<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3059</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211025">October 25, 2021</action-date><action-desc><sponsor name-id="S287">Mr. Cornyn</sponsor> (for himself, <cosponsor name-id="S337">Mr. Coons</cosponsor>, <cosponsor name-id="S389">Mr. Kennedy</cosponsor>, <cosponsor name-id="S316">Mr. Whitehouse</cosponsor>, <cosponsor name-id="S253">Mr. Durbin</cosponsor>, <cosponsor name-id="S355">Mr. Cruz</cosponsor>, <cosponsor name-id="S153">Mr. Grassley</cosponsor>, and <cosponsor name-id="S414">Mr. Ossoff</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Ethics in Government Act of 1978 to provide for a periodic transaction reporting requirement for Federal judicial officers and the online publication of financial disclosure reports of Federal judicial officers, and for other purposes.</official-title></form><legis-body><section id="idDC2C7475DF0148C8839D5688D7CA3F8E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Courthouse Ethics and Transparency Act of 2021</short-title></quote>.</text></section><section id="idE89BE5764CC14C69BF12EC99ED9338DE"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="id973efa115aba486b9a7fd6ba135b78ad"><enum>(1)</enum><text>recent reports indicate certain Federal judges have failed to recuse themselves from cases and controversies in which the financial interests of the Federal judges are implicated;</text></paragraph><paragraph id="idcfbd496efa4f43738cfa300b02d9a577"><enum>(2)</enum><text>Federal law and the judicial recusal rules applicable to Federal judges require that Federal judges disqualify themselves in any proceeding in which the impartiality of the Federal judges might be reasonably questioned, including instances in which a Federal judge has any financial interest in the subject matter in controversy or in a party to the proceeding;</text></paragraph><paragraph id="id7e1509a6f2014cc4bbf467e3c1483131"><enum>(3)</enum><text>litigants and the public have an interest in fair and impartial judicial proceedings, the results and conduct of which avoid any appearance of impropriety; and</text></paragraph><paragraph id="id0fa77404559b430f8c76c7c300e6212a"><enum>(4)</enum><text>in 2012, the STOCK Act (<external-xref legal-doc="public-law" parsable-cite="pl/112/105">Public Law 112–105</external-xref>; 126 Stat. 291) was enacted, which provides that Members of Congress and Federal officials have a duty of trust and confidentiality to not use information obtained from their official duties for private gain, including the purchase and sale of stocks, bonds, commodities, futures, and other securities. </text></paragraph></section><section id="id1C9A35FB69FF4E38B75A525C3AF58D9B"><enum>3.</enum><header>Periodic transaction reports and online publication of financial disclosure reports of Federal judicial officers</header><subsection id="idd2cce861e28f423ca91e2ae5d6856ab1"><enum>(a)</enum><header>Periodic transaction reporting requirement for Federal judicial officers</header><paragraph id="id5C3000D064AF41D2B5552079EA211DCE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 103(<italic>l</italic>) of the Ethics in Government Act of 1978 (5 U.S.C. App.) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc809225a24ca4fcb83ef85a403a49290"><paragraph id="id58ed2edc021343278b2f84dbbb21caaa"><enum>(11)</enum><text>Each judicial officer.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="iddedf81d56c2c4cde93353d827c408e90" commented="no"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall apply to applicable transactions occurring on or after the date that is 90 days after the date of enactment of this Act.