Stafford Disaster Relief and Emergency Assistance Act to improve the provision of certain disaster assistance, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disaster Equity and Fairness Act</short-title></quote>.</text></section><section id="idc5a4615fd1274f59a53424cecddb4e48"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text><paragraph id="id35dc6c25a1594aceb9c50b70c474546b"><enum>(1)</enum><text>the term <term>Administrator</term> means the Administrator of the Agency;</text></paragraph><paragraph id="id26f2cabd013c423ca0de1a36f2af374f"><enum>(2)</enum><text>the term <term>Agency</term> means the Federal Emergency Management Agency;</text></paragraph><paragraph id="id0ea9ebc815e147dd976c369784c43fb2"><enum>(3)</enum><text>the term <term>emergency</term> means an emergency declared or determined to exist by the President under section 501 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5191">42 U.S.C. 5191</external-xref>); </text></paragraph><paragraph id="id3589e37f4b5c4131b85ce9d7c8bf8848"><enum>(4)</enum><text>the terms <term>Indian tribal government</term> and <term>local government</term> have the meanings given such terms in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>); and</text></paragraph><paragraph id="idF5EB5C47C00C495D8B88F8C4249512A2"><enum>(5)</enum><text>the term <term>major disaster</term> means a major disaster declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>).</text></paragraph></section><section id="id2f8738455b26433f9f15cac583d87595"><enum>3.</enum><header>Increase cost-share for consecutive impacts</header><subsection id="idc3671ea0e8e641f0ae9e88c2e77bf800"><enum>(a)</enum><header>In general</header><text>Notwithstanding the provisions of law described in subsection (b), for assistance provided under sections 403, 404, 406, 408, 420, and 428 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170b">42 U.S.C. 5170b</external-xref>, 5170c, 5172, 5174, 5187, 5189f) to a local government or Indian tribal government in connection with the second, or subsequent, major disaster during any 3-year period, the Federal share shall be not less than 90 percent of the eligible cost of such assistance.</text></subsection><subsection id="ida8be7ad026774c6389165ba5bc2f1cfc"><enum>(b)</enum><header>Provisions</header><text>The provisions of law described in this subsection are sections 403(b), 403(c)(4), 404(a), 406(b), 408(d), 408(g)(2), 420(a), and 428(e)(2)(B) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170b">42 U.S.C. 5170b(b)</external-xref>, 5170b(c)(4), 5170c(a), 5172(b), 5174(d), 5174(g)(2), 5187(a), 5189f(e)(2)).</text></subsection></section><section id="ide1ac2af8dc37459abb5e52481a405bc0"><enum>4.</enum><header>State and local plans for meal delivery</header><subsection id="id31b583175410436eaf41cc036be36167"><enum>(a)</enum><header>In general</header><text>Title IV of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida60e44fdc844440fa0ebae91390ddb59"><section id="idb484f12142bc4172b79501293077f129"><enum>431.</enum><header>State and local plans for meal delivery</header><subsection id="idff2de15e5a914b8b9d5b5deab6585c04"><enum>(a)</enum><header>In general</header><text>The Administrator may provide assistance to a State, local government, or Indian tribal government to reimburse the cost of coordinating food delivery, production, and distribution in the event of a major disaster, including—</text><paragraph id="id1e0512a71f4344ca98237b37f6881c9f"><enum>(1)</enum><text>establishing a network to coordinate food delivery, production, and distribution with businesses and private nonprofit organizations;</text></paragraph><paragraph id="idf3c80acfa5ed46339976eefcee36f807"><enum>(2)</enum><text>establishing contracts with small and mid-sized restaurants, food vendors, and private nonprofit organizations, including faith-based organizations, food banks, and soup kitchens, to prepare healthy meals for people in need; and</text></paragraph><paragraph id="id10ff003fb93b4670a2584a920ef3c0d9"><enum>(3)</enum><text>partnering with private nonprofit organizations, including faith-based organizations, food banks, and soup kitchens to purchase directly from food producers and farmers.</text></paragraph></subsection><subsection id="idbee01e76fa214987a591426c756a868d"><enum>(b)</enum><header>Federal share</header><text>The Federal share of the cost of an activity carried out using assistance under this section shall be—</text><paragraph id="id4ffc5ebe6464457d9f1f48c9e0450693"><enum>(1)</enum><text>100 percent of the eligible cost of food delivery, production, and distribution during the 30-day period beginning on the date of the declaration of the major disaster; and</text></paragraph><paragraph id="idf80c8ad8d3e74e859dedbb80063616c0"><enum>(2)</enum><text>not less than 90 percent of such eligible cost after the end of the 30-day period described in paragraph (1).