Chafee Foster Care Independence Program funding to address pandemic-related challenges for older foster youth.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Continued State Flexibility to Assist Older Foster Youth Act</short-title></quote>.</text></section><section id="HE5E9BF7C790C4CC3B615A9B8A8F8B5AD"><enum>2.</enum><header>Extension of pandemic provisions affecting older foster youth</header><subsection id="H1A43909770194F46A6902AE4703D6954"><enum>(a)</enum><header>Extension of Chafee program flexibility</header><text display-inline="yes-display-inline">Section 3 of division X of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677</external-xref> note) is amended—</text><paragraph id="H4DB990DB04EB472EBAC25CC3B7E9317D"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b), by striking <quote>and 2021</quote> and inserting <quote>through 2022</quote>; and</text></paragraph><paragraph id="H98A0B4363FD34AF6B60559A338160DF0"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d)—</text><subparagraph id="H89BDB8CDC4194C6E8C9C92A6ED8165A6"><enum>(A)</enum><text>by striking <quote>During the COVID–19 public health emergency period:</quote>;</text></subparagraph><subparagraph id="H8708E3D1E01A49469E9698D3439182F4"><enum>(B)</enum><text>in paragraph (1), by striking <quote>The</quote> and inserting <quote>Through December 31, 2021, the</quote>;</text></subparagraph><subparagraph id="H707A826426FE4276987941C80C2F37F6"><enum>(C)</enum><text>in paragraph (2), by striking <quote>A</quote> and inserting <quote>Through fiscal year 2022, a</quote>;</text></subparagraph><subparagraph id="H2215C39D2E7C471DA1519C2BBE80DF0A"><enum>(D)</enum><text>in paragraph (3), by striking <quote>Notwithstanding</quote> and inserting <quote>Through fiscal year 2022, notwithstanding</quote>; and</text></subparagraph><subparagraph id="HA46E652F7CBB429A885C2170FF67EB6C"><enum>(E)</enum><text>in paragraph (4), by inserting after the paragraph heading the following: <quote>Through fiscal year 2022:</quote>.</text></subparagraph></paragraph></subsection><subsection id="H681BC7521FD64BE489DFE2C79BC8E133"><enum>(b)</enum><header>Extension of State funding flexibility related to youth aging out of foster care</header><text display-inline="yes-display-inline">Section 4 of such division (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671</external-xref> note) is amended—</text><paragraph id="HE57704CFAF8641BEA75F3B417A659C1A"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (d)—</text><subparagraph id="H62C52291460A45549D58904117985B16"><enum>(A)</enum><text>in paragraph (2)(A), by striking <quote>2021</quote> and inserting <quote>2022</quote>; and</text></subparagraph><subparagraph id="HAF5BFBDC82EA4C36A5AD6645BABAE686"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H8F75A51845F8456986ACFCAF55A5D15F" display-inline="no-display-inline"><paragraph id="H70398AD02B284C7C82BC70562BE15312"><enum>(3)</enum><header>Additional Chafee funding flexibilities</header><text display-inline="yes-display-inline">Notwithstanding paragraph (2) of this subsection, a State to which additional funds are made available as a result of section 3(a) of this division may use the funds to meet any costs referred to in paragraph (1) of this subsection incurred on or before September 30, 2022, with respect to children who—</text><subparagraph id="H1A89872DD46641988AC0E369EAEE9E4F"><enum>(A)</enum><text>have attained 18 years of age;</text></subparagraph><subparagraph id="H01CD610E74D840BAA76EC5078D4064B8"><enum>(B)</enum><text>are in foster care, or re-enter care; and</text></subparagraph><subparagraph id="HE5BC7E8C26B44864AD28F7215A6A28CC"><enum>(C)</enum><text>are not eligible for foster care maintenance payments under section 472 of the Social Security Act.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HFC4FDAA8B4AD404F9F306B6D6299E79C" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (e), by striking <quote>2021</quote> and inserting <quote>2022</quote>. </text></paragraph></subsection></section></legis-body></bill>
