which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the Attorney General to make grants to State and Tribal courts in order to allow the electronic service of certain court orders, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Electronic Service for Effectiveness, Reduction of Violence, and Improved Court Efficiency Act of 2021</short-title></quote> or the <quote><short-title>E-SERVICE Act</short-title></quote>.</text></section><section id="id5bc38fcd464348b0a667078411ef2b39"><enum>2.</enum><header>Grants to State and Tribal courts to implement protection order pilot programs</header><text display-inline="no-display-inline">Part U of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10461">34 U.S.C. 10461 et seq.</external-xref>) is amended—</text><paragraph id="idC53F81315E8346D0B533B3F22BEBDDD5"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating sections 2103, 2104, and 2105 as sections 2104, 2105, and 2106, respectively; and</text></paragraph><paragraph id="id5DA0951174CC44DF864D3CF5ED18B06B"><enum>(2)</enum><text>by inserting after section 2102 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id03A1DEF90884487AA30A0410C261EDCE"><section id="id073E1F741CD34348A2216C1E408BB23D"><enum>2103.</enum><header>Grants to State and Tribal courts to implement protection order pilot programs</header><subsection id="idac95b89f7fa54a2b81c18fec97c40b5f"><enum>(a)</enum><header>Definition of eligible entity</header><text>In this section, the term <term>eligible entity</term> means a State or Tribal court that is part of a multidisciplinary partnership that includes, to the extent practicable—</text><paragraph id="id9bff4510fb6d4c0d80da4058e6d4d354"><enum>(1)</enum><text>a State, Tribal, or local law enforcement agency;</text></paragraph><paragraph id="id6698c46f08bf4402a647ca9d491917f0"><enum>(2)</enum><text>a State, Tribal, or local prosecutor advocate group;</text></paragraph><paragraph id="id822BC030ABA54BD184F7716E56FEEBD2"><enum>(3)</enum><text>a victim service provider or State or Tribal domestic violence coalition;</text></paragraph><paragraph id="id16b2f1cd2c8d446eadbfdd844be44785"><enum>(4)</enum><text>a nonprofit program or government agency with demonstrated experience in providing legal assistance or legal advice to victims of domestic violence and sexual assault;</text></paragraph><paragraph id="idf84cec92503044f58bb4d0f571616bcd"><enum>(5)</enum><text>the bar association of the applicable State or Indian Tribe;</text></paragraph><paragraph id="id661591a16ac343f1b5e01e58032fc6ac"><enum>(6)</enum><text>the State or Tribal association of court clerks;</text></paragraph><paragraph id="id3a6cb29a20e147069741a51247e932bc"><enum>(7)</enum><text>a State, Tribal, or local association of criminal defense attorneys;</text></paragraph><paragraph id="idc24411c069854587a2fb594ce457b266"><enum>(8)</enum><text>not fewer than 2 individuals with expertise in the design and management of court case management systems and systems of integration;</text></paragraph><paragraph id="id45503e8f9f6c4f41b8b168e351db4091"><enum>(9)</enum><text>not fewer than 2 State or Tribal court judges with experience in—</text><subparagraph id="id29DF204E805F4A6BBAE0DABF3C854AED"><enum>(A)</enum><text>the field of domestic violence; and</text></subparagraph><subparagraph id="id60B41D2FEE64444C9C5BE821DCF3E784"><enum>(B)</enum><text>issuing protective orders; and</text></subparagraph></paragraph><paragraph id="id00700f640174440aa9e9860bcc0e156e"><enum>(10)</enum><text>a judge assigned to the criminal docket of the State or Tribal court.</text></paragraph></subsection><subsection id="idC253BC4C7728478E9C2D416F21B885B3"><enum>(b)</enum><header>Grants authorized</header><paragraph id="id80668F6855B1469AA145022260FBE115"><enum>(1)</enum><header>In general</header><text>In addition to grants authorized under section 2101, the Attorney General shall make grants to eligible entities to carry out the activities described in subsection (c) of this section.</text></paragraph><paragraph commented="no" id="idb9db7d1ff66c4e288acbb2e0c330322c"><enum>(2)</enum><header>Number</header><text>The Attorney General may award not more than 10 grants under paragraph (1).</text></paragraph><paragraph commented="no" id="id586f62775cad4ff59211bfc2fe1ab39d"><enum>(3)</enum><header>Amount</header><text>The amount of a grant awarded under paragraph (1) may be not more than $1,500,000.