<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3116</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211028">October 28, 2021</action-date><action-desc><sponsor name-id="S383">Mr. Sullivan</sponsor> (for himself and <cosponsor name-id="S331">Mrs. Gillibrand</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 36, United States Code, to designate October 1 as Choose Respect Day, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Choose Respect Act</short-title></quote>.</text></section><section id="id2D0E229B989B49F9957DD8D2ED2DB45D"><enum>2.</enum><header>Designation</header><subsection id="idB96CB6A501374AC9A09A7DEF047696C0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/36/1">Chapter 1</external-xref> of title 36, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id76E7D6A5971A4612B9CE88177BCCE487"><section id="id6B15DB2E52EB4CDB8EAF130C42B3124F"><enum>146.</enum><header>Choose Respect Day</header><subsection id="id9265BC587AAF47B98F9F78BABCD3AFA8"><enum>(a)</enum><header>Designation</header><text>October 1 is Choose Respect Day.</text></subsection><subsection id="idc4943397817540f5b364ff3a5d4939b8"><enum>(b)</enum><header>Recognition</header><text>All private citizens, organizations, and Federal, State, and local governmental and legislative entities are encouraged to recognize Choose Respect Day through proclamations, activities, and educational efforts in furtherance of changing the culture around the tolerance of violence against women.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idD514455D4D93465DB53EEB90B3A39780"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/36/1">chapter 1</external-xref> of title 36, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="id7a251ebe-49dc-4be2-85c9-3872458717fe"><toc><toc-entry idref="id6B15DB2E52EB4CDB8EAF130C42B3124F" level="section">146. Choose Respect Day.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="idf5fd6b5e0baf47b485dba780cf35d37d"><enum>3.</enum><header>Media campaign</header><subsection id="id421E8C874A8A43DCA00BD792F5998E2E"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id896DF2FE21D04D53B2E63519E9510049"><enum>(1)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office on Violence Against Women.</text></paragraph><paragraph id="id5D77AAA4E4D54DFD9D375D4E87700686"><enum>(2)</enum><header>National media campaign</header><text>The term <term>national media campaign</term> means the national <quote>Choose Respect</quote> media campaign described in subsection (b).</text></paragraph></subsection><subsection id="idFB08FCE9AA144EDC93EA365526DB8D4F"><enum>(b)</enum><header>Media campaign</header><text display-inline="yes-display-inline">The Director shall, to the extent feasible and appropriate, conduct a national <quote>Choose Respect</quote> media campaign in accordance with this section for the purposes of—</text><paragraph id="idc0eb88ae20814f259bbad91373b3ad93"><enum>(1)</enum><text>preventing and discouraging the mistreatment of women, including domestic abuse, violence, stalking, and harassment;</text></paragraph><paragraph id="idbcf03092a86d4b4cae89936a3cd9c68c"><enum>(2)</enum><text>supporting evidence-based prevention programs targeting the attitudes, perceptions, and beliefs of individuals who have or are likely to participate in the activities described in paragraph (1);</text></paragraph><paragraph id="id558b1a8437ae4612a29197160a61c5c9"><enum>(3)</enum><text>encouraging victims of the activities described in paragraph (1) to seek help through the means determined to be most effective by the most current evidence available, including seeking legal representation; and</text></paragraph><paragraph id="id0d6df64f4a0d41dfbe50a9327d205626"><enum>(4)</enum><text>informing the public about the help available to victims of the activities described in paragraph (1).</text></paragraph></subsection><subsection id="idEC2E7AAEE1A7480ABAA7EE3B4DFF0056"><enum>(c)</enum><header>Use of funds</header><paragraph id="idCF5DFE1717DB43DD94FEF954257DD7A1"><enum>(1)</enum><header>In general</header><text>Amounts made available to carry out this section for the national media campaign may only be used for the following:</text><subparagraph id="id8c681f378bf942bb9f176ebf12c56808"><enum>(A)</enum><text>The purchase of media time and space, including the strategic planning for, tracking, and accounting of, such purchases.