the advanced solar manufacturing production credit.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id298DAE7EB57A406BB80AD5F5ADE577E2"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Solar Energy Manufacturing for America Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id3C1967E3FA774E649BFEB425648640ED"><enum>2.</enum><header>Advanced solar manufacturing production credit</header><subsection id="idF0C596F0E07B4CB3AD390DE170E3AFFF"><enum>(a)</enum><header>In general</header><text>Subpart C of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD8F53742C7FE4F05ACC156A778DB1757"><section id="idBE21D7B866334776AF8CC0D6536836D9"><enum>36C.</enum><header>Advanced solar manufacturing production credit</header><subsection id="id3A471CEEFCFB4BCEB9288B4C21C8C296"><enum>(a)</enum><header>In general</header><paragraph id="idC2A0451FAFDE44AE955BCEF8534A2A5E"><enum>(1)</enum><header>Allowance of credit</header><text>There shall be allowed as a credit against the tax imposed by this subtitle for any taxable year an amount equal to the sum of the credit amounts determined under subsection (b) with respect to each solar component which is—</text><subparagraph id="id64871960C7A64BACBA944394F92CFC9D"><enum>(A)</enum><text>produced by such taxpayer, and</text></subparagraph><subparagraph id="id545BACC0499141B2BCF7DEBF464971DD"><enum>(B)</enum><text>during the taxable year—</text><clause id="id6106D961162E41598F5EF7304644A24C"><enum>(i)</enum><text>sold by the taxpayer to—</text><subclause id="id546C40F38A8043659962FF3E1786C43A"><enum>(I)</enum><text>an unrelated person, or</text></subclause><subclause id="id7487DCB66FD041C9A559DF8F17DBE446"><enum>(II)</enum><text>a related person for the use of such person in their trade or business (with the exception of any trade or business related to resale of such solar component without any subsequent modification, assembly, or integration into a project), or</text></subclause></clause><clause id="idC236B08486CD46A2B485DDE03E895A6A"><enum>(ii)</enum><text>placed in service or operation by the taxpayer or any other person.</text></clause></subparagraph></paragraph><paragraph id="id5A998A5D52C949A5A0F07DC57AC4725B"><enum>(2)</enum><header>Production and sale must be in trade or business</header><text>Any solar component produced and sold by the taxpayer shall be taken into account only if the production and sale described in paragraph (1) is in a trade or business of the taxpayer.</text></paragraph></subsection><subsection id="idA7451A6BE3A142C2AEFC4E8AA5ADC8E7"><enum>(b)</enum><header>Credit amount</header><paragraph id="id4179DA7428A647DF9C93077AA4D4A8C8"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (3), the amount determined under this subsection with respect to any solar component shall be equal to—</text><subparagraph id="id176119DFBD50485EB55C5CB61C7001D0"><enum>(A)</enum><text>in the case of an integrated module, an amount equal to the product of—</text><clause id="id02D69916202748D49DC70850994559EB"><enum>(i)</enum><text>11 cents, multiplied by</text></clause><clause id="id08E75E201D2C402F8FA9BADC2530284B"><enum>(ii)</enum><text>the capacity of such module (expressed on a per direct current watt basis),</text></clause></subparagraph><subparagraph id="idE54CFEF98E874C40A9AB9F3E728DBBCC"><enum>(B)</enum><text>in the case of a photovoltaic cell, an amount equal to the product of—</text><clause id="idDF7B416521184F9CA64222DB7625160E"><enum>(i)</enum><text>4 cents, multiplied by</text></clause><clause id="idA3903E7418FD40C4854013D5728A152A"><enum>(ii)</enum><text>the capacity of such cell (expressed on a per direct current watt basis),</text></clause></subparagraph><subparagraph id="id66A1D16DE825484C96BEB8E62AD05E5B"><enum>(C)</enum><text>in the case of a photovoltaic wafer, $12 per square