Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Energy to establish a battery material processing grant program and a battery manufacturing and recycling grant program, and for other purposes.</official-title></form><legis-body><section id="id322EFB438E3B4A9983144B2C4B3DFACF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Battery Material Processing and Component Manufacturing Act of 2021</short-title></quote>.</text></section><section id="S1" section-type="subsequent-section"><enum>2.</enum><header>Battery material processing and battery manufacturing and recycling grants</header><subsection id="ide66641e1460b48df850feca5f87c34e7"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id0d7b97db3ff5421c98679a50d9d283ff"><enum>(1)</enum><header>Advanced battery</header><text>The term <term>advanced battery</term> means a battery that consists of a battery cell that can be integrated into a module, pack, or system to be used in energy storage applications, including electric vehicles and the electric grid. </text></paragraph><paragraph id="id7d5de9998ae14ac79cf0188ed9d1c150"><enum>(2)</enum><header>Advanced battery component</header><subparagraph id="id420879fd1dab4a5996b0ca34c6439815"><enum>(A)</enum><header>In general</header><text>The term <term>advanced battery component</term> means a component of an advanced battery.</text></subparagraph><subparagraph id="idac74d1b18b85476caf5942225b58226d"><enum>(B)</enum><header>Inclusions</header><text>The term <term>advanced battery component</term> includes materials, enhancements, enclosures, anodes, cathodes, electrolytes, cells, and other associated technologies that comprise an advanced battery.</text></subparagraph></paragraph><paragraph id="id218f52ec680348df90f6e4c429ac59b5"><enum>(3)</enum><header>Battery material</header><text>The term <term>battery material</term> means the raw and processed form of a mineral, metal, chemical, or other material used in an advanced battery component.</text></paragraph><paragraph id="id3c4e700e9aa846eabb7a1f38bab82889"><enum>(4)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means an entity described in any of paragraphs (1) through (5) of section 989(b) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16353">42 U.S.C. 16353(b)</external-xref>).</text></paragraph><paragraph id="id597cc777ce2f481a8ddbe382baac0ccb"><enum>(5)</enum><header>Foreign entity of concern</header><text>The term <term>foreign entity of concern</term> means a foreign entity that is—</text><subparagraph id="id701aa17e0ac643ebbb18e01b5446585b"><enum>(A)</enum><text>designated as a foreign terrorist organization by the Secretary of State under section 219(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189(a)</external-xref>);</text></subparagraph><subparagraph id="idbe8ee40298794bca89b5c7e437ca70a8"><enum>(B)</enum><text>included on the list of specially designated nationals and blocked persons maintained by the Office of Foreign Assets Control of the Department of the Treasury (commonly known as the <quote>SDN list</quote>);</text></subparagraph><subparagraph id="id1aaeec3231614e14a93261ee0335eed7"><enum>(C)</enum><text>owned by, controlled by, or subject to the jurisdiction or direction of a government of a foreign country that is a covered nation (as defined in section 2533c(d) of title 10, United States Code);</text></subparagraph><subparagraph id="idfd6c3fe1c5c444939e653bd5fbbf2ff9"><enum>(D)</enum><text>alleged by the Attorney General to have been involved in activities for which a conviction was obtained under—</text><clause id="id41a8a2505eec4eff8b1a6fdcffa3d95a"><enum>(i)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/37">chapter 37</external-xref> of title 18, United States Code (commonly known as the <quote>Espionage Act</quote>);</text></clause><clause id="id0526086e62a64c90aee3b1d0d864c5ef"><enum>(ii)</enum><text>section 951 or 1030 of title 18, United States Code;</text></clause><clause id="ida5277787aa6d497596383c7bf24472ac"><enum>(iii)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/90">chapter 90</external-xref> of title 18, United States Code (commonly known as the <quote>Economic Espionage Act of 1996</quote>);</text></clause><clause id="id544f52ae66ee4d9ba6ebe0099928a15c"><enum>(iv)</enum><text>the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2751">22 U.S.C. 2751 et seq.</external-xref>);</text></clause><clause id="idaa8a46a6493545c3aae279e337bb8aef"><enum>(v)</enum><text>section 224, 225, 226, 227, or 236 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2274">42 U.S.C. 2274</external-xref>, 2275, 2276, 2277, and 2284);</text></clause><clause id="idc5029a70339b42e0b1daf9cabd60a403"><enum>(vi)</enum><text>the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4801">50 U.S.C. 4801 et seq.