</text></subparagraph><subparagraph id="idc42828caf6554f71af804a790c964444"><enum>(B)</enum><text>Creative and talent costs, consistent with paragraph (2).</text></subparagraph><subparagraph id="id0b1835c20b304aae89beac5fad4e8010"><enum>(C)</enum><text>Advertising production costs, which may include television, radio, internet, social media, and other commercial marketing venues.</text></subparagraph><subparagraph id="ida586c3419ee64e778c060a7ce63275ac"><enum>(D)</enum><text>Testing and evaluation of advertising.</text></subparagraph><subparagraph id="id553198ed69fc4c229af282da64669a96"><enum>(E)</enum><text>Evaluation of the effectiveness of the national media campaign.</text></subparagraph><subparagraph id="idb2f23f3a7c964b4c815b22f0ed0f64fa"><enum>(F)</enum><text>Costs of contracts to carry out activities authorized by this section.</text></subparagraph><subparagraph id="id20b6c4508d584e5fbd2d8fbc9922f5b9"><enum>(G)</enum><text>Partnerships with professional and civic groups, community-based organizations, including faith-based organizations, and government organizations related to the national media campaign.</text></subparagraph><subparagraph id="id14cf69a82e314c60b2548bc317eba741"><enum>(H)</enum><text>Entertainment industry outreach, interactive outreach, media projects and activities, public information, news media outreach, corporate sponsorship and participation, and professional sports associations and military branch participation.</text></subparagraph><subparagraph id="id8f82e83c70e54056982227b57f429bfe"><enum>(I)</enum><text>Operational and management expenses.</text></subparagraph></paragraph><paragraph id="id7C415754BB614AA895A896B530AFF3FF"><enum>(2)</enum><header>Specific requirements</header><subparagraph id="idBC1B9679DE2F485AA7399581CA11AABE"><enum>(A)</enum><header>Creative services</header><text>In using amounts for creative and talent costs under paragraph (1), the Director shall use creative services donated at no cost to the Government wherever feasible and may only procure creative services for advertising—</text><clause id="idB026A2E5A4814DAAA41B3CB66C8EAFB1"><enum>(i)</enum><text>responding to high-priority or emergent campaign needs that cannot timely be obtained at no cost; or</text></clause><clause id="id030D61C850BD4541866060ACEB191E5F"><enum>(ii)</enum><text>intended to reach a minority, ethnic, or other special audience that cannot reasonably be obtained at no cost.</text></clause></subparagraph><subparagraph id="id8956789b4ec54f9ab292c0c3e42b7b79"><enum>(B)</enum><header>Testing and evaluation of advertising</header><text>In using amounts for testing and evaluation of advertising under paragraph (1)(D), the Director shall test all advertisements prior to use in the national media campaign to ensure that the advertisements are effective with the target audience and meet industry-accepted standards. The Director may waive this requirement for advertisements using no more than 10 percent of the purchase of advertising time purchased under this section in a fiscal year and no more than 10 percent of the advertising space purchased under this section in a fiscal year, if the advertisements respond to emergent and time-sensitive campaign needs or the advertisements will not be widely utilized in the national media campaign.</text></subparagraph><subparagraph id="id4155D8291A814803A4EBA4138A4A9392"><enum>(C)</enum><header>Consultation</header><text>For the planning of the campaign under subsection (b), the Director may consult with—</text><clause id="id4ad774c268434763bda4b4e456b25630"><enum>(i)</enum><text>leading national advocacy groups;</text></clause><clause id="id80141700a38946a9848c4e32c47a1adc"><enum>(ii)</enum><text>the heads of any victim support or antiviolence against women Federal agency or interagency department;</text></clause><clause id="id6de72fee9ec4427ba60103e670e2abc7"><enum>(iii)</enum><text>State, local, and Tribal governments;</text></clause><clause id="idefb12e9f690640349c65b140746d4f67"><enum>(iv)</enum><text>experts in the field of preventing violence against women; and</text></clause><clause id="idf07e13c7ca404583987d54eacced3f76"><enum>(v)</enum><text>communications professionals.