which was read twice and referred to the <committee-name committee-id="SSEG00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Energy and Natural Resources</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>November 15, 2022</action-date><action-desc>Reported by <sponsor name-id="S338">Mr. Manchin</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To codify the authority of the Secretary of Agriculture and the Secretary of the Interior to conduct certain landscape-scale forest restoration projects, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Root and Stem Project Authorization Act of 2021</short-title></quote>.</text></section><section id="id3BEC3B3726DA41A8919F3314AB25E5DB" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>2.</enum><header>Root and Stem projects</header><subsection id="id5358d01278e74e2b8df63d34f6b92c4d"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idadcab6a4a4754c168ca8224d16d227e9"><enum>(1)</enum><header>Collaborative process</header><text>The term <term>collaborative process</term> means a process that—</text><subparagraph id="id0f5ef0be4af04c5798699cccf89ec89b"><enum>(A)</enum><text>includes multiple interested persons representing diverse interests; and</text></subparagraph><subparagraph id="idd81452cf34c9442c90b6dda78ad6bba3"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id56fde252366742658a9a616444ac28de"><enum>(i)</enum><text>is transparent and nonexclusive; or</text></clause><clause id="id8895dcd099e4489e9f24d5a2acd607ec" indent="up1"><enum>(ii)</enum><text>meets the requirements for a resource advisory committee under subsections (c) through (f) of section 205 of the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/7125">16 U.S.C. 7125</external-xref>). </text></clause></subparagraph></paragraph><paragraph id="id6E93636FAF3442FB8E81B9F346C584B6"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a private person or other public or private entity with which the Secretary concerned enters into an agreement or contract under section 604(b) of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6591c">16 U.S.C. 6591c(b)</external-xref>).</text></paragraph><paragraph id="id78ad209e0d8e4ff0b9f57dfacc7d4efe"><enum>(3)</enum><header>Federal land</header><text>The term <term>Federal land</term> means—</text><subparagraph id="idfb58de4bf90b492ebba0bb39128417df"><enum>(A)</enum><text>land of the National Forest System (as defined in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>)); and</text></subparagraph><subparagraph id="idaa02fe85f0f14f94a9089a96d8ee39a0"><enum>(B)</enum><text>public lands (as defined in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>)).</text></subparagraph></paragraph><paragraph id="id8b5a630bc0cc4845bd2d43975747d421"><enum>(4)</enum><header>Root and Stem project</header><text>The term <term>Root and Stem project</term> means a project under section 604 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6591c">16 U.S.C. 6591c</external-xref>)—</text><subparagraph id="idc100fb1c20314c35aee0874aca80a80d" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text>proposed prior to completing the environmental review process under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); and</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id245FA00F9A25400A81AE438C4EDF22C5"><enum>(B)</enum><text>that satisfies the requirements described in subsections (c) and (d).</text></subparagraph></paragraph><paragraph id="idDC11C785614F40718ED3EAD5F5DA171D"><enum>(5)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means, as applicable—</text><subparagraph id="idE01C18FDD77F45DFB85A0229D166AEFE"><enum>(A)</enum><text>the Secretary of Agriculture, acting through the Chief of the Forest Service; or</text></subparagraph><subparagraph id="id432B69D9336B47798BB1AEFA06C57845"><enum>(B)</enum><text>the Secretary of the Interior, acting through the Director of the Bureau of Land Management.</text></subparagraph></paragraph></subsection><subsection id="id4c311b9d31aa464487a9afc3d7fb62a4"><enum>(b)</enum><header>Authorization</header><text>The Secretary concerned may enter into a contract or agreement with an eligible entity to conduct a Root and Stem project.</text></subsection><subsection id="id80d474fe394044728738bcf009a90a0b"><enum>(c)</enum><header>Requirements</header><paragraph id="idfb6ae2006ba54ae3b9dc67cd2e5d65c3"><enum>(1)</enum><header>Period</header><text>The period of a contract or agreement entered into under subsection (b) may not exceed 10 years.