<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3079</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211026">October 26, 2021</action-date><action-desc><sponsor name-id="S396">Mrs. Blackburn</sponsor> (for herself, <cosponsor name-id="S236">Mr. Inhofe</cosponsor>, <cosponsor name-id="S410">Ms. Lummis</cosponsor>, <cosponsor name-id="S407">Mr. Hagerty</cosponsor>, <cosponsor name-id="S397">Mr. Braun</cosponsor>, <cosponsor name-id="S345">Mr. Johnson</cosponsor>, <cosponsor name-id="S412">Mr. Tuberville</cosponsor>, and <cosponsor name-id="S411">Mr. Marshall</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To exempt essential workers from Federal COVID–19 vaccine mandates.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keeping Our COVID–19 Heroes Employed Act</short-title></quote>.</text></section><section id="idB808392444F740C191082B074919ACD3"><enum>2.</enum><header>Exemption from vaccine mandates</header><subsection id="idE41EB77013354988BEEEF34C74622D2E"><enum>(a)</enum><header>In general</header><text>Any requirement imposed by an entity described in subsection (b) that individuals be vaccinated against COVID–19 shall provide for an exemption from such requirement for all essential workers.</text></subsection><subsection id="idAFE3BEB0CEFD4C9CB3307A61C366A611"><enum>(b)</enum><header>Entities described</header><text>An entity described in this subsection is any of the following:</text><paragraph id="id55D33A592AFB49CCB71A265386E1DA9D"><enum>(1)</enum><text>The Federal Government.</text></paragraph><paragraph id="idEFF84B5549DC440FB0C73D0342F03CE9"><enum>(2)</enum><text>A public or private Federal contractor.</text></paragraph><paragraph id="id57C41D34710B4E5D9F3F1932CAD4E355"><enum>(3)</enum><text>A private entity receiving Federal funds.</text></paragraph><paragraph id="idEB24AF9B866C4A1798E50AD626D66138"><enum>(4)</enum><text>A public entity receiving funding under the Coronavirus Preparedness and Response Supplemental Appropriations Act, 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/123">Public Law 116–123</external-xref>), the Families First Coronavirus Response Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/127">Public Law 116–127</external-xref>), the Coronavirus Aid, Relief, and Economic Security Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>), the Paycheck Protection Program and Health Care Enhancement Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/139">Public Law 116–139</external-xref>), division M or N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>), or the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>), as a condition for retaining such funds or receiving future disbursements of such funds. </text></paragraph></subsection><subsection id="id0577BB9F898B499A8F3838A6D96DC053"><enum>(c)</enum><header>Essential workers defined</header><text>For purposes of this section, the term <term>essential worker</term> means an individual—</text><paragraph id="id60DB01CA30D045E091489791B6DCE614"><enum>(1)</enum><text>whom a relevant State, Indian Tribe, or territory deemed essential during the response to the COVID–19 pandemic; or</text></paragraph><paragraph id="id323D93C238824F48B0CE83B0714D3EFF"><enum>(2)</enum><text>who was exempt from any restrictions in response to the COVID–19 pandemic imposed by a relevant State, Indian Tribe, or territory.</text></paragraph></subsection></section></legis-body></bill>