</text></clause></subparagraph><subparagraph id="id4f048f1052504ffe9d20e8aa8b29831a"><enum>(D)</enum><header>Evaluation of effectiveness of national media campaign</header><text>In using amounts for the evaluation of the effectiveness of the national media campaign under paragraph (1)(E), the Attorney General shall—</text><clause id="idf5d1ee52eac949eb828f6f3dcfc28993"><enum>(i)</enum><text>designate an independent entity to evaluate by April 20 of each year the effectiveness of the national media campaign based on data from any relevant studies or publications, as determined by the Attorney General, including tracking and evaluation data collected according to marketing and advertising industry standards; and</text></clause><clause id="id233ac97dd93b46baaf6e1340a847ada8"><enum>(ii)</enum><text>ensure that the effectiveness of the national media campaign is evaluated in a manner that enables consideration of whether the national media campaign has contributed to changes in attitude or behaviors among the target audience with respect to violence against women and such other measures of evaluation as the Attorney General determines are appropriate.</text></clause></subparagraph></paragraph></subsection><subsection id="id3e62e0dd6bd34570a1e0acff5e0b6a59"><enum>(d)</enum><header>Advertising</header><text>In carrying out this section, the Director shall ensure that sufficient funds are allocated to meet the stated goals of the national media campaign.</text></subsection><subsection id="id64bb835c547a462389d456b0fa7a9d4c"><enum>(e)</enum><header>Responsibilities and functions under the program</header><paragraph id="ida077abc109314c96b09c64ffd77707a8"><enum>(1)</enum><header>In general</header><text>The Director shall determine the overall purposes and strategy of the national media campaign.</text></paragraph><paragraph id="id0d11807ec381428a9f00dafcb50fee32"><enum>(2)</enum><header>Director</header><subparagraph id="id7054af004e364141b8e23ce0802258b6"><enum>(A)</enum><header>In general</header><text>The Director shall approve—</text><clause id="idec11c40d07e6466398bb2735fb9f5371"><enum>(i)</enum><text>the strategy of the national media campaign;</text></clause><clause id="id0f439e68824a415c9d95010a986afeb0"><enum>(ii)</enum><text>all advertising and promotional material used in the national media campaign; and</text></clause><clause id="idd7150f18377b41a39bbb61acd5e47bd6"><enum>(iii)</enum><text>the plan for the purchase of advertising time and space for the national media campaign.</text></clause></subparagraph><subparagraph id="id2d18f3229a8b4d5c9f2d025cfbb18466"><enum>(B)</enum><header>Implementation</header><text>The Director shall be responsible for implementing a focused national media campaign to meet the purposes set forth in subsection (b) and shall ensure—</text><clause id="id8bc24c36b1434a7793a7084089476f94"><enum>(i)</enum><text>information disseminated through the campaign is accurate and scientifically valid; and</text></clause><clause id="idd12bc7e379f4491d84795c1140a3812d"><enum>(ii)</enum><text>the campaign is designed using strategies demonstrated to be the most effective at achieving the goals and requirements of subsection (b), which may include—</text><subclause id="idaf44442045f54b71ad0f184ff376c2d8"><enum>(I)</enum><text>a media campaign, as described in subsection (c);</text></subclause><subclause id="id6d17cc38b80242eb83cc2589ec6530ec"><enum>(II)</enum><text>local, regional, or population specific messaging;</text></subclause><subclause id="idf8a10e7d7ec34effa872ca06f128d44e"><enum>(III)</enum><text>the development of websites to publicize and disseminate information;</text></subclause><subclause id="idab4a9458b34e44f78e00abb5d9641f61"><enum>(IV)</enum><text>conducting outreach and providing educational resources for women;</text></subclause><subclause id="idacd0141658d24f1da6de1f53dfb4346b"><enum>(V)</enum><text>collaborating with law enforcement agencies; and</text></subclause><subclause id="idcb113e21afa040ae898b8ed2eb5c8c3a"><enum>(VI)</enum><text>providing support for school-based public health education classes to improve teen knowledge about the effects of violence against women.