</external-xref>); or</text></clause><clause id="idadb4d234e3a14ddb956ff5edfaf621c1"><enum>(vii)</enum><text>the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>); or</text></clause></subparagraph><subparagraph id="ideed4f232a0a4432fb67f3bfa2dd49720" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text>determined by the Secretary, in consultation with the Secretary of Defense and the Director of National Intelligence, to be engaged in unauthorized conduct that is detrimental to the national security or foreign policy of the United States. </text></subparagraph></paragraph><paragraph id="id167a9d3e08a74eb085c47bfd94ffd90a"><enum>(6)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>). </text></paragraph><paragraph id="id0f6b275b1f494f778abf79fe84da152c"><enum>(7)</enum><header>Manufacturing</header><text>The term <term>manufacturing</term>, with respect to an advanced battery and an advanced battery component, means the industrial and chemical steps taken to produce that advanced battery or advanced battery component, respectively.</text></paragraph><paragraph id="idebf6d7b96ca34256b1738b742a7c141d"><enum>(8)</enum><header>Processing</header><text>The term <term>processing</term>, with respect to battery material, means the refining of materials, including the treating, baking, and coating processes used to convert raw products into constituent materials employed directly in advanced battery manufacturing. </text></paragraph><paragraph id="idb4ff34eef18d47908314fdbf0b3f6f6d"><enum>(9)</enum><header>Recycling</header><text>The term <term>recycling</term> means the recovery of materials from advanced batteries to be reused in similar applications, including the extracting, processing, and recoating of battery materials and advanced battery components.</text></paragraph><paragraph id="id2624FD9B8C2D403A8CE653FE1B8DE846"><enum>(10)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy. </text></paragraph></subsection><subsection id="idfc3ce1bc9b8547368150f37e6694fa56"><enum>(b)</enum><header>Battery material processing grants</header><paragraph id="id87dddfc3cbd44bc48601721219e370d3"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish within the Office of Fossil Energy a program, to be known as the <quote>Battery Material Processing Grant Program</quote> (referred to in this subsection as the <quote>program</quote>), under which the Secretary shall award grants in accordance with this subsection.</text></paragraph><paragraph id="idb588ddfd90fd4278b7c2ac07453387e4"><enum>(2)</enum><header>Purposes</header><text>The purposes of the program are—</text><subparagraph id="id9918cdd912af4989b249fb7678ae4d83"><enum>(A)</enum><text>to ensure that the United States has a viable battery materials processing industry to supply the North American battery supply chain;</text></subparagraph><subparagraph id="id62133640a3e54613bbe0de3ff8fd94ec"><enum>(B)</enum><text>to expand the capabilities of the United States in advanced battery manufacturing;</text></subparagraph><subparagraph id="id442547a550cd48e4adf4cb297635f979"><enum>(C)</enum><text>to enhance national security by reducing the reliance of the United States on foreign competitors for critical materials and technologies; and</text></subparagraph><subparagraph id="id8e35911439584bccb56dff4d15d77b7e"><enum>(D)</enum><text>to enhance the domestic processing capacity of minerals necessary for battery materials and advanced batteries. </text></subparagraph></paragraph><paragraph id="idd1aa5c4a879f43199f05c1427448037c"><enum>(3)</enum><header>Grants</header><subparagraph id="id71bbeced8e994a97aa5e5059fe9a157e"><enum>(A)</enum><header>In general</header><text>Under the program, the Secretary shall award grants to eligible entities—</text><clause id="id226a48077a5c44398afed85294bdc88f"><enum>(i)</enum><text>to carry out 1 or more demonstration projects in the United States for the processing of battery materials;</text></clause><clause id="id92edfee4049945a7a2a80034a39b3ffa"><enum>(ii)</enum><text>to construct 1 or more new commercial-scale battery material processing facilities in the United States; and</text></clause><clause id="id7361bde8bedf470a94fb758be816dbb4"><enum>(iii)</enum><text>to retool, retrofit, or expand 1 or more existing battery material processing facilities located in the United States and determined qualified by the Secretary. </text></clause></subparagraph><subparagraph id="idd105e567270b4ff9aa644a0da8b5f44a"><enum>(B)</enum><header>Amount limitation</header><text>The amount of a grant awarded under the program shall be not less than—</text><clause id="id444d68424f6e4898a87fc946205e6ee1"><enum>(i)</enum><text>$50,000,000 for an eligible entity carrying out 1 or more projects described in subparagraph (A)(i);</text></clause><clause id="id0082201b49384e3f94fe8795a0461a37"><enum>(ii)</enum><text>$100,000,000 for an eligible entity carrying out 1 or more projects described in subparagraph (A)(ii); and</text></clause><clause id="idcb6a3dfbec4340c4935f7516d159e7ff"><enum>(iii)</enum><text>$50,000,000 for an eligible entity carrying out 1 or more projects described in subparagraph (A)(iii).