<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3103</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211028">October 28, 2021</action-date><action-desc><sponsor name-id="S253">Mr. Durbin</sponsor> (for himself, <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>, <cosponsor name-id="S221">Mrs. Feinstein</cosponsor>, <cosponsor name-id="S287">Mr. Cornyn</cosponsor>, and <cosponsor name-id="S057">Mr. Leahy</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to eliminate the statute of limitations for the filing of a civil claim for any person who, while a minor, was a victim of a violation of section 1589, 1590, 1591, 2241(c), 2242, 2243, 2251, 2251A, 2252, 2252A, 2260, 2421, 2422, or 2423 of such title. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Eliminating Limits to Justice for Child Sex Abuse Victims Act of 2021</short-title></quote>.</text></section><section id="id24a57504e5574c609e0b7e3c21105085"><enum>2.</enum><header>Elimination of the statute of limitations</header><text display-inline="no-display-inline">Section 2255 of title 18, United States Code, is amended by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id811b2d28223744aaa3116d03180585ab"><subsection id="id242754dcd64f4da29864ae8b457c6cec"><enum>(b)</enum><header>Statute of limitations</header><text>There shall be no time limit for the filing of any action commenced under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id5c77f990ae6f48d2b36840932da735b1"><enum>3.</enum><header>Effective date; applicability</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall—</text><paragraph id="id8cd4adfa96bd4e1a9f7d3f839f27d9c0"><enum>(1)</enum><text>take effect on date of enactment of this Act; and</text></paragraph><paragraph id="id6913f6419c8d49f8810d64154af5cbbb"><enum>(2)</enum><text>apply to—</text><subparagraph id="id4462116E0FBE446DA671DF5E5D595B3A"><enum>(A)</enum><text>any claim or action that, as of the date described in paragraph (1), would not have been barred under section 2255(b) of title 18, United States Code, as it read the day before the date of enactment of this Act; and</text></subparagraph><subparagraph id="id96D202A3F76C49A59D0DECC2576B569A"><enum>(B)</enum><text>any claim or action arising after the date of enactment of this Act. </text></subparagraph></paragraph></section></legis-body></bill>