</text></paragraph></subsection><subsection id="id42f5be1933c84d01a7eb3f182628dba6"><enum>(c)</enum><header>Mandatory activities</header><paragraph id="id5b7daf50071346379f7554721ef1c234"><enum>(1)</enum><header>In general</header><text>An eligible entity that receives a grant under this section shall use the grant funds, in consultation with the partners required under subsection (a), to—</text><subparagraph id="ide51eec5588544abc9f0c7abca51363f8"><enum>(A)</enum><text>develop and implement a program for properly and legally serving protection orders through electronic communication methods to—</text><clause id="id82de8b5b69444756a78791a9f59a6f31"><enum>(i)</enum><text>modernize the service process and make the process more effective and efficient;</text></clause><clause id="idCEE61A9560FA4A29B41FB30C1A46E8B2"><enum>(ii)</enum><text>provide for improved safety of victims; and</text></clause><clause id="ida62794e0f7d14180826c9da06fc2fbe2"><enum>(iii)</enum><text>make protection orders enforceable as quickly as possible;</text></clause></subparagraph><subparagraph id="id186550bdd14d4368937e5e5ca61eb55d"><enum>(B)</enum><text>develop best practices relating to the service of protection orders through electronic communication methods;</text></subparagraph><subparagraph id="idb032bef21ab149f2b7a1dd5ea4e47d5c"><enum>(C)</enum><text>ensure that the program developed under subparagraph (A) complies with due process requirements and any other procedures required by law or by a court; and</text></subparagraph><subparagraph id="id230a93ef0bde447399280d65cb556dde"><enum>(D)</enum><text>implement any technology necessary to carry out the program developed under subparagraph (A), such as technology to verify and track the receipt of a protection order by the intended party.</text></subparagraph></paragraph><paragraph id="id42569c2e1fda494c9f4ba85c3bbfca5a"><enum>(2)</enum><header>Timeline</header><text>An eligible entity that receives a grant under this section shall—</text><subparagraph id="idACF7D33181D744B2A4C4CC50BF43650C"><enum>(A)</enum><text>implement the program required under paragraph (1)(A) not later than 2 years after receiving the grant; and</text></subparagraph><subparagraph id="idE1F1E766F40F4FFA8B337C3397B9783B"><enum>(B)</enum><text>carry out the program for not fewer than 3 years.</text></subparagraph></paragraph></subsection><subsection id="id92b902d609454844958aebe1dc832ee1"><enum>(d)</enum><header>Diversity of recipients</header><text>The Attorney General shall award grants under this section to eligible entities in a variety of areas and situations, including—</text><paragraph id="id77498c02017d4ea9a9da512581c27ae5"><enum>(1)</enum><text>a State court that serves a population of not fewer than 1,000,000 individuals;</text></paragraph><paragraph id="id5da83144806d42c1a6825a172c63871d"><enum>(2)</enum><text>a State court that—</text><subparagraph id="id6332D8B8F1F6431C85C9B14B7B2455C8"><enum>(A)</enum><text>serves a State that is among the 7 States with the lowest population density in the United States; and</text></subparagraph><subparagraph id="id9CF03E3E163D4A569AB6AB1A26BE1801"><enum>(B)</enum><text>has a relatively low rate of successful service with respect to protection orders, as determined by the Attorney General;</text></subparagraph></paragraph><paragraph id="idc28659a69900454b9918612d00a2b230"><enum>(3)</enum><text>a State court that—</text><subparagraph id="idE1428DB7D1C84790956D1A0A561CD4F3"><enum>(A)</enum><text>serves a State that is among the 7 States with the highest population density in the United States; and</text></subparagraph><subparagraph id="idBE4F18EC03864A1D8F4B8CFE8ABAA0FC"><enum>(B)</enum><text>has a relatively low rate of successful service with respect to protection orders, as determined by the Attorney General;</text></subparagraph></paragraph><paragraph id="id5ce0ca427aab4d93831f84d6cf3464b1"><enum>(4)</enum><text>a court that uses an integrated, statewide case management system;</text></paragraph><paragraph id="id96475d809546417e93d21dc91b95c549"><enum>(5)</enum><text>a court that uses a standalone case management system;</text></paragraph><paragraph id="idf9d6472f208746a28b365143cc972f86"><enum>(6)</enum><text>a Tribal court; and</text></paragraph><paragraph id="id87db5260d6c242f09fd3325c77235446"><enum>(7)</enum><text>a court that serves a culturally specific and underserved population.</text></paragraph></subsection><subsection id="id2635af034a244038afe1bf4f2195a025"><enum>(e)</enum><header>Application</header><paragraph id="id40CB9169590F4E3C984ABE8A3464E28B"><enum>(1)</enum><header>In general</header><text>An eligible entity shall submit an application to the Attorney General that includes—</text><subparagraph id="id78f7edcbbbd34306b3a1d6c390c213f2"><enum>(A)</enum><text>a description of the process that the eligible entity uses for service of protection orders at the time of submission of the application;</text></subparagraph><subparagraph id="idb8d20241998f4866b36766392faa7707"><enum>(B)</enum><text>to the extent practicable, statistics relating to protection orders during the 3 calendar years preceding the date of submission of the application, including rates of—</text><clause id="id17F1DC12C13F4AA9AE2EC2E666919430"><enum>(i)</enum><text>successful service; and</text></clause><clause id="id856F77F751654FE9ABAB26693239C7B5"><enum>(ii)</enum><text>enforcement;</text></clause></subparagraph><subparagraph id="iddfce0f20aef24946b90233bad9b37e40"><enum>(C)</enum><text>an initial list of the entities serving as the partners required under subsection (a); and</text></subparagraph><subparagraph id="id9adf113964b94b1f9b1f12b10639310a"><enum>(D)</enum><text>any other information the Attorney General may reasonably require.