meter,</text></subparagraph><subparagraph id="idC78F2D53E9EF4AF2A49FAC06AB2FDA84"><enum>(D)</enum><text>in the case of solar grade polysilicon, $3 per kilogram,</text></subparagraph><subparagraph id="id7D01E9338DBD4798ADEE14E59E12FE6B"><enum>(E)</enum><text>in the case of a solar module which is not an integrated module, an amount equal to the product of—</text><clause id="id1E9B49418A8149FFB31B8584201B2910"><enum>(i)</enum><text>7 cents, multiplied by</text></clause><clause id="id17FBE1474D584A089295C7758F9A5BCE"><enum>(ii)</enum><text>the capacity of such module (expressed on a per direct current watt basis),</text></clause></subparagraph><subparagraph id="id50FA4CD3A9E7441EAFEF238132FB53FB"><enum>(F)</enum><text>in the case of a solar tracker torque tube, an amount equal to the product of—</text><clause id="id3ED7B44FDE604A4DA084B7979D56D3EA"><enum>(i)</enum><text>87 cents, multiplied by</text></clause><clause id="id6752149095AD47EC87622E7D91F6EB46"><enum>(ii)</enum><text>the mass of such torque tube (expressed on a per kilogram basis),</text></clause></subparagraph><subparagraph id="id6DD00280378D4F14A557F03CE4940B63"><enum>(G)</enum><text>in the case of a solar tracker longitudinal purlin, an amount equal to the product of—</text><clause id="id191C41095E614CD7B2C9486AD4F166CD"><enum>(i)</enum><text>87 cents, multiplied by</text></clause><clause id="id9FD35C9930B143B59FB525BC8CFE0C53"><enum>(ii)</enum><text>the mass of such longitudinal purlin (expressed on a per kilogram basis), </text></clause></subparagraph><subparagraph id="id0A3788B5AF4C4D6DA13C1BA6799F8C37"><enum>(H)</enum><text>in the case of a solar structural fastener, an amount equal to the product of—</text><clause id="idEF358EA2B0434266A9D4C3C7C77F9F27"><enum>(i)</enum><text>$2.28, multiplied by</text></clause><clause id="id5CF695B352BB47B28E3DEDC1E872B376"><enum>(ii)</enum><text>the mass of such structural fastener (expressed on a per kilogram basis), and</text></clause></subparagraph><subparagraph id="id3C66BF89AB0C4460801D3AB9B6888E0C"><enum>(I)</enum><text>in the case of an inverter, an amount equal to the product of—</text><clause id="idE7EB70B45C064FE18BC6B34184AD0A0E"><enum>(i)</enum><text>the applicable amount, multiplied by</text></clause><clause id="id8887B5DA0DC2438F92B4FBE22AD55E47"><enum>(ii)</enum><text>the capacity of such inverter (expressed on a per alternating current watt basis).</text></clause></subparagraph></paragraph><paragraph id="id6C6F4F314C2544DCA38B0FC8DC0D772B"><enum>(2)</enum><header>Applicable amount</header><text>For purposes of paragraph (1)(I), the applicable amount with respect to any inverter shall be—</text><subparagraph id="id984EC5F145384F31A04BB043823CADCC"><enum>(A)</enum><text>in the case of a central inverter, 0.25 cents,</text></subparagraph><subparagraph id="id7434C1A736F64C52A6243839F0D0ACE4"><enum>(B)</enum><text>in the case of a utility-scale inverter, 1.5 cents,</text></subparagraph><subparagraph id="idAC2FDE9A544A403ABE78D129DDD937EB"><enum>(C)</enum><text>in the case of a commercial inverter, 2 cents,</text></subparagraph><subparagraph id="idE5BD507C2CEC448F9C598C7AA4DEA6AC"><enum>(D)</enum><text>in the case of a residential inverter, 6.5 cents, and</text></subparagraph><subparagraph id="id653595AC21334D8F83BD6CA011A85273"><enum>(E)</enum><text>in the case of a microinverter, 11 cents.</text></subparagraph></paragraph><paragraph id="id076436F03D8A49C085007CA46C1B510B"><enum>(3)</enum><header>Phase out</header><subparagraph id="id86BA9AA54255401CB4AF40142B8F9312"><enum>(A)</enum><header>In general</header><text>In the case of any solar component sold after December 31, 2028, the amount determined under this subsection with respect to such component shall be equal to the product of—</text><clause id="id7970EE308C804D48938A9CC83C89673B"><enum>(i)</enum><text>the amount determined under paragraph (1) with respect to such component, as determined without regard to this paragraph, multiplied by</text></clause><clause id="idD5AA38BEC82546A49F525B90DACD247A"><enum>(ii)</enum><text>the phase out percentage under subparagraph (B).