</text></paragraph><paragraph id="idbcae4ed9bcde4ccc87203372eaaa1138"><enum>(2)</enum><header>Requests for proposals</header><text>The Secretary concerned, in coordination with State and local stakeholders, shall—</text><subparagraph id="idA0F87DD279D4463B875CA367436F0EB5"><enum>(A)</enum><text>identify areas well-suited to conduct Root and Stem projects; and </text></subparagraph><subparagraph id="id9E717EA6E97E4F27873D3FC521C11368"><enum>(B)</enum><text>issue requests for proposals for Root and Stem projects, including, at a minimum—</text><clause id="idf72eb1daa7734e1ca926aff8c2cba08a"><enum>(i)</enum><text>the total acreage and boundaries of the proposed Root and Stem project area;</text></clause><clause id="id6d258bbdc9954c48ba5dce4308d4e1a8"><enum>(ii)</enum><text>the land management objectives of the applicable unit of Federal land to be achieved by the Root and Stem project; and</text></clause><clause id="idc66b77fbdb02450aaac4715d82a50144"><enum>(iii)</enum><text>monitoring and performance standards for the Root and Stem project. </text></clause></subparagraph></paragraph></subsection><subsection id="id53505481dd2940469028783ef2adb96e"><enum>(d)</enum><header>Environmental analyses and project design</header><paragraph id="ide53ea46866f14b928ffe4ca33e4dcc7a"><enum>(1)</enum><header>In general</header><text>The environmental analysis and review under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) for a Root and Stem project shall be conducted—</text><subparagraph id="id9F97AEFBB6654C50A598BB523A966D6D"><enum>(A)</enum><text>after the applicable contract or agreement is entered into under subsection (b); and</text></subparagraph><subparagraph id="id465F70E89F464279B42CDAA5FB1FE5F2"><enum>(B)</enum><text>by an independent third party approved by the Secretary concerned in accordance with paragraph (2).</text></subparagraph></paragraph><paragraph id="id9DB14059E78149779A86B412DD83E0B8"><enum>(2)</enum><header>Review and approval of independent third parties</header><text>The Secretary concerned shall—</text><subparagraph id="idBBF96C2052CD4A6F942C1A0D723D6EF9"><enum>(A)</enum><text>review an independent third party selected by an eligible entity carrying out a Root and Stem project, including a review for any conflict of interest between the independent third party and the eligible entity; and</text></subparagraph><subparagraph id="idCE13DBB74CF34984821015A1C6F26F36"><enum>(B)</enum><text>approve that independent third party if the Secretary concerned determines that—</text><clause id="id2004966C44ED48EFA3AF20249596A814"><enum>(i)</enum><text>there is no conflict of interest described in subparagraph (A); and</text></clause><clause id="idE983F2D8A07A4C7A95CA551F774825D9"><enum>(ii)</enum><text>the approval is otherwise appropriate.</text></clause></subparagraph></paragraph><paragraph id="id001ccae44d944bbea408c62310327ebc"><enum>(3)</enum><header>Authority of Secretary concerned</header><text>Any decision required to be made under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) with respect to a Root and Stem project on Federal land shall be made by the Secretary concerned.</text></paragraph><paragraph id="idec147572290b4abbbda631ee3fa09dbc"><enum>(4)</enum><header>Services under stewardship contracts</header><text>In determining the cost of services received under a contract or agreement entered into under subsection (b) in accordance with section 604(d)(4)(A) of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6591c">16 U.S.C. 6591c(d)(4)(A)</external-xref>), the Secretary concerned shall apply the cost to the eligible entity associated with work performed to develop and complete an environmental analysis under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) with respect to the applicable Root and Stem project.</text></paragraph><paragraph id="id9E0A1B03595D47B082DE7344D5D6AD98"><enum>(5)</enum><header>Collaborative process</header><text>The Secretary concerned shall ensure that a collaborative process is used to design and implement a Root and Stem project.