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="id29f229f79dde405c8af43d1e3361a0c5"><enum>(f)</enum><header>Prohibitions</header><text>None of the amounts made available under subsection (c) may be obligated or expended for any of the following:</text><paragraph id="id1509e35dc2c9402cbcf40b76e87fa14e"><enum>(1)</enum><text>To supplant current antiviolence against women community-based coalitions.</text></paragraph><paragraph id="id4cecc038aaf0491a85edb37398ca3172"><enum>(2)</enum><text>To supplant pro bono public service time donated by national and local broadcasting networks for other public service campaigns.</text></paragraph><paragraph id="idef5d610e7d7b4ef08659b7cac3b18333"><enum>(3)</enum><text>For partisan political purposes, or to express advocacy in support of or to defeat any clearly identified candidate, clearly identified ballot initiative, or clearly identified legislative or regulatory proposal.</text></paragraph><paragraph id="id8ff329d8a6e64340b5910a61327bd549"><enum>(4)</enum><text>To fund advertising that features any elected officials, persons seeking elected office, cabinet level officials, or other Federal officials employed pursuant to section 213 of Schedule C of title 5, Code of Federal Regulations.</text></paragraph><paragraph id="idce562be7dca14f659a9901db58f04dbc"><enum>(5)</enum><text>To fund advertising that does not contain a primary message intended to reduce or prevent violence against women.</text></paragraph><paragraph id="id2400eac8a852411ab1fb29110201d5c9"><enum>(6)</enum><text>To fund advertising containing a primary message intended to promote support for the national media campaign or private sector contributions to the national media campaign.</text></paragraph></subsection><subsection id="id087d78f0702f4da597fc72df6794f8eb"><enum>(g)</enum><header>Financial and performance accountability</header><text>The Director shall cause to be performed—</text><paragraph id="id34bb69d7200047d0bb61ba8ff47cd1d4"><enum>(1)</enum><text>audits and reviews of costs of the national media campaign pursuant to section 4706 of title 41, United States Code; and</text></paragraph><paragraph id="ide3ee60b1e7444d5c884d17690d62e663"><enum>(2)</enum><text>an audit to determine whether the costs of the national media campaign are allowable under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/43">chapter 43</external-xref> of title 41, United States Code.</text></paragraph></subsection><subsection id="idb2a28b11a7904cdc9ee64049ba5f5fb6"><enum>(h)</enum><header>Report to Congress</header><text>The Director shall submit on an annual basis a report to Congress that describes—</text><paragraph id="id8bb035b8516f46b5b9da7a53bd3c3049"><enum>(1)</enum><text>the strategy of the national media campaign and whether specific objectives of the national media campaign were accomplished;</text></paragraph><paragraph id="idb945929acbe34e88b80e6b1ca29475b7"><enum>(2)</enum><text>steps taken to ensure that the national media campaign operates in an effective and efficient manner consistent with the overall strategy and focus of the national media campaign;</text></paragraph><paragraph id="id9c346141933f4a4495a802f4ebba1c4d"><enum>(3)</enum><text>plans to purchase advertising time and space;</text></paragraph><paragraph id="id319f97e98ed54676a0ffdf749b40f6dc"><enum>(4)</enum><text>policies and practices implemented to ensure that Federal funds are used responsibly to purchase advertising time and space and eliminate the potential for waste, fraud, and abuse;</text></paragraph><paragraph id="idbf3dbe66023a4aaabd2ef2a9d59a139b"><enum>(5)</enum><text>all contracts entered into with a corporation, partnership, or individual working on behalf of the national media campaign;</text></paragraph><paragraph id="id1f80f9de5ee94f3fa5a2be0aa091faed"><enum>(6)</enum><text>the results of any financial audit of the national media campaign;</text></paragraph><paragraph id="id7eb97561c01349ed900deee05cca54d8"><enum>(7)</enum><text>a description of any evidence used to develop the national media campaign;</text></paragraph><paragraph id="idb6b240319a0a4619adf486e99476eda3"><enum>(8)</enum><text>specific policies and steps implemented to ensure compliance with this section;</text></paragraph><paragraph id="id093935a5d8914a8b93060c8ea2735650"><enum>(9)</enum><text>a detailed accounting of the amount of funds obligated during the previous fiscal year for carrying out the national media campaign, including each recipient of funds, the purpose of each expenditure, the amount of each expenditure, any available outcome information, and any other information necessary to provide a complete accounting of the funds expended; and</text></paragraph><paragraph id="idba84f46aea574c0db351f8c1ff5bf884"><enum>(10)</enum><text>a review and evaluation of the effectiveness of the national media campaign strategy for the past year.