</text></clause></subparagraph><subparagraph id="id17BC2C529A4A4690B40DF667BF1C9E66"><enum>(B)</enum><header>Phase out percentage</header><text>The phase out percentage under this subparagraph is equal to—</text><clause id="id9820AAFB944F455AB698C8F92829950D"><enum>(i)</enum><text>in the case of a solar component sold during calendar year 2029, 70 percent,</text></clause><clause id="idEF34E9A306984C328D2F22ECF66160D7"><enum>(ii)</enum><text>in the case of a solar component sold during calendar year 2030, 35 percent, and</text></clause><clause id="id461FB31AF9EF4C2FB83B39F7B1F58B52"><enum>(iii)</enum><text>in the case of a solar component sold after December 31, 2030, 0 percent.</text></clause></subparagraph></paragraph></subsection><subsection id="id4A9F36A5DAC34D45B82325F934538753"><enum>(c)</enum><header>Definitions and other rules</header><text>In this section—</text><paragraph id="id8B71F91EAF0C484AAF6128D63D453618"><enum>(1)</enum><header>Solar component</header><text>The term <term>solar component</term> means any property described in paragraph (2).</text></paragraph><paragraph id="id079B016CA0894F35AA1D813BD4F48D85"><enum>(2)</enum><header>Other definitions</header><subparagraph id="id20FF30D450144E0C9FC20D47B5D30326"><enum>(A)</enum><header>Integrated module</header><text>The term <term>integrated module</term> means a solar module produced by a single manufacturer through the conversion of a photovoltaic wafer or other semiconductor material into an end product which is—</text><clause id="id2DA488C2D13B4F9CAE68778DDCA863C8"><enum>(i)</enum><text>suitable to generate electricity when exposed to sunlight, and </text></clause><clause id="id277CBCC59A3441AF90F8B7C985FC0566"><enum>(ii)</enum><text>ready for installation without additional manufacturing processes. </text></clause></subparagraph><subparagraph id="id0699D15C7DB34EBEA09804645DF64726"><enum>(B)</enum><header>Photovoltaic cell</header><text>The term <term>photovoltaic cell</term> means the smallest semiconductor element of a solar module which performs the immediate conversion of light into electricity.</text></subparagraph><subparagraph id="id85CDFEF850F24F6A9BA50C878B041821"><enum>(C)</enum><header>Photovoltaic wafer</header><text>The term <term>photovoltaic wafer</term> means a thin slice or sheet of semiconductor material of at least 240 square centimeters produced by a single manufacturer—</text><clause id="id0E662DC4E1D246D6B484281828AA1921"><enum>(i)</enum><text>either—</text><subclause id="id5801EC064AD548DD8E9164C5DB3ED275"><enum>(I)</enum><text>directly from molten solar grade polysilicon, or </text></subclause><subclause id="id12EDCD9A0A694D15A85F767ECBF336AB"><enum>(II)</enum><text>through formation of an ingot from molten polysilicon and subsequent slicing, and</text></subclause></clause><clause id="idFF409BBD97D946718898A5929D16AF18"><enum>(ii)</enum><text>which comprises the substrate of a photovoltaic cell.</text></clause></subparagraph><subparagraph id="id28B226B86DB341FDB554B64A7CBD03AD"><enum>(D)</enum><header>Solar grade polysilicon</header><text>The term <term>solar grade polysilicon</term> means silicon which is—</text><clause id="id02DF876BC07C4B8CA38465F2809F5C81"><enum>(i)</enum><text>suitable for use in photovoltaic manufacturing, and </text></clause><clause id="id7165E7EA5BF54C0FBE7C906BDEF76064"><enum>(ii)</enum><text>purified to a minimum purity of 99.999999 percent silicon by mass.