</text></paragraph><paragraph id="id199c3948fc6848bfaa00f78effa45c63"><enum>(6)</enum><header>Oversight</header><text>Not later than 60 days after the date of enactment of this Act, the Secretary concerned shall provide a notification and guidance to each local field office of the Forest Service and the Bureau of Land Management establishing a process for—</text><subparagraph id="idCE74122BE8BF4F8EBA86CAE395131FBD"><enum>(A)</enum><text>monitoring the integrity and development of the environmental analyses for Root and Stem projects;</text></subparagraph><subparagraph id="id5CB556F35AB5494DAFF737CAB1632AC5" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>reviewing and approving an independent third party under paragraph (2);</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id4A2698AF4575427D9A36C510AA53BF97"><enum>(C)</enum><text>ensuring compliance with paragraph (5); and</text></subparagraph><subparagraph id="id0e8df62d3de14a409d7cc1b9dcfe6f09"><enum>(D)</enum><text>carrying out corrective actions if an eligible entity carrying out a Root and Stem project does not comply with this section or any other applicable provision of law, including with respect to whether to issue a decision notice and when to require changes or additions to the environmental analysis if appropriate. </text></subparagraph></paragraph></subsection><subsection id="id8149335a40f04e9bbccf908449b2d220"><enum>(e)</enum><header>Judicial review</header><paragraph id="idBB2089C0FE3043DD9FBBEF9B57023FC3"><enum>(1)</enum><header>In general</header><text>Section 106 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6516">16 U.S.C. 6516</external-xref>) shall apply to the judicial review of a Root and Stem project in the same manner as that section applies to the judicial review of an authorized hazardous fuel reduction project (as defined in section 101 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>)).</text></paragraph><paragraph id="idFFDDFEAE9128401FAFE8595910006913"><enum>(2)</enum><header>Statute of limitations</header><text>No legal action challenging a Root and Stem project or any activity under a Root and Stem project may be brought more than 120 days after the later of—</text><subparagraph id="idCA9C40562AAB48E6A374555711590D48"><enum>(A)</enum><text>the date on which the Secretary concerned provides public notice of the award of a contract or agreement to carry out the Root and Stem project; and</text></subparagraph><subparagraph id="id6208DD899BE643D69E159AC3E8D1DB6E"><enum>(B)</enum><text>the date on which the Secretary concerned issues a decision approving the Root and Stem project.</text></subparagraph></paragraph><paragraph id="ida8e143a702754553b61c34be9e3f05ec"><enum>(3)</enum><header>Injunctions</header><text>A court shall not enjoin a Root and Stem project authorized under this section that is developed and implemented through a collaborative process if the court determines that the plaintiff is unable to demonstrate that the claim of the plaintiff is likely to succeed on the merits.</text></paragraph></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="iddc45470e-52f4-44b5-b12b-d9113dbb32ba" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Root and Stem Project Authorization Act of 2022</short-title></quote>.</text></section><section id="id1d0d5ea9-0b91-47d2-98d8-799a3cc573eb" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>2.</enum><header>Root and Stem projects</header><subsection id="id820bd0d7-f18a-4813-b640-aa7620a927b4"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id528bb349-d235-4719-be65-9caa9be88e70"><enum>(1)</enum><header>Collaborative process</header><text>The term <term>collaborative process</term> means a process that—</text><subparagraph id="ida3de24d7-7d3c-4365-af5e-61db383a1554"><enum>(A)</enum><text>includes multiple interested persons representing diverse interests; and</text></subparagraph><subparagraph id="id1b2629fc-ec2c-46df-874a-d7ccc61dc2b9"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id3af26271-51fd-470c-94b3-cd54547600b2"><enum>(i)</enum><text>is transparent and nonexclusive; or</text></clause><clause id="id906d6d8a-edf9-4983-b83a-d49778ed7912" indent="up1"><enum>(ii)</enum><text>meets the requirements for a resource advisory committee under subsections (c) through (f) of section 205 of the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/7125">16 U.S.C. 7125</external-xref>). </text></clause></subparagraph></paragraph><paragraph id="idda20b647-81f2-4609-95fe-dfe1d6838a1c"><enum>(2)</enum><header>Federal land</header><text>The term <term>Federal land</term> means—</text><subparagraph id="id4c13de1a-363c-4515-af71-7a76a7da2e1e"><enum>(A)</enum><text>land of the National Forest System (as defined in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>)); and</text></subparagraph><subparagraph id="id3666d434-f79f-41c1-898c-253c55fdfdb4"><enum>(B)</enum><text>public lands (as defined in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>)).