in of the Representative's successor as Representative occurs after the date of the deadline for submittal of nominations for cadets for the academic year, the nominations for cadets otherwise authorized to be made by the Representative pursuant to such section shall be made instead by the Senators from the State of the congressional district concerned, with such nominations divided equally among such Senators and any remainder going to the senior Senator from the State.</text></subsection><subsection id="id6f5a297809cd44889e6a4bbc6eba7188"><enum>(c)</enum><header>Construction of authority</header><text>Any nomination for cadets made by a Member pursuant to this section is not a reallocation of a nomination. Cadets: nomination in event of death, resignation, or expulsion from office of Member of Congress otherwise authorized to nominate.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="ideb72c184691b42c8895e68d7472d6daa"><enum>(d)</enum><header>Merchant Marine Academy</header><paragraph id="id7b1ee05893c14315b2f04e77dc34206c"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/513">Chapter 513</external-xref> of title 46, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/46/51302">section 51302</external-xref> the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="id48efc36bd25a42bda35d1f3a0c8a6754"><section id="idbcbaf865ae9b4bedaa2f179dd6ec3a6c"><enum>51302a.</enum><header>Cadets: nomination in event of death, resignation, or expulsion from office of Member of Congress otherwise authorized to nominate</header><subsection id="id0ee8487e58fa494a9890b0f4c480e935"><enum>(a)</enum><header>Senators</header><text>In the event a Senator does not submit nominations for cadets for an academic year in accordance with section 51302(b)(1) of this title due to death, resignation from office, or expulsion from office and the date of the swearing-in of the Senator’s successor as Senator occurs after the date of the deadline for submittal of nominations for cadets for the academic year, the nominations for cadets otherwise authorized to be made by the Senator pursuant to such section shall be made instead by the other Senator from the State concerned.</text></subsection><subsection id="id05f211878d6f4571a154a8090595e289"><enum>(b)</enum><header>Representatives</header><text>In the event a Representative from a State does not submit nominations for cadets for an academic year in accordance with section 51302(b)(2) of this title due to death, resignation from office, or expulsion from office and the date of the swearing-in of the Representative’s successor as Representative occurs after the date of the deadline for submittal of nominations for cadets for the academic year, the nominations for cadets otherwise authorized to be made by the Representative pursuant to such section shall be made instead by the Senators from the State of the congressional district concerned, with such nominations divided equally among such Senators and any remainder going to the senior Senator from the State.</text></subsection><subsection id="idd88ab3d5256a4c28a05c1d8b146b818e"><enum>(c)</enum><header>Construction of authority</header><text>Any nomination for cadets made by a Member pursuant to this section is not a reallocation of a nomination.