</text></clause></subparagraph><subparagraph id="idfa83df3bc3fa4c8f98e332709164ebd1"><enum>(C)</enum><header>Priority; consideration</header><text>In awarding grants to eligible entities under the program, the Secretary shall—</text><clause id="id64cb8e9f734a410e9307457d260d450a"><enum>(i)</enum><text>give priority to an eligible entity that—</text><subclause id="id8c551854563f4473b484029abf87af2c"><enum>(I)</enum><text>is located and operates in the United States;</text></subclause><subclause id="id3EED5963BE5E417CBE6D2E67160C7012"><enum>(II)</enum><text>is owned by a United States entity;</text></subclause><subclause id="ida1c1f1f6a0b54bb29269f755a38d2148"><enum>(III)</enum><text>deploys North American-owned intellectual property and content;</text></subclause><subclause id="id414488c535354e68aacc1c8b9aa80241"><enum>(IV)</enum><text>represents consortia or industry partnerships; and</text></subclause><subclause id="id1D60122AA4B64FCB9AFAE688BD9F79CA"><enum>(V)</enum><text>will not use battery material supplied by or originating from a foreign entity of concern; and </text></subclause></clause><clause id="id09b0717c51fe4c8a98d7b48f70fa945b"><enum>(ii)</enum><text>take into consideration whether a project—</text><subclause id="id6e4db54d34e345379d5c03b0a7e315a8"><enum>(I)</enum><text>provides workforce opportunities in low- and moderate-income communities;</text></subclause><subclause id="id778146e1e448490fa21d2cea49b8b0fd"><enum>(II)</enum><text>encourages partnership with universities and laboratories to spur innovation and drive down costs;</text></subclause><subclause id="idA5F89D0DD00843AE9F84953E1A97D6BA"><enum>(III)</enum><text>partners with Indian Tribes; and</text></subclause><subclause id="idd3946953aade462984b438dcbcc321c8"><enum>(IV)</enum><text>takes into account—</text><item id="idD278F14323BD4E7393633DF82A505338"><enum>(aa)</enum><text>greenhouse gas emissions reductions and energy efficient battery material processing opportunities throughout the manufacturing process; and </text></item><item id="id3B8146B065014C3A8BF02AD7A5469A68"><enum>(bb)</enum><text>supply chain logistics.</text></item></subclause></clause></subparagraph></paragraph><paragraph id="id8d5043488f2b4098aebe50aad6843ab2"><enum>(4)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out the program $3,000,000,000 for the period of fiscal years 2022 through 2026, to remain available until expended. </text></paragraph></subsection><subsection id="id4cec6eebf4e64a1bba6034cbb51fd66c"><enum>(c)</enum><header>Battery manufacturing and recycling grants</header><paragraph id="ida88b1da12dd640729f739fcadeed6ee9"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish within the Office of Energy Efficiency and Renewable Energy a battery manufacturing and recycling grant program (referred to in this subsection as the <quote>program</quote>).</text></paragraph><paragraph id="id6fcb8b471274402699c0aeae73820fe5"><enum>(2)</enum><header>Purpose</header><text>The purpose of the program is to ensure that the United States has a viable domestic manufacturing and recycling capability to support and sustain a North American battery supply chain.</text></paragraph><paragraph id="id61fa92cd0f58483abb649213b11c0c7c"><enum>(3)</enum><header>Grants</header><subparagraph id="id183b449e1116415fa3ad826ca673dab9"><enum>(A)</enum><header>In general</header><text>Under the program, the Secretary shall award grants to eligible entities—</text><clause id="id6bdbb5e5082b451f82b96339341e0bc3"><enum>(i)</enum><text>to carry out 1 or more demonstration projects for advanced battery component manufacturing, advanced battery manufacturing, and recycling;</text></clause><clause id="id1aa96d91597e4c30bea95b766ec4794d"><enum>(ii)</enum><text>to construct 1 or more new commercial-scale advanced battery component manufacturing, advanced battery manufacturing, or recycling facilities in the United States; and</text></clause><clause id="id2c2334cd79914a0fb239970d0afcffb9"><enum>(iii)</enum><text>to retool, retrofit, or expand 1 or more existing facilities located in the United States and determined qualified by the Secretary for advanced battery component manufacturing, advanced battery manufacturing, and recycling.