which was read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Small Business Act to include hospitals serving rural areas or areas of persistent poverty in the paycheck protection program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HC3728C9821D448FEA615A8EABEA567AD"><section section-type="section-one" id="H96C1506CFAA74FE3955689FFF7F15561"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PPP Access for Rural Hospitals Act</short-title></quote>. </text></section><section section-type="subsequent-section" id="H2C50A5ACC0624BE5AD12115407DB0D1E"><enum>2.</enum><header>Inclusion of critical care hospitals in the paycheck protection program</header><subsection id="H2974C7C99F824F9283E49AF70BBFA3CC"><enum>(a)</enum><header>Eligibility of hospitals with more than one physical location</header><text display-inline="yes-display-inline">Section 7(a)(36)(D)(iii)(I) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)(D)(iii)(I)</external-xref>) is amended by striking <quote>beginning with 72</quote> and inserting the following: <quote>beginning with 72 (or, in the case of a critical care hospital, is assigned a North American Industry Classification System code beginning with 62)</quote>.</text></subsection><subsection id="H1BDEE13E12844EB8BA751ECC58386572"><enum>(b)</enum><header>Waiver of affiliation rules</header><text display-inline="yes-display-inline">Section 7(a)(36)(D)(iv)(I) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)(D)(iv)(I)</external-xref>) is amended by striking <quote>beginning with 72</quote> and inserting the following: <quote>beginning with 72 (or, in the case of a critical care hospital, is assigned a North American Industry Classification System code beginning with 62)</quote>.</text></subsection><subsection id="HBB2E55B1A8E249E4B102D18B182D8979"><enum>(c)</enum><header>Critical care hospitals defined</header><text display-inline="yes-display-inline">Section 7(a)(36)(D) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)(D)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HBF54675057DD47DEB6AB534AF96A0064"><clause id="HF58D3DEEF31B487AA94C1A4AD7D4D2E2"><enum>(ix)</enum><header>Critical care hospital defined</header><text>In this subparagraph, the term <term>critical care hospital</term> means—</text><subclause id="id20EB35C2D01F49019A5472501ED76535"><enum>(I)</enum><text>a hospital (as defined in section 1861(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(e)</external-xref>)) that—</text><item id="HBD9EDA64E24144EEAB75534B015422E3"><enum>(aa)</enum><text display-inline="yes-display-inline">is located in a county (or equivalent unit of local government) in a rural area, as defined in section 1886(d)(2)(D) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(2)(D)</external-xref>);</text></item><item id="idBA314898CF7B47EE810082AEC36ACEEE"><enum>(bb)</enum><text display-inline="yes-display-inline">is treated as being located in a rural area pursuant to section 1886(d)(8)(E) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(8)(E)</external-xref>); or</text></item><item id="HE5F4794ADD6E47CDB4601EFC68C14B41"><enum>(cc)</enum><text display-inline="yes-display-inline">for the most recent cost reporting period under section 1886(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)</external-xref>), received an additional payment under section 1886(d)(5)(F) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(5)(F)</external-xref>); and</text></item></subclause><subclause id="id0225d87f416340c387cb4a56727c9641"><enum>(II)</enum><text>a nonprofit or public critical access hospital, as defined in section 1861(mm)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(mm)(1)</external-xref>).</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
