Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a pilot program to support medical residency and fellowship programs that assist veterans, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Pro Bono Corps Act of 2021</short-title></quote>.</text></section><section id="id8EDB71BFE8064DD2A1A05C178E4207A2"><enum>2.</enum><header>Pilot program to support medical residency and fellowship programs that assist veterans</header><subsection id="id0ACDE78209F0480393108AA34FC075DE"><enum>(a)</enum><header>Pilot program required</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall commence a pilot program to assess the feasibility and advisability of providing assistance to eligible recipients to establish or maintain programs that assist veterans applying for compensation under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">chapter 11</external-xref> of title 38, United States Code, in substantiating their claims with independent medical examinations and opinions.</text></subsection><subsection id="id762B2A59DC1D4B219231A3EDA9008FE0"><enum>(b)</enum><header>Eligible recipients</header><text>For purposes of the pilot program required by subsection (a), an eligible recipient is an entity that— </text><paragraph id="id69E0D2AA20A644018D7C7A36FC805DF3"><enum>(1)</enum><text>is administering a medical residency or medical fellowship program in the United States or a territory of the United States; and </text></paragraph><paragraph id="id37D72B2A25A44644AFC1E40B729D97F3"><enum>(2)</enum><text>is accredited by a nationally recognized accrediting agency. </text></paragraph></subsection><subsection id="id13930E9BFDBD4581A0A827A60F6D81AE"><enum>(c)</enum><header>Duration</header><text>The Secretary shall carry out the pilot program required by subsection (a) during the five-year period beginning on the date of the commencement of the pilot program. </text></subsection><subsection id="idDDA173A2E098472EB68811B59BAC5898"><enum>(d)</enum><header>Grants</header><text>The Secretary shall carry out the pilot program required by subsection (a) through the award of grants to eligible recipients to establish or maintain programs as described in such subsection. </text></subsection><subsection id="id437A10DF0E7144DDB74DE794BF5E62C2"><enum>(e)</enum><header>Competitive process</header><text>The Secretary shall establish a competitive process for the award of the grants under the pilot program required by subsection (a). </text></subsection><subsection id="id61E9415AB3EE4F9296277E212C6D53F0"><enum>(f)</enum><header>Selection of grant recipients</header><text>In awarding grants under the pilot program required by subsection (a), the Secretary may give preference to an eligible recipient located in a rural area or an underserved area. </text></subsection><subsection id="idB77916A3782342FF90ADDC450F8A8F97"><enum>(g)</enum><header>Use of grant funds</header><paragraph id="id1CA9854AC1B44CD281D8A425D4F45168"><enum>(1)</enum><header>In general</header><text>Each eligible recipient receiving a grant under the pilot program required by subsection (a) shall use the grant to establish or maintain a program as described in such subsection in which medical residents or fellows provide pro bono medical examinations and opinions for the purposes described in such subsection. </text></paragraph><paragraph id="idCDE673F0050D4105B40EEDFF940B4D09"><enum>(2)</enum><header>Requirements</header><text>For each program established or maintained with amounts from a grant under the pilot program—</text><subparagraph id="id8FC3C50AB7274D83ADC86B79EE221815"><enum>(A)</enum><text>medical residents and fellows shall practice under the supervision of attending physicians in accordance with such supervisory requirements as the Secretary shall prescribe in regulations; </text></subparagraph><subparagraph id="id08029DC157204739B4BC2D5580E81370"><enum>(B)</enum><text>each attending physician providing such supervision shall be in good standing with the medical licensing board of each State in which the attending physician is licensed; </text></subparagraph><subparagraph id="idC0F1DA884D2E44A59C6065A02103830B"><enum>(C)</enum><text>each medical resident and fellow shall be in good standing with—</text><clause id="id3204C94A0A4F40028733E15D6371FFB7"><enum>(i)</enum><text>the program established or maintained with amounts from the grant; and </text></clause><clause id="id5350B8FA51FA4A9F83FB9715AD91F97B"><enum>(ii)</enum><text>the medical licensing board of each State in which the resident or fellow is licensed; </text></clause></subparagraph><subparagraph id="id233ABBB157004D58A822931EAB9244A2"><enum>(D)</enum><text>each medical resident, fellow, and attending physician shall undergo training that is substantially the same as or equivalent to training required for medical examiners of the Veterans Health Administration or contractors of the Department who conduct medical examinations for purposes of supporting claims for compensation under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">chapter 11</external-xref> of title 38, United States Code; </text></subparagraph><subparagraph id="idDE284A40DE384A36A967E905FFD8324E"><enum>(E)</enum><text>medical residents shall be in their second year or later of a medical residency; </text></subparagraph><subparagraph id="idB75A71A0CA7F4263999281ED79D9F667"><enum>(F)</enum><text>the program shall not charge veterans fees for the services provided; </text></subparagraph><subparagraph id="id62D5CD45C8C64C0EAA4299DBA6C6ACCE"><enum>(G)</enum><text>the program shall screen individual applicants who are veterans using such income