</text></clause></subparagraph><subparagraph id="id5b183293bcf647449a87ee21febc39d2"><enum>(B)</enum><header>Amount limitation</header><text>The amount of a grant awarded under the program shall be not less than—</text><clause id="id012cad06cf7d4470b165785927c620cd"><enum>(i)</enum><text>$50,000,000 for an eligible entity carrying out 1 or more projects described in subparagraph (A)(i);</text></clause><clause id="id096384fc804d4a01a9fe1963f5e69721"><enum>(ii)</enum><text>$100,000,000 for an eligible entity carrying out 1 or more projects described in subparagraph (A)(ii); and</text></clause><clause id="ida25bb82da0a540b2932c3c48ecef40cf"><enum>(iii)</enum><text>$50,000,000 for an eligible entity carrying out 1 or more projects described in subparagraph (A)(iii).</text></clause></subparagraph><subparagraph id="id1af71651ce0346028c52190092b8e2c8"><enum>(C)</enum><header>Priority; consideration</header><text>In awarding grants to eligible entities under the program, the Secretary shall—</text><clause id="id6cedd9bbfb1a4aa59509f5789703de7a"><enum>(i)</enum><text>give priority to an eligible entity that—</text><subclause id="idc302b276d1144a78ae9f1df6a6e5c0c9"><enum>(I)</enum><text>is located and operates in the United States;</text></subclause><subclause id="idc7d791c6eaf649329fae3f11f88c8c65"><enum>(II)</enum><text>is owned by a United States entity;</text></subclause><subclause id="idcb0d6141ca39416ca334ee61712fd53d"><enum>(III)</enum><text>deploys North American-owned intellectual property and content;</text></subclause><subclause id="idc013a1b69a6a4ead9f17a6b2dcab5461"><enum>(IV)</enum><text>represents consortia or industry partnerships; and</text></subclause><subclause id="id4fb425196dd048d4a4dc0d247801679b" commented="no"><enum>(V)</enum><item commented="no" display-inline="yes-display-inline" id="id243BE409554545DCB252B29250FC8CD8"><enum>(aa)</enum><text>if the eligible entity will use the grant for advanced battery component manufacturing, will not use battery material supplied by or originating from a foreign entity of concern; or</text></item><item id="id409ad376f8a64dd280d3c80708326a53" commented="no" indent="up1"><enum>(bb)</enum><text>if the eligible entity will use the grant for battery recycling, will not export recovered critical materials to a foreign entity of concern; and</text></item></subclause></clause><clause id="id8c73579f1e884a9d87405786b3b084b2"><enum>(ii)</enum><text>take into consideration whether a project—</text><subclause id="id4f8d69595873461cbb7178ac408c5c5c"><enum>(I)</enum><text>provides workforce opportunities in low- and moderate-income or rural communities;</text></subclause><subclause id="idd65cfb2a50e84140a051abb811508b29"><enum>(II)</enum><text>provides workforce opportunities in communities that have lost jobs due to the displacements of fossil energy jobs;</text></subclause><subclause id="id2ebe2ab9397d457aacf7a02dd836c484"><enum>(III)</enum><text>encourages partnership with universities and laboratories to spur innovation and drive down costs;</text></subclause><subclause id="idC96F882ACFBF4F65AB08DF1333558862"><enum>(IV)</enum><text>partners with Indian Tribes;</text></subclause><subclause id="id4cad9111f2914c9d9fd3c368eb931826"><enum>(V)</enum><text>takes into account—</text><item id="idA8C557D630074400AE1833D945FB1156"><enum>(aa)</enum><text>greenhouse gas emissions reductions and energy efficient battery material processing opportunities throughout the manufacturing process; and </text></item><item id="idFB0DE5B5A65841A894383275974D3AD1"><enum>(bb)</enum><text>supply chain logistics; and</text></item></subclause><subclause id="id5EF4FE4E050949D4BE098F8165D619EB"><enum>(VI)</enum><text>utilizes feedstock produced in the United States.</text></subclause></clause></subparagraph></paragraph><paragraph id="id7ab9be66fdc644c89c5feb10ca4ec521"><enum>(4)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out the program $3,000,000,000 for the period of fiscal years 2022 through 2026, to remain available until expended. </text></paragraph></subsection><subsection id="id04cf62e518aa47a6988cf5d83a9d5c31"><enum>(d)</enum><header>Reporting requirements</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary shall submit to Congress a report on the grant programs established under subsections (b) and (c), including, with respect to each grant program, a description of—</text><paragraph id="id76b79bbb5d63412b9ac60662a76a3c4b"><enum>(1)</enum><text>the number of grant applications received;</text></paragraph><paragraph id="idfe9680db4a68417abaf4def69e065c4e"><enum>(2)</enum><text>the number of grants awarded and the amount of each award;</text></paragraph><paragraph id="id251fa783f8dd4144b9dfe2c74acef7ad"><enum>(3)</enum><text>the purpose and status of each project carried out using a grant; and</text></paragraph><paragraph id="idfdd63d7c06f34a5dba7592c1b4dbbe97"><enum>(4)</enum><text>any other information the Secretary determines necessary. </text></paragraph></subsection></section></legis-body></bill>