</text></paragraph></subsection><subsection id="id31C27B90AE5E4055879144D2FDFC0CBC"><enum>(b)</enum><header>Online publication of financial disclosure reports of Federal judicial officers</header><text display-inline="yes-display-inline">Section 105 of the Ethics in Government Act of 1978 (5 U.S.C. App.) is amended—</text><paragraph id="ide1df58c0d2ec46e88e0059b6a37ce4bc"><enum>(1)</enum><text>by redesignating subsections (c) and (d) as subsections (d) and (e), respectively; and</text></paragraph><paragraph id="id39e57dfe28e94dcb9d34f67a6ca72070"><enum>(2)</enum><text>by inserting after subsection (b) the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idE3A6D399AF3E41ACA0DF89C744761867"><subsection id="idf56186ce439a42f28904ad84af6a67a7"><enum>(c)</enum><header>Online publication of financial disclosure reports of judicial officers</header><paragraph id="idFA2F6BEFCD1A43D0B59F527D8AEA0A42"><enum>(1)</enum><header>Establishment of database</header><text>Not later than 180 days after the date of enactment of the <short-title></short-title><short-title></short-title><short-title>Courthouse Ethics and Transparency Act of 2021</short-title>, the Administrative Office of the United States Courts shall establish a searchable internet database to enable public access to any report required to be filed by a judicial officer under this title.</text></paragraph><paragraph id="id32CB0030C95F42C5B4F04EA36E91CC72"><enum>(2)</enum><header>Availability</header><text>Not later than 90 days after the date on which a report is required to be filed under this title by a judicial officer, the Administrative Office of the United States Courts shall make the report available on the database established under paragraph (1) in a full-text searchable, sortable, and downloadable format for access by the public. </text></paragraph><paragraph id="idad33ce4d7fd6468e83a0dae8833d99c5"><enum>(3)</enum><header>Redaction</header><text>Any report made available on the database established under paragraph (1) shall not contain any information that is redacted in accordance with subsection (b)(3).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idD6F209AF7276402C827A2DD6BA87F2B1"><enum>(c)</enum><header>Technical and conforming amendments</header><paragraph id="idAD03C74354DD4059B9D79F8646012BCD"><enum>(1)</enum><text>Section 103(<italic>l</italic>) of the Ethics in Government Act of 1978 (5 U.S.C. App.) (as amended by subsection (a)(1)) is amended—</text><subparagraph id="id49da1b11429e4fc0a47fd1b9034765d4"><enum>(A)</enum><text>in paragraph (9), by striking <quote>, as defined under section 109(12)</quote>; and</text></subparagraph><subparagraph id="idb5ba1174215e4c17b0d30946e0f26a9e" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>in paragraph (10), by striking <quote>, as defined under section 109(13)</quote>. </text></subparagraph></paragraph><paragraph id="idbd22d4078fbc472ca676f258dacaeb6d"><enum>(2)</enum><text>Section 105 of the Ethics in Government Act of 1978 (5 U.S.C. App.) (as amended by subsection (b)) is amended—</text><subparagraph id="id06bbc3e9ed2b4bf8a386cb16e3c381d2"><enum>(A)</enum><text>in subsection (a)(1), by striking <quote>be revealing</quote> and inserting <quote>by revealing</quote>; and</text></subparagraph><subparagraph id="id9b7ff0c1ad9a488cbe71d387fc95951c"><enum>(B)</enum><text>in subsection (b)—</text><clause id="id5AA5CF4CFF644C649C86506832A16818"><enum>(i)</enum><text>in paragraph (1)—</text><subclause id="iddc80aedfe22547ed810da2e8ef35ccc5"><enum>(I)</enum><text>in the first sentence, by striking <quote>be,,</quote> and inserting <quote>be,</quote>; and</text></subclause><subclause id="idca5f9d492af1420981d42698f04b970f" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text>in the third sentence, by striking <quote>may be may</quote> and inserting <quote>may be, may</quote>; and</text></subclause></clause><clause id="idb27a1e4e83ec4e99a0d94842b5217be2"><enum>(ii)</enum><text>in paragraph (3)(A), by striking <quote>described in section 109(8) or 109(10) of this Act</quote> and inserting <quote>who is a judicial officer or a judicial employee</quote>. </text></clause></subparagraph></paragraph><paragraph id="ida316be2251a34eb297df110e60a20441"><enum>(3)</enum><text>Section 107(a)(1) of the Ethics in Government Act of 1978 (5 U.S.C. App) is amended in the last sentence by striking <quote>and (d)</quote> and inserting <quote>and (e)</quote>.</text></paragraph></subsection></section></legis-body></bill>
