<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3084</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211027">October 27, 2021</action-date><action-desc><sponsor name-id="S388">Ms. Hassan</sponsor> (for herself and <cosponsor name-id="S398">Mr. Cramer</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Servicemembers Civil Relief Act to provide for the termination of telephone, multichannel video programming, and internet access service contracts by servicemembers after the receipt of stop movement orders due to an emergency situation, and for other purposes. </official-title></form><legis-body><section id="id3F0D340BEB1D49FD9562F2F0F7271DBE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Emergency Relief for Servicemembers Act of 2021</short-title></quote>.</text></section><section id="H1A1AD34D7B5242DD9DF382B0E0359FB1" section-type="subsequent-section"><enum>2.</enum><header>Termination of telephone, multichannel video programming, and internet access service contracts by ser­vice­mem­bers who enter into contracts after receiving military orders for permanent change of station but then receive stop movement orders due to an emergency situation</header><subsection id="H0397687C562E40D4A2CB51E5AA44B145"><enum>(a)</enum><header>In general</header><text>Section 305A(a)(1) of the Servicemembers Civil Relief Act (50 U.S.C. 3956 (a)(1)) is amended—</text><paragraph id="HE76EAC74B8164DD3A73716685AB34E8C"><enum>(1)</enum><text>by striking <quote>after the date the servicemember receives military orders to relocate for a period of not less than 90 days to a location that does not support the contract.</quote> and inserting <quote>after—</quote>; and</text></paragraph><paragraph id="HBF747AAA1F7040868F10B54F1C3B3A23"><enum>(2)</enum><text>by adding at the end the following new subparagraphs:</text><quoted-block id="HCB6B9993D9034318BB1008044A63F7ED" style="OLC"><subparagraph id="H3E590ED3A6D241F3A7BFD48B815B61B1"><enum>(A)</enum><text>the date the servicemember receives military orders to relocate for a period of not less than 90 days to a location that does not support the contract; or</text></subparagraph><subparagraph id="HC41FD56F85B3452DB664A94B318F2BE8"><enum>(B)</enum><text>the date the servicemember, while in military service, receives military orders (as defined in section 305( i)) for a permanent change of station (as defined in section 305(i)), thereafter enters into the contract, and then after entering into the contract receives a stop movement order issued by the Secretary of Defense in response to a local, national, or global emergency, effective for an indefinite period or for a period of not less than 30 days, which prevents the servicemember from using the services provided under the contract.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H2F71F63961864A32B9B91B03FC8E5A0D"><enum>(b)</enum><header>Retroactive application</header><text>The amendments made by this Act shall apply to any stop movement order issued on or after March 1, 2020.</text></subsection></section></legis-body></bill>