</text></subparagraph></paragraph><paragraph id="id7D6FA2653AD645C19EFE2A4B8CB42E07"><enum>(2)</enum><header>No other application required</header><text>An eligible entity shall not be required to submit an application under section 2102 to receive a grant under this section.</text></paragraph></subsection><subsection id="idd51e3829d3e24a829422c73557b38b41"><enum>(f)</enum><header>Technical assistance</header><text>Notwithstanding section 40002(b)(11) of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12291">34 U.S.C. 12291(b)(11)</external-xref>), as applied under section 2106 of this part, not less than 5 percent and not more than 8 percent of the total amounts appropriated to carry out this section shall be available to the Attorney General for technical assistance relating to the purposes of this section.</text></subsection><subsection id="idb225078eab624df282be5e188e682400"><enum>(g)</enum><header>Report to Attorney General</header><paragraph id="id8a2aae209804494ca7b98ce90580d994"><enum>(1)</enum><header>Initial report</header><text>Not later than 2 years after receiving a grant under this section, an eligible entity shall submit to the Attorney General a report that details the plan of the entity for implementation of the program under subsection (c).</text></paragraph><paragraph commented="no" id="id54A271E03CAE4DB287CF274D2B90962A"><enum>(2)</enum><header>Subsequent reports</header><subparagraph commented="no" id="idCCA606A1270D4F00803661D51C83D10D"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after implementing the program under subsection (c), and not later than 2 years thereafter, an eligible entity shall submit to the Attorney General a report that describes the program implemented under subsection (c), including with respect to—</text><clause commented="no" id="id2EAC22A8931A4E26B46D53025CEE1E66"><enum>(i)</enum><text>viability;</text></clause><clause commented="no" id="id808DFB1EC2AB464CB23586DE691DB07A"><enum>(ii)</enum><text>cost;</text></clause><clause commented="no" id="idD087FB1785AE4C4FA3EA613DBDB7E8D1"><enum>(iii)</enum><text>service statistics;</text></clause><clause commented="no" id="id6BAE3161B8564DEE80297CB222051DCD"><enum>(iv)</enum><text>challenges;</text></clause><clause id="idb8cf23201b8b432f898f058a2c76c0b9"><enum>(v)</enum><text>analysis of the technology used to fulfill the goals of the program;</text></clause><clause id="idcc1719d631c249e296112c1b7216abad"><enum>(vi)</enum><text>analysis of any legal or due process issues resulting from the electronic service method described in subsection (c)(1)(A); and</text></clause><clause commented="no" id="id834D1D6273A84A8286EC8638868874B0"><enum>(vii)</enum><text>best practices for implementing such a program in other similarly situated locations.</text></clause></subparagraph><subparagraph commented="no" id="idad9f0bb0c26949fdb93ae6339d7ad553"><enum>(B)</enum><header>Contents of final report</header><text>An eligible entity shall include in the second report submitted under subparagraph (A) recommendations for—</text><clause commented="no" id="idDD7B63C6324F4C3C93061F0D2D2C3C93"><enum>(i)</enum><text>future nationwide implementation of the program implemented by the eligible entity; and</text></clause><clause commented="no" id="idC1509861E77C49A7B755A3024AF75A2B"><enum>(ii)</enum><text>usage of electronic service, similar to the service used by the eligible entity, for other commonly used court orders, including with respect to viability and cost.</text></clause></subparagraph></paragraph></subsection><subsection id="id016c6fa958ac4e6c847cd876d7513def"><enum>(h)</enum><header>No regulations or guidelines required</header><text>Notwithstanding section 2105, the Attorney General shall not be required to publish regulations or guidelines implementing this section.</text></subsection><subsection id="id0E7D032C36F04C5FA216F71945FFD74A"><enum>(i)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">In addition to amounts otherwise made available to carry out this part, there is authorized to be appropriated to carry out this section $10,000,000 for fiscal years 2022 through 2027.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