</text></subparagraph></paragraph><paragraph id="id42aef67d-3384-4967-bccd-567b799674d1"><enum>(3)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means, as applicable—</text><subparagraph id="id609f306c-987a-42e9-ade8-62ea701f3417"><enum>(A)</enum><text>the Secretary of Agriculture, acting through the Chief of the Forest Service; or</text></subparagraph><subparagraph id="id5a1f7daf-517e-4048-8ff2-138a23a5bbac"><enum>(B)</enum><text>the Secretary of the Interior, acting through the Director of the Bureau of Land Management.</text></subparagraph></paragraph></subsection><subsection id="id73c6cb9e7a0e4fdbb5b3c1e69db1a4a2"><enum>(b)</enum><header>List of contractors</header><text>The Secretary concerned shall—</text><paragraph id="id2c6c701978f9438184b65cdecd10ecd3"><enum>(1)</enum><text>maintain a list of non-Federal, third-party contractors that the Secretary concerned can hire in each State to complete the analysis described in subsection (c)(1); and</text></paragraph><paragraph id="id6e79f13960cc4c969c914af029153b09"><enum>(2)</enum><text>not later than 180 days after the date of enactment of this Act, and every 3 years thereafter, submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a copy of the list described in paragraph (1). </text></paragraph></subsection><subsection id="id8f1dee3e-a7d1-45cb-b6c1-6dd8e4f46a71"><enum>(c)</enum><header>Agreements</header><text>If a person submits to the Secretary concerned a proposal for a project on Federal land that was developed through a collaborative process and that meets local and rural community needs, the Secretary concerned may enter into an agreement with the person, under which—</text><paragraph id="idbda373bc3e6f40918ad5e011e7b37d51"><enum>(1)</enum><text>the person initially provides to the Secretary concerned all, or a portion of, the funding necessary to complete any analysis that the Secretary concerned determines to be necessary under Federal law, including the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) and the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>), for the consideration of the proposed project;</text></paragraph><paragraph id="idd8f0fc2f5f6e47d4a0bf9f6218a6de82"><enum>(2)</enum><text>the Secretary concerned uses the funding provided under paragraph (1) to pay a contractor included on the list maintained under subsection (b)(1) to conduct the analysis described in paragraph (1);</text></paragraph><paragraph id="id0d3897b8bcf04fed845f573075b7be22"><enum>(3)</enum><text>on completion of the analysis described in paragraph (1), if the Secretary concerned makes a decision to proceed with the project, the Secretary concerned—</text><subparagraph id="ide3c47d2577e74584819a5bdb9a023c43"><enum>(A)</enum><text>solicits bids to carry out the project; and</text></subparagraph><subparagraph id="id973a50668aae46e1962400f75d4c3833"><enum>(B)</enum><text>enters into a contract or agreement under section 604 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6591c">16 U.S.C. 6591c</external-xref>) to carry out the project; and</text></subparagraph></paragraph><paragraph id="id8f733abfab5542929bc33f0736378b44"><enum>(4)</enum><text>using any receipts described in subsection (d)(1), the Secretary concerned, to the maximum extent practicable, repays to the person the funding initially provided under paragraph (1).</text></paragraph></subsection><subsection id="id956bbbfae11742a3ba8ced402c1735d2"><enum>(d)</enum><header>Additional related authorities</header><paragraph id="ida40d8af2c89d42399192c064630bf3ef"><enum>(1)</enum><header>Use of receipts</header><text>Any receipts that are generated by a project described in subsection (c) that are normally deposited in the General Fund of the Treasury shall be available for expenditure by the Secretary concerned, without further appropriation or fiscal year limitation, for the use described in subsection (c)(4).