</text></clause></subparagraph><subparagraph id="id5A7443B2E42E42C38DB83153E8F3EF2F"><enum>(E)</enum><header>Solar module</header><text>The term <term>solar module</term> means the connection and lamination of photovoltaic cells into an environmentally protected final assembly which is—</text><clause id="id921E2DC0CACD46D7AAFC94C4801D63EE"><enum>(i)</enum><text>suitable to generate electricity when exposed to sunlight, and </text></clause><clause id="idEFCAE2B23D7E4FD99FAF2485EC498C92"><enum>(ii)</enum><text>ready for installation without an additional manufacturing process. </text></clause></subparagraph><subparagraph id="idBC3CB9FB05024B429877E74E4F82B40D"><enum>(F)</enum><header>Solar tracker components</header><clause id="id451BC8EF440A4FED8E3397214AD0F30F"><enum>(i)</enum><header>In general</header><text>The term <term>solar tracker</term> means a structural support element which supports and mechanically moves solar panels to varying angles with respect to the position of the sun to optimize solar panel output throughout the day.</text></clause><clause id="id622EC2E7B49243DBAE04DD2A1EA55329"><enum>(ii)</enum><header>Solar tracker torque tube</header><text>The term <term>solar tracker torque tube</term> means a tubular structural steel support element of any cross-sectional shape which—</text><subclause id="id4F5C321719D14FCFA4AB7663675974A6"><enum>(I)</enum><text>is part of a solar tracker,</text></subclause><subclause id="idCF11D439AE85428A9076854FBB5F0A55"><enum>(II)</enum><text>may be assembled from individually manufactured segments,</text></subclause><subclause id="id1C93FC53F4A54C4C9C7903B13EDCDABF"><enum>(III)</enum><text>spans longitudinally between foundation posts,</text></subclause><subclause id="id4FE2B8F0F3264ED0B5EE06C0FAC35F4D"><enum>(IV)</enum><text>supports a solar panel (with or without the use of additional support rails), and</text></subclause><subclause id="id60199FF169FC4F449C00A629E92C3ACF"><enum>(V)</enum><text>is rotated by means of a drive system.</text></subclause></clause><clause id="idEA9DB2741C824754A704A0B27364C710"><enum>(iii)</enum><header>Solar tracker longitudinal purlin</header><text>The term <term>solar tracker longitudinal purlin</term> means a structural steel support element which satisfies the conditions described in subclauses (I) through (V) of clause (ii).</text></clause><clause id="idE4AF20B4C4AC4F24B8298D7B431390D1"><enum>(iv)</enum><header>Solar structural fastener</header><text>The term <term>solar structural fastener</term> means a component which is used to connect—</text><subclause id="id6049589C60A1422185EBE33E2301B1EA"><enum>(I)</enum><text>segments of a solar tracker torque tube or solar tracker longitudinal purlin,</text></subclause><subclause id="idE05A4223DDC84959BF2AB70FADB94A5F"><enum>(II)</enum><text>the mechanical and drive system components of a solar tracker to the foundation of such solar tracker, or</text></subclause><subclause id="idDAFC2E2E0727448BA37FA6C466F312A6"><enum>(III)</enum><text>solar tracker torque tubes or solar tracker longitudinal purlins to drive assemblies. </text></subclause></clause></subparagraph><subparagraph id="idFA481249AFED4D32815C3512ED9A8105"><enum>(G)</enum><header>Inverters</header><clause id="idE21EDC518DBF4382B9A4CF11B57A3D25"><enum>(i)</enum><header>In general</header><text>The term <term>inverter</term> means an end product which is suitable to convert direct current electricity into alternating current electricity.</text></clause><clause id="id4B405D09AF3349E8BC39F927133BF63C"><enum>(ii)</enum><header>Central inverter</header><text>The term <term>central inverter</term> means an inverter which is suitable for large utility-scale systems and has a capacity which is greater than 1,500 kilowatts (expressed on a per alternating current watt basis).