eligibility criteria as the Secretary shall prescribe in regulations;</text></subparagraph><subparagraph id="id1162D4E7F0C24041B46B109E029E5963"><enum>(H)</enum><text>the recipient of the grant shall, on an annual basis, provide the Secretary with an accounting of how the recipient has used and allocated grant funds; and</text></subparagraph><subparagraph id="idB9881706AA5D4BA5852F81509CA09E4E"><enum>(I)</enum><text>the program shall meet such other criteria as the Secretary may prescribe in regulations. </text></subparagraph></paragraph></subsection><subsection id="id983A366B268849F48C9D3DF3FC55F829"><enum>(h)</enum><header>Forms</header><text>The Secretary shall provide to each recipient of a grant under the pilot program required by subsection (a) all current disability benefits questionnaire forms of the Department of Veterans Affairs.</text></subsection><subsection id="id483D4B1B3930488BADBCD579BAAF01D1"><enum>(i)</enum><header>Outreach</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary shall, in partnership with veterans service organizations, implement an informative outreach program for veterans regarding the availability of services from programs established or maintained under the pilot program required by subsection (a). </text></subsection><subsection id="id7B0DD0F234654ADC8457F97C51BBDD24"><enum>(j)</enum><header>Rule of construction</header><paragraph id="id696189FBA9EE4582B0EFF57B8C655235"><enum>(1)</enum><header>Voluntary participation</header><text>Participation by any veteran in the pilot program required by subsection (a) shall be voluntary. </text></paragraph><paragraph id="idA13F95BC38584B42BC87771FA7636828" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Right to medical examination</header><text>Nothing in this section shall be construed to invalidate or replace the right of a veteran to a medical examination provided by an employee or contractor of the Department of Veterans Affairs under section 5103A(d) of title 38, United States Code. </text></paragraph></subsection><subsection id="id1D60FA60DC9A48839F0BDC6153A1B847"><enum>(k)</enum><header>Annual reports</header><paragraph id="id1E938A9D594A407BB600D8B0DDBBF183"><enum>(1)</enum><header>In general</header><text>Not less frequently than once each year for the duration of the pilot program required by subsection (a), the Secretary shall submit to the Committee on Veterans' Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a report on the pilot program.</text></paragraph><paragraph id="id5C7A215524A74C8B95178F94D9C4C698"><enum>(2)</enum><header>Contents</header><text>To the extent feasible, each report submitted under paragraph (1) shall include the following:</text><subparagraph id="idC3F76B5CFBD247C89F0B27689ACD6215"><enum>(A)</enum><text>The average time to complete medical examinations and opinions under the pilot program during the period covered by the report. </text></subparagraph><subparagraph id="idC371D8C6F2EF4A05B67B985ECE0EC4BC"><enum>(B)</enum><text>The number of medical examinations and opinions completed under the pilot program during such period. </text></subparagraph><subparagraph id="id55DEF52C1D2D40BFAC1B453DD3754155"><enum>(C)</enum><text>The number of veterans served under the pilot program during such period. </text></subparagraph><subparagraph id="idBBB3F2026BD241A580C5654ABADD85FE"><enum>(D)</enum><text>The number of cases during such period in which personnel of the Veterans Benefits Administration or the Board of Veterans’ Appeals found a medical examination or opinion under the pilot program to be inadequate for purposes of adjudicating a claim for compensation under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">chapter 11</external-xref> of title 38, United States Code. </text></subparagraph><subparagraph id="idF964540480234AE7AA7D7F971E2B7DCE"><enum>(E)</enum><text>An analysis by the Secretary regarding the operational effectiveness and cost-effectiveness of the services provided under the pilot program. </text></subparagraph><subparagraph id="id0105CE97FF0E46D38B77B4E1A20C7E73"><enum>(F)</enum><text>Such suggestions as the Secretary may have for legislative or administrative action to improve the pilot program.</text></subparagraph></paragraph></subsection><subsection id="idcf84d412318043e5aa38aac72db9dcc6"><enum>(l)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section: </text><paragraph id="idAA8E2989D51943A1B754F08AF13F71D9"><enum>(1)</enum><header>Rural area</header><text>The term <term>rural area</term> means an area classified as <quote>rural</quote> by the Bureau of the Census. </text></paragraph><paragraph id="id6A834C7E95F64290A1D2F98099B7A7AD"><enum>(2)</enum><header>Underserved area</header><text>The term <term>underserved area</term> means an area that meets one or more of the following criteria: </text><subparagraph id="id3B80D66F73C54A5D840D92F33D8F5602"><enum>(A)</enum><text>The area has a high proportion of individuals who have limited access to health care. </text></subparagraph><subparagraph id="id4BADCDC6575D453782CAA39277F1BB5F"><enum>(B)</enum><text>The area has a high proportion of individuals who have limited access to legal services. </text></subparagraph></paragraph><paragraph id="id43C3FDB46D2C4603B5E17AA5F0E3E7A0"><enum>(3)</enum><header>Veterans service organization</header><text display-inline="yes-display-inline">The term <term>veterans service organization</term> means an organization recognized by the Secretary for the representation of veterans under section 5902 of title 38, United States Code. </text></paragraph></subsection></section></legis-body></bill>
