<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3110</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211028">October 28, 2021</action-date><action-desc><sponsor name-id="S376">Ms. Ernst</sponsor> (for herself and <cosponsor name-id="S397">Mr. Braun</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Director of the Office of Management and Budget to issue guidance relating to reporting by agencies on Federal financial assistance programs that do not provide Federal financial assistance during the 1-year period preceding the date of the report.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Zombie Programs Survival Guide Act</short-title></quote>.</text></section><section id="id8466CB3AF098461A9EE7E28A32E9C901"><enum>2.</enum><header>Guidance for agencies</header><subsection id="id4B19CAA48FD44070A08DA66B18E33D98"><enum>(a)</enum><header>Definitions</header><paragraph id="id1F27F9FBD2304B199D9487844F0741F8"><enum>(1)</enum><header>Covered agency</header><text>The term <term>covered agency</term> means—</text><subparagraph id="idA4180B84AF124246B0C7DC9B06C3818A"><enum>(A)</enum><text>an Executive agency, as defined in section 105 of title 5, United States Code; and</text></subparagraph><subparagraph id="id97CA57D5F7D7407AA4E229F08AE43FD8"><enum>(B)</enum><text>an independent regulatory agency, as defined in section 3502 of title, 44, United States Code.</text></subparagraph></paragraph><paragraph id="idABDB5856150047E386916E7BBE0AA07B"><enum>(2)</enum><header>Federal financial assistance; program</header><text>The terms <term>Federal financial assistance</term> and <term>program</term> have the meaning given those terms in section 1122(a) of title 31, United States Code.</text></paragraph><paragraph id="id8D3FE5D93C7745339FDA3C7359BD8420"><enum>(3)</enum><header>Relevant report</header><text>The term <term>relevant report</term> means—</text><subparagraph id="id04544526344A4D8E8476DA9A6E0E43C6"><enum>(A)</enum><text>a report described in section 3516(a)(2) of title 31, United States Code; or</text></subparagraph><subparagraph id="id40C8946967F24D03800F8E454D4E1197"><enum>(B)</enum><text>the consolidated report described in section 3516(a)(1) of title 31, United States Code.</text></subparagraph></paragraph></subsection><subsection id="id58856D85CF184635B25417F0758B2B88"><enum>(b)</enum><header>Guidance</header><text>Not later than 1 year after the date of enactment of this Act, the Director of the Office of Management and Budget shall issue guidance that requires the head of each covered agency to include, on an annual basis, in a relevant report—</text><paragraph id="id2bac5414b3204688b82e15ecdf2975db"><enum>(1)</enum><text>a list of each program and revolving fund of the covered agency that—</text><subparagraph id="id52A924B4969744F9A13203FFD8F765ED"><enum>(A)</enum><text>provides Federal financial assistance; and</text></subparagraph><subparagraph id="id575C3B27B6094779BB08946F147310BF"><enum>(B)</enum><text>did not provide Federal financial assistance during the 1-year period preceding the date of the report;</text></subparagraph></paragraph><paragraph id="iddc88ba65b1a54e5c891b87840ff04760"><enum>(2)</enum><text>an explanation of why each program or revolving fund described in paragraph (1) did not award Federal financial assistance during the 1-year period preceding the date of the report; and</text></paragraph><paragraph id="id5e02a3472d3a44f7aab3a2182c778614"><enum>(3)</enum><text>the amount of budget authority available for each program or revolving fund described in paragraph (1).</text></paragraph></subsection></section></legis-body></bill>