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idd10585b9fe384c609ee9b381ab07f433"><enum>(b)</enum><header>Emergencies</header><text>Section 502(a) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5192">42 U.S.C. 5192(a)</external-xref>) is amended—</text><paragraph id="id52d9693aa2ee448fbb94fed8122a5910"><enum>(1)</enum><text>in paragraph (7), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id6d2235fa136d4d179f9971368d575657"><enum>(2)</enum><text>by redesignating paragraph (8) as paragraph (9); and</text></paragraph><paragraph id="idb9db48a9440e4101bfef5c4477724a59"><enum>(3)</enum><text>by inserting after paragraph (7) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5414e93ab0d645bb98027938fedfcc02"><paragraph id="id4ea34ebd56924801b569a2289f741a00"><enum>(8)</enum><text>provide assistance for food delivery, production, and distribution in accordance with section 431; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id13b6127e6f0f442497780d1b12af9bec"><enum>(c)</enum><header>Guidance</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator shall issue comprehensive guidance to States, local governments, and Indian tribal governments regarding receiving reimbursement for the cost of food delivery, production, and distribution in the event of an emergency or major disaster under section 431 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act, as added by subsection (a), including—</text><paragraph id="ida62f3c75114c410e852ef6267d05f878"><enum>(1)</enum><text>establishing a coordination network;</text></paragraph><paragraph id="idc1c15603f0f5485a98c226ecda2aca2c"><enum>(2)</enum><text>enabling streamlined arrangements for food production and distribution; and</text></paragraph><paragraph id="id2cfbd1fcc2714384b066aa42bb8a3722"><enum>(3)</enum><text>streamlined contracting and partnering with private nonprofit organizations such that private nonprofit organizations may apply directly for reimbursement under such section as an agent of a State, local government, or Indian tribal government.</text></paragraph></subsection></section><section id="id2b9d58c0fe1f4ecbade6ee1fba0671a8"><enum>5.</enum><header>Underserved communities</header><subsection id="idd750574f35dc44c8b5be633e4c481084"><enum>(a)</enum><header>In general</header><text>Section 203 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133</external-xref>) is amended—</text><paragraph id="id8655beb9735f40509db78e26fe051b9e"><enum>(1)</enum><text>by striking <quote>small impoverished</quote> each place it appears except in subsection (a) and inserting <quote>underserved</quote>;</text></paragraph><paragraph id="id4269f4358c9c470fb623015641e3aed6"><enum>(2)</enum><text>by striking subsection (a) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5bfbc50733c14467b42f73419df2e316"><subsection id="id38818af72fbd467faa9884e102afa08b"><enum>(a)</enum><header>Definition of underserved community</header><text>In this section, the term <term>underserved community</term> means populations sharing a particular characteristic, and geographic communities, that have been systematically denied a full opportunity to participate in aspects of economic, social, and civic life, such as—</text><paragraph id="idddf96ca0327e4a2680a0bab4bc3bca7e"><enum>(1)</enum><text>Black, Latino, and Indigenous and Native American persons, Asian Americans and Pacific Islanders, and other persons of color;</text></paragraph><paragraph id="id9b50ec71e41349f8aee6d077bf2326bd"><enum>(2)</enum><text>members of religious minorities;</text></paragraph><paragraph id="idc847d1f1ae614cacad043e3f7d5054a5"><enum>(3)</enum><text>lesbian, gay, bisexual, transgender, queer, and nonbinary persons;</text></paragraph><paragraph id="id08ea2bb40a904c40ad751274a739691a"><enum>(4)</enum><text>persons with access and functional needs;</text></paragraph><paragraph id="id47baa17a6e5c4240b1f18f4377c39c55"><enum>(5)</enum><text>persons who live in rural or geographically isolated areas; and</text></paragraph><paragraph id="id6bd18629d9c64971b24925ad23b51a59"><enum>(6)</enum><text>persons otherwise adversely affected by persistent poverty or inequality.