</text></clause><clause id="id48F35064B3E1476E9694665E9F5C7A35"><enum>(iii)</enum><header>Commercial inverter</header><text>The term <term>commercial inverter</term> means an inverter which—</text><subclause id="idCC60364D0A6F4F8F81E50EEAACF7CC33"><enum>(I)</enum><text>is suitable for commercial applications,</text></subclause><subclause id="idFE13F74A19C4462C864F23B6E1F794AC"><enum>(II)</enum><text>has a rated output of 208, 480, or 600 volt three-phase power, and</text></subclause><subclause id="id12B7CFA9B1424EE99378E5AD2F1FC0F0"><enum>(III)</enum><text>has a capacity which is not less than 20 kilowatts and not greater than 170 kilowatts (expressed on a per alternating current watt basis).</text></subclause></clause><clause id="id288F03A632C04FCFB57455B578ABA71A"><enum>(iv)</enum><header>Microinverter</header><text>The term <term>microinverter</term> means an inverter which—</text><subclause id="idA4E5C4504F15465A99421577E824D4F5"><enum>(I)</enum><text>is suitable to connect with at least one integrated module or solar module,</text></subclause><subclause id="idA5C54852DB65449F9C53257DD9221D53"><enum>(II)</enum><text>has a rated output of 120 volt single-phase power, and </text></subclause><subclause id="id0CCBAA05783C49A6B37CA732757C9459"><enum>(III)</enum><text>has a capacity which is not greater than 650 watts (expressed on a per alternating current watt basis).</text></subclause></clause><clause id="id7F60D28020AC40478221133B8E43B945"><enum>(v)</enum><header>Residential inverter</header><text>The term <term>residential inverter</term> means an inverter which—</text><subclause id="idD835C59A1EE844C49B615B26ACDC434C"><enum>(I)</enum><text>is suitable to connect with at least one integrated module or solar module for a residence,</text></subclause><subclause id="id59B3677D89E44FA1979853EE95A77A69"><enum>(II)</enum><text>has a rated output of 120 volt single-phase power, and</text></subclause><subclause id="id7133D25137944111965B980C692C6C6A"><enum>(III)</enum><text>has a capacity which is not greater than 20 kilowatts (expressed on a per alternating current watt basis).</text></subclause></clause><clause id="id82C3BA62AF5D48F189828507AABB5705"><enum>(vi)</enum><header>Utility-scale inverter</header><text>The term <term>utility-scale inverter</term> means an inverter which—</text><subclause id="id2C279D9B216F4F208AF3BA53D4770552"><enum>(I)</enum><text>is suitable for large utility-scale systems,</text></subclause><subclause id="id70FEB382AE224E0AA0F63590DA1583C2"><enum>(II)</enum><text>has a rated output of not less than 480 volt three-phase power, and</text></subclause><subclause id="idF47588844AD54D498A82102FE7165AB4"><enum>(III)</enum><text>has a capacity which is greater than 170 kilowatts and not greater than 1,500 kilowatts (expressed on a per alternating current watt basis).</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" id="id56091EF4C5D749C8BC88AEFC27E72488"><enum>(3)</enum><header>Related persons</header><text>Persons shall be treated as related to each other if such persons would be treated as a single employer under the regulations prescribed under section 52(b). In the case of a corporation which is a member of an affiliated group of corporations filing a consolidated return, such corporation shall be treated as selling components to an unrelated person if such component is sold to such a person by another member of such group. </text></paragraph><paragraph id="id552CFB064F2549948194EE04C0B526CF"><enum>(4)</enum><header>Only production in the United States taken into account</header><text>Sales shall be taken into account under this section only with respect to solar components the production of which is within—</text><subparagraph id="id909708620CDE4136BB545D9B1620F5B1"><enum>(A)</enum><text>the United States (within the meaning of section 638(1)), or</text></subparagraph><subparagraph id="idBEBAE3215FDB4269908DF9C94A16A6A9"><enum>(B)</enum><text>a possession of the United States (within the meaning of section 638(2)).