</text></paragraph><paragraph id="idb1fb65b5488649f0948161424e14df19"><enum>(2)</enum><header>Contractors</header><text>The Secretary concerned may noncompetitively hire a contractor included on the list maintained under subsection (b)(1) to conduct the analysis described in subsection (c)(1).</text></paragraph></subsection><subsection id="id685b2a226d6e439aa34052fcd61ec3aa"><enum>(e)</enum><header>Savings clauses</header><paragraph id="idde4c2ccf5a0e4e7da127947f28044ddc"><enum>(1)</enum><header>Authority of the Secretary concerned</header><text>The Secretary concerned shall—</text><subparagraph id="id1f8bf92c9cf6456e9a03ebb88acc53be"><enum>(A)</enum><text>determine the sufficiency of any documents prepared by a contractor under subsection (c)(2); and</text></subparagraph><subparagraph id="id6884457feb5f4aa78c69eae1a77bb027"><enum>(B)</enum><text>retain responsibility for any authorizing decision relating to a proposed project described in subsection (c).</text></subparagraph></paragraph><paragraph id="id1c569b84e1ca41eb804396d4cda93037"><enum>(2)</enum><header>Review and approval of independent third parties</header><text>The Secretary concerned shall verify that there is no conflict of interest between—</text><subparagraph id="id76D9DB9BA0C44C069DCCB0F3D241F45E"><enum>(A)</enum><text>a person that submits a proposal under subsection (c); and </text></subparagraph><subparagraph id="id52F040F59ADD4F0A95232BA85A1D6C93"><enum>(B)</enum><text>a contractor that the Secretary concerned hires under paragraph (2) of that subsection to carry out an analysis with respect to that proposal.</text></subparagraph></paragraph><paragraph id="id1b23230ba24b44afa4167c14917e26c3"><enum>(3)</enum><header>Administrative costs</header><text>The Secretary concerned—</text><subparagraph id="id950E755D980446E9B1A524DC5A48829E"><enum>(A)</enum><text>shall only use the funding provided to the Secretary concerned under subsection (c)(1) to pay a contractor pursuant to subsection (c)(2); and </text></subparagraph><subparagraph id="id7B719264CA254C2D8C8BCF92A0BD052F"><enum>(B)</enum><text>shall not use any portion of the funding provided to the Secretary concerned under subsection (c)(1) to cover any other expense or cost incurred by the Secretary concerned, including administrative costs.</text></subparagraph></paragraph><paragraph id="idce254aed4c6f479aa3d84adb39ac086f"><enum>(4)</enum><header>Limitations on reimbursements</header><text>If insufficient receipts are generated by a project described in subsection (c) to reimburse the person that provided funding under paragraph (1) of that subsection, the Secretary concerned shall not provide additional funding to the person.</text></paragraph></subsection><subsection id="id9558e62e23414725adf833131295e3cc"><enum>(f)</enum><header>Promotion</header><text>Not later than 60 days after the date of enactment of this Act, the Secretary concerned shall provide guidance to each local field office of the Secretary concerned for—</text><paragraph id="id837A96FC155A48A694AD3BA59BA0B124"><enum>(1)</enum><text>making stakeholders aware of the authority under this Act; and </text></paragraph><paragraph id="id0C2CA3BAFE184DC9889A8A4C1D4DD45A"><enum>(2)</enum><text>encouraging use of that authority to meet land management goals.</text></paragraph></subsection><subsection id="id0cd70bbf62814080af693a5214feec01"><enum>(g)</enum><header>Treatment of collaborative members</header><text>For purposes of a civil action relating to a project described in subsection (c), any person that participated in the collaborative process to develop the proposal for the project shall be—</text><paragraph id="idd5b66ca7c6b744209892dcfd673fd758"><enum>(1)</enum><text>entitled to intervene, as of right, in any subsequent civil action; and</text></paragraph><paragraph id="id0089d5cd860f4cb696fdd18b0e6ca2fd"><enum>(2)</enum><text>considered to be a full participant in any settlement negotiation relating to the project.</text></paragraph></subsection><subsection id="idb7d74c7148284412a388ee219c958342"><enum>(h)</enum><header>Sunset</header><text>The requirements described in subsection (b) and the authority to enter into an agreement under subsection (c) shall expire on January 1, 2033. </text></subsection></section></legis-body><endorsement><action-date>November 15, 2022</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