</text></paragraph></subsection><subsection id="id24F81F4F527A4C999D8563112D563187"><enum>(i)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Director to carry out this section $5,000,000 for each of fiscal years 2021 through 2026, to remain available until expended.</text></subsection></section><section id="idEF5BFDD198CE4537B8B75E705F5EA9F3"><enum>4.</enum><header>Reimplementation of Choose Respect Initiative</header><subsection id="idC33DFC63C39342F1AD2457CEC2C93921"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the Centers for Disease Control and Prevention shall reimplement the national <quote>Choose Respect</quote> initiative that the Centers for Disease Control and Prevention implemented in 2006.</text></subsection><subsection id="id6872010A39134135850551A948B862BC"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">The Director of the Centers for Disease Control and Prevention shall submit to Congress a report on the reimplementation of the <quote>Choose Respect</quote> initiative required under subsection (a).</text></subsection><subsection id="idF91E94449DF141DDBEEB7F4E18B4A529"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Director of the Centers for Disease Control and Prevention to carry out this section $1,000,000 for each of fiscal years 2021 through 2026, to remain available until expended.</text></subsection></section><section id="id583B3254D2234F61A6D25D115C09FBA3"><enum>5.</enum><header>Semipostal</header><subsection id="idf458b9393965476191f1364f47e2004f"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>semipostal stamp</term> has the meaning given the term <term>semipostal</term> in section 416(a) of title 39, United States Code.</text></subsection><subsection id="ida401b2a4df38416a93d53e2d5abadaf0"><enum>(b)</enum><header>Issuance</header><text>In order to afford a convenient way for members of the public to contribute to changing the culture around the tolerance of violence against women, the United States Postal Service shall issue a semipostal stamp (referred to in this section as the <quote>Choose Respect Semipostal Stamp</quote>) in accordance with subsection (c).</text></subsection><subsection id="id16d83f1901644eeca1f13ecfd025b92a"><enum>(c)</enum><header>Terms and conditions</header><paragraph id="id4fe18d79476c4b4089c4d556d430856f"><enum>(1)</enum><header>In general</header><text>Except as provided in this subsection, the issuance and sale of the Choose Respect Semipostal Stamp shall be governed by section 416 of title 39, United States Code, and regulations issued under that section.</text></paragraph><paragraph id="id0dedb14c1ed24766800bc96c41d984dd"><enum>(2)</enum><header>Duration</header><text>The Choose Respect Semipostal Stamp shall be made available to the public for a period of 5 years, beginning not later than 1 year after the date of enactment of this Act.</text></paragraph><paragraph id="id370a84329c4f4c0dbd7f866f5ba18fe1"><enum>(3)</enum><header>Disposition of proceeds</header><text>All amounts becoming available from the sale of the Choose Respect Semipostal Stamp (as determined under section 416(d) of title 39, United States Code) shall be transferred to the Director of the Office on Violence Against Women, for the purpose described in subsection (b), through payments which shall be made not less frequently than 2 times a year.</text></paragraph><paragraph id="id806dd68776f643df9a9e560c803e2a93"><enum>(4)</enum><header>Limitation</header><text>For purposes of section 416 of title 39, United States Code (including any regulation prescribed under subsection (e)(1)(C) of that section), the semipostal issued under this section shall not apply to any limitation relating to whether more than 1 semipostal may be offered for sale at the same time.</text></paragraph></subsection></section></legis-body></bill>