</text></subparagraph></paragraph><paragraph commented="no" id="id8DFEBF2DAA414F7B95B149C94E52C2E9"><enum>(5)</enum><header>Pass-thru in the case of estates and trusts</header><text>Under regulations prescribed by the Secretary, rules similar to the rules of subsection (d) of section 52 shall apply.</text></paragraph></subsection><subsection commented="no" id="idBFF0EC5133F043B783D039A034E00BD0"><enum>(d)</enum><header>Registration</header><paragraph commented="no" id="id7C274014D559460C8A3AB6C9F06F63F0"><enum>(1)</enum><header>In general</header><text>The Secretary shall require any person claiming tax benefits under the provisions of this section to register with the Secretary at such time, in such form and manner, and subject to such terms and conditions, as the Secretary may by regulations prescribe. A registration under this subsection may be used only in accordance with regulations prescribed under this subsection.</text></paragraph><paragraph commented="no" id="id88198F74DDA2440BADE9DF8FD2C64EE3"><enum>(2)</enum><header>Registration in event of change in ownership</header><text>Under regulations prescribed by the Secretary, a person (other than a corporation the stock of which is regularly traded on an established securities market) shall be required to re-register under this subsection if after a transaction (or series of related transactions) more than 50 percent of ownership interests in, or assets of, such person are held by persons other than persons (or persons related thereto) who held more than 50 percent of such interests or assets before the transaction (or series of related transactions).</text></paragraph><paragraph commented="no" id="idC86C434F16F84BF48798F92F01319FCD"><enum>(3)</enum><header>Denial, revocation, or suspension of registration</header><text>Rules similar to the rules of section 4222(c) shall apply to registration under this section.</text></paragraph><paragraph commented="no" id="id0CB9524517734B9C8AF9022B3B63D480"><enum>(4)</enum><header>Information reporting</header><text>The Secretary may require—</text><subparagraph commented="no" id="id6BCE7A8312FB41A7B61786CB3B7A4E99"><enum>(A)</enum><text>information reporting by any person registered under this subsection, and</text></subparagraph><subparagraph commented="no" id="id32EDBCD788994BD98FE32A3165E242CC"><enum>(B)</enum><text>information reporting by such other persons as the Secretary deems necessary to carry out this section.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idF9E0B250F84D4457ADF7C1D184AEDCA1"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="id42B76973F1E548D399F0F1FC0C45EF30"><enum>(1)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/26/6211">Section 6211(b)(4)(A)</external-xref> of the Internal Revenue Code of 1986 is amended by inserting <quote>36C,</quote> after <quote>36B,</quote>.</text></paragraph><paragraph id="idCC5FAE21912D442CBDF8F85E9F45C080"><enum>(2)</enum><text>Paragraph (2) of section 1324(b) of title 31, United States Code, is amended by inserting <quote>36C,</quote> after <quote>36B,</quote>.</text></paragraph><paragraph id="id98304BBA52864F48B027322EFD587D61"><enum>(3)</enum><text>The table of sections for subpart C of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after the item relating to section 36B the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB4A28D615D1B46B5AAF26E6CACD156B2"><toc><toc-entry bold="off" level="section">Sec. 36C. Advanced solar manufacturing production credit.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idC191A4216AA44FD0A8C4712D50BF0667"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to components produced and sold after December 31, 2021.</text></subsection></section></legis-body></bill>