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idb5797873800545ac99777c2c7f69c18f"><enum>(3)</enum><text>in subsection (h)—</text><subparagraph id="idf1994fbc546f4133b2d7313da50309db"><enum>(A)</enum><text>in paragraph (2)—</text><clause id="idf4c0dd1501434323a2a86b3a81e7bc5e"><enum>(i)</enum><text>in the paragraph heading, by striking <quote><header-in-text style="OLC" level="paragraph">small impoverished</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">underserved</header-in-text></quote>; and</text></clause><clause id="ide115a441f3244efa810af1b54d779c35"><enum>(ii)</enum><text>by striking <quote>carried out in a</quote> and inserting <quote>carried out in, or that will benefit persons who are members of, an</quote>; and</text></clause></subparagraph><subparagraph id="idc940939cb78344e7a28f8f463cd075ff"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id92c7735d1db04ccd96b9877b83a9d803"><paragraph id="idefb6f4c3408641f5938b9ef5dcb0eb24"><enum>(3)</enum><header>Technical assistance</header><text>The Administrator shall provide direct technical assistance to eligible entities under this section for applications under this section, prioritizing communities that—</text><subparagraph id="idc2228a9cf3c44ad2a63d5559f5f21202"><enum>(A)</enum><text>have not received hazard mitigation assistance under this Act during the 5-year period ending on the date of enactment of this paragraph;</text></subparagraph><subparagraph id="idc084ee338cb84e5ba924594e3bdf67a7"><enum>(B)</enum><text>are Indian tribal governments;</text></subparagraph><subparagraph id="id9266550e632e43c19100af98e62e8c63"><enum>(C)</enum><text>are underserved communities;</text></subparagraph><subparagraph id="id3e9a616c6c1c4092b2bbf175a0ac4814"><enum>(D)</enum><text>have demonstrated a compelling need, such as significant social vulnerability; </text></subparagraph><subparagraph id="ideaac4f3c28e8409e9b3f4719e218a21a"><enum>(E)</enum><text>have experienced multiple major disaster declarations during the 5-year period ending on the date of enactment of this paragraph; or </text></subparagraph><subparagraph id="id8F4D81486730420A871281DFD163530F"><enum>(F)</enum><text>are exposed to increased hazards or vulnerabilities.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id6606577edc144895bf7f4ee8ecb6d66f"><enum>(b)</enum><header>Increase cost-Share</header><paragraph id="idd10aafe2115d433c8e8d82e5c0f67bd3"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>underserved community</term> has the meaning given that term in subsection (a) of section 203 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133</external-xref>), as amended by this section.</text></paragraph><paragraph id="id2de153ee9d01465b9d580903dcd7d8f1"><enum>(2)</enum><header>Federal share</header><text>Notwithstanding the provisions of law described in paragraph (3), for any emergency or major disaster, the Federal share of assistance provided under sections 403, 404, 406, 408, 420, 428, and 503 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170b">42 U.S.C. 5170b</external-xref>, 5170c, 5172, 5174, 5187, 5189f, 5193)) or section 1366 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4104c">42 U.S.C. 4104c</external-xref>), shall be not less than 90 percent of the eligible cost of such assistance for a recipient—</text><subparagraph id="id2c2a3c74e96e49e4b4ee9617eced5c08"><enum>(A)</enum><text>that will use the assistance in, or for the benefit of persons who are members of, an underserved community; or</text></subparagraph><subparagraph id="id6c4bf553a382405491b173052c1eec64"><enum>(B)</enum><text>who is in, or who is a member of, an underserved community.</text></subparagraph></paragraph><paragraph id="idaff45f4dc0f54b98ab2a22e33944a5eb"><enum>(3)</enum><header>Provisions</header><text>The provisions of law described in this paragraph are sections 403(b), 403(c)(4), 404(a), 406(b), 408(d), 408(g)(2), 420(a), 428(e)(2)(B), and 503(a) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170b">42 U.S.C. 5170b(b)</external-xref>, 5170b(c)(4), 5170c(a), 5172(b), 5174(d), 5174(g)(2), 5187(a), 5189f(e)(2), 5193(a)).</text></paragraph></subsection><subsection id="id99639a4ce64043c3b5cf1a7f27058486"><enum>(c)</enum><header>Technical and conforming amendment</header><text>The Earthquake Hazards Reduction Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/42/7701">42 U.S.C. 7701 et seq.</external-xref>) is amended—</text><paragraph id="idd1bf309938d44a939844c45ccc08c078"><enum>(1)</enum><text>in section 4 (<external-xref legal-doc="usc" parsable-cite="usc/42/7703">42 U.S.C. 7703</external-xref>), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id138e460edac7415b9b81868d65ffe7ac"><paragraph id="id0e8d523ac0f749eca3759c81649217c2"><enum>(11)</enum><text>The term <term>small impoverished community</term> means a community of 3,000 or fewer individuals that is economically disadvantaged, as determined by the State in which the community is located and based on criteria established by the President.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id5f0345ed4cab4682a8dc760ebbfe490a"><enum>(2)</enum><text>in section 5(b)(2)(B)(ii) (<external-xref legal-doc="usc" parsable-cite="usc/42/7704">42 U.S.C. 7704(b)(2)(B)(ii)</external-xref>), by striking <quote>, as defined in section 203 of the Disaster Relief Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133(a)</external-xref>)</quote>. </text></paragraph></subsection></section></legis-body></bill>
